to local officials and migrants, as his administration tries to make the case that they are doing a lot to combat the prices, and are prepared to do more. >> i want him to see the extraordinary work of the men and women of the united states border patrol. of customs and border protections field operations. how we have -- addressed a challenge that is not unique to the southern border of the united states. it is a challenge that is a really gripping our entire hemisphere. >> we are also following the drama on capitol hill, kevin mccarthy said to faces first big test as speaker. right away as members continue to dodge just the chaotic fight that got mccarthy the gavel, and what it means moving forward. >> i would argue that exactly have offenders extended -- it >> the function that was historic we saw this week is not at an, and it's just the beginning. >> i will be talking about all of this live with the democratic congresswoman debbie

dingell and ilhan omar. that is ahead. first, we await the presidents arrival, it's also coming at the same time, we're getting a look at new video of -- obtained exclusively by msnbc news. strong border agents and el paso police arresting migrants sleeping on the streets outside a catholic church, serving as a shelter. this video was taken just this past tuesday. nbc's gabe gutierrez is on the ground in el paso this afternoon, for us. gabe, you've seen a lot right now. tell us what you've seen, also, what we might expect from the presidents visit. >> have everett, good afternoon, the president is expected to land in el paso in a short time. he's expected to tour migrant processing facilities as well as a court penitentiary. we're outside of this church, you mentioned the video last, week migrants were arrested this morning, we've seen migrants, some of, them six of them, arrested here outside this church. unclear exactly why, but it was local officials who arrested them. i'm giving you a look at what

the scene looks like right now. you see dozens upon dozens of migrants here, they've been camping out here, for varying amounts of time. many of them are from venezuela and my photojournalist colleague, and his colleague paul, they come here. i want to introduce, you richard, to my producer maria. she just spoke with this group right here. i'm eating them for the first time. but she tells me that they are from venezuela. and we will talk to them very quickly to find out their story. [speaking non-english] richard they say they've been here for eight days. [speaking non-english] they're seeking a better future and to work. [speaking non-english] she knows the president is coming here today. what is your message for president biden? [speaking non-english]

>> richard what they're saying is exactly a response from president biden. this echoes what we've seen throughout the morning. many of these migrants say they have personal messages for president biden. but they want to be seen here, they want -- they feel like the president needs to see what is going on here on the streets of el paso. and earlier, last time on msnbc i spoke with another, 1:25 years old, she came from venezuela, and she had been told that if she were to come with their family, she would be allowed to stay. of course, this goes to what we often see here at the border that these migrants are given misinformation, or perhaps may hear of the information incorrectly. there was a parole program

introduced in october, some of the migrants who are thought that meant they could just come here, but when in fact, they had to apply for asylum before they got to the united states. and, they listen to this information, and thought they could come. so many of them now are waiting to see what happens next. president again expected to land an el paso and local facilities with local officials. biden says the number of unauthorized border crossings has dropped since mid december by 7%. but as you can see there still many migrants here camped out of this church. >> msnbc's gabe gutierrez, thank you for those conversations, we will touch base with you later this hour, when the president does landon el paso. of, course we will get straight to, that if the president doesn't say anything, and as gabe is reporting for us live here on the southern border. now, on tomorrow on the capitol hill, new house beaker kevin mccarthy's leadership will be put to the test as republicans gear up to debate and possibly vote tomorrow in a rules package.

