actively considering sending multiple criminal referrals of donald trump to the department of justice. the charges they are considering include, inciting an insurrection, obstruction of an official proceeding, and conspiracy. multiple sources are telling nbc news that all three options are on the table, but if i don't call has yet to be made. the panel these two meetings this weekend, they will decide before it votes on its final report, and any potential referrals on monday. meanwhile, the house committee this week is preparing to vote on whether to release six years of tech trump's tax returns to the public. trump of course, it's not the last four years suing to prevent that outcome. until losing in the supreme court. and, more breaking news. a federal appeals court has cleared the way for the administration to lift title 42. that covid related policy allows u.s. officials to expel migrants from the border. attorneys general from 19 republican led states had asked the appeals court to temporarily prevent the end of

title 42. they are likely to appeal. let's begin with breaking news from capitol hill where the general six committee is working through the weekend to complete its final report. we expect that report to be released next week. in addition to its findings about what happened on it generates x, again, the committee is expected to issue a criminal referral to the justice department. and among the potential targets of those referrals, it cannot be understated, former president trump. allie raffa covers the hill for nbc news. and joining me now. there's a lot to go through, so what is the latest, ali? >> yeah, alex. committee members have said for months now that decision of whether or not to issue criminal referrals for former president trump to the justice department must be unanimous with all committee members in agreement to do this. and ahead of, this last public meeting they are gonna have on monday, committee members are saying they're confident we have enough evidence to make such an unprecedented decision. we >> all eyes on the generals

six committee as its year and a half invests long investigation comes to a close. members using the weekend to complete a lengthy report of their findings and recommendations. that will be presented at a final meeting on monday. and released widely on wednesday. included in those recommendations, potential criminal referrals to the justice department for former president trump over his role in the attack on the capitol. >> we fight like. all >> members still debating whether to recommend charges for insurrection, destruction of an official proceeding of congress, and conspiracy to defraud the federal government. >> we have been very very careful in crafting these recommendations and tethering them to the facts that we have uncovered. >> while all three charges are possible, three sources actively involved in the panels deliberation, tell nbc news that a final call has not been made. what will likely be the last public appearance by the committees seven democrats and two republicans, it is the culmination of more than 1000 winches interviews. millions of pieces of evidence,

and nearly a dozen public hearings that laid out a painstakingly detailed record of the january 6th capitol insurrection. trump's efforts to overturn the results of the 2020 election. the committee, using never before seen video when members of the former president's family and inner circle. to lay blame for the violence, at his feet. >> you may not send an armed mob to the capital. so we have been very clear about a number of different criminal offenses that are likely to at issue here. >> chairman bennie thompson says, a 5 to 6 different types of referrals for other targets are also on the table monday. including for ethics and campaign finance violations, as well as a legal misconduct. critical decisions, members are mulling throughout the weekend. that could shape the legacy this committee leaves behind. with >> alex, you and i have talked about how these referrals are largely symbolic and don't carry any real legal weight, especially to the justice department, who we know is conducting their own separate investigations into

former president. but the doj is eventually going to have to decide whether to move on this potential decision by the committee. a decision that committee members say if nothing else is needed for the historical record, alex. >> ali, thank you very much for setting us up with all those details. join me right now is msnbc contributor jacqueline alemany. congressional investigations reporter for the but washington post. olivia, former homeland security and counterterrorism adviser to former vice president mike pence, and msnbc legal analyst legal lisa rubin. ladies, welcome all. jacqui, you first. the committee is weighing whether or not to recommend the three charges against former president. what do we know about what is going into these deliberations, and what is a political risk in making these referrals in terms of how damaging they could be? with >> alex, i think that ali really did say it perfectly which is that at the end of today, there is a feeling amongst committee members on the january 6th panel that,

even if the department of justice ultimately doesn't decide to pursue these charges, and indict the former president, that it is their responsibility to put as much evidence as possible into the historic record. whether or not it rises to the level of being criminally material. we have been talking about for quite some time, and there have been federal judges in particular we judge david carter who has previously written that some of the activity that the former president engaged in along with this top allies amounted to a conspiracy to defraud the american people and an obstruction of congress. but this charge of insurrection is a new one. although we did see how house lawmakers pursue the insurrection charge against the former president during their impeachment proceedings. i think, all in all with this represented is some of the most serious charges really in american history brought against a former president. we obviously, if it ultimately

