recommending charges for insurrection for obstruction of an official proceeding of congress and also for conspiracy. three different sources involved in that committee, deliberations tell nbc news while all recommendations are possible, a final call has still not been made. that committee is set to vote on its final report and any potential referrals on monday, before releasing its report on wednesday. meanwhile, another major vote involving former president trump takes place this week. the house committee meets tuesday to discuss time trump's tax returns as it weighs whether to make those documents public. trump spent of course, the last four, years suing to try to prevent that outcome until he lost in the supreme court. more breaking news, a federal appeals court has refused a republican effort to uphold the covid related border policy. it is known as title 42. which allowed the u.s. to expel migrants from the border. that ruling clearing the way for the by dunn administration to lift the measure by wednesday. gop led speeds that fought the

lawsuit indicated that they plan to appeal to the supreme court. and, republican kari lake is ramping up her stolen election rhetoric as she seeks to overturn the arizona governor's election that she lost by 17,000 votes. in a new video obtained by a republican attempt kind ability project, here's kari lake while speaking at trump's mar-a-lago resort. >> i watch these people, these evil, bastard's. can i say that, that all right? what to watch them steal this in broad daylight, and if they think they are going to get away with it, then we that's the wrong -- okay? >> okay, well later this hour i'm going to disgusts kari lake's election challenge with the woman who defeated her, arizona-elect governor katie hobbs. we'll go back to that breaking news on capitol hill. the january six committee working to complete its final report. nbc's ali rabat is on capitol hill, and ali, once again walk

us through what that committee is considering. >> yeah, alex, well monday is likely going to be the last time we see this panel assemble publicly and in person. and, when chairman bennie thompson gambles in for the last time, there are a couple of things that we could see him consider and this whole panel consider as they wind up their investigation. these are certainly things that the committee is still considering and to beating. whether these could happen, and should happen. one of those things are those criminal referrals for former president trump to the justice department for his role in the attack on the capitol on january 6th. some of those charges that we know committee members could be considering our insurrection, obstruction of an official proceeding of congress. and conspiracy to defraud the federal government. alex, this would obviously be historic, unprecedented. this is a decision. the weight of which is not lost on committee members. they have said for months now

that the decision to be able to do this would require all committee members on board a full unanimous vote. and, chairman bennie thompson says that trump is not the only person that committee could issue these referrals for. he says, there are five or six other different types of referrals that there are other targets for. these could be people like house gop members who ignored subpoenas from this committee. these could be people who that committee believes may have intimidated their witnesses. witnesses possibly lied to that committee's investigators. and so, these are referrals that could happen on monday. they could not happen at all as a matter of fact. still a decision being debated by committee members. so, all of these looming questions happening as the committee prepares for this final meeting on monday where they will make that vote and also prepare to present a final report of their findings and recommendations. they will present that on

monday. but it will be more widely distributed on wednesday, alex. >> okay, we are looking for to that, that's for. sure thank you so much, ali raphael. let's bring in hugo lowe. investigative reporter for the guardian, and harry lippman, former u.s. attorney, deputy assistant to the attorney general the glenn administration and host of the talking that's podcasts. welcome. hugo, first. as the january six committee is meeting this weekend, ali gave us a sense of what is on the agenda. what are you going to be looking for? >> we look, i think the criminal referrals for trump are always going to be the most interesting thing. because, there is obviously that parallel criminal investigation going on over to doj. and, anything that the committee has, likely the doj also has. so i think if you see the way that the committee in issues is referrals, for instance for obstruction of an official proceeding or conspiracy, you have to think that the doj is also looking at the evidence in the same way. when we broke this news yesterday we, one of the things that really stuck out to me was,

the subcommittee was looking at the statute and seeing how it would fit in with the evidence that they had. and one of the things that they really latched onto, which for instance was the obstruction of an official proceeding statute, is you don't actually have to successfully obstruct congress. you just have to tempt to obstruct congress, and the subcommittee thought that that was a compelling argument and that was why that was one of several recommendations that they presented to the full committee. we >> harry, as we look at specifics here, the committee is weighing whether to recommend the three charges against for the former president. insurrection, obstruction of congress, and a conspiracy. give me your assessment of this. given what the committee has presented as evidence during the hearings? we >> yes. thanks, alex. i think the wildcard here is insurrection. there has been a lot of speculation for quite some time that the obstruction charge and conspiracy to defraud charge would be part of any referral. that is because the concern

