to reconsider title 42 again. but as you would expect, we'll begin with the mess on capitol hill. and there could be some good news for kevin mccarthy. overnight the house republican offered more concessions to a group of 20 ultraconservative gop lawmakers who have consistently voted against him. ask with just two hours to go until the house is set to reconvene and continue voting, mccarthy arrived at the capitol a short time ago and expressed some optimism. >> i think we're making progress. i think we're all working together to find a solution. >> do you have the votes today? >> we'll see. >> with us to start off our coverage this hour is capitol hill correspondent ali vitali. peter baker, jake sherman and brendan buck, a senior adviser to boehner and ryan. tell me what is happening right now on capitol hill. >> reporter: just feet from us is kevin mccarthy's office. the speaker eegs office, not his office, but the office he's currently occupying. the fact that conservatives are suting down with the leadership, the fact that mccarthy is giving up even more concessions, seats on the powerful rules committee, which sets the floor procedure for the house of representatives, lowering that threshold for the motion to vacate, which boosts out a speaker. he's doing that. but good is relative. a good bounce around the room is still just bouncing around the room. you have to take it with a grain of salt.

i will say this. kevin mccarthy is fighting a daily battle. he has to the get from one day to the next. yesterday he was able to adjourn the house of representatives. that was a good thing. not a great thing, good, relative. today, according to people close to him, he wants to not lose any of the 200 people he has with him. 201, 202 depending upon the vote. he wants to show visible progress, what he calls visible progress to the rest of the house republican conference. those 200 people in his talks with conservatives. now, good is relative. we have still seven ballots in he's still relatively unlikely to become the speaker. relative because he's gone through seven ballots, but that's where we are. >> he's making concessions. run through a few of them. concessions on the rules committee, concessions on making it just one person in the house who can vote to have no confidence in the speaker like they do in parliament.

what else is there? there's a superpac that's not going to be spending money in open seat races. what is he giving in to and while it might him with conservatives, is it going to help with the rest of the conference who has been consistently voting for him? >> as brendan and ali will tell you, this will hobble him with the rest of the conference. it will hobble future speakers because he's just giving up the store. the superpac thing is interesting. conservatives feel like kevin mccarthy's superpac, the superpac he's associated with, has targeted conservatives far long time. they are no longer going to do that in open primaries. now with every action there's equal and opposite reaction with moderates. we have to see if moderates want kevin mccarthy to be speaker enough to swallow this massive pile of concession ises. i don't know the answer to that. my guess is yes because people are getting tired of sitting on the floor and voting, tired of kevin mccarthy losing over and over again. it's humiliating for him and

supporters. but progress is progress. he has to get through today and get to tomorrow. >> progress is progress. he has to get through today and tomorrow. there are whispers getting louder about potential other candidates for speaker. one of them is steve scalise. is he going to be if his name comes up and if he decides to move into that position, kevin mccarthy, could he get enough votes with these never kevin people who are are also kind of never leadership people. >> yeah, that's an important distinction that you're making. jake and all the rest of the folks here scrambling around the capitol with me day in and day out know this. for some of the 19 to 21 no votes that exist right now, for some of them, it is a kevin mccarthy problem. but it's not exactly clear that steve scalise wouldn't come with his own set of problems whether it's that he's not palettable to some of the moderate parts of the conference or whether he's also just the same kind of a stand-in for the people who already are just sort of having

authority problems. you especially see it when you consider the 19 to 21 people that they are having individual negotiations. a lot of of the concessions that jake is talking about and that we put up on the screen here for viewers are meant to target specific people. because there are five or six of these folk who is are never going to get behind mccarthy. i will say right now in talking to folks when i ask about the likelihood of mccarthy dropping out, people are saying it's slim to none. in large part he has made clear he's happy to break records here. the record is like 130 ballots. i i really hope for our sanity we don't get there. but nevertheless, he's been steadfast in his desire to stay in and grind this out. whatever he ends upcoming out with, he has really given away the store here. a lot of the red lines he said he's never going to cross, he's crossing. as difficult as this speaker's battle has been, it's also going to be very difficult every single day that kevin mccarthy

or someone else who may have to deal with whatever the concession doles were. >> how does it come to this? these 20 republicans, really just 5 of them, can have complete control over the entire conference? >> basically they don't care what their colleagues think. this is the reality we have base faised for a long time. the dynamics are not all that different than the boehner and ryan speak issership. he only has a five-seat majority. that really is the name of the game. it's a math problem. usually around 20 or 30 folks gave us the same types of problems. but the situation that kevin found himself in now is, i think, long-term very damaging. and so we're throwing out concessions. we don't know whether some of these members are even going to accept this deal. now that these things are on the table, it feels like it's pretty hard to walk back.

