and officials urging people to stay off the roads. we're live with the latest forecast and what's to come. also this hour, the clock ticking down to a government shutdown. the senate just sending a bill over to the house to try to keep everything open. a live report from capitol hill on the last minute vote wrangling. plus the january 6th committee still get to release their final report. our team here with the holdup and when we might see more transcripts. i'm lindsey riser in for hallie jackson and we will begin with the latest on the powerful winter storm and the latest forecast in a minute, but first, marissa joins us from i 95 in philadelphia and katie beck is at reagan national airport outside washington, d.c. and marissa, 100 million americans say they plan to take to the roads for the holidays. how is it looking and what should drivers expect over the coming days? >> before i get into what we're seeing on the ground here, we got to talk about what the midwest is seeing, because they are just, they're seeing a whole lot more compelling images that

you're about to see. a lot of parts of them are getting pummelled with the arctic temperatures and the snow that makes for very dangerous driving conditions some of the no matter where you, are i think the number one tip, we'll say it over and over again, it is to take it slow on the roads and back out to us live here, we're not seeing anything like the blizzard-like conditions, there's blizzard warnings for up to eight states, but here in the maryland, dc, and new york, and philadelphia area, where we are, it's just rain, it's just a miserable gross commute. and if anything, we did see one minor accident, and that didn't really look to be too serious, but what was serious was all of the traffic behind it, just backed up for miles and miles, and so when it comes to traffic, i would say it's hit or miss, there are parts that get a little bit more congested than others, but you mentioned it yourself, 100 million americans expected to take to the roads for this holiday season, and it is something that is really interesting, it is 90% of those who are traveling, so whether or

not driving is the preferred method, aaa expects this to be nearing pre-pandemic levels, we caught up with a few people, while we were at a rest stop in aberdeen, maryland, and they were saying they were seeing people along the same lines as what they were seeing in 019 before the pandemic hit. so i will say that the one thing is we're seeing people perhaps a little more congested, when we approach cities like philadelphia, but so far, relatively good. keep in mind in the northeast, you're seeing the images in the midwest, that's coming, that's coming our way and don't get too excited about the fact that we have no snow here where we are, because we could be seeing very slick, very icy conditions, especially tomorrow, where we're going to be seeing the temperatures dip, so one of the things we're telling people is that if you do plan on being on the roads tomorrow, know how to drive on black ice conditions, because you might be encountering that and one of the main things is don't slam on

those brakes. and of course, we'll say it again, not just pack your patience, but also just take your time with it. lindsey? >> certainly. katie, over to you at the airport. we've seen already nearly 2,000 flights canceled today. and another 5,000 delays. just awful, and i already can hear a lot of ambient noise around you that place is pretty busy behind you. >> yes, it's getting busier, today has been a pretty routine day here in dc, most of the flights have been on time, not a lot of delays or cancellations. many passengers have had sighs of relief when they walked up to the departure board to see that their flights were going to take off and get where they're going for the holidays, but the storm could not come at a worst time. thursday and friday of this week are projected to be the largest travel days of the holiday season. 7 million people are expected to fly, between now and the new year. so there is going to be millions of people that are experiencing

holiday headaches over the next few days, as they try and get where they are going, and try and side step the storm. one thing the airlines did was wave those change fees, so that people might change their flights earlier today, to try and get ahead of the storm, and we spoke to some folks here at reagan, who did just that. >> we're watching this pattern and we decided it is better to move it up? >> yes, my dad texted me, and he was like, i don't think you'll make it if you come on friday. and we're like yeah, maybe we should change our flight, so we did. otherwise, we wouldn't be able to be in chicago with our family for the holiday. >> now, as the hours have ticked on, we are seeing more delays and cancellations pop up on that board. we did hear from one passenger headed to denver, that his flight had been delayed and we know another going to traent, and chicago today, had been canceled. so i think as the midwest starts to really feel the impact of that weather, that trickle-down effect to the other airports

