i'm chris jansing in for jose diaz-balart. right now on capitol hill, democratic lawmakers are about to gather for a remembrance event marking two years since the deadly insurrection at the u.s. capitol lawmakers, staff and law enforcement fear for their lives after a pro-trump mob stormed the halls of congress. norma torres will account her experience on that terrible day. we're day four of an intense speakership battle where a group made up of 2020 election deniers is rebebl belling against kevin mccarthy's bid throwing congress into paralysis. mccarthy isn't backing down. >> we're going to make progress. we're going to shock you. >> why? >> why what? >> how are you going to shock us today? you're going to get there today? >> i don't know, you'll see progress. >> reporter: a brand now gnu jobs report shows a better than expected 222,000 jobs were added in december. we'll ask the labor secretary what this means for the state of

our economy. also this hour, we'll take you live to moscow, idaho, where we're learning shocking new details about one of the surviving roommates and what she saw the morning of the murders. plus an update on 24-year-old damar hamlin, doctors say is awake, alert and asking after he went into cardiac arrest during monday night's game against the bengals. we begin this busy hour with our top story. 11 votes over 3 days and now day 4 in the historically long battle for the speakership. house republicans will hold a conference in a few minutes where they will hear details about the latest deal with a group of ultraconservative defector who is are committed to blocking him from getting the dpavl.

it comes as the house is expected to reconvene for another day of voting in less than two hours. as punch bowl news put it, gop leaders now believe they are reaching a tipping point. either a large block of mccarthy's opponents moves in his direction following yet another round negotiations or his quest may have stalled out permanently. joining us with more is capitol hill sont ali vitali. also with us is founder of punch bowl news jake sherman. and national political correspondent steve kornacki joins us from the famous big board. so ali, let's start with these concessions mccarthy is talking about. do we know what they are? >> reporter: yeah, they haven't changed over the course of the last 24 to 48 hours. leaders were here from mccarthy's team hashing this out with conservatives. jake and i were staked out here well into last night as they were finishing up their negotiations. people were mum as they were

exiting, but there's a sort of optimism that today could be a day where this deal actually bares fruit on the house floor potentially moving some votes in mccarthy's direction, though no one i have talked to is under the impression it gets the full vote. even though we could see incremental rog, that could be enough. i think what jake ask his colleagues report overnight is the same thence that we have here at nbc, which is that while mccarthy seems to have some momentum, had he either needs to capitalize and show he has spg to show for these negotiations, or people are going to start having some frustrations of what are these negotiations actually yielding because it doesn't seem we're any closer to electing a speaker. if we're looking ats the specific concessions, i'll pul them up on the screen. the first on the screen is this idea of the motion to vacate the chair, which is how easy is it for members to triger firing the speaker from their job. that's now at a one-member threshold in these negotiations.

that's a redline that mcthi's team said wouldn't cross. they made it down to 5 and now there you are at one member being able to trigger that. then there's the idea of who sits on these important committees, specifically the rules committee, the banking committee. a lot of these committees that deal with spending, how money flows through the building. it's going to be really, really tough. perhaps that's one of ft key points for these negotiators who are currently the no's for kevin mccarthy and he's trying to get on board. >> and all of this is playing out against the backdrop of the fact that this is the anniversary of that terrible day on january 6th where so many people waiting to see if they are going to get sworn in. let's pause for a moment as they pause for a moment. >> today members of the house of

representatives in a bipartisan i way pause solemn recognition of the violent attack on the capitol that occurred two years ago on january 6th, 2021. we are joined by the families of several heroic police officers who gave their lives protecing the congress, the constitution and the country. we are gathered here to honor their memory and acknowledge with deep gratitude the tremendous bravery of the hundreds of officers who defended us at this citadel of democracy that fateful day. as a result of the events on january 6th, the lives of five heroic officers were lost. another brave capitol police officer lost his life defending the the capitol on april 2nd,