carries any real legal weight that is in the hands of the department justice. but you will see the committee going home after a year and a half long investigation, feeling like there has been no stone unturned and that they left it all out on the field. >> you know, olivia, it is not just donald trump whose committee is also considering criminal frills for some of his closest allies. and working to overturn the 2020 election who, turns out, as potentially in the cross hairs for a criminal referral on that front. >> well, certainly john eastman and rudy giuliani have this entire until circle. and i do think that that is the main point here. while it is donald trump at the helm, it is bigger than trump. there's multiple layers here. and honestly, i really hope that the report actually discusses what happened within congress with these members of congress who were part of the enabling, and protecting the white house and going along with this. but i do think that john eastman is in trouble. i think rudy giuliani is in

trouble. honestly, i have a strong set sentiment about why we are not talking about gene thomas moore. because she is at the center of this. and she has a direct link to a major center power on the supreme court. so i am hopeful, hopeful that the committee will talk about this in the reporting really cover this. i think it is important for the future of our country, and i think it is important for national security efforts, as well. >> so, lisa, these three potential charges that are being looked at for criminal referrals, does the evidence presented by the january six committee support them? i mean, it's almost like listening to liz cheney right there. what was her, quote she said you may not send an armed mob to the capital. isn't that kind of a no-brainer? isn't that exactly what we heard donald trump do? we have heard it again and again again. he said, we are marching to the capital. so is their question about whether or not he is guilty of this? or at least, should be charged? >> we well, each of these

charges, alex, have separate elements. i think you are right to say that that committee has not only been talking about insurrection in terms that sort of map on to the federal interactions statute, but they have been talking about the other two crimes as well. conspiracy to defraud the united states, as well as obstruction of an official proceeding. and, each of those crimes as weighty as they are, they are simpler to prove that some of the other alternatives. for example, seditious conspiracy which requires a conspiracy to use force to overthrow the government. it is going to be difficult to show that trump himself conspired to use force, but it won't be that difficult for that committee, based on the evidence they marshal today, to show that he incited that mob, incited an insurrection, gave aid and comfort to those that would overthrow or overturn this election. >> so then,, lisa what impact does a criminal referral potentially have on the doj? does it move the needle for

special counsel, jack smith, in a very tangible way? when >> i am not sure that the referral itself is what moves the needle. but certainly, alex, the committee has a amassed quite a body of evidence. literally, hundreds of thousands of documents as well as thousands of interviews and testimony from witnesses. some of those things may overlap with the department of justice's investigation. but, some of them maybe entirely new to the department of justice. so, i think what is underlining these criminal referrals may help the department of justice substantially. that having been said, we learned yesterday a little bit more about the doj's investigation that we hadn't known previously. including that they have been searching and looking closely at the emails, for example, of scott perry. a member of congress, to olivia's point. one of the things that i am most curious about is what blame is laid at the feet of certain members of congress who acted as organized forces,

essentially to link up some of the legal masterminds between these schemes and the trump white house. and scott perry i think it's gonna be at the center of that. >> olivia, as all of this comes to an end and you reflect on what happened to your former boss, vice president mike pence, what goes through your mind as you just reflect on this? we >> honestly, it is the ultimate betrayal. when serving under someone who is so completely reckless and this is how it ends with a complete attempt to overturn our free and fair elections and what it means for our democracy. moving forward. and to think that the vice president of the united states was in harm's way in such a way by the person that he worked solely for, for four years, and i really gives you pause. all these other people that are involved. across that republican enterprise. whether we want to admit it or, not or whether we want to call it out especially as members of congress. look, i know how hard it is to call it your teammates. i have been.

there i certainly have lived it. but, it is something that really matters. if we are going to actually write the course where we are going here as a nation. >> profound words, right. they're okay, let's head south with the next topic, everyone is when you talk about the new report in the new york times. goes inside mar-a-lago where thousands partied near secret files. the times investigation gives a deeper look at how donald trump stored classified documents in a high traffic area add to mar-a-lago. where guests may have been within feet of the material. so, jacqui, you covered the status of key investigations involving donald trump this week, including the doj's documents case. what role could disinformation play as a special counsel is weighing whether or not trump should face criminal charges? we >> yeah. well, the new york times visual piece is certainly extremely compelling in the way it lays out for a lot of readers who have struggled to really understand the severity of the

