of ayman, breaking news with january six committee and how it might affect trump's stranglehold over the gop. plus, president biden's planning for 2024. while chuck schumer is planning for subpoena power. and famous last words, outgoing congressman adam kinzinger's powerful speech to his colleagues. i'm michael steele in for ayman mohyeldin, let's get started. ♪ ♪ ♪ we start this hour with breaking news from capitol hill. nbc news has learned that the january six committee met today to finalize plans to issue criminal referrals for donald trump. those referrals which will be presented at the panels final meeting tomorrow, include obstructing an official proceeding of congress. conspiracy to defraud the u.s. government. and inciting and assisting an

insurrection. nbc news has also learned that the committee plans to refer to several republican members of congress to the house ethics committee for their failure to comply with the subpoenas. five house republicans, kevin mccarthy, scott perry, jim jordan, andy biggs, and mo brooks, all ignored requests from the committee to cooperate. now it's important to remember, these criminal referrals carry no official legal -- remains up to the department of justice to decide whether or not to charge the ex president, or anyone else who might be referred to by the committee. for more on this breaking news, let's bring in nbc's ali vitali, who's live on capitol hill. ali, great to see you again, what more can you tell us about this exclusive reporting? >> michael, and addition to all the things that you laid. out that we overheard from inside the committee here today. the larger question is whether or not the trump campaign, it's

gonna respond in the inquiries that we sent to them tonight. they didn't respond to the substance of the reporting on these multiple criminal referrals that the committee is going to announce tomorrow. instead they surprise -- with platitudes talking about this committee as a kangaroo court in the same way that we've heard the former president do on social media platforms. and that we've heard from his campaign team is before. the difference right now, michael, it's an active political candidate, the conversations that i've had with lawmakers on the hill, each various turn of trump -centric news cycle has been that they don't want to talk about him, on the senate side, the dynamics are different than they are in the house side. their most interesting regarding kevin mccarthy, other top republican leaders in the house. because that house republican conference is so remain in the former presidents image. what's been striking though, when we've asked questions about the former president,

both in light of the january six committee's investigation, and other inflection points like his dinner with white supremacist, nick fuentes, and antisemitism comments from kanye west. after all those moments, lawmakers haven't wanted to talk about it, instead they seem to be taking the trump-ism, the focus that he had during his presidency on things like, the origins of covid. hunter biden's laptop, trying to apply those ideologies or focuses if you want to call them that, to what they want to do with the majority. but they don't necessarily want to talk about him. this is gonna be yet another moment where the january six committee shines a spotlight on trump, makes history referring a former president on criminal referrals charges. even though those don't have weight, legally, within doj it's historic, a moment that republicans are gonna have to figure out what they do, and if this is a moment where they again, move away from him. we've had several of those moments and that has not yet happened, but it is another reminder to voters, this is a

ballot box, and that's because from the national level down to the state party organization, it's the maga stream of republicanism, that's become dominant. it's now standard practice in the gop to change the rules, to work to overturn elections, to call an insurrection, political discourse and unfortunately, i don't see that changing anytime soon, until republicans well, start acting like republicans again and get tired of losing. joining me now is democratic congresswoman, and he custer of new hampshire. she's chair of the new democrat coalition. welcome congresswoman, great to see you. >> great to be with you, michael. thank you for having me. >> i want to get your reaction to the breaking news on the january six committee, what do you make of the recommended charges that they're proposing against donald trump, and do you see an impact from all of

this? >> well, first i want to say that i was a victim, a witness, and our survivor of the january 6th insurrection. i was in the gallery in the house of representatives and one of the last to be evacuated. i'm so grateful to our colleagues for everything that they do, hours an hours, of painstaking work, thousands of depositions, getting to the bottom of this case, and now they're ready to make the referrals. i think the american people will respond, certainly the hearings that they had last july had a big impact on the results of the election in november. the voters rejected republican extremism, and what they're looking for as more of a mainstream approach. so, that's why i'm proud to be leading the new democrat coalition, or the ones that will get the job done, and work with reasonable republicans to move our country forward.