that are hubs is going to happen eventually. right now, things are pretty calm and steady here in washington, d.c. but the next 24 hours may have a different story behind it. >> thank you so much. i want to bring in dasha burns at newark airport and you saw people who had to rejiggy and it is not easy when you have kids. what is the latest you have? >> christmas spirit is in full swing. we just saw a will farrell style efl up stairs trying to cheer up the kids waiting for their flights right now. and this storm is moving into this area. it is really nasty outside, already, we are expecting that to last through tomorrow. only get worse. we will see wind gusts here, we're going to see flood watches here. all as the travel levels are up to the pre-pandemic. and the delays are stacking up on the board. last hour, i was looking at that departure board, it was about a third of the flights or so, with

some kind of delay. and now it is looking about half. so the later in the day that it get, the worse it seems to be getting. so we have been talking to people who tried to move their flights up a little bit earlier, but a lot of people who have connecting flights are especially worried, especially those flights that are going to be going into the storm. we talked to families flying to san francisco, they've got that earlier flight, but they're still worried, are they going to make it, how are things going to look, are they going to be dealing with turbulence, and the reality is, you're going to have to be patient. you may have some trouble here, and you've got to make sure that you get here as early as possible. you might see the delays. you might have to make changes, which means you might be waiting in a line to talk to a representative from the airline you're flying with. so as much as you can do to prevent some of the chaos, do it, but also just be prepared that things might be getting a little hairy here. the authorities in this area, the port authority folks say that they're going to see about

over on capitol hill, senators just passed that massive $1.7 trillion government funding package. by a vote of 68-29. meaning lawmakers are one step closer to keeping the lights on and avoiding a government shutdown. the package includes aid for ukraine, and more money for emergency disaster relief, and an overhaul of the electoral counteract. senator majority leader chuck schumer celebrating at a news conference just in the last half hour. >> we've concluded this congress, one of the most productive in decades, with one of the best omnibus packages in decades. and here's one of the things that amazes me. the amendment process made it better. >> the bill now heads to the house, where lawmakers are under

a really tight deadline with government funding set to run out tomorrow. let's bring in nbc news capitol hill correspondent, julie, will the house get this done before the deadline tomorrow? >> this morning, a little nervous there, but now that the senate was able to squeak it by, i think the general shutdown idea has changed but there is a lot that the house has to process this procedurally before they can vote on it on the floor, and that's in part because the senate was able to add some last-minute amendments that passed today. expanding post-partum care and women who are breast feeding in the workplace, major wins on that end that senators were trying to get into the bill, so what happens now? they just passed it 6-29 in the senate. it heads over to the house where it will go to the rules committee and work on adding the amendments in. one thing that could potentially gum up this process and make it

longer in the house, is republicans are against the bill and kevin mccarthy, the leader vying for the speakership gavel needs to stay strong, and passing a continuing resolution 2023, and all signs are pointing to the midnight deadline tomorrow, and president biden signing it, too. >> julie tsirkin, nothing like last-minute drama. thank you very much. on the other side of the capitol, there is news today of a new investigation, and not by congress, but into someone elected to congress. the new york attorney general saying today, she's opening an investigation into congressman-elect george santos, the 34-year-old republican who just won a house in the seat in the midterms but a bombshell report in monday's "new york times" revealed many details about his life that he talked about on the campaign trail, including his education and his work history, and they may have been fabricated. that story by the times also raising questions about his

financing, and campaign disclosures. santos tweeting today that he quote has a story to tell. his campaign calls the "times" story a smear campaign. nbc's ryan nobles is on capitol hill. so ryan, republicans have been pretty reluctant to talk about this. i can imagine though, an investigation into one of their new colleagues isn't how they imagined starting the new congress. >> no, not at all. and you know, the extent to which this investigation by the new york attorney general's office and how deep it has gotten is really unclear. they're just saying that they're basically looking into the allegations around george santos and the house minority leader, potentially the next speaker of the house, kevin mccarthy was asked about george santos today, and he simply didn't answer the question. so it is unclear how republicans here in washington are going to handle this situation. and they're in kind of a tight spot, because the margins between republicans and democrats are so tight, they're just a few seats that separate the republican majority from the democratic minority in the new