the island which contains several concessions from mccarthy to far-right members as well. msnbc's julie tsirkin on capitol hill for us. taking a bit of a press today on sunday after quite a busy week for yourself. walk us through this all for, mccarthy going to have the votes to push this rose pack through? is that one question. what else can we expect from house republicans this coming week? theoretically it is their first week of work. >> it, is after effectively the third branch of government was shut down last week over that speaker fight that took five days to resolve. kevin mccarthy was actually here yesterday in his casual clothes, touring his new office space. showing family and friends around. and i asked him if he has the votes for the rules package, and he didn't answer. and that's because the margins are so tight, and the fact that we are even talking about burst a speaker rice, and now a rules package, should be indicative of everything you need to know about the next two years. these are basic votes --

votes that any new congress needs to take at the beginning. they are rules by which the body is going to govern itself, republicans now in charge of the house. i want you to take a listen to what moderate member, congresswoman nancy from south carolina, she represents a purple district, what she had to say when asked if she would support the rules package tomorrow. >> what i don't support as a small number of people trying to get a deal done or deals done for themselves in private, in secret, to get a vote or a vote present. i don't support that. that is just what nancy pelosi does. >> at the end of the day, you can't, let you, know the insurgency caucus take hold and dictate. it's gonna be ugly. >> tony gonzales there at the end, he is actually a congressman who represents the el paso area. and his problem with the rules package actually has to do with defense spending. potential cuts happening to that, where a more moderate member has concerns that these backroom deals, she calls them, with those 20 or so members

that were against mccarthy, that she wasn't even able to see those while she supports the underlying rules package itself, which is called the most fiscally responsible in 30 years. let's zoom out a bit. if kevin mccarthy gets the votes for this package, we still has quite a bit of work ahead of him including whether they would be able to pass anything in this chamber, border security any of these bills that they want to get done. it will constantly be a fight in his party, and remember, democrats still control the senate. >> all right, julie tsirkin, thank you so, much there on capitol hill for us. for more, now i want to bring in robert, white house press secretary under obama, who is also an msnbc political analyst. great to see you. and as we look at what is happening, julia's reporting to, us tomorrow's another major question. these rules not fully known by the members that are gonna have to approve, as of this moment, we know. what is next for us here robert? >> well richard, i think what is next is really anybody's guess.

i think we're gonna get used to the storyline not only over the past five, days but maybe the next 5 to 15 months. which is every one of these votes is going to be tricky for new speaker mccarthy to navigate. the organizational power -- process by which congress has to vote on in order to start legislating is just that next step. and i think what we have been focusing on is, how do you get 20 or 21 of the members that are quite frankly more in the freedom caucus, ultraconservative, part of the political spectrum, how do you get them on board? but i think starting tomorrow the speaker is now going to have to deal with a zero report, how do you deal with members in swing districts or more purple congressional districts? like quite frankly, there used to being insulated from having to vote for some of that things like before -- that the freedom of caucus wants to put of front and center of this time. i think it's complicated as 2021 and 2022 were for democrats, with a narrow margin

in the house, and one vote at the senate is going to be quite frankly exponentially more complicated. in the house. in the next two years for kevin mccarthy. >> a lot more popcorn to be popped, certainly, in the next few years. you know, when i look at what you were alluding to, robert, jim mcgovern, right, the congressman, top democrat, on the rules committee, telling locks this quote. the deal is, if they want to get stuff done, they're going to have to work with us. and they're not going to be a cheap date. so that's part of this dysfunction, if this rules package does get passed this week, this is potentially one of those rules and can democrats hero, do you think robert, tempt mccarthy, and his allies to try to have that mixed potentially? potentially in the majority to get these things done. >> we know the makeup of what we think of the world's committee, viewers will understand.

essentially think of it does, that's what governs what gets on the floor, what doesn't get on the floor, the manner in which things get voted on. and so if the freedom caucus decides to withhold its votes on the rules committee then it's going to be democrats and other republicans that are going to have to work together in order for the legislation to go from the rules committee to the florida front of the house as. i think there will be opportunities for democrats to play in an important role. i think of anything is gonna get a middle require some level of bipartisan compromise. which hasn't exactly been an illuminating feature on the freedom caucus in the house side of republicans. >> so for what we know at the moment, concerns about the debt ceiling, also concerns about the pentagon budget, and how that might parse out in the end. what is the opening for moderates on both sides of the aisle right now?

