it is no secret that legal trouble has followed donal trump for much of his adult an pet professional life. but, 2022 has been entirel something else for the forme president. his namesake company, the trum organization, was found guilty by a new york jury and a 1 year tax came to pay top executives off the books now order to avoid taxes the company faces roughly 1. million in fines with othe possible financial implication because of that verdict. and, although donald trump himself is not implicate directly in that case, trump the company and three have his adult children are implicate in a civil case that the new york attorney general letiti james brought this year. the attorney generals suit alleges the trump and th company committed alleged fraud, including undoing and over valuing assets in order to

receive better terms fro lenders and ensures. if the trumps were to lose thi civil suit they would face a steep list of penalties, including hundreds of millions of dollars in fines and bans from doing business in the state of new york. then, of course, there is no one, not two, but thre criminal investigations focuse on the former president. in fulton county, georgia, the attorney there is investigatin trump's attempts to overturn the states 2020 election results. after a recorded january 202 phone call where the on his wa out the door trump told th georgia secretary of state t find 11,780 votes, she has interviewed a number o individuals in trump's inner circle, including his lawyer rudy giuliani, who is actively pushing election conspiracie across the country, and was th face of trump's legal effort to overturn the 2020 election.

the fulton county case is on the state level, and i separate and apart from the tw federal criminal investigation now being overseen by specia counsel jack smith first up at that is th mar-a-lago documents case, i august the fbi executed search warrant of donald trump's mar-a-lago home an retrieve multiple boxes filled with classified and sensitiv documents that donald trump ha taken with him after leaving the white house. some of those document contained the highest markings of classification. special counsel smith and hi team are now investigating any improper handling and storag of those documents, as well as any possible obstruction b trump and his team smith is also heading th expansive investigation into the attempts to overturn the 2020 election results. in addition to what the do hasn't collected so far th investigation will also have access to the materials an evidence from the committee' investigation. this past week the house selec

have to have you here to b able to break down the lates and trump at all joyce, i would love to start with you they won six committee voted o criminal referrals for donal trump and a number of hi allies but, at the end of the day i will be merrick garland and hi special counsel who will decid to pursue indictments if at all. as a former prosecutor tal about how this committee's wor has assisted the doj i advancing the ball on thos indictments, especially when i comes to someone like donald trump. >> so, the house committee has played a very unusual role here it is almost always the case the doj is out in front of congress in these sorts of investigations doj has access to granbury subpoenas which ar enforceable. doj has access to a range of federal agencies, la enforcement agencies that ar skilled in conducting this work but, here for whatever reason, and it is never been quite

clear to me. for the first year that merric garland wasn't office there wa very little sign of activity i the justice department on this investigation and it was reall the house committees work earl on that shook everything liz now they have amassed an incredible body of information and evidence, includin transcripts from all of thes witnesses that will be ver helpful to doj as it moves forward. you know, katie, and you understand this from your work as well. the real issue here is what is the difference between what we can all judge with our commo sense at this point, tha donald trump was in the thic of things, and doj's need to prove that with evidence tha will stand up in court, that will be proof beyond a reasonable doubt doj will be coming through these materials from congres to see if they have additional information to what doj ha begun to compile and the las year, see if they can meet tha difference between what common sense now suggest very clearly

is true, and the need to b able to prove it so that i will hold up on appeal if ther are convictions. >> hugo, you know, we can no rate for ourselves transcripts of the committees interviews with several witnesses plenty of those witnesses pled the fifth, but the line of questioning from investigators is just as important, what insights did you take away fro the committee's questions that were posed to those witnesses? >> yes, i think that i absolutely right and if yo look at these transcripts a lo of at least the initial ones were people who were invokin the fifth that every question. but, if you look at the line o questioning from investigators especially from people on th team focused on the proud boys and the oath keepers and the extremist groups that storme the capitol you can really see where their investment interes is it is really about how thing were coordinated in the days leading up to january 6th, and

