good monday morning. i'm hallie jackson in washington we're coming on the air learning more people have been killed in a massive winter storm with emergency workers only starting to get to some of the hardest hit areas now. we just got an update from officials near buffalo we will bring you live what they said we are looking at western new york buried under several feet of snow. the governor describing it all as a war zone. >> i know how hard this is but western new yorkers are tough. we know how to deal with this. we will get through this together we'll have more on that in a second new tension on the korean peninsula after north korea fires drones over soak soak for the first time in years. how the south is responding. plus, the first christmas holiday inn ukraine since the war began. the defiant message from president zelenskyy later in the show here at home with holiday shopping season over, the return the gift season is kicking into high gear. what you should know about the

new policies for the biggest stores and what it could all say about the economy in the new year we start with the deadly winter storm and hard-hit erie county they just announced 12 more people have been killed because of this storm. that means 25 people in all in just this county alone are dead after 60 deaths nationwide when you pull back, when you look at not just the weather situation but the travel situation, hundreds of flights have been canceled today, meaning more headaches for travelers this morning yet again. jesse kirsch is live from new york jesse, let me start with you and the latest from buffalo. it sounds like they are saying, hey, people still need to be off the roads. it is incredible hard for emergency workers to get to where they need to get yeah hallie, there have been instances as well where we have heard of emergency workers themselves getting stuck and needing help getting their vehicles out of the snow that is the dire situation we're

looking at in buffalo. remember, this is a community that is used to bad weather in the winter and they are still talking about this storm as the most devastating in the history of that city. that is from new york's governor who is of course familiar with that part of the state of new york in the western part of the state. we are learning that the death toll continues to climb. just this morning alone, buffalo is reporting an additional 12 deaths at this point we are looking at least 50 people across the country who have been reportedly killed as a result of the winter weather we have experienced for days buffalo appears to have suffered the worst brunt of this or one of the worst over the weekend. we are talking about close to four feet of snow reported the governor says there were wind gusts approaching 80 miles per hour, just below 80 miles per hour also the governor says state police have been involved with at least 500, more than 500 rescues. state police even helping to

deliver a baby that is the kind of situation we're hearing about. although there are many instances of sadness, the mayor of buffalo telling me around christmas when people should be celebrating, people are making funeral arrangements there is some silver lining and hope as well there is a story of a couple who wound up having a group of tourists from korea who were driving to niagara falls, got stuck on the side of the road outside their home knocked on the doors asking for shovels. they said you can't be out there. they housed nine people and their driver for two nights. they made the most of the holiday. they had dinner together they kept everyone warm and safe and i talked with one of those tourists this morning who was on his honeymoon. he said plans did not go as expected but this wound up being a great trip it looks like the two groups have essentially become new extended family out of this.

there are signs of hope coming out of this. people teaming up and working together that couple, who might have possibly saved these people's lives, said the real heroes are the rescue workers going around the clock helping people stranded out there officials still warning people to stay off the roads. even if the snowfall is tapering off, it is still a long road ahead in buffalo >> jesse, thank you. now to chad brewster live with what has been a travel nightmare for a lot of people trying to get around this week back home after the holidays >> that's right, hallie. those travel delays are continuing today i said if you are going to an airport today and have any holiday cheer left in you, hold on tight to it it is looking tough at these airports we got new numbers in the past couple of minutes. more than 1,600 flight cancellations. more than 2,200 flight delays at

airports across the country. we have been seeing reports of lines not only inside the airport but lines of cars. folks are going to those terminals after a nightmare issue holiday weekend where we saw 6,000 flights canceled between christmas eve and christmas day. as i have been talking with folks here, more people are in a positive mood and spirit than would have been expected not to say they're not dealing with trouble they know what to expect they know they should be coming here early listen to what some of the folks in chicago have been dealing with >> it looks like a zoo a complete and utter zoo, chaos. it's crazy >> i haven't been to the airport in a while, but i have never seen it this crowded >> we got canceled, had to scramble and ended up on a charter. the only way to get here >> it was a might mayor. >> nightmare >> planes, trains and automobiles. >> on christmas day.

