plus, thousands of travelers stranded this afternoon with southwest airlines at the center of a hot mess. 70% of their scheduled flights canceled we've got the nightmare situation for folks trying to get home after the holidays and what the biden administration is saying about it in just the last couple of hours. we'll also take you live to one of the hardest hit areas in the destructive holiday winter storm where they are just starting to dig out even with driving bans still in effect in some spots. and donald trump's tax returns could be made public at some point. i'm hallie jackson in washington, d.c. with you on this tuesday afternoon and we're starting with the uncertainty over what could happen with title 42 as we await a decision from the supreme court we know the biden administration wants this to be lifted, but they don't want the rug pulled out from them overnight. josh is live at the white house with this story. the issue with this, right, is that many people think it's not

a question of if but when there is a surge at the border if in fact the justices do decide to end title 42 we don't know when we're going to hear from the supreme court we think it's soon, but i'm sure everybody in the building behind you the bracing for the possibility at this point. >> it occurred to me as we keep talking about this surge, we already have a surge we're seeing record numbers. the numbers in november, higher than ever from a previous november and officials anticipating the numbers for december will be even higher the surge is here, but the question is how much more will that be if and then title 42 is lifted you are right. officials here at the white house are watching anxiously for if and when that happens they say they are prepared to surge federal resources to the border through the department of homeland security. white house officials also say the state department has been in

touch directly with the countries whose citizens are the ones largely populated the groups of migrants who are coming over, but the fact of the matter is officials say they're not sure there's any amount of additional resources that you can send that would simply solve this issue and that's why the administration is also looking at changes they might be able to make to their immigration and asylum policy unilaterally meaning without going through congress, which has been so illusive and some of those changes could include restricting the number and types of migrants who could enter and speek asiep lum by a transit ban. meaning if you came through a third country such as mexico before getting to the united states and did not apply for asylum in that third country and then had that claim rejected, you would not be eligible to apply in the united states so that's one example of the

kind of ideas the administration is looking at to try to get a handle on this situation if that surge increases even more after title 42 is lifted, but that is raising some real questions comparisons frankly with the trump administration which pursued a similar approach and really critiques from immigration advocacy groups who say it's not a humane approach giv given the dire need of these migrants >> josh, thank you to the point josh is making about migrants being at the border already, we're seeing that at the southern border with the numbers overwhelming some towns there. like el paso, where they're sleeping on the streets from bitterly cold weather. sam brock has the latest from texas. >> reporter: on the streets of el paso, temperatures were in the 30s again overnight as so many people just trying to stay warm the issue right now, capacity at shelters i'm standing next to a church

here the church has a kcapacity of about a couple of hundred in the basement it's full. you're finding people in the crevice in sleeping bags if they're lucky and blankets from local charity groups and good samaritans who are handing out clothes and food and other forms of aid behind me, you see the folks huddled here this was all bodies in blankets this morning all crammed together there's a bus next to them where they can go for brief respites of warmth, but otherwise, they're dealing with these frigid conditions. people waited months to get to this day because they were promised, they believed from the administration here, title 42 was going to be lifted on december 21st. that's when a federal judge said it would be pulled away then the supreme court issued that stay so now they are all in limbo many are coming with their families i spoke with a woman who had five kids wrapped under a blanket. all under the age of 8

you could barely see them until their heads poked out. they have friends in dallas to go to try to get gainful employment it is representative of the situation we're seeing as the supreme court is going to either take up the case for title 42 and debate its merits and it would stay in place in the interim or pass and pave the way for this to no longer be the case what will happen when it's lifted, experts say you're going to see a surge of people coming across the border in the first few months what happens beyond that point is in question >> thanks to sam for that. let me bring in tyler for many tell me what you're hearing from sources in the biden administration about this as it moves forward. >> josh just laid out earlier, the biden administration has been preparing for months for this moment and it's less of a question of if than when so the administration has been putting in plans, the pres

secretary has been getting questions about what the white house, the department of homeland security and other officials throughout the government have been doing to prepare because they know at a certain point, this order will be lifted and they'll have to reckon with what experts say will be a massive influx of migrants at the border but it's a cause of anxiety for people because this issue of border crossings has challenged both democratic and republican administrations and there's no easy fix, no easy solution and they know in those first few months, it's going to be a constant story and challenge for people at the border american citizens living in those border towns, and they're trying to do all they can to serve resources there, but as josh said earlier, that's not going to be enough so really, i think they're trying to figure out how they can best manage this problem in the immediate term but also pushing congress to act. i think that's going to be ooeeven more of a challenge as republicans take control of the

