when da mar hamlin collapsed on the field. we'll have an update on his condition this morning. and happening right now, house republicans are holding a meeting ahead of a nail biter vote for kevin mccarthy's bid for speakership. steve kornacki will break down how historic it would be if he doesn't clear a first round. and in just a few hours, the suspect accused in the murder of four idaho students will peer in a courtroom. we'll have a live report from outside the courthouse. and in brazil, crowds are gathered to bid farewell to the late soccer legend pele. the only player to ever win three world cups. we begin with the latest on the condition of damar hamlin. the 24-year-old collapsed on the field last night after making a hit in the first quarter of the highly anticipated game against

the cincinnati bengals. the bills say he suffered cardiac arrest and said, his heartbeat was restored on the field and he was transferred to the uc medical center for further test asking treatment. monday night's game was postponed with no decision yet on when or if the game will be restarted. joining us now is mora barrett. what can can you tell us about his condition this morning? >> good morning. just an absolutely tragic situation as damar hamlin remains at uc health this morning. the bills saying he's in critical condition and has been sedated. in the last hour, a family spokesperson and friend appeared on abc and while he said he can't speak to hamlin's specific medical condition, he did say he's fighting and that the family is in good spirits. he said they are taking it minute by minute, hour by hour. this comes after this rye hiely anticipated game where the incident happened. the teams matching up, two of

the best in the afc right now. so players watching across the country and this had the stadium absolutely stunned to silence when they saw hamlin take that hit and then quickly pop back up ready to play again. but then he very quickly fell to the ground going limp. we learned from the nfl that local and team medical professionals administered cpr for nearly ten minutes restoring his beat on the field before he was driven off in an ambulance and transferred to uc health. there was a lot of speculation as tans were watching. obviously concerned for the player's health. he's just 24 years old, but also confusion over whether the game was going to get started again. fans and then spectators concerned about the fact that maybe they were going to be expected to play again after playering were watching stunned to tears. they formed a human wall around hamlin as he was receiving medical attention to get that privacy. so there's a lot of criticism

around the nfl right now. the organization under a microscope after tua suffered the concussions and was transferred to the same hospital in cincinnati earlier this season. the nfl saying that there wasn't any talk of them getting back on the field. there's a lot of of back and forth in terms of those questions before they postponed the game. there's no plan as of yet to continue the game. players, fans, family members, very concerned about how the nfl could be responding to this in coming days as we watch for anymore more updates. but a stark reminder of the danger and health conditions and the players face every time they get on the field. >> certainly a sobering reminder. thank you very much. we'll have more on damar hamlin later on this hour. right noul, we want to turn to dramatic and torque day on capitol hill republicans in

charge of the house. but who will be the next speaker is still unclear. republican leader kevin mccarthy is holding a closed-door meeting making a last-ditch effort to get the votes. it would be the first time in 100 years speaker election will go beyond the first ballot. with us to talk about this on the phone is jake herman, founder of punch bowl news. and former congressman carlos corbello, and both of you welcome in. thank you for being here. jake is on the phone because it's a wild day on capitol hill. taiks through what will happen today. >> thank you for having me. we are outside of the house republican conference where kevin mccarthy is making his pitch to become speaker after 16 years after he was first sworn into the house of representatives. he is listing all the concessions he's made.

members are opposing him on the grounds he's not a strong enough conservative. it's not at all clear when there will be a speaker chosen or if it will be mccarthy. this is a volatile situation, but important to keep in mind, this is a gripe that the right has had for a long time. this is not new and this is an extremely small minority of the republican conference. less than 10%, closer to 5%. mccarthy needs the votes to win the speakership. >> there's a new sign that his efforts may not be working. house freedom caucus chair of pennsylvania put out a statement this morning saying that mccarthy rejected the group's demands and that kevin mccarthy had an opportunity to be speaker of the house. he rejected it. that statement doesn't sound good. is there any path right now that mccarthy can get the vote he is

needs to be speaker despite some of the negative reaction we have heard as of late? >> there is a path. it's a narrow path. it's a very long and treacherous path, with us there's a path. i tonight know what it would look like. mccarthy plans to stay on the floor voting over and over again for speaker until he gets the 218 votes he needs. and this could come a lot of different ways. people could vote present, which lowers the number of people he needs. there's a lot of tricks that can be pulled. at this point, it's not clear who will be speaker. >> just this morning, we also heard from republican congressman dan crenshaw. let's listen this on that. >> you have these members, you just showed who they are. to one knows their goal. they say their goal is some noble cause for the cause of conservatism, for the people, for holding the swamp of accountable, these are the phrases they will use to make themselves seem like they are some white knights to save you.