2021. 140 officers were seriously injured that day. many more will forever be scarred by the blood thirsty violence of the insurrectionist mob. we stand here today with our democracy intact because of those officers. [ applause ] violent insurrectionists stormed the capitol and attempted to halt the peaceful transfer of power, a cornerstone of our republic. they failed. they failed because of the bravery and valor of the united states capitol police and the metropolitan police department officers who fought heroically to defend our democracy we will

never forget their sacrifice and we will never forget this day. it is now my honor to yield to our speaker, who led the house of representatives on that fateful day with strength, courage, and resilience, nancy pelosi. >> thank you very much, mr. leader. thank you for having your first official public to be a moment of reflection, a time of reflection and gratitude to our heroes. i associate myself as do all our colleagues with your remarks and singing their praises. the january 6th insurrection shook our republic to the core. for had in the congress and across our country, the physical, psychological, and emotional scars are still raw.

yet from the unspeakable horror spraying heroism, law enforcement confronted the insurrectionists to protect the capitol, the congress, and our constitution. and it is with great respect and admiration that we are joined by the families this morning. thank you to the families for considering us worthy to share your grief to honor your loss. when we had the gold medal ceremony, the highest honor the congress can bestow, i said at that time your acceptance of that gold medal brought luster to the medal. we always pray for god to bless america, and he certainly did with the heroism of these heroes. as we mark this solemn day, let

us draw strength and inspiration from the timeless words of president lincoln. in his message to conference, he offered in the heat of the civil war he said, we cannot escape history. he called upon congress to honor our sacred duty to nobly save or lose the last best hope on earth, which he believed was american democracy. that is our test today, too, so help us god. now we will hear from the families of our heroes. we thank them for their sacrifice, for their patriotism. we will always carry the memory of of their family members in our hearts and our tribute is to those who suffered psychologically and otherwise protecting our democracy. i thank all of our colleagues for joining us here on the steps

two years ago when it was under attack, as they remember the police officers who gave their lives, those injured. a particularly moving moment when the children of officer billy evans walked up to the microphone to say his name. there will be other remembrances today, including one at the white house, but again, all of this emotion playing out while there is a congress that at this point is not functional. jake sherman w we know a call is expected with kevin mccarthy. we are trying to come to some sort of resolution to this or make a step toward that resolution. what does that even look like? is there any expectation that he's got the numbers? >> no, he doesn't. it looks like him not getting 20

people against him for the 13th vote, he feeds to start showing positive movement or else he's not going to be the speaker. and that's what republicans are telling me and telling us last night when we were staking out these rooms. this deal either gets him there or it's time for him to move on. that's the basic message from a lot of people. now, it's not going to get -- he's at 201, 202 depending on how you at it. he needs to get 16 more members. this is a big task. you could ask anybody that's been around this institution about how much it takes to flip 16 votes on any issue and it's a herk huge task. he has a lot of tools at his disposal. he's given all those away.

he's given up pretty much all he can give up. and there are two camp here's. there's the matt gaetz and lauren boebert camp. they are u.n. playable. they are not going to vote yes. then there's the rest of them. the rest of them seem open to voting for mccarthy. they need to start turning today. or tomorrow or sunday. the dam feeds to break in some way. we'll see what happens after this call. that's the reality. congress needs to get underway here at some point. you can't just be stuck in time for weeks at a time. >> jake, as you well know, there are occasions when you bring a vote to the floor that you can't win because you want to get the other side of the record. you want to make them take a position on something that maybe controversial or maybe they are voting against something that that you on the opposition side know constituents want, but for other reasons they aren't

willing to support it. in this case, explain to me whew you keep going to the floor again and again and again, or maybe the question is in the first place, when you know you're nowhere near having the votes. was there an alternative to what we're seeing play out here today? >> no, because the first order of business, according to precedent and basically the house rules, the first order of business in a new congress is selecting a speaker. there are ways to get around that. people on twitter are worked up there could be all these things they could do, they can't. the house is a majoritarian body. nothing else is going to happen besides adjournment, a break for some certain period of time, or voting on the speaker. those are the two things that could happen. every time they close the floor, they feed 218 votes to close it. and then they have to start voting again. that's what's going on. there's no alternative. the alternative, quite frankly,