house in january but they want to see congress find a long-term solution. >> like sure, they would want congress to do something, but house republicans will take control of that chamber a week from today and they have made clear their focus is going to be on the border and impeaching secretary mayorcas what's the expectation on that >> i think a lot of the attention from house republicans is going to be on these investigations along with hunter biden, the president's son. covid, china, a whole range of issues republicans are eager to launch oversight investigations into so there's not a lot of hope within democratic circles about real policy conversations and ultimately policy solutions to the ongoing problems there's a lot of attention from border states about trying to the administration over their policies, blaming biden for this influx, but as we've discussed, looked at the numbers, this has been a problem that's persisted

we are watching this chaotic situation because nearly 5,000 flights have been canceled today alone. that's on top of the thousands called off over the weekend. why so many disruptions? mostly because of southwest airlines, which is only flying about a third of its schedule for the next few days. that is getting even transportation federal government's attention with the department calling it unacceptable as blaine alexander well knows as she's at hartsfield jackson, this has gotten even the ta

attention of the president, the messy situation with southwest a >> reporter: i think messy is an appropriate word with southwest and i think the many people i've spoken to throughout the day would agree. yeah, we just heard from the president within the past hour he tweeted about this. knowing that thousands of flights have been canceled around the holidays then said our administration is working to ensure airlines are held accountable. he then pointed to the statement from the d.o.t. that said they're going to be looking into whether or in the this unprecedented amount of cancellations was in the control of southwest airlines. that's notable because it tells what, if any, additional compensation these many, many stranded travelers could be entitled to. southwest was one of many major airlines that said if flight

were canceled for situations within their control, they would reimburse passengers for meals, taxi really what the d.o.t. finds could give insight into what these folks will get in the days ahead. you see this big line behind me at the southwest counter it's looked like this all day. we've been here since before 7:00 this morning. a constant line. what you don't see is how slowly it's moving. some people said they've waited for an hour and a half just to move a little bit ahead. every person who goes up to the counter has a specific issue, very detailed issue. most of them are frustrated. we're talking about a long line and long conversations happening. here's one person who told me they had to take a bus from new york down to atlanta trying to get to las vegas if you can believe that. here's what they told me about what they found when they tried to call the customer service line take a look. >> i spent about nine and a half hours trying to get through to southwest, just on hold with them

probably about 17 calls and every time i get about two and a half hours, it just dropped. the line just dropped. >> get a busy signal >> i've gotten through three times then the line suddenly, while they're on hold, thank you for waiting, then it just drops. >> so there you saw them a husband, wife, they were trying to get from new york to vegas. their best option because they couldn't get a flight until sometime around the 30th, they said we'll hop this random bus down to atlanta and try our luck there. see if we can get a flight the kicker is that they have a 2-year-old son at home they're still trying to get back and celebrate christmas with so this airport -- >> oh, man >> just dotted with different stories like that one. frustrated passengers, certainly. >> yeah, and they're just stuck waiting for days longer. thank you very much. part of the reason why we saw so many cancellations over the last few days have been that

huge winter storm over the holiday weekend. it was dangerous and it was deadly we now know at least 63 people have been killed 33 in just one county. erie president biden authorizing emergency federal help that means more resources and money can go to these folks who desperately need it. right now for 5,000 people there, they're still in the dark officials are concerned they could find more people dead considering the snow, which is still falling, still making it hard to get through some roads marisa has been reporting. you have been driving through and up into the buffalo area you are in the vicinity now. you're obviously able to make your way around certain locations. tell us what you're seeing and hearing. >> yeah, add us to the list of people who are having issues getting to where we need to be through the air so we had to take to the roads. so we've been driving from cleveland. we're finally here in the

buffalo area i'm going to flip the camera so you can see what i'm seeing as we are seeing it so we saw dramatic change. in the cleveland area through ohio and pennsylvania, it was just a light dusting on the roads, but as you can see, this is anything but a light dusting where we are at the moment which again is the greatest buffalo area we're not in buffalo proper at the moment, but we know just how deadly this storm has been i was just here a month ago and it did not look like this. what we know is that it hit the area so much harder at the time when we were here, people were not fazed by it. buffalo is an area that knows snow, but just in buffalo city alone, at least 28 people have died the majority were found outside, but in some instances, some died inside their cars. one from carbon monoxide poisoning. another from lack of heat. so many people are still left in

the dark we talked about how unfortunately city officials are afraid that number will climb. but you talked about the federal emergency declaration that president biden did approve. there are so many resources including here on the roads. as soon as i see one, i'll point it out, but they have over 300 pie pieces of equipment on the roads to try to clear them one of the issues that they're running into all those abandoned cars from people who had to leave their cars on the roads. emergency vehicles and snowplows have had an issue. so now they're having to find tow trucks to get those cars out of the way so these roads can get cleared. fortunately, we are able to drive as slowly as we can through these roads and one more piece of good news for you there is expected to be a warm-up somewhere upwards of the 40s and 50s so we are expecting to see some snow melt, but ahead of the weekend, there will be flooding concerns as they expect to see rain as well.