ended up in the dark after an attack on electric sub stations christmas day. suspects forced their way into three separate sub stations sunday nothing was taken, even though the places were vandalized it is not clear if this is a coordinated attack nobody else is in custody. only a few weeks ago in north carolina that somebody shot at two sub stations there, triggering a three-day blackout. breaking news from overseas. a new provocation by north korea this morning five north korean drones crossing into south korean airspace for the first time since 2017 they scrambled fighter jets, firing warning shots live from london, raf afternoon. this is yet another escalation in a relationship that's already been on the tense side of things lately bring us up to speed >> yeah, hallie, that's right. not only tense, but this is a new level of provocation from the north koreans.

almost every day the last couple of weeks we have come on the air and said kim jong-un's regime has been firing missile, shooting out into the sea. this is different. this is flying them into south korea itself this is something we have not seen them do since 2017. here's what we know. they appear to have flown five small drones, about two meters long four flew along the west coast one of them flew to the edge of seoul, the capital it caused a lot of alarm two civilian airports were ordered to halt takeoffs for about an hour or so. that's a scary moment. if you were at one of the airp airports, you were waiting to take off and told you can't because there are drones in the air. they tried to intercept the drones helicopters fired, we're told,

around 100 rounds at the north korean drones. it doesn't matter they were able to bring any down. it's not totally clear what happened to the other four in the process of this military response, one south korean light fighter aircraft crashed coming off the runway it doesn't appear it has anything to do with the north koreans. it looks like it was an accident the two pilots were able to eject. they were taken to hospital. and the south korea answer announced publicly they were carrying out a corresponding reconnaissance mission of their own. they flew their own reconnaissance jets to the north korean border. not totally clear if they flew into north korean airspace or not. but it is pretty unusual for the south to say we are carrying out these kinds of missions. they normally keep them totally classified buff i think this was a message to the north that if you come into our territory, we will head

affecting consumer behavior to an extent. for now, the economy is still holding up next year is a separate question where we run the risk of going into recession it looks like -- by the way, this is one of the top five holiday shopping days of the year it doesn't look like there is any big disaster as far as the holidays go. coming into 2023, things will likely slow down a bit >> we have been alluding to this here change is to the way that you can return some, some of the biggest stores here. what do people need to know? >> now they are going for in-store exchanges so you get a merchant credit. that happens in a lot of stores as opposed to cash back or refund on your credit cards. refund policies are more stringent. retailers are getting more disciplined about that you have to go back to the store and buy something else or just

replace it at equal value. that is something that holds up retail sales and the revenues retailers are having many are struggling. some of this is because of their own issues as opposed to economic issues. we're still generally speaking overstored in the united states. so there's some retailers that may have a difficult holiday season irrespective of what th ron, that you are looking for that will give us a sense of a snapshot of the economy and where it's headed. >> when we come back to work tomorrow, not a lot of heavy duty economic numbers. it's the first week of january that will get the unemployment report for the month of december that is closely watched. we won't hear from the federal reserve until the end of january. it is expected to raise a quarter and a half point that will tell us a lot about what the arc is going to do with respect to inflation the good tphurbgs every measure

light blanket. you have hundreds still facing freezing temperatures outside. for now homeland security is still enforcing title 42 we talk about that a lot -- to send migrants back the administration wants two business days to decide if it ends the temporary because on title 42 josh letterman joins us. a pretty angry response from the white house today after what we saw on christmas eve >> reporter: that's right, hallie the white house has been critical of governor abbott for sending migrants to washington, d.c., new york and elsewhere but over the weekend really coming out swinging against his decision, according to the white house, to abandon these people in the middle of the cold on the side of the road as temperatures plunged to about 10 degrees here in washington on saturday night. with the white house saying that this was a cruel, dangerous stunt, a political game by

governor abbott saying that the texas authorities did not coordinate at all with the federal government, with folks here on the ground in washington who could be prepared to accept those migrants the white house also saying his actions here really put the lives on the migrants in danger. governor abbott has not publicly confirmed whether he had sent specific buses to the outside of the naval observatory, the vice president's residence. but we do know all three buses did come from texas. this is certainly consistent with what we have seen from governor abbott over the past several months >> talk to us about title 42 the timeline is a question mark. what is sort of the -- you're talking with sources there what is their action plan for when that happens? >> this is hanging over the administration right now they know title 42 is probably going to go away sooner than

later. they are likely to have a surge. homeland security department says they have plans in place that includes surging resources to the border, including about another $3 billion they have requested from the white house to help with that. it will include not only more agents but building new facilities to house some of the migrants, as well as new capabilities to deport them back to their countries of origin once title 42 is no longer in place. homeland security department is not claiming this is some panacea. they say this is a broken system they inherited and these are band-aids they will try to slap onto a problem as they implore congress to actually deal with this crisis by passing immigration reform >> josh letterman live on the north lawn josh, thank you. we'll check back in with you later on today appreciate it. the justice department investigation on the attack on the building behind me has a