congress. so it's not as if pushing santos out would make life easier for kevin mccarthy, it would actually make it more difficult. and as you point out santos for the first time responding directly in his own voice to these allegations, he said in a tweet today, to the people of new york 3, i have my story to tell and it will be told next week. i want to assure everyone that i will address your questions and that i will remain committed to deliver the results i campaigned on, public safety, inflation, education, and more. happy holidays to all. that certainly doesn't read like someone who is ready to step away from this position that he was recently elected to. although, as you rightly point out, there is a long list of in accuracies in his biography, there is the potential of fraud or criminal activity related to the financing of his campaign that is still being looked into. so this is going to be an uphill climb for this new member of congress, if he ever ends up taking a seat here in the new year. >> ryan nobles, thanks so much. next, what we're learning, a

the january 6th committee continuing to tease that final report, with more transcripts from their depositions. standing out, the full conversation between the panel and cassidy hutchinson, who we now know testified from everything from the former president's temper to his own recognition that he lost the election, to potential witness tampering, on the day before she was set to testify. not talking is a dozen people who were close to the events of the 6th, all of whom pleaded the fifth to nearly every question asked them of the committee's final report still mia after the panel missed the deadline to produce the eight chapters. ali vitali is here, and punch bowl co-founder jake sherman and former prosecutor and msnbc legal analyst charles coleman. ali, no final report still, but we are getting new transcripts

from the committee today. what are we learning from those? >> we're still playing the waiting game here, for a second day, on if we're going to get this final report. but we have been seeing drips and drabs of the transcripts that we think are going to be the most interesting. yesterday, we got a series of 4 transcripts, mostly of people who pled the fifth, but today we're seeing cassidy hutchinson, two depositions, from september of this year, after she had switched her counsel, and that's important, because what we've seen in these is the pressure that she may have been under from her original counsel, one of the top white house ethics lawyers, who was representing her, and basically telling her, say you're a low level secretary, don't tell them if you remember everything, and it's not perjury because they don't remember what you don't remember. that was the advice that she was initially being given. then, when she switches her counsel though, we see her become much more transparent with the committee, we of course see her give that testimony that is next to me on the screen here, when she came in for that explosive hearing, but i'll pull up for you two other messages

that caught other attention, specifically one from ben williamson, one of meadows' closest aides, texting her the day before her testimony, saying, ben williamson, these are cassy hutchison's words, said something to the effect of well, mark wants me to let you know that he knows you're loyal and he knows you're going to do the right thing tomorrow and he will protect you and the boss. and that's one. pieces where we've seen this committee multiple times over the course of the last few months tease out the idea that there might have been witness tampering, and this is one of those moments that catches up, and actually lets us fill in the blanks on who might have been the witness being tampered with, and how, but then there is another piece of this, too that we can pull up something that she talked about in exchange of john ratcliffe where she said rat cliff said, i've had a few conversations with the president, where he acknowledged he's lost, he hasn't acknowledged that he wants to concede, but he acknowledges that he lost the election. it's important, because this is

again, that the committee has tried to continuously drive to the mindset of the former president, what he knew and what he was being told by his aides and what he did anyway. what he knew, and this is yet another piece of evidence to that, is that he lost the election, whether or not he was ready to concede it but that he still was going forward with efforts to try to overturn the election, a false slate of electors, and encouraging supporters to come here on january 6th and on the day of the insurrection, we know what happened in the halls of congress. these are key piece, the committee's work is done, and we know what the department of justice will know, and of course, they'ring did their own investigations on top of that, to see if any of this is able to be prosecuted. >> jake, it should have been spilled into the public view. why the delay here of the full report? >> well, what i've been told is that they are printing it. it's over 800 pages. that everything is good and we shouldn't be worried. but here's the problem, lindsey, and i think that this is a political problem, not a substantive problem, but we are, as we all know, just a couple of days ahead of christmas.

so if they release it today, or tomorrow, i'm not sure it has the balancing political salience that it would otherwise have after an 18-month investigation. so maybe they kick it into next week but then you're in the week between christmas and new years, so i think it behooves them to get it out as soon as possible. >> charles, i want to pull on a thread that ali started with, that question of loyalty here, committee members have alluded to witness tampering before, and what she just heard from ali, where they mentioned loyalty, recommends stonewalling the committee. does any of that amount to a crime? >> well, lindsey, it, could but i do think there is something else that ali said that could be quite important, in terms of understanding how the d.o.j. might process this, it is important to understand that what we're seeing is only a fraction of what the d.o.j. is looking at, as they are conducting their own investigation as well. and so then they have the additional evidence that corroborates what has been put out there, and fully bolsters the charge of tampering with a