story over the next several days we are looking at an atmospheric river that's quite literally a river of moisture moving onshore from the pacific we're looking at heavy, heavy rain from washington to southern california you add on to that, really high, heavy, mountain snow combining that also with some winds dwusing up to 70 miles per hour so think of the people who are traveling. really tough traveling conditions the holiday hump impact, there's still a lot of major issues, but weather, we're looking good from boston, d.c., and atlanta. minneapolis, chicago, dallas, houston, it's really the west and along the coast we're looking at major problems. looking at the potential from seattle to san francisco, los angeles, also moderate delays las vegas, salt lake city, phoenix. that continues into tomorrow,

legislative statements sometime very soon by releasing former president trump's tax returns. it's a week after the house ways and means committee voted to release these documents following this prolonged legal fight that went up to the supreme court. got some top lines from the committee including that mr. trump apparently paid littile t no taxes and that the irs did not audit the former president the first two years in office even though there's a federal law requiring them to do so. let' bring in ryan nobles as well as former federal prosecutor and msnbc legal analyst, carol one week since the committee voted to release the returns it's been interesting because they have been shrouded in sec resy community members have been cagey and careful to talk about what they don't know when are we going to know more explain why this is so significant here >> committee members told us last week we should expect to see the full run of returns sometime this week but didn't

specify the specific date or time and they've been very careful about the handling of these documents and it stands to reason they're going to be just as careful with their release. they're likely going to redact personal information that could lead to identity theft or security issues so that could be part of the process of scrubbing this information when they do release them, it's going to be a lot of information. it's going to be dense all the different financial information that the former president and his businesses were required to submit to the irs. so it's going to take some time to kind of read through them and figure out what is the most significant aspects of this. it's likely that most of what we learned last week in the report that was filed by the joint committee on taxation are the big headlines. the lack of the use of the mandatory presidential auditing system the huge business losses that the former president claimed to have taken on and the lack of federal income tax paid on those three years. those seem to be the biggest revelations from these tax returns which honestly, are not

that big of a surprise >> yeah, you know, part of the context is that for years, ever since he ran for president back in 2015, he insisted he wouldn't release those despite the sort of modern historical precedent for him to do so he has insisted voters don't care that he's been under audit we know the truth in that instance part of this, right, is that it is a long time coming to be able to see some of these tax returns and the reason why it matters is the potential for conflict of interest given he still has a stake in his business. the trump organization, and is a current presidential candidate for 2024 >> yeah. and that's exactly right and you know, exactly where his financial investments, where they lie, who are they are connected to those are all important. in fact, a member of the committee talked about some of the things thaer interested in seeing and we heard from her today. >> we got a summary of the hred

flags in trump taxes that should have been followed up on such as claiming mammoth business losses, possibly claiming as business deductions things that should have been just personal expenses loans to his kids that really should have been possibly gifts. >> and what's interesting about a tax return is it's really kind of only the tip of the iceberg in a financial picture doesn't get down into the nitty-gritty of where money is coming and going, but it opens the door to these questions and that's part of why the committee arguing they needed access to this information to reform laws as it relates to the taxation and examination of taxes by presidents and make it policy. make it legal under statute that every time a president takes office that their tax returns are audited every year >> ryan nobles, thank you very

much it's good to see you carol, let me turn to you because i love your take on what you think we should be expecting here in other words, is the anticipation in line with the expectation as far as what we're actually going to see? >> you know, a couple of things really did surprise me i thought i was beyond surprised here one is the committee's report that did come out. really made it very clear that the irs simply ignored their own policies the whole idea of the annual presidential audit, the auditing of the president's tax returns every year was exactly to take away the discretion of the president's own appointees dec deciding whether the president should be audited or not the whole idea was the audit was going to be automatic and shockingly, this really does shock me in i think four out of five years, the irs simply didn't

even designate the president's tax returns for auditing and that is a violation of its own policies and so now the house ways and means committee is suggesting legislation to actually make that a law that the president's tax returns have to be audited every year and it's not just irs policy >> what's the one big thing you're looking ahead to, carol, when these returns get released in full? sometime in the next few days we anticipate >> this is what the irs in many years has not looked at is these massive deductions and expenses for deductions that apparently trump and his organizations took in order to, in order to off set income so in other words, expenses and various real estate deductions, which seem to have been very, very inflated. those are the deductions that have to be looked at in order to do that, you have to go to third parties and say how