>> yeah, i think the biggest opening is, look, i think if you watch the last election, voters wanted to take the chaos out of the government. they wanted to take the guessing game out of it. they wanted to take the drama out of it. and i think there is a real potential, a slim majority no divided legislative government, and overall government, the process is going to become more filled with drama and much more chaotic. so i do think that the sort of swing districts on each side, republicans and democrats, are going to have an opportunity to try and help forge some pathway through. but it's going to be fascinating to watch, i mean, there's a lot of things that are going to be debated in the house. don't go anywhere, but we know a budget is going to have to be constructed by next fall. the debt ceiling is going to have to get raised. so a lot of things are going to

have to happen that's going to require participation of the house and the senate. and it'll be interesting to watch, defining the political well action to, president biden and house republicans. how does that relationship play out? how day, how did they basically play off of one another, politically? i think it's going to be fascinating to watch as well. >> you said democrats working with republicans that sounds like the old days there robert, in terms of impossibilities. a lot of people watching that very possibility. appreciated. later this hour, i'll be joined by congresswoman debbie dingell, talking about the speakership, and what might be next in terms of those questions. in the next level speak to congresswoman ilhan omar. congresswoman's already put this into motion, stripping her from all committee assignments.

it's continuing to improve, posting this picture from his hospital bed just moments ago. great to see him. let's bring in msnbc's kathy park, outside the medical center in cincinnati, where hamlin is recovering. so many fans as we look into this, copy, we look at the picture, we see that he is taking taken off intubation. which is a big deal. what's the latest of his condition? and the latest on his bills teammates today? >> yeah, he richard, great to be with you. damar hamlin, he is recovering and improving each and every day. you mentioned he's off the breathing tube, he's able to communicate with family, friends, as well as his teammates. he's been very active in the past 24 hours. obviously expressing his gratitude for the ongoing support, literally from all across the country, he showed that picture there on his hospital bed surrounded by family members.

so he certainly is in good spirits, but i can tell you his teammates are certainly rallying around tomorrow right now. just a few moments ago, at kickoff, we saw each of the players wearing his number three on their jerseys. they're honoring him that way. also, they played tribute to him before the game as well. meanwhile, here in cincinnati, they stand to show their support for damar in their own way. take a listen. >> our area code is 513, and so of course, hamlin's number is three so we are supporting him in those colors for the bills. and since he had a quick turnaround for this awesome design, with a simple message, -- >> my brothers and i bought these hats, and we wanted to show we are still supporting the bangles, but we are supporting tomorrow. we're supporting the bill. as you know? we are supporting people. and having fun. and i think that's why there's this outpouring of support.

not >> now, richard it's been nearly a week since that traumatic experience that we all kind of experienced on live television, monday night. we all kind of know, or want to know, wind more might be released from the hospital. that still is the big question. but based on his social media post, any updates that we continue to get used to from the hospital, it seems like they're looking up? meanwhile there's a fence right in front of me and there's an outpouring of support. we see signs, balloons, people just coming by from literally all across -- they want to show their support for the recovery, i want to show you the bangles fan, there with that t-shirt, we got a hold of one of those right here. 513 is the area code here in cincinnati. obviously that meshes with the buffalo bills, in honor of damar. it seems like cincinnati as well as the buffalo bills are able to put football aside and

jordan this morning, putting a spin on that very incident, near physical confrontation on the house floor. as mike from alabama launched at matt gates. and there could be more to fight about, as republicans gear up to hold a big debate on the house rules package. that's on monday. let's talk about this and more, congresswoman debbie dingell, -- representative from michigan. great to see you right now. we've seen that video over and over again. democrats repeatedly throughout all of these votes stood together arm and arm, now as you move to monday, assuming that somehow a rules package gets passed, what do you think the opportunity is for you and other democrats are to work with republicans here? understanding that they are not altogether at the moment. >> well, good afternoon, happy new year, and it's good to see you. you, know democrats really were united when we came to the