would have been for kevin mccarthy to do this over the last eight months. he didn't do that for a variety of reasons. he wasn't speaker and it's presumption shs ask there's nothing that focuses the mind like a deadline. unfortunately, he's in this position now and has to do it now. so that's where we are. and it's time for mccarthy's detrack torts and supporters and mccarthy to put up or shut up. i want to make one more point. the detractors haven't picked up any steam either. they are stuck at 20. one of the sides has to move or they are going to have to move to a plan b here. >> i agree with jake that there's nothing that focuses the mind like a deadline. he mentioned today, tomorrow, sunday, is there, in most people's minds, understood deadline that if mccarthy doesn't get to it in the next

day or two or three, they have to have a plan b. >> i think that we're about to get to that point. they are getting on the phone right now over the course of the last few minutes. members have started dialing in. we'll hear what we hear as it goes. there is a mind set that i have heard and that i knowshake has heard that this is a moment they need to show these discussions actually mean something and they are moving people in mccarthy's direction. i also think it's important when we talk about these other names, they all have their own problems atached to them. there are unofficial whip counts for these folks too that don't seem anymore promising than the one that kevin mccarthy himself is dealing with now. so i think that's a really important thing for us to keep in mind as we start exploring theoretical alternatives, though at this point, mccarthy is extremely dug in. i think this 10:15 call is going to jog a few things loose but

it's important as we are here january 6th, you watch these the democratic lawmakers out on the front steps. many of them walked behind me as they were on their way out the door. there's so much heaviness in the remembrance to this day. it's important for us to really put a fine point on the parallels between the key players of the speaker draw dra ma and what happened on january 6th because several of the names that the january 6th committee really underscored in their work are people who are at the center of this battle. scott perry. one of the key players in the push to install jeffrey clark atop the department of justice, obviously, he's the leader of the freedom caucus. several of the members who defied their subpoenas are obviously integral in the battle. kevin mccarthy himself in the fight to become the top republican. and one of the key people responsible for really the whitewashing of what happened here on january 6th.

and the normalization of donald trump in the aftermath of that. then people like matt gaetz and andy biggs, who were requesting pardons from the white house for whatever role they thought they were going to play in overturning the election results. it's important to underline the parallels between the players in the republican party and what happened two years ago here on this day. >> it is when you have a majority of the people who are in that group who are election deniers, i also have garrett haake. let me bring you into that biggerer picture. you're honoring the folks who gave up their lives or were injured, had to give up their careers, remain with the impact of what happened to them that day. because they believe it was their job to defend democracy. now we have a nonfunctioning democracy because we don't have a speaker of the house. we don't have house members who are sworn in.

i know you talked to the police chief and i want to fwi you a chance to put into context. what i think ali put appropriately is that there's a heainess about this. what those folks fought for and gave their lives for, they are watching that it's not playing out the way they would have hoped or expected. >> they made that point that he fought for the opportunity to be in the chamber all day long as much as you're correct about the broader picture, this is a form of election denialism. the republican conference picked

tok speaker. so they are denying the results again. >> off political process for the former police chief who was forced out of that position the day after january 6th, he makes an argument you can't separate the security failures that happened here on january 6th, primarily intelligence failures and the failure to respond quickly by the national guard, the pentagon and by other federal law enforcement part they ares that exist here from what happened in washington, d.c. in the summer of 2020. and that the politicized response to the protests, to some of the rioting behavior that began late at night in the summer i days of june 2020 are president trump's walk across lafayette park to the church and the images of national

guardsmen, federal policing agencies putting down those protests basically gave those agencies and the lawmakers a bit of cold feet. he argues that if it were not for the positioning of d.c.'s local police force, things could have been much, much worse here. take a listen to some of our interview. >> if they hadn't been there as quick as they had, the breach would have happened quicker. members would have been trapped and we'd be dealing with a worse situation. >> reporter: it's a reminder as bad as things went, capitol police completed their mission. there were no members of congress hurt or killed. the certification of the election results did occur. it could have been worse. that's something we cannot forget. >> so let me ask you about what you feel the mood is.

we heard from ali vitali. do you think there's any through line that this has any impact in the way people look at how this unfolds or is that just too pie in the sky to think there could be some thoughtfulness tying the two together? >> reporter: not from the anti-mccarthy folks, but in the group of republicans who voelting for kevin mccarthy who see themselves as part of a governing party who are have a duty to go ahead, they are very much aware that having more dysfunction on this day only makes their party look worse. unfortunately for anyone that would like to see this solve quickly, they are not the ones who necessarily need to be convinced of the importance of governing and coming together. they are already on board. >> so do we still have alu and jake with us?