>> what do you make of the possible ethics violation for members of congress, is inappropriate recommendation for the failure to comply with subpoenas? >> absolutely. as members of congress, we take an oath to abide by the law. the subpoenas were lawful, they were instructing members of congress to provide documents, testimony. they were ignored and i think it's important and inappropriate for our ethics committee. >> i want to get your take on this current strain of the gop, you heard my take on it. in my view, the maga strain, has become dominant. it seems the only way that that's gonna change, is if republicans keep losing for a while. what are your thoughts on that? >> that's what we saw here in new hampshire. we had a resounding successful election, two house seats, i

won by 12 points, chris pappas by eight points. maggie hassan from the u.s. senate, by ten points. the voters here rejected are extreme republican opponents, who are all three trump republicans. and they are very, very clear that they want people to take a much more proactive approach to working across the aisle. and to solving americas serious problems. and i look forward to doing that in the 118th congress. i've already reached out to my counterparts, dave joyce, and as i say is the leader of the new democrat coalition where they can do caucus, where the ones that gets the job done. right now, we're working frantically over the last few days of the session here, to pass major bipartisan mental health, addiction legislation. -- so, --

and so, we need to make sure that we do come together, another example, michael, is the nda, the defense authorization. 350 members, 176 republicans, 174 democrats, they came together to pass that bill. and so, that's what the american people want, they want us to work together, get the job done. and they're ready to reject this extremism from the maga republicans. >> you've referenced your newly elected roles of leader of the new democrat coalition. that can dukakis, how do you see that caucus working with republicans in the house, how do you brand that caucus says work outside the congress, so the american people can get behind that can do attitude, and push which i think they

should, to get congress to actually accomplish something in the next session. >> thank you, it's conversations like this, telling people that we are 96 democrats, or from those purple districts where we defeat maga republicans. 22 frontline members who were in top districts, made it back our new democrats. and 17 brand-new members of congress, for the 118th, who are new democrats as well. and seven of those, flip seats these are new democratic members. we are the ones that will bring back the majority for democrats, in 2024. but in the meantime, we'll work with anyone, or stand up to anyone. as is necessary. there is any number of issues that were already working with republicans on immigration reform, we've got a bill about

farm, workers i work in immigration and also climate change, with a colleague from utah as co-chair of the bipartisan ski caucus. we look for any opportunity to find common ground. i mentioned we work with addiction climates, so all of these issues, and plus we have the farm bill coming up. it's a bipartisan process. i serve on the agricultural committee, i look forward to that process. >> i appreciate that caucus, you gotta get that scheme on. but before i let you go, i want to get a little bit more into the political weeds a bit. and get your thoughts on the possible shakeup of the democratic primary calendar ahead of 2024, president biden's plan was to strip new hampshire of its first in the nation primary status. i need to admit, i'm straight-up bias about this, i applaud this, for sometime now

even as chairman advocating, these type of changes in our primary system which has grown stagnant, and actually ferments a lot of the extremism. but that's me, not you, what could you say and tell us about the thoughts on, this and what is the case we made for keeping the system the way that it is? >> i'm not opposed to change, michael, you know that iowa will drop out of the first caucus spot. what i think it's a complex puzzle with a simple solution. it's not an either or, or it's a both hands solution and what's that about is that of course we want to lean in and welcome the participation of black voters, latino voters to our process, and make sure they get hurt early in the process, but i continue to believe that new hampshire has a unique position, a small state, you