witness that the d.o.j. might look to act on. and i do think that, with respect to probable cause, and perhaps reasonable suspicion, that a crime has occurred, we may have that. we may have enough to actually secure an indictment from a grand jury. is it reasonable doubt? i don't know if we hit that territory yet. and i think that's where the additional investigation from the d.o.j. will lead us, as to whether there is more information that is going to support that sort of a prosecution. >> jake, a pattern is starting to emerge here from these transcripts and a lot of key figures in the committee's investigation, pleading the fifth, to every question they were asked, including the mundane. are you getting a sense of how much that, or even just those who blatantly ignored subpoenas, didn't even show up, ultimately hurt the panel's fact-finding mission? >> not much at all, i think, ali would agree with me here, i think they had so many cooperative witnesses who were around these witnesses that did not talk, that they were able to paint a very full picture. i mean they had so much participation from the

president's circle, so much participation from people close, and in the white house, who sat for hours of depositions that these other figures, while it would have been nice of course, to have their thoughts, were not really material to the investigation at the end of the day. >> these moments that are coming to light in the transcripts where we hear trump admitting he lost the election, does that give the conspiracy to defraud the u.s. referral more weight? >> absolutely. in the wake of an unsuccessful conspiracy or contempt charge you need to frame the defendant's frame of mind and i think what the committee is doing here is they are clearly establishing their frame of mine, the frame of mind of the former president, and in establishing what it is that he knew, putting out the fact that he knew it, putting out the fact that he was having conversations with other individuals, where he acknowledged it, and so i think that's a big part of the actual mens rea which is necessary to establish this sort of crime. having said that is correct lindsey, i want to underscore for viewers and for the audience, that these are still very difficult charges to prove

and very challenging nonetheless. so while i do think that the d.o.j. is being given a nice head start, with the information that's gleaned from the 1/6 committee, i don't want people to think that this is in any way shape, or form, an open/shut case. the d.o.j. still has a lot of investigating to do. and a lot ahead of them, if they want to make a direct connection between donald trump and what actually happened from a standpoint of being the ring leader. however, with what we are seeing trickle out from the committee, in respect to these transcripts, this is absolutely a good start. >> mens rea, i didn't know i would be brushing up on my latin today. charles, real quick before you go, i want to play something that the former lead counsel for the mueller investigation, andrew weissmann said last night, and get your thoughts. >> one of the many things that the january 6th committee did, that is so poignant -- the leeway for the department to take up what was going on in the white house, and to not just be

pursuing the people who are sort of foot soldiers. >> charles, will this report give the d.o.j. cover, the leeway, as he says, to go after some of the bigger fish? >> well, i do think it provides an opening. as we all know, everyone in the white house, everyoneconnected to the white house, in any way shape, or form from january on up has had the notion of executive privilege and that is a very difficult thing to pierce at a number of different levels and i think where the committee has already made some headway, it gives the d.o.j., i think, some guidance and some opportunity to explore different everybodies that may have already been shut, or may have been tried to be shut by people associated with the white house. so in terms of cover, i don't necessarily know that it protects them. but i certainly do think that it gives us some clues and perhaps some gingerbread sticks, if you will, keeping with the holiday season, to follow their way home, if you will, around the white house, and going forward, and moving beyond just the foot shoulders, into the sort of upper tier, the higher tiers of people who were actors around january 6th and the

insurrection. >> ali vitali, jake sherman, charles coleman, thank you all. the future of title 42 is still in limbo, as the supreme court weighs whether to let the covid era border policy end. the biden administration wants it, to in as soon as five days. the 19 republican-led states don't. and the uncertainty comes as we see migrants crossing into el paso, texas, facing unusual and dangerously cold temperatures. sleeping in the streets sometimes. and some told our nbc news team, they didn't know the cold front is on the way and they only have light winter clothing an temperatures below freezing tonight. i want to bring in guad venegas in el paso, texas. help us make sense of what it is like for people today and what the city is doing to help them? >> lindsey, i should say that i spent the day yesterday, doing my job, and talk can to the migrants that were arriving, telling them about the weather because they had no idea it is getting even colder and