investigation into the former presidents mishandling of classified documents. although, it is not necessarily new information one of the main reasons that the department of justice ultimately executed a search warrant of mar-a-lago for the fbi to go down there and csis classified materials was because they had teens security footage showed that there was movement in and out of this shed that the former president was supposed to be storing these materials in, at least in the meantime. and that there was someone who was moving his materials around. and that was a longtime concern with regards to mar-a-lago. the former presidents winter white house so to speak. about how the lack of security and the measures and sort of the way that trump has carried himself without the usual rigors of either president or a former president. it was really concerning, and now it's especially concerning to federal investigators as

they, and special counsel's office, as a move forward with this investigation. >> yeah, and as we look at that investigation even more granular, it found that guess may have had access to the storage area where the classified documents were. the times even has these pictures. you mentioned, them of guest sanding just feet away from doors leading to the storage area. the doors are open in some of them. i mean, how unprecedented is this, how dangerous is this, olivia from a national security perspective? >> it's completely reckless. and this is a complete slap in the face every military intelligence officer that has ever served. it is a betrayal of our entire national security committee community to think that former commander-in-chief did this to us. and, when i see these images, actually it pains me. if i get physically ill because i think of the potential damage for people out there on the field, potential damage to things that have been in the works for decades. things that people give their

lives for. fathers, mothers, daughters, sons. i mean, people who have served. that is what i think about. and at this point, i would be looking at money trails, here. because how did people not know that this was there? certainly someone did. where those documents go, where does that lead to, why were they there, and who benefited from this? >> does this, but new visualization we are seeing here, does it make a legal case against trump even more clear? how is mar-a-lago's lack of security a factor in determining whether to charge trump or anyone else in the case? >> we, alex with respect to the legal charges, here what really matters is that the president knowingly and unlawfully retained documents that impact the national security. but in terms of circumstantial evidence, that could be presented to a jury, that visualization to the time together was extraordinarily compelling because, tampa philothea's point, it's just showed us how absolutely positively reckless the

president was, not only in taking these documents, but retaining them in a way that they could have been accessible to any time to get harry having dinner at mar-a-lago. wow, jacqueline, olivia, lisa, you guys are the best. thank you for joining me on this saturday. and the meantime, we have a break in detail or the details plural this hour and a federal court i refuse with a republican effort to uphold a covid related policy. known as title 42. not policy allows the u.s. to expel migrants from the border. and d.c.'s in wilmington delaware with the president spending his weekend. gary, thank you for joining us. after this ruling, title 42 is set to expire on wednesday. how is the biden administration responding to the critics who say it is not prepared for an influx of migrants and can republicans appeal this decision at this point? >> yes, so the white house is really trying to get ahead of things here. overnight, there really had a statement where they said the part of title 42 public health order does not mean that border

is open. the biden administration knows this is going to make a whole lot more migrants tried to claim asylum in this country because by definition, lifting title 42 will make it easier for them to do so. there are things that the administration is doing. they are hiring thousands more border patrol agents to be down there on the southern border. they are opening up a number of more processing centers or down the border, not at the main checkpoint areas. they are on the defensive now. they are calling on congress to do something about this. to do something about the soon but if you look at the schedule of congress and how realistic that may be, a lot of other things on their plate including funding the government within the next week. so this is what white house press secretary kareen jean pierre had to say this week. >> i will reiterate here is that you know we are doing the work, we are going to do this and they're safe and humane way. we have 23,000 border security agents at the border and that is the most amount that we have

ever had. that is because of what the president has been able to do. and we have worked to launch a historic anti smuggling operations that are taking thousands of smugglers off of the streets. but look the reality is, we need congress to take action. we need to do this in a bipartisan way as we have done. >> so there is a chance of the republicans of often filed a lawsuit an appeal that goes to the supreme court between now and wednesday. the one thing that will not change regardless of what happens on wednesday is the busing that has been occurring since april of this year, from taxes to democratic led cities including chicago, philadelphia, new york and washington d.c. where they have sent 14,000 migrants from taxes to those democratic led cities. the texas governor's office tells me that week that it's only going to continue. alex? >> okay gary, thank you for that's upon all of that. if you haven't seen the latest pronouncement from terry lake caught on tape, i will not

from his staunchest defenders. it is trump's maga movement kurt going to break away from him? >> well i think that you are starting to see just a lot of concern that is being for the first time in this whole saga, publicly expressed as to you know really what in the world is this guy up to. i think adrienne hit the nail on the head, very clear that everything that he does is geared towards trying to keep himself out of jail and trying to raise money to support his legal defenses which are amounting by the day. so it seems very clear that the republicans have been looking for this off ramp from trump for so long, this is why they have elevated ron desantis and trying to make him their go-to, second coming hero. because they expect on some level trump just continue and floating. and it's getting to kind of an embarrassing standpoint, i think that's the thing. all of these people remember, they hedge their wag of the trump, made millions of dollars, nays to roy to ride the and gotten famous because of him. he has been the gravy train for