>> jake, what are you watching for next? it's going to be what comes out of this call. >> mccar thi said he had an agreement with chip roy. we'll see what that means. and what i'm looking for in an hour and a half whether there's any -- whether that moves any votes. whether he's able to move some of these 20 votes to the yes column. >> of course, as we know and have been saying all along, a vote or some votes is not going to get kevin mccarthy where he wants to go. ali had to go do some reporting. you probably have work to do as well, so i'll lt you do that. . all the best as you continue your reporting. thank you for being with us. we're going to hear more from former police chief steven sund at 2:00 p.m. eastern here on msnbc. joining us now is democratic

congresswoman-elect norma torres of california. i want to thank you for being here. we just saw the emotional ceremony that was held on the east steps. i wonder what your thoughts are today on this second anniversary of january 6th and the insurrection. >> today continues to be a heartbreaking day for all of us, especially the people that were trapped in the balcony like myself for 45 minutes. face down, crawling from one side to the other not knowing if we were going to be able to walk or run out of there alive. and figuring out how to arm ourselves so that we could defend ourselves if we would have to fight to get out of there. it is devastating that this would happen on u.s. soil. not just any place in america, but here at the u.s. capitol. >> and as you well know and are

in the middle of right now, before the house is able to do anything, there needs to be a house speaker. as that continues to unfold perhaps another set of votes today, what are your biggest concerns right now with the fact that there isn't a functioning house of representatives? >> my biggest concern right now is with the last three days of unable to govern, it's signaling for the next two years with a republican majority. i think the american people are seeing that they are unable and unwilling to govern the chaos that we're seeing unfold before us. it's something that hasn't happenedn over 100 years. yet here we are again making history. the 201 republicans that are staying united, i think i feel

more shame for them that are not coming to our side because this is america. we are not able to get classified briefings. we have been told that we should not be accepting case work. and my office is open. i maybe congresswoman-elect, but we're continuing to answer the calls for assistance from our constituents. so these are the impacts that this impasse is having on our entire country. >> i don't know if you had had your ear piece in or were able to hear, but we're having a conversation with three of the best capitol hill reporters. they were talking about this call that's going on right now with the republicans trying to see if they can come to some sort of deal. and in the meantime, there's also a reality that there's a clock that's ticking. could it be a day or two days or three days, but at some point, will they decide if kevin mccarthy doesn't have the votes to move on. so that brings me to this

question in the name of a functioning government. are there any scenarios where you would be willing to vote in support of a unity or a consensus candidate for speaker? essentially, to make some kind of deal with republicans. >> i think right now we are looking to our leadership to begin those conversations with anyone on the other side. if there is a deal to be made. but i have to be mindful that in politics, the only thing that we have is our word. our word is our bond. and on the other side of of of the aisle, time and time again, they tell us if you change this on this set of bills, we will vote for them only to go to the floor and see them voting against every piece of legislation that we have attempted to pass in a bipartisan way. so i would be very cautious. i think the proof is in the

pudding it's not just verify that they are being honest with us, but we have to see the end result. do they have the courage at the end of the day to vote for a different candidate. democrats have stayed united not only the last three days with 212 votes in support of hakeem jeffries, but the last two years with, at best, a four-member majority and at worst a two-member majority. we have passed legislation that has been able to get us out of this horrible recession that we have been in. our economy has returned. we have created many not just jobs, but really good-paying jobs. we have a bipartisan infrastructure bill. we have many accomplishments and we have demonstrated to americans and the world that we can stay united and we can

govern. >> we're out of time, and i know you have other things you have to do, but can i ask if you think there's a possibility a deal could be made? i understand your hesitation that you're maybe not as frusing of the other side, but if there's a deal to be made, what should the democrats expect to get out of it? >> i think we should expect to get out of a government that would continue to be for the people, as it has been the last two years. that we would commit to passing a budget on time. that we would commit to raising the debt ceiling. that is a start. but that is not the end. >> congresswoman norma torres, thank you for being with us. still ahead, buffalo bills player damar hamlin is aafter suffering that cardiac arrest and now we are hearing reaction from the bengals player who hamlin tackled just before collapsing on the field.