obviously they are not looking at the weather forecast, so every person i spoke, to i would ask do you know how cold it is going to get, and make sure you figure out where to sleep because many are sleeping by the river on the mexican side and hundreds are lining up on the american side, and this is the border wall behind me, and down in that direction, that's where federal agents, border patrol is processing the asylum seekers and they bring them in advance, and go through here and get information here, and we know the asylum seekers that end up in el paso, and it is an overwhelming number of migrants arriving in el paso, with the cold temperatures, and not enough shelter, and the city and the county declared a state of emergency, but every day, we continue to see people that sleep on the streets. so we spoke to authorities here, local authorities, who talk about their plans, offer more shelters. here's part of the conversation. >> hundreds, we have space right now, and we have the potential to expand.

fortunately the current placement of the convention center is very close to where we're seeing a lot of the congregation so we will see more as i've been here. >> reporter: now, lindsey, here is something that we still don't understand. so you have the asylum seekers that are being processed by cdp, released, and then those asylum seekers will get on a bus, and go to one of the shelters, but you have another group of migrants, and this is a reality, because this other group has grown. and these are undocumented migrants that did not turn themselves in to seek asylum. they crossed through other parts of border wall, and have not turned themselves in to border patrol. and a lot of these migrants continue sleeping on the streets, and they have told me, they cannot go to the shelters because they are not documented through the asylum process. and whether they're doing one thing, you know, the way that border patrol is asking to do it or not, they're on the street, and the reality is when the temperature drops into the 20s, and the national weather service says the wind chill will make it

bell. the dow currently down more than 400 points, and that pretty much totally erases the rally we saw earlier in the week. investors are growing more worried about a potential recession next year. cnbc's contessa brewer is watching from the new york stock exchange. it has been a rollercoaster of a week, a rollercoaster of a day, and right now markets are kind of in recovery mode. what is going on right mow? >> it is a rollercoaster of a year, too, and investors are looking for a santa rally, really thought that they got it yesterday, and you give it a day, and it is looking more like a santa slump. although i will say, the dow down a percent or so, and you have the s&p off by a percent and three quarters and the nasdaq off 2.5%. that is an improvement from the lows of day. at one point the dow was down 800 points. strong numbers on the labor market. and what shows economic growth in the third quarter. and that is giving investors the heeby jeebies, because the economy is growing and we think this is all good news, right?

but instead it means that inflation keeps being part of the picture, in part because the employers have to pay more in order to attract and retain workers. and the fed is very clear that low inflation is more important than unemployment or recession. now, on the day, trading stocks, on the shares of movie chain theater amc entertainment, a new low for the year, down about 11% right now, it proposed a reverse stock, where each current share then becomes a fraction of a share. we have been watching, talk about a bad day, week, month, year for tesla, tesla stock down about 9% today, on news that it is offering discounts on its cheapest models now, it is taking some tough times, never mind the elon musk headlines. and one more for you. casino giant caesar's gets a losing hand today down about 6% a lot of worries about whether americans, facing a recession, will stop their discretionary spending. but so far, most of the casino

companies say no, they are seeing americans just in there at the restaurants, the spas, at the bars and certainly the gaming tables, spending. >> con tessa, what is affecting investors today? >> well i think, as we said, the economic reports, that indicate that we are not in 5, that we are not seeing growth slowing down as much as the fed would like. and so if you see, for instance, third quarter gdp numbers come out better than anticipated, when investors think oh, my gosh, is the fed going to keep hiking rates? are they going to get more severe? when really the stock market wants the fed to stop hiking rates and maybe start thinking about a pivot. >> thank you so much. sam bankman-fried, the one-time crypto king is now back in the u.s., being released on $250 million bail. and the new york federal judge ruled earlier this afternoon. this ruling comes as sam bankman-fried's first u.s. court appearance, after his

extradition from the bahamas, he's in court right there on the screen, the former billionaire and ftx co-founder facing charges including fraud, money laundering, and campaign finance offenses, stemming from the dramatic collapse of his cryptocurrency exchange ftx. nbc news correspondent ron allen outside that courthouse in new york city. so ron, what can you tell us here about what went on in that courtroom today, and also the bail terms. >> well, it was quite a moment when he left the court. it was stunning to see. because the big question of the day was whether he would be granted bail or not. and he was. and the $250 million bond that he had to post was, the prosecutors said, the largest amount of bond that they had ever seen, or that they can recall. and significant amount of money. and he was able to do it, because his parents secured it, his parents are, attorneys, lawyers who live out in palo alto, in california, and the property, the value of their