so long so a lot of what you are seeing one people express alarm or concern, they are expressing alarm or concern from themselves because they don't know what they will do if they lose the gravy train that is donald trump and their lives. >> so adrian, president biden appearing to kind of troll trump on twitter writing i had some later announcements a last couple of weeks to. he then less that recent accomplishment including the respect for marriage act, and then brittney griner's return home. as trump politically sabotaging himself with all of this? this was as major announcement, it came a month after announcing a third white house run and yet, tomorrow your point, he has yet to hold any major events, and just trump just becoming a joke politically? >> yes look alex, i said on your show a number of times that i have learned to never underestimate donald trump. given what happened in 2016 and given you know even though president biden, beaten by over 7 million votes and 2020, it was still very close election.

i think we can ever underestimate how ever it does feel like his support is declining. we are seeing poll after poll, it shows rhonda scent is either a head to head beating trump or coming very close. i think what you just show there, that clip of steve bannon and mike flynn and some of the staunchest, maga supporters who have been with him since the very beginning, starting to sort of the fact and at least criticize some of his decisions. and as you know perhaps the clear sign that we have seen so far about maybe this people are open to picking a different horse. i think the next three months will tell us a lot and you know will trump go out on the campaign trail? will he try and do some rallies, will he be able to get crowds to show up in his rallies. if we start seeing a consistent decline in crowds, at some of these events, should he do them? i think that is a clear sign because that's been one of the things alex, he will always be able to do. for the most, part coronary pretty large crowd. but it does feel like you know the maga base maybe looking for someone new. i think time will tell and we

what happened on january 6th and washington, the sea happens at her home state of arizona. sounds like someone who was on hand, detached from reality and looking to use our lies and conspiracy theories to incite and i mobilize her lunatic followers to take action. and that could have very real, world repercussions. we live in a time now where we know, rhetoric is not just saying something and you know this people don't act on it. we have seen time and again that the most ardent supporters of these conspiracy theory driven type people, they take their words as marching orders and they act on them. the results can oftentimes result in violence or death, mayhem and i know it sounds like she is hoping and egging summit like that to happen in arizona. incredibly irresponsible and frankly, every republican needs to be speaking out and announcing this. if you say nothing, if you aren't willing to step up and say something, then you are culpable when bad things happen. we saw that in the runoff to january six and we are seeing this now with kari lake. and against the backdrop of the

recently appointed special counsel's moving fast and this criminal probe surrounding donald trump and maybe broader than previously expected. jack smith has now subpoenaed state and local officials from all seven battleground states that trump's allies targeted and their efforts to overturn the election. the subpoenas like this one dated december 9th and georgia secretary of state brad raffensperger requested any and all communications and any form to, from or involving the trump campaign or anyone affiliated with it. it's pretty broad. joining me, now msnbc analyst

lisa rubin who stuck around for which i thank you. so let's get into this lisa because what merrick garland announced the appointment of jack, smith as special counsel late last month, he suggested he would be focusing on two investigations, the 16 transfer of power interference allegations and the classified mar-a-lago documents. to all of these new subpoenas to state officials fall within that mandate or has a special counsel now extended his purview? >> no, i think these new subpoenas alex to the state and county officials as you were mentioning earlier fall squarely within the january six investigation. let me outline how. right, now we know the department of justice as well as congress is sort of looking at whether trump and people in his inner circle who have looking to obstruct a proceeding and interfere with the lawful function of government by gumming up the works and the chance for power on january 6th. they did that in a variety of different ways, it was sort of a series of overlapping schemes to do that. one of the ways they did that

as by asking people in the states to convene as state or alternate electors on december 14th. and on those flights to the national archives and to congress. but another way that they did that is by trying to influence the administration of those elections and those up and say that you identified. and as various counties within it, and jack smith is trying to understand what where the pressure points? how did they intend to and try to stop the transfer of power by influencing different people who played a role in the administration of this election. >> so after looking at these subpoenas, what do you think are the specifics that the special counsel team is looking for? what kind of paths are they going down? >> i think they are looking to understand whether people who are acting on behalf of the trump campaign, either because they were hired council or they were volunteer council. you know the subpoenas all up the list of 19 people.