don't need to be wealthy, famous to run for president here, you can have normal conversations with hairdressers, truck drivers, teachers, and police, just people in diners, town halls, all across the state. it's served us well, look at jimmy carter, barack obama, i was on the barack obama campaign, he cities me before michele was on board. and he went to those town hall meetings, talk to voters in their living rooms, and i think he improved as a candidate. i said to president biden, look, i'm a big fan he's just had an extraordinary two years session of congress, and everything he's done for the american people, i told them, come to new hampshire you will win handily, you'll clear the field. and, so he has nothing to be afraid of. new hampshire, south carolina, nevada, one, 23 would serve our

gonna start over an investigation based on these referrals. that this point i'm more curious what the recommendations are gonna be. so they don't see this happen again. >> basil, this is a big deal, it's historic. -- from congress, how do you see this what are you hearing among democrats about something like this happening? >> well you know, i grow back to the overturning of the special master, a few weeks ago. in the outcome, i think it was, even the former presidents aren't above the law for all intents and purposes. i think that's the message that democrats carry, ever since january six committee started leading. i wonder if a lot of folks just want to see the president and members of congress being hauled out and hand graphs, in some ways i think it's

something that a lot of voters want. but probably feel they're never gonna get. but some accountability is important, the congressman said earlier that there's ethics violations, those in congress they would like to see -- i know a lot of americans a lot of democrats want a step further. they may not get it but i do think what happens thus far with the january six committee. and having in times an uninterrupted narrative for several months to be able to lay out the case. it did a lot of the job already. which was convinced the americans, to tell the story of how so many republicans, trump included, really -- insurrection. even if we don't get to see that perp walk if you will. i think it rests within the minds of many americans, that all of these folks that have been named, including the former president, they're all accountable. >> it's one hell of an image

for folks to have in mind. and i think it's probably an image that's concerning to donald trump. he's already posted about the committee's work several times this weekend. calling them corrupt cowards. how do you expect other republicans to react. we've heard crickets out of them for the most part. what's your take on how they respond here? >> you, know i cannot, i cannot predict how they will behave, ever. watching, first of all watching the january six hearing which by the way was one of the top 28 television shows of the year on a pool. i cannot believe there is been some utter silence. from the republicans, and come, on this is the united states of america. when you talk about discarding parts of the constitution.

>> new today from nbc news, according to white house officials, president biden plans to speak to the american people this week, before the christmas holiday and new year. about what he sees as his major accomplishments since taking office. that comes just days after the white house held a series of closed door meetings. from which democratic strategist and activists came out with an emphatic message. go out and sell president biden's record. it's the latest sign that biden is preparing to mount a reelection campaign. according to nbc news, a battery of senior white house officials delivered presentations on biden's tenure and the briefings on the economy, climate change, and the way forward. political reports, biden aides have been working with outside advisers to help sketch out

than the midterms, this may be the closest that democrats are getting to reconstituting the original obama -- it won't be the same. there is no question about. at this completely different candidates. given the role that independence played in the midterms, it's a great time for not just having democratic loyalists, but others who are more moderate, independent being able to go out and talk about joe biden's record. it was a big part of why democrats did so well during the midterms. let's also be clear on the other side, if maga republicans do what mackerel publicans do. he's gonna have a pretty good foil, that they'll be able to use as a lever and wedge going into the presidential -- he's in a good position right now. >> susan, is a, think about it

he's gotta go out and sell his accomplishments. but then he's got a deal with the rock gop, the infighting inside the gop, it will spell out, and everybody's gonna get splattered, but in addition they're gonna be coming after the administration on some of those accomplishments. how do you think the president does and the efforts to sow what he's accomplished? >> well, i tap into what basil talked about in using surrogates, i think will be much more effective, and frankly with the president giving his state of the union next month he should save it for that, he can really set himself up for a really important speech going into what will be the presidential -- i also wonder if biden and his people should be a little concerned from what we're staying in trump. meaning, people want to say goodbye to trump. they also are willing to say goodbye to biden. if it means a new future of

