pacific. i'm jose diaz-balart. this morning another setback in the biden administration's immigration policy. a federal judge said the white house could not formally end the trump era policy known as remain in mexico as the humanitarian crisis at the southern border reaches cities across the u.s. we're going to ask denver mayor why he's declired a state of emergency. in ukraine, metro stations being used as bomb shelters as russia unleashes an intense round of missiles across the country. we have a report from kyiv. the white house is preparing for a rise in covid cases ahead of the holidays. announcing new plans to expand testing and vaccination sites. health and human services secretary will join us live. this weekend the whole world will be watching arkansas gent argentina taking on france. we'll talk with two of the biggest names about the game everyone is going to be watching.

we begin with a setback for the biden administration on immigration policy as it struggles to deal with the growing humanitarian crisis at the southern border. overnight a federal judge temporarily blocked the administration from ending the trump-era remain in mexico policy, which requires people seeking asylum to wait in mexico until claims are decided. this policy is separate from the pandemic era trump border restriction known as title 42, which is set to be lifted next wednesday as that deadline approaches, thousands of people, including many children, are crossing the border from mexico into el paso every day. once there, they are finding that shelters are overwhelmed forcing many of them to sleep on the streets in frigid temperatures. telemundo was at one shelter

no winter clothing, no water new york city food, no way to stay. this is a very difficult situation that many families are going through. and it also represents a a major failure of different administrations in providing some kind of infrastructure that we don't have at the border in el paso specifically. >> these are men, women and children who were really forced to leave their countries, many of them have dealt with horrendous conditions as they made the long journey to the u.s. border. they have been exploited, just destroyed in many ways. what are you seeing? who are these people and i think it's important that we don't lose sight that these are human beings. these are men, women and children, who are they? >> it is very important to humanize the issue.

everybody is talking about members and they are not watching people the at the border as you have described. many of them, they come for at least three different regions. there's the historic group that comes to the border looking for an economic opportunity because there's crisis in their communities. economic depression. the older sector that is coming, it is fleeing violent conditions throughout governments. dictatorships, seeking asylum or refuge. and then you have the cost of climate change. you have an expanded flow of immigrants specifically the ones that we have now are venezuelans, coming from there. they thought the united states would welcome them buzz they were fleeing these dictatorships there. >> this humanitarian crisis has been going on for months now. el paso is not ground zero, but

i'm just wondering where is the urgency of folks? and fernando was talking about failures of a lot of administrations, but where is the urgency on what's happening to these people? it seems like they are on their own. >> jose, i was born and raised on the border. i have been shedding immigration and the border for over 20 years. and i really think that this moment is the greatest moment that i have ever seen. my heart aches, and its especially aches puss i'm not seeing any real resolution being put on the table. and my greatest worry is that we're luting loouzing the humanitarian that we're used to and accustomed to the human suffering at the border. so i think it's at the peak in

terms of crisis mode, but i'm worried that our lawmakers and our public conscientious is not grasping the need to do something. we actually can do something about it. there's immigration policy that can help folks at the border also stem the tide from countries, understanding that imfwrags is pushed and pull. something can be done. i think we have to not let ourselves lose hope. >> but doesn't it seem in a way like u.s. policy is being set by court decisions on the one hand? and then by pressure of other countries, regimes that decide how to use their own people as human pawns and when to let them go, how many to let go. it just seems like where is immigration policy? >> look, you're absolutely right on those fronts. however, i do think that we can stem the courts if we allow the

folks here in our congress to do something. if we pressure them, on the flip side, there's countries like veezuela that won't cooperate with us. but there are countries like mexico there are countries like guatemala where we can work with them. so again, we need to figure out where we can work. it's not going to be a perfect solution, but we can figure out ways to do incremental change. >> fernando, what do we need to know about what's happening at that humanitarian crisis? how can we all help you and others? >> i think it is important to recognize that this might be strags also has a big responsibility on delivering on immigration reform promise, but also in building necessary infrastructure at the board. we have been worried since two

years ago, the need to have resources that are not just the patient centers of expansion but to have more welcoming infrastructure. we need to deploy the resources by the federal government. there's an expectation like ourselves will resolve this issue. that's not sustainable. we need the federal government to step up immediately and start saving these publicing centers. >> fernando and victoria, thank you for being with us this morning. this morning a barrage of russian missile attacks reported across all ukraine with officials in kyiv saying they have survived the biggest missile attack since the start of the invasion. kyiv's mayor says all underground lines have been temporarily stopped as the staugss were once again turned