conduct, all the kind of conduct laid out over the course of the hearing, try to just impede the results. insurrection is special because it involves making trump complicit with the actual violence of the afternoon of january 6th. the arguments there would be he wasn't actually wanting that to happen, and the proof there would be under what lawyers call an aiding and abetting theory. that in those hundred 87 minutes while he watched on tv, even jubilant as the rioters arranged. that we amounted to criminal liability for insurrection. it is a big possibility and, jamie raskin seems to be carrying it. and there is some possibility of collateral consequences under it. so that is the wild card to think about in the charges. the people, the wild card to think about is whether anyone else besides trump is referred

for subsistent charges under the doj as opposed to barr associations. for example, whether john eastman or jeff clark or rudy giuliani or even mark meadows gets a referral to the department of justice for violations of the federal covid. >> i know you tweeted about those five specific specifically, is there anybody else who put on that list? and, let me ask you the guard insurrection, you're thinking that's a wildcard. the fact is that liz cheney said, quite bluntly and appropriately, you cannot send an armed mob down to the capital. weijia. that is exactly what he did >> with well, okay we look. that would be the proof and what happened after. but the intent that they have brought forward is much stronger for generally trying to come up the works in any of six different with. and we whose differences might be stronger asked to, i didn't

realize it would break out as it did. i agree with you, but remember we, beyond a reasonable doubt. >> we are gonna fight like hell. when he said we're gonna fight like hell and, you know i mean, really? it is hard for me to see the defense on that. we >> well, the defense is, didn't exactly mean they would break the windows and do everything they did. but, the argument would be, look you can't start the train rolling and then be surprised that it keeps going. i agree with you. i just want to say that, a, this hasn't been front and center before and be, they are doing it i think for reasons potentially having to do with his eligibility for future office. so, that is a big wildcard for that reason. the other people, yeah those five were the ones mentioned. there are others you can think of. and also, it could be they will shy away from some of the five. but, i am looking at whether they charge tony were ronaldo for lying to them behind the

scenes. and anyone else who they think didn't cooperate. and, another big part of the puzzle that i don't think they can refer would be the five members of congress who basically told them to go take a hike, rather than cooperates with such an important mastication. >> and very quickly, before i get on to other stuff, with regard to the referrals that will come, how seriously does the doj take that? what is the process by which they consider referrals from the 16 committee? we >> short answer is, they like the evidence. >> i'm sorry, he'll go ahead. >> oh i'm sorry. >> no i'm at it for you, harry. we >> yeah. the short answer is, yay for the information, but the facts of it itself doesn't play on the scale, i believe. for whether they charge. >> okay. so you go, now to you. i want to ask you about the bombshell report from the new

york times. the details how thousands of mar-a-lago guest may have partied within feet of those classified materials. the ones that were later seized by the doj. so, as someone who has been covering the mar-a-lago investigations, hugo, what is your perspective on this? we >> well my first we comment is that i could listen to her talk all day. so that is totally fine. but with respect to mar-a-lago, look. it is a really unsecured location. he hopes events there all the time. he hosts, trump does, he house all sorts of functions. whether it is a ground ball room or off the side of the property, or if it's a smaller ballroom that is directly adjacent to the pool. there is always an event going on at mar-a-lago. especially because he likes to host these kind of events. he likes to kind of have circumstances that come with him being at his own events. and i will just say, one thing that the new york times investigation noted there was that the arch doors that lead to the storage room were retune

the open. and i just went back and checked my photos that i took at mar-a-lago when i was there for the election night party, the midterm election night party. you can quite clearly see both of those are doors open in that photo as well. in fact, it is on the head of the photo on my twitter for vial. anyone can go and see that. so i think it is just emblematic of the fact that these documents were really in a position that they should clearly not have been. they were with. they are released sensitive documents being casually handle by the side will. cool and, it all comes back to the central issue of there was a real reckless disregard for secrets. especially when they are just kept behind a public door in the storage room where they were also keeping deck chairs. >> yeah, exactly. and then having the stores be open. can i just ask you about your experience that night at the midterm elections at the party. what was the mood there hugo? >> it went from pretty high spirits to pretty low spirits pretty quickly. in fact, it was pretty remarkable because, when we arrived at mar-a-lago in the