leadership within the democratic party. i think that should also be on the presidents mind. and be careful of taking a victory lap too early. again, save it for the state of the union. >> yes. exactly. i think that's an appropriate point to make. judy, that kind of leans into the question about the team's plans to use trump's words against. i'm including recent comments about terminating the constitution. as we, seen the strategy oftentimes doesn't work. how strategically, strategically, how do they push back against the republicans in pressing the case for biden's accomplishments and the potential opportunity for a second term? >> well, i think i agree with both basil and susan. i think that people are sick of trump. but i do believe they can take

a page from the republicans on how to tout all of your accomplishments even if there are not true accomplishments, and they're just lies when i think that we need to drive home how much she's accomplished in the last two years. and the midterms, where history making. when i think we need to focus on the positive, and use that negative stuff, when it is needed to fight back. and we can get at this, our messaging, the democrats messaging is not great, but hire some comedians, -- >> judy, you sound like you're trying to convince yourself. we could be good at this. i know we can. were the little engine that couldn't can.

senate democrats are preparing to respond by wielding their newfound subpoena power. political reports, now the senate democrats have an outright majority in the legislative set and the next session. they intend to use the investigative authority as a counter point to the house gop probes of hunter biden and the biden administration's withdrawal from afghanistan. this would be democrats way of flipping the script, so to speak. by shining a light on trump and corruption within the republican party, as former republican spokesperson, kurt, writes in an op-ed for the los angeles. times quote, there is no reason senate democrats shouldn't turn the tables on republicans by finally investigating the conflicts of interest created by donald trump, ivanka trump, and jared kushner during their time in the white house. let's bring back our sunday night panel. susan, do you see senate democrats successfully flipping the script on republicans? it's never happened?

>> it should happen, democrats can act like republicans to be successful. they need to act like democrats. what that subpoena power they can also do some good. like look into some of the issues that caused the supply chain issues. and other things that may help this administration. i'd also like to highlight that the biden administration is one of the most successful two years that any president has had. they got so much done. they did it because they got republican by again. to move stuff out of the committees, which were down under a power sharing agreement. it was 50/50, representation. -- i honestly wonder, if they didn't have that and this first two years, when anything have gotten done. but as we're looking forward, i think that there are some target things they should do, they should do investigations into corruption, absolutely. but also, wield the power of

good if you will. >> awe, the power of good. that's leading concept. basil, political piece reports that senate democrats are considering taking the baton from house democrats investigating trump's tax returns, and the oil industry's couple billet-y when it comes to climate change. the question is will senate democrats be able to fill that investigation now that democrats have lost control of the house. and pick up that process in the senate? >> yeah, i piggyback on susan's point. as long as democrats use it for good not evil, -- then i think that the american people look at that and say, this is the good use of political power. but if they are doing it, essentially, to counter everything that the republicans do. then nothing is gonna get done, and everybody in d.c.'s gun of a subpoena and be called in front of a committee. that dueling, those dueling

trials and -- not good for american voters. the voters particularly, independent, voters perform the way that they did during the midterms. so, i think of its use widely to get them to the meat and colonel of the important policy issues that affected a lot of those moderate and independent voters. i think you have something there. i will say quickly, for all of those text messages that were sent to him from mark meadows. there's 100 that we didn't see. so, if there is an opportunity for democrats to actually open the door amid -- and expose the length and breadth of this sort of community that was involved -- talking about. it then i think you're getting into -- >> so, i appreciate both susan and battles approach here.

developments from nbc news that the january six committee met earlier today to finalize plans to issue coming up -- ahead of tomorrow's public area. those referrals include obstruction of an official proceeding, conspiracy to defraud the government, and inciting or assisting an insurrection. adam kinzinger sits on that committee. he was also one of just ten house republicans who voted to impeach trump after the attack on the capitol. out of those ten republicans, only two were reelected. the first either lost or races, or the rest either lost the races, or like kissinger, left office at the end of their term. this week kissinger -- farewell speech on the house floor. where he condemned his party's