none of this is true. some of the reasons they are not voting for mccarthy are unbelievably petty. this is about showmanship and notoriety. it has nothing to do with the conservative agenda. >> is all this in fighting an indication of the health of the gop right now? and the fact that republican congressmen seem to be levying their votes and possibly take them away if they don't get what they want, rather than support his bid for the sake of keeping the gop unifying and not airing their dirty laundry to democrats who could capitalize on it ahead of 2024? >> this dynamic is nothing new in the house republican conference. probably for about ten years now, a small minority of house republicans have dedicated themselves to undermining their leaders, trying to impose their will, despite not having the votes. they don't even have half of the votes within the house republican conference. but with 10%, with 15% of the

votes, this is a very small minority. they want to impose their will. in doing so, they undermine their leaders, they embarrass their colleagues and they make the house republican conference look like a disorganized group that is incapable of governing. what kevin mccarthy is dealing with today is exactly what john boehner dealt with for five years when he was speaker and what paul ryan dealt with when he was speaker for three and a half years. this is nothing new. except this time it's very dramatic because they might actually block their leader from taking the speaker's gavel, something we haven't seen in at least 100 years. >> jake, if kevin mccarthy can't get the votes he needs to be speaker, what's the alternative? is there a name that pops up for you? >> it will be open season. there are a lot of moderates who

will vote against scalise. it is really in unchartered water. with to real idea about how this will dissolve. >> stick with us for a moment here. the speakership battle the is not the only big story on capitol hill today. congressman elect george santos will take office, despite being under investigation by federal, state, and local prosecutors and admitting he lied about parts of his background. last week he said he embellished his resume. this as prosecutors say they are reviving a fraud case against him. police could not locate him. he recently denied any criminal activity in brazil in an interview with "the new york post." nbc news repeatedly tried to reach out to san toes. we have not received the response. i want to bring in antonia

hilton. you have been speaking with constituent there is. what are they telling you? >> reporter: the mood here as people have been commuting has been a mix of outrage and also disappointment and exhaustion. they don't expect any politicians to tell the truth all the time. they have been shocked at the nature and fabricating much of his educational history and lying about the nature of his mother's death claiming she passed away during the terrorist attacks in nempb. the kind of lies that has nothing to do with his work in office and seem to be entirely unnecessary to the voters here. thr both shocked and disturbed and feel it's a symptom of a larger disease of politics. >> the bar seems to be set so low over the last few years.

it seems like lying is almost acceptable these days. and it's really a sad thing for our society that everyone knows how much had he lied and yet hooesz probably going to be sworn in. >> i would have preferred someone else, but considering quite a few of the politicians are liars themselves, so be it. >> reporter: is once he's in, the only people who can do anything about it is are going to be the lawmakers in the house. and the voters here who i talked to don't seem to have a ton of confidence that mccarthy or others are going to take action against santos. they say in just a few years when they get a chance to go back to the polls, they will. >> thank you so much for speaking with voters, because it is interesting to see how they

feel, even though they seem to be powerless in the situation. carlos, let's bring you back in. now that santos is set is to take office, what do republicans need to do next? >> they are going to use mr. santos' vote whoever gets elected speaker from the republican party is going to need every single vote. so they will use his vote for that purpose. they will also use his vote to pass a rules package for the house, which isly the first vote that members take. but mr. santos being in congress, being a member of the house republican conference is not viable long-term. i think within a matter of months, he will either be expelled from the house or he will be pressured to resign. this is a major distraction for house republicans. it's extremely embarrassing. the problem they have now is that they have very votes to spare. they cannot expel santos immediately. they will let him serve for some time and then try to get rid of