bunch of new material from the january 6th committee. you know the evidence has been assembled into a report. transcripts have come out as well jonathan allen and msnbc danny savales. the biggest theme is accountability we knew there was a ticking clock considering republicans take the house a week from tomorrow basically talk us through what the landscape looks like >> basically the january 6th committee is over. it has made its recommendation to the justice department. we have seen them prosecuting and winning convictions against people who participated january 6th. the question going forward is how seriously the new congress

is going to take what the january 6th committee did in terms of its recommendations and how the justice department will look on any evidence it receives from the committee that it didn't have on its own >> it seems for all the investigations that the house republicans are set to pursue, once they do take control of key committees come the new year it is not likely they will investigate the january 6th committee, right that's something that some top republicans have said is not so much on the table. yeah they have been talking about investigating the investigators for a long time, but it doesn't look like that is actually going to happen. what you will see is the january 6th committee sunset you will see its work disappear from the lips of house republicans until they try to compare other things and make a comparison of the two. homeland security, for example and you will see an investigation into president biden himself and his son hunter

biden. >> john says it will disappear from the lips of republicans it will not disa prior from the minds of those at the department of defense what do you think the justice department is looking most closely at probably the transcripts they have wanted their hands on. now they have their hands on them >> yes i take the position that it is thank you very much for all these documents but we have plenty of documents of our own we have our own ways to get these documents and, quite frankly, they are much better than what january 6th committee has in terms of manpower they have cooperating witnesses. doj can go to somebody and say you can either be charged with a crime and go to prison for a long time or the other option is you come to us and we'll give you the lightest sentence, the lightest punishment we possibly can.

that's not really something that the january 6th committee can do yet as a criminal defense attorney i can tell you that doj loves that system. it's a powerful way to induce people to come in and testify. compare to cassidy hutchinson who reportedly had a change of conscience she said i have given testimony a couple of times but i personally don't feel i did a good enough job. witnesses like that are very rare doj knows that bottom line, doj is certainly looking at all this evidence because there's just so much they are making their own inquiries and they will make the decision completely by themselves look for that to be a major theme. doj makes clear they are an independent agency they make their own decisions. >> so lay out a bit of a road map on what the first few months of 2023 look like for the doj. what is your expectation for work behind the scenes and what we may see, say, in the first

four months of the year. >> doj has handed this off to special counsel jack smith they will accept this evidence they will be reviewing it. this 800 pages of just report to get through, let alone the transcripts, the witnesses, and maybe the other directions that this investigation could take. even things that are not yet known. things doj may know that nobody else knows or the completely unknown that they may unearth during their investigation doj has a duty to conduct a more expansive, more detailed investigation before they make the decision to charge anybody with a crime because, look, january 6th commission did a good job of making a prima facia case. they have probable cause it would appear they need a lot more than that they need to prove beyond a reasonable doubt and january 6th commute used to have evidence like hearsay and things that may not be admissable in court.

they are a higher burden if they want to bring criminal charges. they know it they know they need to investigate any case and make it airtight it may be against one of the most elusive criminal defendants in the history of criminal defendants >> john, let me go to you on the congressional piece of this. danny has given us a 6 forward looking sense of it. the january 6th committee made a series of recommendations they think congress should do the electoral count act passed when the spending bill passed. it was the bare minimum congress needed to do what of the other recommendations might realistically make it through a republican-controlled house and a tight senate what's your sentence. >> it suggests to me you may know the answer to that question >> leading you on. that's fair. >> it is unlikely the republican house will take up a bipartisan committee that included two

republicans seen as turn coates by a lot of their colleagues what you see from this committee is frustration that the congressional be committee didn't have the power to do more they are asking for more power to enforce subpoenas they are asking, you know, to be able to prevent people who are involved in the insurrection from holding future office, whether i guess that's former president trump or anybody else. and things like that where they basically want to see investigations to power, and people involved in insurrection, insurrection-adjacent activities to be punished more severely both from the barring of future office, and through criminal penalties. again, i don't see anybody who is speaker of the house as a republican taking up any of these recommendations directly one thing you could see is perhaps more oversight of the capitol police that is something there could be more agreement on. i don't think you are likely to see the report being cited as