morning we you do a preset and we kind of sit and get the sense of what the atmosphere is going to be like. and you can see everyone was really jubilant. and as the night wore on in the republican results came in and they weren't nearly as good as expected, trump spirits really dipped. this was not an event where he came back to talk to reporters. he really sat as far away from reporters as he could at a small roundtable near the front of the stage underneath the tv and he was just speaking with a couple of aides that were there. because, remember, not a lot of people showed up for his election night party. the number of people that he was talking to severely limited anyway. so i think the entire atmosphere grew pretty dark pretty early in the evening. >> okay, hugo and harry. i can listen to you both talk forever. but unfortunately, i've got more news to get to. so thank you so much. coming up monday at noon eastern, join msnbc for special coverage of the final january six committee meetings led by andrew mitchell, katie toured and hi kiley jackson. then, monday night at eight eastern, a recap of the hearing

with rachel maddow, joy reid, as well as our email burn. there is more breaking news to share on twitter, rather at twitter after 24 hours of the company elon musk's now lifting the suspension of the accounts of several journalists he had banned on thursday. this after the result of a twitter poll that story that favored restoring the accounts of reporters that musk accused of violating the company's new rule about revealing peoples locations. joining me now is nbc tech and culture reporter, katie ten barge. katie, welcome. or cat, i should. say the suspensions, they immediately set up this media firestorm. the mainstream press was crying foul over what they say was an attempt by musk to try to silence critics. you had right-wing voices arguing that the liberal media finally got a taste of its own medicine. so musk says that he stands for free speech. but won't this kind of inconsistency of his content moderation alienates advertisers and potentially threaten the platforms viability?

i mean, this is a business for him given how much money he sank into it. >> absolutely. i think there is a false equivalent being made with people comparing the moderation decisions that we -- must take over to what is happening on the platform right now. part of that is because in the previous iteration of twitter, when people were suspended from the platform, that was based on principles and rules that were created by an entire team of people. so you have a system of checks and balances coming into play. with elon musk, he appears to just be making these decisions on a whim himself, and then enforcing them selectively on different individuals who may or may not actually even be in violation of those rules. so, with this rollback of some of these restrictions of journalist account, we are seeing in questioning whether or not they even broke the rule that elon musk claims they did, which he only came up with a couple of days ago. >> so, as you know, he claims that the journalist c suspended had doxxed him. but in fact, their articles

didn't include information about his realtime location. so, if their bans were retaliation for their work, how concerning is this for journalists, the right to report the news without fear of reprisal on twitter? when >> it is extremely concerning. one of the journalists who was suspended as a columnist for business insider named linette lopez. she has still not had her accounts restored to her. she is still a fan of suspended. lynn that is something who's been reporting and elon musk for years going back to ensure reported on safety violations at tesla factories. so, it really does seem like these sorts of blanket new rules that are being forced only to journalists and left-wing-leaning accounts, our way for elon musk to remove voices from the platform that he personally does not like. and lanett of course did not tweet elon musk's real kind of information. none of these journalist provide information through twitter that could lead to somebody discovering elon musk or anyone in his family. >> why do you think she hasn't been reinstated yet?

do they have a beef going on do they have some sort of a feud back? >> elon has been talking about lynette in a disparaging way for years. she is one of the people who have been covering him over a long period of time, and he has publicly engaged with her before. he has undermined her credibility and question to reporting before. so, elon musk has always had a very antagonistic relationship with the media and the press. he has retaliated against entire newsroom for coverage that predates -- his factory. banning people from being able to attend press conferences, this is just another step in a long line we -- . >> okay, cat ham, barge it is most curious. thank you for talking about it with us. meantime, the joke from marjorie taylor greene that did not land well at all. plus, the new push to keep trump from holding federal political office in the future. stuff molten, on all of, this next. f molten, on all of, thi next next

news generations committee actively considering suspending multiple criminal referrals to the doj ahead of monday's vote. nbc news is weighing whether to make criminal three criminal referrals for the former president no formal decision ever made yet. those potential charges, inciting an insurrection, obstruction of an official proceeding, and conspiracy. joining me now is massachusetts congressman, seth moulton. a democratic member of the house budget armed services, and transportation and infrastructure committees. congressman, it is always a pleasure to get you on the show. so, the first question, should that committee make these criminal referrals and how significant a message would that send? >> when it is good to see you too, alex. i think that this is remarkably simple. this is about, nobody in america being above the law. and, i think that anyone who watched the january six