floor, prepared to work. friday night had been a long, long week, and it's not good -- seeing people that intense and close to that kind of anger. i think we're gonna have more folks -- fights this week as we go through the rules package. we don't know the deals that kevin mccarthy cut behind closed doors, we're gonna get those both done friday night. but what we even know about the rules package, from across -- republicans, they're concerned about what happened in the world, packaged on the bills that they want to immediately vote upon, on the floor, without any committee duration. one of the first launches one of the major issues that played out in the elective. and it would criminalize -- with no exception. even donald trump himself has said many of the republican candidates lost because they did not report any exceptions. and there are a number of other bills are going to try to get through, without any iterations,

-- >> if it doesn't play well the republicans as they try to get stuff done, as they need to, debt ceiling as i mentioned earlier, pentagon budget which will certainly not necessarily fit well, if they don't pass that 75 billion penalty and not, excuse, me apply that 75 billion -- that could be very costly, politically, for the party at the moment. what do you think will be the next issue that gets you back to what you were experiencing last week. because we're that close, right and if you want to understand what's in this rules package, any disagreement, you know, the rules committee, are throughout the process, we could be right back with kevin mccarthy, being put in question. >> well, with regard to the rules package, they've gone back on was one member -- >> right -- >> which is very dangerous when speaker pelosi was there, we change the rules, and the majority of the caucus had to support wanting to make changes

to the speakership. that's why you see paul ryan and jon bader not appreciate -- being speaker because you could never pull together. one that i'm the most board by, i think i believe in what jim jordan said. democracy [inaudible] i think that's very important. it's a party, it's a party. i want to do that. i want to work with republicans i've already talked to them about a number of issues, and there could -- there should be accountability at the pentagon, or any place that we are sitting spending money. but playing games with the debt dealing is playing games with our economy, our country, our national security, and our economic security. and they've made it clear that they are, and that is dangerous. >> so representative, you're saying that you can actually see some bills being passed what they notable number of democrats and are republicans working together across the aisle, to get a bill passed? >> i think there are a number of issues like continuing to

work on lowering prescription drugs, i'm concerned about long term care for the elderly, it's a crisis, it's not a republican or a democratic issue. hubert [inaudible] and of the year with liz cheney. there's a lot of issues that all of, us they're not as political in some of the ones that everybody is talking about. and i've talked to the chair of, the new chair of the energy commerce committee. and i've been friends with her for a long time. and i think there are things that people, can try to work together on, and we have to see -- freedom caucus, blowing it up on the floor, or recognizing that the american people are concerned about a number of, issues and wanna see things get done. >> representative, i know we're just getting out of the past election, we are barely into the new congress, but why not ask you this. the next election, are you considering now, that we understand longtime democratic senator debbie stabenow is

retiring, and political reporting that you are seriously considering a run. marie and they're familiar with the thinking. are you gonna do? a >> lot, this is the -- i'm committed to making when you don't lose that seat. that's a democratic seat. i've had a lot of people call and asked me to consider. it's why haven't said no. but i'm getting the data, the research, talking to everybody and we are going to make sure we don't lose at sea. and that's not the one thing that i'm committed to which is why, like everybody, we've gotta figure out who the strongest candidate is. and get behind them and make sure they would. >> so when are you gonna make your decision? what date? >> i'm gonna not give you -- those are false deadlines. and people are all pushing. and i think people have gotten out there early, have a lot of people shooting at them already. and, look, i'm very committed to getting the research done, talking to people, and i have said to a number of people i won't say know yet. >> you know i had to ask.