into shelters. in one of those underground shelters a man broke into song to comfort hisfelt low ukrainians. ♪♪ >> the entire city of kharkiv is without electricity this morning as russia continues its focus on destroying critical infrastructure amid freezing temperatures. meanwhile, we have new nbc news exclusive reporting that a biden administration official told members of congress that ukraine now has the military capability to retake crimea. some officials are concerned that that kind of large scale attack could push vladimir putin to use nuclear weapons, according to officials familiar with the matter. we have the latest on the attacks. >> people woke up to the sounds of air raid sirens and explosion. the administration says this

mandate for troops. it authorizes more security spending on ukraine and taiwan. and provides a pay increase for troops. joining us with more is capitol hill ali rafa and jeff bennett. so how optimistic are lawmakers they can get an agreement? >> reporter: good morning. we saw how quickly lawmakers could get things done when last night when the threat of working on a friday loomed large. you can only imagine how quick ly they want to get this done with christmas just around the corner. and all signs are looking like they will be able to do that. senate negotiators had reached an agreement on a framework for this bill, but they were dill stil divided on that overall number for government funding for this long-term omnibus bill to fund the government through september of 2023. they will now have the next week to be able to hammer out all the

details on this. mitch mcconnell is saying on the senate side his deadline is going to be december 22nd, that would kick this off to the house, which could be working on this as late as the 23rd or possibly even the 24th. so the pressure is really on to get this done, to get this bill released and get it on the floor for a vote as soon as possible to reduce the risk of any lawmakers trying to put their two cents in at the last minute. >> so jeff, when it comes to the defense bill, why was it a priority for republicans to remove the vaccine mandate? >> it's to extract political points wherever they can find it. the covid vaccine mandate has been a major political issue on the right for years now. so the white house views this as a mistake, but the press secretary said that president biden will look at the totality of the bill. privately, i have spoken to administration official who is say this won't be a deal breaker. in large part because so many

members of the military service have already been vaccinated. and looking at what else this bill does, as you mentioned, $800 billion specifically for the department of defense. that's $45 billion more than what president biden himself had called for in his own budget request earlier this year. there's a nearly 5% pay increase for service members it's the largest increase in 20 years. there's a 2% bump in the housing allowance, which is important given inflation and higher prices being what they are. and there's also increased support for taiwan and continued congressional support for ukraine, which they view as being important given there are some republican who is have questioned ongoing u.s. support for that country. >> all this as the january 6th panel considers criminal referrals. what are you watching for? >> it's interesting. the chairman of that committee has said that there could be somewhere between 5 to 6 categories of referrals extending beyond just the

criminal referrals potentially for donald trump and some of his allies to include campaign finance violations, referrals to bar associations given there were a number of conservative lawyer who is helped donald trump in his overall scheme to overturn the election results. so this will be thorough report coming out next week. as i understand it, it will be separated into eight chapters that will sort of respond with the committee's work product and the story, the narrative that they played out over the summer in their public hearings. starting with trump's effort to sew distrust in the outcome of the election, to continue all the way through the push to send up fake electors and to link to the u.s. capitol and to do nothing for 187 minutes when donald trump refused to call off support rs at the capitol. it will be the final act of what has been a year's long effort by this committee.ers at the capit.

saying that would be a sentence sufficient but not greater than necessary. the iowa construction worker was one of the first rioters to enter the capitol during the attack. and he led what prosecutors called a menacing chase inside the capitol of officer goodman who are is seen in that video heroically diverting rioters away from senators. a jury found jensen guilty on seven counts, including civil disorder and assaulting police officers. capitol police officers said during the trial that jen sent's actions endajd the entire senate and jensen's attorney described his client as a man who had fallen deeply down the rabbit hole of qanon. as we all know, that's a conspiracy theory holder that donald trump was engaged in a battle against child abusers. so goodman's actions -- he testified at the trial and his actions were so important that day. that's what make this is case

$800,000 so far on shelter, food and other expenses. the denver mayor joins us this morning. thank you for your time. wl appreciate it. so why did you decide to declare a state of emergency and what does that give you? >> first, thanks for having me. i think the declaration after consultation with my staff and also visiting some of these centers that we have seeing and we are a at the brink of needing to free up resources as quickly as possible. to meet the challenge of this time. we have seen over 900 migrants come to our city over the last several months. over 600 in the last couple weeks. so we need to meet the urgency of the moment. this allows flexibility to do just that. >> it's pretty amazing.

it's 600 miles away from the border. there you are acting in many ways proactively. mayor, what does denver need from the federal government? >> first of all, we need the federal government to work with the president to come up with an immigration policy. we need action as kwukly as possible with ill grags policy. it's a lack of activity at the federal level to address serious issues at the borders. and secondly we want to make sure the government is helping our cities get through these tiflt times. >> have you spoken to the homeland security secretary or anybody else in the might be strags on this issue? >> my team is in contact with the homeland security as well as our federal delegation. the governor has leaned in as well. so we're confident in everyone.

but give them the scope and shape of this challenge we're facing here in denver. then maybe throwing some ideas on how they can help us meet this challenge. and what we can do to get through this moment. >> so what do you want us to know about denver and how you're acting on this issue? >> i think it's important to recognize that cities all over this country, cities have an amazing challenge. we're baring the brunt of activity at the federal level. we need to address this immigration policy and make sure the city has resources in order to respond appropriately. that's what we're trying to do in denver. i know other cities are trying to do the same thing. we have to meet this challenge.