proceedings, even just one that night whether you're a friend of donald trump or an enemy of donald trump. we would all have to agree that he broke the law. these are pretty obvious criminal referrals. so i, think they should go forward. i think that is what the committee should recommend. >> so, ahead of the 16 committee's final public hearing on monday, before releasing the report on wednesday, big picture. what is the takeaway that we have learned that we didn't know before. and what is the impact overall the committee's work? we >> well, certainly one of the takeaways. you've heard liz cheney talk about this quite a bit. is that donald trump himself is really at the center of so much of this, and it really does come back to him. to his behavior as an individual, his behavior as the president of the united states. that is a big takeaway. but, i think even bigger than that is the fragility of our democracy. the fact that one man can come into that office and do what donald trump did.

and, if it happened once that means it could happen again. so, in the long run here, we have to not just learned some lessons from january 6th but put those lessons into action by changing our laws, by tightening up our standards, by revising the way that congress and the rest of the government hold the executive accountable. so that this can never happen again. >> okay, while on that front. so let's look at 40 democratic colleagues led by david sweeney. they have introduced legislation to bar former president trump from holding future office. it's under the 14th amendment. a section that amended says, no one who previously took an oath to support the constitution, and engaged in insurrection shall hold any office, civil, or military and in united states. do you support this legislation and do you think that it could realistically pass before republicans take control of congress? when >> i fundamentally support the legislation, of course. i will --

you can tell. i feel very strongly about. this and, it is important to set a precedent that someone like donald trump cannot serve again. my only concern with this bill is that the republicans turned around and essentially weaponizes kind of tactic against us. that if we don't come to some bipartisan consensus about the laws that need to be changed to ensure that this never happens again, that it will just be a tit-for-tat and that is how it will play out. the republicans will use some crazy excuse to pass something like this about joe biden, even though of course, we all know that joe biden has done nothing wrong and trump has broken the law multiple times. but this is what the republicans tried to do, they always try to find the false equivalency. so, that is the one caveat here that we have to be careful of as we look to the aftermath of january six, and the aftermath of the trump presidency. we don't want to start a tit-for-tat. fundamentally do agree with the resolution? fundamentally do i agree with

the idea that trump should never hold office again? of course. we >> let me ask you something. you are speaking in a very realistic tone about all of this and what could come down the pipe, as a result, but are there enough republicans in the halls of congress that are whispering amongst themselves, whispering to friends they have on the other side of the aisle, whispering behind closed doors like, can't trump just go away? and wouldn't this be a way to do it? i mean, literally, there are other republicans i'm sure who would love to run for the presidency. when >> i mean, it is a great question, alex. the answer is, there are more than enough. there are more than enough republicans to all along have realized how terrible trump is behind the scenes. whispering to themselves, whispering to their colleagues, even whispering to democrats like myself across the aisle. the problem is, they don't have the basic political courage to come out and say these things in public. that is the challenge. the challenge is just getting republicans to vote on a

resolutions like this, that they know are the right thing to do. >> well, the calls are growing for can republican leaders to contend the comments of marjorie taylor greene about january six. let's all take a listen to her when >> i have to tell you something, steve bannon if you've been in and i had organized that we would've won. we not to mention, it would've been armed. >> so, she says she was only joking, but how troubling is that? especially from someone who appears primed for a major role in next year's republican caucus? with >> a treasonous comment like that from my colleague, which i are frankly just embarrassing. embarrassing to the institution, even embarrassing to me as a fellow member of congress, don't really dignify a response. but the reason we have to talk about this, alex, is that people like her have a

stranglehold on kevin mccarthy. who is on in line to be the next speaker of the house. they are controlling him. that is how broken the republican party is right now, that is how weak the potential future speakers leadership really is. so, the fact that we can have a speaker of the house who's essentially on strings controlled by people like marjorie taylor greene should have a cell frightened. we >> let's talk about the war in ukraine. russia, as you, know has launched a new wave of missile attacks across the country. the u.s. is stepping up training ukrainian forces, and inches towards approving a patriot myths soul to ukraine. that is certainly a move that the kremlin is warning against. but, you are part of a group of bipartisan lawmakers on a recent secret trip to ukraine. what do you think ukraine needs right now? >> they need patriot missiles right away. because the russians are sending missiles against their energy infrastructure, really trying to freeze the ukrainians to death. i don't think that the russians are ultimately going to succeed,