we have talked about the motion to vacate and how you kick a speaker out. the changes to the rules committee are really important for people to understand. the rules committee is the committee that decides what bills come to the floor fundamentally. it also decides amendments and the rules of debate. but unlike other committees that have policy jurisdiction, this is controlled by the speaker and what controls the legislative agenda on the tloor. if kevin mccarthy is handing over the keys to the rules committee to some of these members, that is going to have profound ability on the house's ability to govern. i don't the want to use the nightmare scenario, but a debt limit increase needs to come to the floor and there are enough freedom caucus members on the rules committee they don't allow that bill to come to the floor, we can't raise the debt limit, that's a big problem. maybe that's an extreme example, but he's saying the speaker's committee that controls the agenda is going to have somewhat controlled by the freedom

caucus. >> explain that more. how is it possible that a couple people on the rules committee can reject what the speaker of the house is saying needs to be brought to the floor? how is it possible that they would have more power than the speaker? >> the rules committee is basically there as a function of the leadership. it has a pretty large majority spread. usually nine majority members and four minority members just to ensure that the majority can always move the agenda. the democrats on the rules committee almost always will vote no on what the major is trying to bring up. if you have four democrats always voting no and you have enough republicans say three republican who is are going to vote no as well, you have a 7-6 situation where the bills of the leadership wants to bring up is blocked. now it doesn't mean they can bring up anything. you still need cooperation from the rest of the republican who is bring up something

proactively. but if they don't want to bring something to the floor and partner with the democrats on the committee, who will almost always vote no on what the majority wants to bring up, then the house is paralyzed and the speaker cannot bring bills to the floor. >> that's just wonderful. jake, i saw that you were off camera waving to get back in. what do you want to add? >> this is the traffic cop. that's the way to think of this. this is the traffic cop for legislation. but also historically, the rules committee used to be a power center where the speaker didn't control it. it used to be rules committee was all powerful and you have to watch the rules committee to understand what's coming to the floor. as the leadership has consolidated power consistently over the last 50 years, the rules committee has become a the tool of the leadership. what the freedom caucus is demanding that it retains or regains some of its power it does -- it would be a massive sea change for the modern house of representatives and it would make kevin mccarthy's job nea

impossible. >> the democrats are watching all this happen. they are watching the republicans essentially implode on themselves. there's been talk, and some republican lawmakers have floated this, about a consensus speaker. somebody that could come and get votes from both some moderate republicans and some moderate democrats. there are others who say no way, no how. as this drags on, does that scenario potentially become more of a less of an extreme ask hr of a possibility. >> in the last two years, we have seen anything can happen in the sense that things we thought were unthinkable are clearly thinkable. we haven't seen this kind of scenario in a century. and here we are. so is it possible, anything is possible. but it's more of the wishful thinking situations where everybody likes to play clever

games and create the most fantastic, fabulous proprost rous scenarios and see if they might fly. the longer this goes on, the more creativity will be put into this. and the more things then spin out of control for mccarthy. he needs to end this before you have people playing out scenarios, however unlikely they maybe, because this continues to weaken him. it's about who has power. if you give up the rules committee, you're creating a joint power sharing agreement here in which you the speaker could go through the exact kind of paralysis we're seeing on every big vote. imagine going through this again and again. this should be the easiest vote of all. you're voting for your own party's lieder. we'll have a lot harder votes

we have also learned his dad called up the bills to update them. what did he say? >> reporter: he had some welcome news for the buffalo bills team. his father joining a zoom call to update them saying he is making progress. several of the bills players reached out to his father saying that's exactly what they were looking to hear. several of them still in shock, obviously, after an emotional after watching that hit on monday night and seeing the aftermath of hamlin suffering that cardiac arrest. he remains in the intensive care unit here at uc health. stars we know, the latest update from the team, who has been in touch with medical team, said that he is still sedated on a ventilator ask in critical condition. but that note he's making improvements, taking steps in the right direction, even with a long recovery ahead is welcome news. new data showed that 24 million

back to idaho and could appear in court there as soon as today. we're also learning new details about what he was doing prior to his arrest. police released body cam video of bryan koh beenberger ask his father on a trip. public records show the suspect received new plates for his car just five days after the murders. joining us from moscow, idaho, is dana griffin. he will be appearing in court today. a what can you tell us about the new plates? >> reporter: good morning, katy. according to our nbc affiliate ktvb, they obtained documents that show five days after those murders, the plates were changed from pennsylvania to washington. the car was also registered in washington. so there's a presumption of innocence here, but it's adding to this puzzle of what happened and what was done that maybe

part of why police have linked him to these murders. right now, bryan kohberger sits in jail waiting to learn when he will appear in court. he's not on the the docket, but that will change once court opens around 8:30. right now, we know that he is likely been served those charging documents. he may have an idea of why he has been arrested. that's the big thing we're hoping to receive today. so everyone of else can learn those details. investigators have kept a lot of details close to the vest. the police chief saying once that information is released, we'll understand why they were so protective over this case. so once he make it is to the first court appearance, the judge will read his charges. he will not enter a plea. that will come at a later date. based on conversations that he had with his public defender during the extradition part of this, he believes that kohberger

contestants ready? go! only pay for what you need. jingle: liberty. liberty. liberty. liberty. kevin mccarthy is hoping the numbers start breaking his way today, and who is better at numbers than steve kornacki. you're at the big board, what do the numbers tell us? >> with the 7th ballot, these are the names to keep an eye on. this is from the sixth ballot and every ballot we have had so far. these are the republicans who have been holding out and not voting for mccarthy. you see they were voting for byron donalds. there were 20 republican who is voted for donalds. then a 21st who ended up voting present on the final two ballots. so the math for mccarthy is basically this. all of the democrats have been