him. >> between all the possibilities that carlos just mentioned and the investigations that santos is now facing, what do you believe is the most likely outcome here? >> i agree with him. i do think it's going to be a really high bar to expel. you need two-thirds of the house to do that. who knows what's going to happen with the department of justice. but i could see the leadership wanting to push him out. but that could go to a democrat if he gets pushed out. so it's a very dangerous thing to take somebody out of congress. >> it's a risky move for them. they might continue to need his vote or his seat as a capitol arm beyond this initial vote. thank you all for starting us off. we appreciate the discussion. later this hour, we'll dive deeper into math behind the house speaker vote with the one and only steve kornacki. plus we are just starting to

this afternoon the suspect in the murders of four university of idaho students is expected to appear in a courtroom. the tore neurosurgeon bryan kohberger says hen won't fight extradition. kohberger was taken into custody friday. steve gonzales, the father of one of the victims, told gadi schwartz he and other parents plan to face the suspect when he gets to idaho. >> i want this guy to get is

sick of seeing us and knowing that these people won't let it go. >> joining us now from pennsylvania is stephanie gosk. stephanie, good morning to you. what more have we learned today? >> reporter: unfortunately, you're not going to learn much today. this is an extradition hearing. what we're told from the public defender is that he's not going to fight extradition. this could be as short as 15 minutes. he could be on his way to idaho tonight even flying there. he says, according to his attorney, that he believes he will be exonerated. his attorney spoke exclusively with nbc news this morning on "today." >> has he reacted to the charges at all? one can imagine being accused of something like this and saying where did this come from? why are they coming after me? have you seen that behavior from him? >> it is a little out of character. he said this is not him.

he believes he's going to be exonerated. that's what he believes. those were his words. he's really been very easy to talk to. he's in a calm demeanor, like i stated. >> reporter: investigators have not released much information publicly on what led to this arrest. nbc news has learned from two law enforcement officials that forensic genealogy played a role. in other words, the dna of his extended family, that would suggest that they had his dna in connection with the murders back on november 13th, but as you know, it took weeks for this arrest to take place. we know that he drove with his father in december cross country here to eastern pennsylvania, where he grew up. and the arrest took place about a month and a half after the murders themselves. it is possible when he goes back to idaho where he's formally charged that we may see an

affidavit that maybe released, a probable cause affidavit that may provide more details about the evidence that they gathered against him. >> stephanie gosk in pennsylvania for us this morning, thank you. turning now to another courtroom. this one in manhattan where later today the founder of crypto exchange ftx is expected to plead not guilty to an eight count fraud and conspiracy indictment. that's according to a source with direct knowledge of the situation. before his arrest, bankman-fried said he did not know about improper use of funds. he remains free on bond that requires him to wear an ankle monitor. as we await the house speaker vote, steve kornacki going to break down the numbers. you're watching "jose diaz-balart reports." ing "jose diazal-bart reports.

flooding major ciies and trapping dozens of cars in sacramento with torrential rainfall. which could have contributed to three deaths. outside san francisco people ewe used kayaks to make it down streets. now the state is left with millions of dollars in damage with some areas still impossible to navigate. official says more than 300 migrants, mostly cuban, arrived in the florida keys leading the federal government to close a national park monday morning. with that park tweeting that resources and space are needed to tend to the migrants. miami herald now reports that days could go by before federal officials are able to pick up many of the people now stranded there on the side of u.s. 1 highway. that's the only major highway on the florida keys. the county sheriffs department posted a statement calling the situation a federal failure creating a humanitarian crisis.

let's return now to one of our top story this is morning. house republican leader kevin mccarthy is still searching for the vote he is needs to be elected speaker today. and if he doesn't get them, he could become the first party leader to lose a first round vote. national political correspondent steve kornacki joins us from the big board to take a closer look the at the numbers. >> let's take a look at this. we have had some of these suspenseful days in the last decade when they elect the speaker, but none like this. so let's set the picture here. republicans now come into the new congress with 222 seats. democrats with 212. there was a democrat from virginia who passed away between the election and today, so that's what the vacancy is for. that means if every member is present today and votes this this house speaker election, there would be a total of 434 votes cast. you need a majority to be