it is 38 past the hour. to our other breaking news, the government reporting that employers added 223,000 jobs last month, slugtly more than the 200,000 economists had predicted and the unemployment rate fell to 3.5%. hispanic unemployment edged up by .1%. black unemployment stayed the

sail. ask just moments ago, president biden issuing a statement on the jobs report saying in part, today's report is great news for our economy and more evidence that my economic plan is working. the unemployment rate is at the lowest in 50 years. we have just finished the two strongest years of job growth in history. joining us to talk more about this is labor secretary marti walsh. thank you for being patient with us as we went to capitol hill for breaking news. there is a definite positive side. 2022 was the second best year for job creation since 1940. on thing in side, there are a the lot of analysts looking at this new we have a with wave of tech and finance industry layoffs saying it suggests that the labor market might be start lose momentum and the gains could reverse in the year ahead. how do you see the job market going forward? >> i think on that last point, we're going to watch the numbers really closely and not just

check the tech sector but other sectors. it showed strong growth in construction and education and hospitality. if we were seeing a slowdown in the economy, those three areas wouldn't be going in that direction. now that's a one month report. we'll keep an eye on this as we continue to move forward. the tech side, i'm watching those closely. we have heard conversations layoffs. we saw them last month, but hopefully it's short-term and not long-term. >> do you think the numbers today impact the federal reserve's aggressive pace of interest rate increases? >> that's a question you'll have to ask the federal reserve. i'm not really sure. i think they probably like this report better than some of the other reports we have had, but certainly this is a good report where you're seeing good, strong job growth. we saw a dip in wages. so we're still seeing 4.6 wage

growth. >> if we look back account a little bit, economists were surveyed and 63% saw a probability of a u.s. recession in 2023. do you see anything in these numbers or in the overall economy now that you think might mitigate that possibility? >> i think we need to stay focused as an min on the economy and bringing back the economy and continue to make it strong. with the president said today is right. his plan is working. there's no question about it. and i didn't see a speech, but he always does acknowledge we still have work to do when it comes to inflation. we have seen inflationary pressures come down and we need to continue that momentum. >> let me ask you about the wall street reaction, which was very positive. at least the last time i looked, i don't know if we have the latest, i'm looking at the dow up 522 points there it is thank

you for that. wall street also generally doesn't like uncertainty. do you have i any concerns that the fight over who should be house speaker could have an impact if we don't have a fully functioning congress, thot just maybe for the next couple days, but even beyond that. >> i can't really say what wall street wants and doesn't need. i think the american people deserve to know soon who is going to be the leader of this congress. we need to make sure that they need to get together and elect a speaker so we can move the american business forward. we might have disagreements on policy and different issues, but it's important for all of us to get up to capitol hill to start to work with the chair. ooud like to know who those folks are so i can can start working with them and the work we do on behalf of the american people. >> secretary, great of you to come on the program. thank you.

>> reporter: right. it just keeps going. this is the news that everybody was asking about yesterday. it was like yesterday we knew, okay, he's awake. he's reacting to family. now today the breathing machine has been removed and he's talking. that's massive. the bills sending out this tweet to show how this is hitting the team letting them know he face timed his taem mates today and told them love you boys. we know how much that means to the team. we saw the press conference with josh allen and the coach yesterday. they were just so emotional having gone through this and seen it happened firsthand. someone else this is really hitting is the bengals. and the wide receiver who hamlin tackled just before he collapsed, untwhing that stuck out to him is yesterday when hamlin was awake and writing on pen and paper, one of the first questions he asked when he regained conscious was who won the game. who would be monday's game.