much money was really spent here how much did the trump organization really spend? there is some investigative leg work that has to be done, but that's what audits are about and it is true that prosecutors probably had a lot of the tax returns already, but building a criminal case against trump himself is very different from doing a civil audit, which is what the irs should be doing now. what this really reflects is that every mechanism that has been put in place in order to hold the president accountable for filing his taxes like any other american citizen or american resident, really broke down there was just no accountability whatsoever >> carol, thank you very much. good to see you. as we approach a full year of war in ukraine come up in february, the holiday season has brought ukrainians new ways to act in solidarity against russia, but it's also bringing new warnings about what could come next with some ukrainians bracing for the potential of escalated attacks by russia over

new year's eve i want to bring in now live from kyiv, matt bradley talk through the expectations over the next say five, six days or so. and what you're seeing on the ground >> reporter: we heard from president zelenskyy that there could be attacks anytime now between now and new year's but the fact is there were a lot of opportunities, a lot of occasions when putin and his army could have attacked ukraine in these sweeping bombardments that have really cut out a lot of power in the kyiv region. now a lot of the lights are back on, but there are still rolling blackouts. this is still a crisis i got to tell you, the battle lines have been frozen for the last several weeks and they are going to be literally freezing in the next couple of months that's because you know, winter is descending and that's dpgoin to make it easier for troop movements to happen. basically once the ground freezes then russia or actually ukraine, might find it easier to

launch an offensive because they can roll their heavy artillery, their tanks, they're mobilized heavy weapons, some of which on the ukrainian side are provided by the u.s., and launch more offensives right now, the heart of the fighting is in the eastern part of the country and the russians have been making some advances very, very small, modest advances over the past couple of weeks. but north of that is a city where we're starting to see some ukrainian advances and actually the russian command there has withdrawn and it looks as though ukrainians might be within striking distance of taking that city if or once they do, they'll be in a good position to really erode a lot of that front line right around the frontier of the donbas region and that could be a game changer, but you know, coming up, it looks as though this is a really cold conflict the battles are fierce

to a new twist now in the catch me if you can saga over a soon to be member of congress. with republican george santos acknowledging today to the "new york post" and others that he didn't tell the truth about himself on the campaign trail. like that degree from baruch college. he didn't do there didn't graduate from anywhere. what about working at goldman sachs and citigroup? didn't work there. what about the claims of being jewish he's catholic. santos telling the post he's embarrassed he never graduated from college and that it was a poor choice of words to say he worked at those wall street firms and that it was obvious he's clearly catholic and never claimed to be jewish only jew-ish

this individual's background not really scratching past the surface. in fact, it's not until after an election that a lot of this comes out. it's a really fascinating scenario i think for people on the hill because he's supposed to be seated and the margins are pretty thin in the house of representatives and they need that vote and that seat in order to for republicans to get their sort of legislation enacted. so i think they're in a bit of a pickle for how they handle this because they want to hold on to that seat. him individually doesn't necessarily matter but they need that vote. they need that seat to keep things moving in their direction. >> and no sense, really at this point, no sense that house republicans are going to do anything but welcome him into the caucus next week >> we haven't seen a statement come out of the nashua republican party, but no signs thus far that there's going to be any try to not seat him

going on in jackson, mississippi because a lot of folks still don't have safe water to drink you know jackson has been struggling with water problems they're now working to get water pressure back so they can get water to people's homes after pipes burst because it was so cold during the winter storm over the holidays. blaine alexander has more. >> reporter: down south where temperatures rarely dip this low, the bitter cold is taking a toll on the water system in city after city, pipes snapping, leaking, and leaving thousands without running water. at south carolina's largest fod bank, a burst pipe threatened the food supply for thousands. water forced atlanta's busy airport to temporarily close a gate the issues span from memphis to selma, to jackson, mississippi, a city long plagued by water problems there, officials issued a boil water alert on christmas day were you able to cook christmas dinner >> no. it was very disappointing. >> she's already been without water five times this year that means spending her days

even though people have been spending less money, this holiday season seemed to be the exception. a spike in retail sales. 7.5% increase in spending more than the last holiday season still less than the 8.6% spike retailers saw in 2021. so even though stores worried shoppers would spend less because of inflation, there are signs in some areas that spending is up brian chung is with us tell us where spending is up and how retailers seem to be feeling this week. >> if you are a regular retailer, you're probably feeling about how people are spending, but -- >> is that a technical term? >> 7.6%, that's fine but if 7.1% is the increase, that's essentially a wash, but there are some bright spots. when you take a look at