elected speaker. so if everybody shows up and votes, 218 still is the magic number for kevin mccarthy. you can see with 222 republicans, it doesn't leave much margin for error. he could survive four defections there's already five republicans who are publicly repeatedly, insistently saying they intend to vote against him and to vote for somebody else in that first ballot for speaker. if they stay true to that word and everybody else is there and voting, then mccarthy would fall short. the other problem is those five are not necessarily alone. there are at least nine other republicans who are making signals to varying degrees they may vote against mccarthy on this first ballot. and further imperilling him. one of the keys when i say it's a big if, if everybody is there,

if everybody is voting, here's the rule or at least the precedent. i'm going to zoom in here. a majority is defined as a majority of the total number of votes cast for a person by name. that's the key right there. because the way this vote is going to work on the floor is every member's name is going to be called and they shout out their vote. they could say kevin mccarthy. they can say hakeem jeffries. but they can say any name they want. they can say bob smith. the key is if they vote for anybody by name, that counts as a vote and affects the math of what mccar needs to win. if they say they are present or in the chamber and don't vote, then that could change the denominateer. instead of being 434 andajority. we have seen this in recent times where the threshold has not been 218 votes.

most recently, np temperatures, the threshold was 214. why? because there was some members who weren't present. not everybody was there and voting. so pelosi had less than 218 and got elected speaker last time. but the bottom line on this is as you said, here it is. this is from 1923. you see the date. this is the last time you had a vote for house speaker and on the first ballot nobody emerged with the majority. this was a house speaker from massachusetts he ended up they tried four time this is day. he failed to get the majority on the first ballot. he and his allies tried three more times on that day and couldn't get to a major ty. they adjourned. finally, it took him nine ballots. he granted enough concessions to the rubbles in his own party and he was elected speaker.

36 past the hour. academy award nominee jeremy renner is recovering from surgery after a terrifying new year's day accident. his rep says renner suffered blunt chest trauma and orthopedic injuries while plowing snow. he was the only one involved in the accident. heavy snow blanketed the region over the holiday weekend and it was so deep that dispatchers didn't know the emergency chopper would be able to reach him. his family says they are overwhelmed with the public show of support and say they are grateful to his rescuers. we are continuing to follow the latest on the condition of safety damar hamlin after collapsing during last night's game against the bengals. right now, the 24-year-old remains in critical condition after suffering cardiac arrest according to a statement from the bills. joinings now is eric wood, a former player for the bills who was at last nugt's game calling it for the bills radio network. he's also the author of "tackle what's next."

also with us the founder and ce of advancing health equity and an msnbc medical contributor. thank you for being here. eric, as someone who played in the nfl, what did you make of what you saw last night? >> it was horrifying. and as an nfl player, you understand there's a certain amount of risk any time you step on to the field. but what damar hamlin was experiencing on field and what the players were witnessing almost ten hadn't manies of cpr, losing your pulse on the field and having cardiac arrest. that's not something we have seen in the nfl on a field. it was just horrifying to see the reactions of the players. you knew it was something severe. this was a very anticipated "monday night football" game. maybe the most electric and loudest stadium i have been in all season. and then just based on the players' reaction, silence throughout the stadium. it was just an unbelievable atmosphere. >> it's hard to describe the

emotion on the field from those players that witnessed it last night. doctor, i want to get your reaction first of what you saw when hamlin made that hit, and then got up and just collapsed. did that signal anything to you about what happened in the moment? >> think obviously there needs to be more detail that we'll learn about eventually. it sounds like something that is common in sports when there is sudden impact of blunt trauma to the chest. and it happens at just a specific time in the cardiac cycle over the heart to put the heart into an abnormal rhythm. most likely when that happens, it's of the utmost importance that cpr is started right away and an aed is used.

because every minute counts. every minute that that person is not defib rilating decreases their survival rate by 10%. we saw medical personnel on that field got on him as quickly as possible doing cpr. i heard a defib ril later was used. what is encouraging is he had return of pulse. so he had circulation between his heart that started again. the concern is whether or not there's been any brain injury. that all depends on how long his brain was without oxygen. >> that was my follow-up question. we know that it was several minutes that they were administering cpr. so you have this, i guess, the good side of this they were a able to revive that pulse. the possibly difficult side of this is he might have been under without oxygen to his brain for several minutes.