there and voing for hakeem the jeffries. so jeffries had been getting 212 votes. donalds got 20. then there was that one vote. so basically, depending on a number of present votes, the threshold could change a bit. it's obviously this group that mccarthy needs to make end roads in. he needs to get 17 of them to vote for him. if he does that, if he gets 17 to vote for him, he would have 218 votes. that would leave wiggle room for four to actually vote against him. and the magic number would be 218. if he can get that, he would win that. look at this. when the vote starts, you'll see it right away. is there any movement? i think that's been the question overnight with all of these concessions and meetings, it's

not necessarily is mccarthy going to win on then skechbt ballot, but is he going to get anybody to budge. you look at this list. they vote alphabetically. we could get an early sense. biggs is dug in. better is dug in. you wouldn't expect them to be flipping to mccarthy. but what about bishop. that name will be called early. is he flipping. is there an early indication that some of these holdouts are flipping to mccar thi. does that send a domino effect. gaetz seems very dug in. it's these other members here who don'ts necessarily -- it's tough to read them all, but they haven't been as outspoken and adamant as a biggs and boebert. do you see see any movement with them?

that's what mccarthy is looking for. it's not that he thinks he can win it on the 7th ballot. it's a question of does he show he's starting to win over some of the holdouts. can he narrow down the number of republican who is are voting against him. the goal there would ultimately be it could take them a number to get there if they can get there at all. the goal for mccarthy would be to isolate this as much as they can. isolate it down to a handful of republican holdouts and really amp up the pressure on them. it really does seem clear there are some who are just adamantly not going to vote for kevin mccarthy. and he can afford to have four who stake out that position that they are not going to vote for mccarthy and they are going to vote for somebody else. he would need every other republican. he would need every other republican to vote for him. >> the tricky thing is that anybody else is going to be facing the same math in this scenario. so far scalise has been whut perred out. there hasn't been a consensus

candidate that seems like they can break the log jam that stands against kevin mccarthy. >> and that's the other interesting thing. they nominate. then this renegade faction is a couple different candidates anybody could be nominated nobody has nominated scalise. the members themselves, as you see watching these votes, they are free to shout out any name they want during this roll call. that's one thing i have been looking for. does somebody at sam som point throw the name steve scalise out there. does that generate any kind of response? is there a scenario where some of these holdouts, if somebody puts the name out there and says it, do a couple holdouts start seeing it too as a way of indicating if it's scalise, i might be more open to that.

florida. he's not had an active campaign. i don't think he's done much of any campaigning since making that announcement in november that he would be seeking the presidency again. he would have him scared away other challengers. we're seeing a thunderstorm of other prominent republicans including ron desantis, continue to make noise about running for president despite trump's status as a candidate. just to underscore something that's so interesting about the last two days, these 20 defectors are like hard core trump supporters. these are people who are part of that maga base whose whole political identity is election deniesers. most were endorsed by trump in their primaries and still his endorsement has not moved them. >> why is that? why if they are tlez ultramaga who are election deniers themselves, why does his opinion, does his recollection, his endorsement not hold the

same sway? >> i think there are two things to consider here. trump was never that great at whipping when he was the president. so while some things have changed, we can sometimes overanalyze this stuff. he wasn't that good of the inside game. his power was always in the crowds. and he could control the republican politicians by controlling their voters. you can't really do that in a speaker race. so in that way things haven't changed. the way they have, while he's exiled himself down there and hasn't been out campaigning, other things have come to fill the vacuum. he's created this beast. this was a bottom-up issue, republicans theed the fighting that i wanted the showmanship that they got from the trump era. now a bunch of other republican politicians from ron desantis to

matt gaetz to lauren boebert are saying i'm going to give you what trump gave you in a miniature form. so those people are creating their own bases. they are getting smaller donors of it. they are getting attention on conservative media from it. so their incentives are to continue acting like trump, maybe not acting in the way that trump wants. >> they have been made relevant by j.d. vance at his primary victory. giving credit to the likes of charlie kirk. he's made these individuals relevant. andy biggs was at several campaign trump rallies in 2022. there was one in wyoming in which they were trying to oust liz cheney. this was andy biggs, quote, she's willing to wreck the congress just to keep power. this individual craves power and abuses power. andy biggs is the one who is now craving that very power that he was claiming liz cheney. >> what's the back story on andy

gop primaries. how does that affect who gets elected to congress? >> well, it's a commitment from mccarthy's political machine that they are not going to vie to unseat some of these rebels or turn against people who could join this rebellion in the next congress. mccarthy has done a lot of work the last year or two in trying to minimize the influence of this rebellious group of house republicans and try to bring in some more main line republicans into the conference. this is him basically conceding that he's not going to be doing that work. which could mean that two years from now after the next election, there could be more than 20 of these hard line republicans. >> which would not make the mod