how these different groups wer intermingling. how they had connections a previous rallies and how a various points in th postelection period both the proud boys and the oath keeper seemed to have almost rehearsa events whether it was storming th georgia state capital or doing the million maga march, or whether it was having a protes at the supreme court reach before january 6th it is very clear from ho investigators approach the questioning of people like enrique tarrio, who was no actually in d.c. on january 6t but still had overall comman of the proud boys. it is very clear that they already have a lot o information and it was jus about trying to figure out where the pieces fit together. it is not clear that they were able to figure that out in the end but i think it gives the an excellent roadmap of trying to connect the probabl conspiracy that we now too place in the white house o trump trying to obstruct the certification and the physical coup element of that plan. >> you know, i know there ar

some things in the transcripts of cassidy hutchison hutchinson's interview tha particularly jumped out to you attention. what is in there that you thin the people should be focusin on especially from a crimina standpoint >> so, katie, i think this i some of the most shockin testimony that we have seen. we had some angling that thi was coming from comments tha were made during her testimony in front of the committee. but, now that way see it i it's full force it is clea that hutchinson was bein groomed to commit perjury when she testified to the committee they language her lawyer use is very careful. it is couched in terms of if you do not remember than you can say that you do no remember, but read it in context she is clearly being encouraged when she does, in fact remember to liberally refuse to recall testimony that would be contrary to trump's bes

resources in trying to fin clear links between trump an what happened on january 6th especially on the politica level that is really where the focused their bandwidth. they had projected litigatio to try and get john eastman' emails, the conservative lawye who was involved in trying t pressure pence to decertify th election results in favor of trump. i think the byproduct of tha was the other teams did not ge as much time at energy, an effort as they might have liked. i think that goes to the question of the intelligence we know that there were becaus a lot of intelligence wa coming into the fbi, the washington office in the weeks before january 6th and they were not getting past the capitol police but, the team examining th intelligence failures really did not get that much after an resources of the committee t investigate that

and that is just how the investigation went i do not think it was a willfu decision to not investigate th fbi intelligence failures. i think this was potentially a byproduct of the investigation >> final question goes to, joyce, what do you expect from donald trump, legally, in th air ahead. both on the mar-a-lago documents case and the 1 investigation by the doj >> i understand how sony peopl are impatient with the crimina justice system, which seems to move very slowly that, i think where finally at tiktok for donald trump. finally they georgia distric attorney is wrapping up he appreciating, the mar-a-lago document situation where trump took classified materials with him is extremely serious and i is the simplest kind of case t make, it is not complicate like january 6th so, i think that is also a pressing consideration for the

evidence that was uncovered by the 16 committee, do you think average americans will be able to easily understand what th committee was trying t accomplish here? i think the committee did good job in their hearings a lot of people criticize them for being produced, like a, or whatever it was relayed-able, it didn't leave you with looming questions about how did they get to this conclusion o understanding. they literally laid the fact out in the individual's ow words. there may have been a few cu scenes or hot clips or whatever, hotcakes, but they wer directing straightforward abou what happened. if people are left confuse about it, i think it is thei choice that they might want to be confused about it

the year that was in the supreme court and what t expect in the year ahead, it i senior writer for slate, mar joseph stern mark, it is a pleasure a always to have you on the show i want to start off first with your recent, very interestin article where you interviewe the chief judge of the 11t u.s. circuit court of appeals, bill pryor junior. now, he is a well-known member of the federal society in his speech at the federal society's convention last month, he not only quoted your articl about the organization, he als outright mocked you during his speech let's be clear, there were als for sitting supreme cour justices who attended that convention, including amy cohe

different from past cour opinions >> well, i don't know that the have been lying in wait so muc as awaiting their opportunit to move on some of these big issues for many years, sandra day o'connor and anthony kennedy kept the jurisprudence i check. both of them recognized that i violates the separation of church and state for these coercive, religious exercise to take place and especially i public schools where student are pressure to join in. they violate your freedom of conscience to be forced to giv your own taxpayer dollars to subsidize the exercise o religion those concerns have really flowed out the window over the last few years the supreme court very recentl forced taxpayers to begi subsidizing private religiou schools that openl discriminate against women against muslims, against lgbtq people, and also allowed schoo officials, including a footbal coach, to pray during school