but they are attacking civilian infrastructure. they are attacking the ukrainian people. not just the ukrainian army, and we need to give the ukrainians everything they can. everything that they need, to defend themselves. including patriot missiles. so, we came back, bipartisan delegation, completely in favor of getting these missiles approved right away. they need to be in ukraine, now. >> okay. let me ask you quickly about the boston globe report today which talks about a veteran's town hall where you recently spoke. and other papers as you are pushing to take this concept nationwide. tell us about its real quick? >> we sebastian younger and i started. this week and he is amazing. he came up with this concept, although he is quick to say that really it originated with native americans. the idea is that to bring together warriors with the communities that they serve, to bridge that divide between veterans and non veterans. and that is exactly what this best handhold of. so instead of just going to upgrade our veteran say, come to a town hall where you can

city were cut off earlier this week. it comes amid the countries plunged into a state of emergency following the ousting of its president, officials in the city say those stranded tourists are expected to be evacuated by today. back in the u.s., starbucks workers across the country are holding a three day strike in an effort to unionize the employees at 100 stores reportedly walked off the job. the second strike in a month. starbucks opposes unionization, saying the company functions better when it works directly with employees. and, an arizona judge granted a request from kari lake to inspect ballots from november's election. the ruling states that are representative chosen by lake may inspect 150 randomly selected ballots after the former republican governor tory challenged a date filed a lawsuit alleging thousands of illegal votes. the judge denied lakes request to copy and photograph the ballots. >> also, in arizona. a new democratic governor will soon take office. a state where registered

issues we are facing. you mentioned border with, that is a huge issue. affordability, housing, education. these are our priorities that we need to tackle and voters, elected leaders that are gonna get to work on those. things >> you have busy agenda. let me ask you about the big story with regard to the justice department. suing the outgoing republican governor over these shipping containers that are stacked along sections of the arizona and mexico border. what are your concerns there? when >> i said from day one that the shipping containers are nothing more than a political stunts. they are a liability for the state, they are not an effective barrier. people continue to scale them, to prove that point. and, they are we put up in areas where there are considerable environmental concerns with erecting a barrier. and we are embroiled in a lawsuit there. plus, now the justice department getting involved. and, it is going to be a problem that we are going to

inherit. this has come at the expense of millions of dollars to arizona taxpayers. and those resources could much better be spent addressing the real issues that we are going to see when title 42 is lifted next week. >> well, let's talk about that because, as you know, california governor gavin newsom was also on the mexico border this week. here's what he told abc news. the quote goes like, this the federal government is sending more and more flights and more and more buses directly here to california because this state is doing what no other state is doing. then he added, the fact, is what we have got right now is not working. and it is about to break in a post-42 world, unless we take the responsibility and ownership. do you share his frustration? what kind of action would you like to see the federal government take? >> yeah, i absolutely showers frustration. i have been saying all along that title 42 is not working. we need to have a plan in place to process these folks that are

going to be stuck when title 42 is lifted. it is going to put undue burden on a lot of our border communities and the nonprofit organizations that are already involved in helping these folks. and, as border states, california, arizona. we are all bearing the brunt of decades of inaction from the federal government. we need real action from congress to address companies and immigration reform. and this is a time where we need to be working in partnership to address these issues. >> so, i mentioned the inauguration date, january. five it is less than three weeks away. and, you are still in a court battle with the republican trump backed candidate that you defeated, kari lake. how much of a distraction cut this sideshow of elections and i'll be. i know your lawyers have told the court not to indulge lakes law any longer. but, you heard. that the judge is letting her inspect 150 ballots. >> yeah, you're exactly right. it is a sideshow. and i think her entire campaign was a sideshow. we stay focused on what we knew