46 past the hour. harvard will soon have its first black president. the university announced she will be its 30th president making her the first black person and second woman to lead the ivy league school. she's the daughter of haitian immigrants and her parents believed education opens every door. she will step into her new role july 1st. her challenges will include the fallout from the supreme court's review of harvard's use of race in admissions. with covid cases on the rise again across the u.s., the biden administration has released a plan to try to address the increase this holiday season.

joining us now is health and human services secretary. it's a pleasure to see you. so let's talk about the highlights of this plan. >> sure, thanks for having me. we're saying what we were saying three months ago. that is that during the winter season, we know that rates of flu go up. we expect rates of covid to go up. now we see rsv. no one should be surprised. we're concentrating our efforts to make sure the communities that are most at risk get the help first and foremost and today all of our providers can sustain that effort and so we reached out to governors. we have reached out to hospitals. we reached out to nursing homes. we're trying to make sure everyone is aware we know how to save lives and protect from getting the most severe forms of covid. it's including flu as well let's do what we know keeps us safe and healthy and enjoy the

holidays and celebrate and hug and cuss our families. >> so secretary, one of the things that you just made available once again are free covisit tests. i went online yesterday and in about 15 seconds got my tests registered. so in addition to this at home testing program, can americans be confident that pharmacies will also have covid tests available on the the shelves at the pharmacy this winter? >> that's right. they will be available there as they have been in the past. but what the president asked us to do is make these tests available online because so many people did take advantage. hundreds of millions of tests were sent out free to americans as a result of the president's efforts. we wanted to make sure that folks knew that they could get tested. it wouldn't have to worry about trying to find a test in case they were concerned a about covid. so we have upped that program. we can only do it for a short amount of time. we had to pull money from other sources to make it available, but we thought it was important to give those who wanted to be

55 after the hour. families in a texas city are filing a civil rights complaint with the department of education accusing schools of dealing with blatant racism. joining us now is antonia hilton. tell us about this environment. >> reporter: they describe an environment where they hear racial slurs on a daily basis. their parents are fed up and turning to the federal government for intervention. when the kemp family moved to lubbock, texas, they knew sending their son to a new school might come with challenges. nothing prepared him, his mom or

step-dad for what they were able to endure. >> we feel the racism here. >> i feel like it's blatant incompetence from the schools. >> reporter: over the last two school years brady and nine other black children say they have been suffering from constant racial harassment. they hear classmates call them monkeys. >> i get looked down at. >> how often have you heard the "n" word? >> it's an every day thing. >> reporter: last spring someone created an instagram featuring the school's logo encouraging students to send pictures of monkeys. his mother was shocked to see a picture of her son. >> we watched him change, his mood, not wanting to go to school. >> reporter: they brought their concerns to the lubbock school district. eight months later they say they've never seen an update and white students keep taunting their kids. they felt they had no choice but

to turn to the federal government. they filed complaints alleging lubbock and slaten, texas, refused to acknowledge the parents concern. >> they're not asking for money. they're just asking for equal treatment. >> reporter: the district superintendent says the school has taken appropriate action and that staff are trained to report bullying. >> do you believe there's racism here in lubbock cooper? >> i believe there is. do i think our society is racist? absolutely. does it spill over into the schools? it certainly can. we work hard to mitigate that. there's no place for racism in any form or fashion. >> reporter: he says the investigation into the racist instagram account remains open. >> they talked to hundreds of kids and never found out exactly who it was. i was frustrated about that.

i sought the help of the fbi behind the scenes. >> you interviewed hundreds of people, but none of the black students say they were interviewed. >> i can't speak to that. the administration at that campus did that. >> reporter: families arrive to a school board meeting wearing all black. >> we will not quit. we simply will not go away. >> reporter: their hope is that the federal government which can withhold funds from schools that violate the law will intervene. brady plans to spend the next few months focussed on getting good grades. his family hopes to move to a new town. brady has a message for his classmate. >> i bleed the same blood as you do. you treat me differently because i'm darker than you. why? >> reporter: lubbock, texas, is part of a growing pattern where we're seeing districts around