home was enough to sustain that level of a bond. so that's why he is able to post it. he's essentially going to be under house arrest in their home, and he is wearing a monitoring device on his ankle, and it's very strict, the judge said, and the judge was satisfied that he was not a flight risk, because he would be recognized wherever he goes, and everyone seemed to agree that his finances were significantly diminished, was the word that was used, which would also lower the risk of him fleeing. the other big development of course was two of his top business partners, his associates, essentially turned on him. and agreed to plead guilty to multiple fraud counts, in exchange for, and to cooperate with the continuing investigation. they were facing anywhere from 15 to 100 years in prison, which is the sentence that they had, and the u.s. attorney was very vocal in saying to others who worked at bankman-fried's

worse, we're getting toward the peak of the storm which is friday, and christmas eve on saturday and things will get a little bit better in most areas, so almost half of the country, almost half of the population, i should say, is under a wind chill advisory or warnings or watches, and look at the south texas, and north florida. it is going to be cold. and up to this point, we've been dealing with mostly just the cold a little bit of snow. and nothing that has been too bad. even the winds haven't been doing any damage. and looking at the power outages, not that many, a couple of, a thousand here and there in texas and oklahoma. and the cold wind chills the next two days. we are at that in south dakota and the midwest. tonight the coldest night in the areas of the deep south and areas of texas. and then on friday afternoon, and saturday, morning is the coldest in areas of the east coast. and as we mentioned, it includes all of the 50 states. we will have wind chills below 32. so how cold are we and where is the holdest right now? we've been watching sioux city, negative 35.

montana still takes the cake negative 49. and dallas, right now this is unusual, negative 3 degrees. chicago, you're crashing, earlier today you felt like twa 35 and now down to 1. and that cold air now it has made its way to the south, and heading to houston and san antonio, and then tomorrow, it is going to head to the east coast. i mentioned we had rainy weather in the mid atlantic, and a little bit of wet snow in the areas of upstate new york and also in parts of pennsylvania, state college had about six inches of snow today. and the dry snow is st. louis to chicago, the powdery snow blowing all over the place. the snowfall totals, a lot of people will see a coating but the only areas that will have a lot of heavy snow, it will be drifts, and not saying shovel, and it will be too windy, but the drifts will be high, and there in michigan and especially off lake erie, coming into buffalo. this is the highlight, as far as extreme weather goes, and the areas off of lake erie, here, near buffalo, 60 to 70, and 75 mile-an-hour winds. that will do damage, to trees and structures. and a lot of power outages. and at the same time, they're going to have a heavy lake

to an agent what i recommend is get out your phone, even if you're in the line, try dm'ing the airline, a lot of airlines have chat bots that will let you change your flight. if you want to get through on the phone, you have five plus hour waits. one of the favorite tips is calling the international service line so call the mexico city office or asian offices, the agents speak english and often the wait times are shorter than the u.s. lines during storms. >> if you are at the airport and are in line to talk to a gate agent. what are the questions that a travel pro would know to ask that maybe they wouldn't ask you? what should you be talking to them about? >> you know, one of the things you want to ask is, can you protect me? if your flight is delayed, which almost half of flights are today. if you're not going to make your connection, see if they can protect you on a later flight. you keep your original rear evaluation, but they reserve a seat for you. often they won't do this unless

you ask and if you have elite status with the airlines that helps. but unfortunately in the u.s., the airline's responsibility is to get you there and it might be days away. if the airline can't get you home in time for christmas you are owed a refund if your flight is delayed or cancelled, rebook yourself, use frequent air miles in times like this. so you have to be really proactive hoping for the agent at the airport to bend over backwards isn't it going to happen. you have to get crafty. >> i hope i'm not catching you off guard you say if you miss christmas they have to guarantee that, is that a certain amount of days they can't get you there or christmas because it's a big holiday? >> any time. if the airline dramatically delays your flight, generally like four to six hours or cancels it, you're owed a full