what implications could that have? >> right, and a that's a great question. it remains to be seen. one, he is young, so he has youth on his side. there have been people who have regained normal brain function after a few minutes of being deprived of oxygen. there are also other techniques that critical care doctors can use. like hypothermia, putting patients in a cold environment that has been shown to improve the brain function. so i'm sure those doctors at uc and the whole team are doing what they can and using a all of that evidence-based medicine that they know to make sure that this young person is able to regain full brain and cardiac function. >> eric, as somebody who has been around the organization, ha can you tell us about his journey in the nfl and a ha he meant to the team? >> i had the pleasure of

covering damar hamlin at the university of pittsburgh as well for espn. when we would talk to their coaches, they would talk about how he's such a special young man. he was from the pittsburgh area. and they had guys that were drafted ahead of him, but he said this is the top pro that we have on our team. he acts like a professional at such a young age. he's been raised by incredible parents. so this is a very special young man that tries to do erg he can to use the platform of football to make an impact in the community as well. now donations supporting his foundation and the gofundme have gotten $3.5 million. the outpour has been absolutely incredible. i feel like in a nation that's just full of shock, people are willing to do anything they can. i would just encourage those out there to continue to pray as well. >> i couldn't agree more. eric wood and dr. blackstock, we appreciate your time.

this question for you. kellyanne conway testified that trump spoke to her about discussing a pardon for steve bannon. she did so reluctantly. what questions do you have and could this be significant to the justice department? >> i think a lot of it is significant. it all goes to what ali was talking about this wasn't a spontaneous attack on the capitol. this was a coordinated campaign at multiple levels with people like southbound is southbound is included in the planning and masterer minding of this. and if he wasn't directly at the center, he went along with it knowing that it was an attempt to overthrow the election. so all of this goes to that question of mental state and what donald trump was doing and how all of this came together with him at the center. >> what are the conversations among lawmakers about this committee's work coming to an end. tell us what that process looks like. >> it's over. they have turned over all of the

information they have both to the appropriate places for it to be archived, but also it's all online for all of us to look at. we have poured over the text messages that we're now able to seerks the transcripts we're able to see. all of that is really important. if you look at the political ramifications of this, there are questions about what this means for trump himself as the only active republican candidate for president at this point. that's something that's going to be important, especially as we move ahead in the political calendar. but you look at the members on the screen. right there in the center as we tush the page from the 117th to 118th congress today in the next hour or so, they are no longer in congress in large part because of the way that because they called on donald trump, and that was seen as unforgivable. the political ramifications of this are palpable, and not just

for republicans. a democrat from virginia in a very swing district that i spent time in in the leadup to election day this fall, she's also no longer a congress member here. there was swift ramifications here for a committee that said they only wanted to do a public accountability hearing for january 6th, and they landed where this is falling squarely at the feet of former president donald trump. >> it's somewhat unprecedented to have the treasure trove of evidence in the public domain, and what we don't know is what jack smith is doing. there may be other evidence gathering efforts that is going on within the doj right now, but it's highly unusual to have this much of the evidence that would support the prosecution already in the public domain. >> a quick pivot here. you have new reporting on what

is happening ahead of the house speaker vote we have been covering today. what is going on there? >> we are talking about turning the page between congresses, and now they have to pick a speaker and we know that negotiations for mccarthy started right after election day and continued until late last night. most members i have spoken to today, when i ask how many ballots they think we will go to, what will happen, and i have seen more shrugs from them today than the last few months, really, and there's still the reality that there's more than a dozen people likely to vote against mccarthy on the first ballot, and the question is will it shake anything loose for the man that started moving into the speaker's suite here in

accountability and kevin mccarthy was taking the path of nancy pelosi and following her precedence with the motion to vacate. we were just told when we left this door, we will give you single member motion to vacate, just today. that was the starting point for negotiations. that was the starting point to everything we were want to go transform the way washington, d.c. operates. if you go to the american people and ask them if congress is doing a good job and if they like the way things are run in washington, d.c., you will probably get a big hell no. we want to change the way things are done here. we did not offer up a personal wish list. we were told to provide lists of what members needed to be on committees, and we did that. there were items listed as well, for border security and term limits. just bring the bill to the floor so we can have a vote on term limits.