we needed to do to win and we are focused now on what we need to do to be able to take office in january. i am not letting her spectacle be a distraction, and folks in arizona shouldn't either. >> okay, julie no didn't totally agree. that, said when you look at donald trump who still is bellyaching about 2020, what if she takes that tactic? because, dangerous things can happen. and you know very well. just a few days ago in ohio a man was indicted on the charges related to death threats against one of your staffers. what has this been like for you? we can't forget, secretary of state has been the had you most recently have warren. particularly since the election november, what has this been like? >> well, this is an environment that we have been in for the last two years. it is incredibly unfortunate. i have said many times, i think that it is disqualifying for folks to put themselves forward

as so-called political leaders to continue to jim up this rhetoric that leads to this, not just threatening environment but dangerous environment. not just against, me but against other election officials. county supervisors that oversee elections in our state, and it is very dangerous. it needs to stop. and, we need leaders on both sides of the aisle who are going to continue to call it out. and, at the same time move forward on the real issues we're facing. >> how do you think you can win over the people who voted for kari lake, and one of the issues out there that you are optimistic that you can get some bipartisan support? >> i have met with leadership on both sides of the legislature and we talked a lot with the republicans about areas that we could find common ground. i know that the issues, i heard about from arizona is on the campaign trail or not different than issues that republicans are hearing from their

murders of four university of idaho students. police are sorting through a list of roughly 22,000 hyundai elantra,'s after announcing a week ago that they were searching for the arguments of a white car who they believe may have seen something important the night of the killings. despite receiving a new leads every, day officials have yet to name a suspect or find the weapon used in the gruesome murders that happened over a month ago. joining me now is kevin -- investigative reporter at the idaho statesman. kevin, welcome. look, finding the occupants of

a white van dialect or, appears to be investigators primary focus at the moment. but, what can you tell us about the significance of this vehicle, and what kind of information investigators may be looking for from them? and if any other new developments of have emerged? >> police officials have put out words to the public that they are obviously searching for this vehicle. they have been, they have said that this is critical information and the person is in the vicinity of the home at the time of, the vicinity of the murder. >> has there been anything other than that, again we are talking four plus weeks. a month plus nelsons those grisly murders. i mean, today put out anything that you can go on? >> you are right. so tuesday marked the one month since the incident. police have not held a press conference since november 23rd. more than three weeks now. there is a lot of information we don't know, at least publicly. and to your point, there weren't all that many

developments in this last week. at least publicly. >> here is something. though the police body cam video from the night of the murders, show that cops were stopping suspected under age drinkers near the crime scene. so online sleuths, as you, know i have pointed out the seashell on the video that they say authorities have missed. a detail of several figures walking in the background of the footage just two houses down from the students home. authorities have dismissed the significance of this video, but do we know if police or if the fbi have interviewed or identified the people in the background? >> we don't, actually. police, when they put out this video, stated that it wasn't related to their investigation. which is exactly why we have this body cam footage. not clear who those individuals are and, to your point, online sleuths reddit folks who are following this case closely, have suggested that we need to pay more attention to those individuals are.

but, at this time we do not know they are. >> well, speaking of those on minors, they've been pleading with the internet amateur sleuth community to stop spreading rumors about the crime after a deluge of misinformation was posted online as well as harassing and threatening behavior towards potentially involved people. how about the volume of chips and rumors, hasn't made it more difficult for investigators? >> yes, one of the police captain's stated in a video that was released by the department that the ongoing speculation has been one of the most frustrating parts of this entire case. and, while they continue to get tips, thousands of, them digital, email, phone calls they are sorting through and deciding what is important or critical to review, it's continues to be a source of trouble for them. and they are warning people that, do not harass individuals who might be associated with this case. >> you know, in the first few

days after the killings, police play down the fears about a killer being on the loose, saying there is no am imminent threat to the community which of course made everybody think, oh they must know something. but then, days later officials said they couldn't say whether there was a threat. they don't know whether the attack was targeted or not. and furthermore, the university of idaho increased security for its winter commencement ceremony last weekend. why have authorities walked back there earlier statements about any risk to the community and what are you hearing from residents about how safe they feel, or not? >> they did walk that back a few days after during the first press conference. they basically just said that they couldn't definitively say that, in fact. because as you pointed out, they have not found that weapon and they do not have a suspect even today. now it's four and a half weeks. so, as far as additional security, they've had idaho state police, at fbi agents out there. they just need to continue to. they tell everyone to continue to stay vigilant.