50 past the hour. we're turning back to the chaos in the house of representatives which is now in its fourth day of trying to elect a speaker. right now house republicans are holding a conference call to review what may be some progress toward a deal that would bring over some of the 20 republicans that have voted against kevin mccarthy. but it appears the agreement would not help mccarthy secure all the votes he needs to secure speaker. with us now, matthew dowd, founder of the group country over party. here's what chris stewart told me yesterday about whether there's a point where kevin mccarthy gives too much away. take a listen. is there anything that kevin mccarthy could give up in these negotiations that would make you give up your support of him? is there a bridge too far? >> there actually is.

and honestly, there's many of us who feel like we're very, very close to that at this point. you're going to begin to lose support of the other 200. kevin, i know is aware of that and i think he's careful not to go beyond that line. >> so, matthew, do you think there's a line? in your mind, has mccarthy already conceded too much? >> well, i watched your interview with him yesterday, i was struck by how pointedly honest he was in the midst of this. i think there's a -- many lines that have gone too far already. we'll see what it matters in the functionality in the house of representatives and being able to govern. the other thing, chris, i was sitting here listening to the show and i'm struck by three things that are happening today almost at the exact same time. one is this incredible dysfunction by the republicans in the house unable to pick a leader. that's going on in the midst of this. today is the anniversary of january 6th where many

republicans enabled what happened on january 6th and didn't hold it accountable, and, three, the president of the united states is holding a ceremony at the white house at noon to give the presidential citizens metal to leaders who defended our democracy in the course of the secretary of state benson, rusty bowers, the republican from arizona, al schmitt who defended our democracy. all of this having simultaneously today on the anniversary, interestingly enough, of the death of teddy roosevelt who said at one point in time, patriotism is not the support of a president, it's the support of your country and it is unpatriotic not to tell the truth about the president or anyone else. all of this is converging at one time. and it actually is incredibly revealing to me where the republican party is today and where we are as a country. >> i think this question, then, might sound a little facetious, but i don't mean it that way,

are you looking for, hoping for, thinking there could be an outbreak of patriotism if this continues to drag on? >> well, i'm glad you asked that because i'm always a hopeful or optimistic person in this and i always think the best comes out of the worst circumstances, listening to your lead in on damar hamlin. that was an awful circumstance, but it looks like what we're seeing is the best of america and god-willing, he continues to recover from this, but it revealed the best of america. maybe in this incredible dysfunction there's a moment in time where we basically have a coalition government that seeds power to each party in some way that's fair and equitable and we get past that. that is my hope. but oftentimes it's at terrible times of chaos and dysfunction and disruption where good comes out. >> i just got a note from ali vitali and one of our producers, and here's what it says.

the conference call apparently with mccarthy and company is ongoing. and she says that mccarthy expressed optimism but made clear he didn't have the votes yet, according to more than six people on the call. i'm not telling you we have an agreement, mccarthy said at one point, we're in good position to have meetings. which means there's no deal that makes mccarthy speaker right now. they keep talking about a deal. it's not a deal unless he becomes speaker. it's not a deal if you one or two or three people, at least, i think in the normal sense of the word. what's your sense of sort of timing and where the breaking point might be? >> well, i think it all depends on kevin mccarthy's ego. i think it completely depends on his ego, and i think he's demonstrated his ego is large enough and bigger than the sake of the country and the sake of the functionality of government in this. and so will at some point in

time enough republican members go to him who actually believe in the idea that government is supposed to work, that we're supposed to work on behalf of the people and go to him and say enough is enough, you've got to go. and then going to the previous conversation we just had, are there six, seven, eight remember members who decide, the american people are more important. we're going to sit down with the democrats and work out a deal to make this thing function and work on the behalf of the american public. right now, standing in the way of all of that is kevin mccarthy's ego. >> well, matthew dowd, we're going to watch it together as it unfolds. thank you for being with me today. we're just about an hour away of day four of votes for house speaker. i'll talk to colin allred about the democrats' strategy while republicans remain in chaos. we'll be right back. we'll be ri.