>> and i don't have to answer it. >> that's exactly right. lower right hand corner of your screen if you're watching as well with us representative, we've been following air force one, the president going down to the border, el paso texas, we've had our gabe gutierrez reporting on migrants there. some being arrested. tell us your thoughts about where you think the president might be moving in terms of immigration and what this means for the new republican congress if they're answering to that. >> you know what i'm gonna tell you? i'm gonna tell you that we have needed not republicans and democratic presidents, republican and democratic congresses comprehensive immigration. the republicans that they want to do something about the border, democrats want to do something about the border, we're not gonna get it done if we don't work together. i think it's going to be very hard. i'm not gonna sit here and tell you that we're gonna be able to get it done.

could be one of the first movement by this president, to give a head nod, that's an issue important to the white house. >> yes, richard, and comprehensive immigration reform, many immigration in both parties for decades, we're looking at those live pictures of biden about to step off air force one. his first trip here to the border has president, has you no record, republicans criticize this administration for not, in their view, taking this humanitarian crisis seriously enough. this is his first trip to the border. and we're here outside of sacred heart church. a church here in el paso where migrants have been camping out here for quite some time. and we're seeing the president right there getting off air force one. he's expected to tour a migrant processing facility as well as a port of entry. it's hard to see texas governor

greg abbott, there's some glare on the monitor, i'm looking at right now, but those live pictures, president biden significance of this, this is something that his administration says they're working on now. within the last month or so, in december, el paso officials saying they seem up to 2500 migrants a day. coming into this area white house now says that has dropped. 70% since mid december. last week, they hope it will continue this drop. now mexico has agreed to accept tens of thousands of migrants from nicaragua, haiti, and venezuela, that will be expelled back into mexico. that will discourage some of

the migrants here, in the u.s., but at the same time, the u.s. plans to take up to 35,000 -- if those migrants to go through the process, applying for asylum. here inside the church they're seeing here, dozens of migrants have been here, this is something that we've seen throughout the morning. there are six -- last week, there were some federal officials, critics have said, local officials may have been trying to sanitize the presidents trip here. they would get to see the confusion amongst local officials here. again, migrants crossing how dropped in the last few weeks, that's what they're trying to highlight. they're taking this seriously, and are setting aside money

from the infrastructure law to make a more robust immigration system. i want to play as we keep up this live picture, i spoke with the local officials here that had a direct message from the government she spoke to me earlier about what she wanted to tell president biden. take a listen. >> i think they have done zero things to prevent this. i think they are trying to cover bullet wounds with band-aids. by sending fema down there. i'm happy that he's coming but i hope that he comes and he sees this part of el paso. not just the rest of the community, but this part, and really talks to people in el paso. because the citizens of el paso are ones that elected him and i hope they're able to tell him that this is not normal. >> that's a former city councilman we spoke with earlier today. live pictures, landing in a

border, you heard what gabe was reporting to, us which we've also heard from the immigration community. where is the president? the president is now arriving. but try to answer, first of all, for us, where has been the president to answer those critics questions. >> richard, great to be back with, you thank you for all of you are spotlighting up this really important issue. for me, it warms my heart to see air force one landing in my hometown of el paso. you see the beautiful franklin mountains behind the jet there and the president has been focused on this literally from the first day of his administration. who introduced the bill the first day calling for comprehensive immigration reform. and what we've seen since the term that bill was introduced is almost no activity from the republican party, in any meaningful way, to try to get that done. so time and time again the administration has had to use executive action, or agency action to deal with this issue.

and the massive influx of migrants that we are seeing, in el paso, the part breaks your heart when you see it. and it's a problem because in years proceeding biden's administration you have donald trump, who really gutted those agencies. and rolled back some of the work that was happening. in central america to support those governments. and that is part of the reason why we have this massive influx, coming in now. i'll also say as you saw those pictures there, coming out of air force one, he's got the congressional delegation, he's got congresswoman escobar from el paso, as well as some, other members with them. followed by secretary mayorkas. marcus has been there many times, the vice president has been there and others so there has been a laser focus on it. unfortunately, the supreme court has lifted title 42. republicans of sued. we also saw greg abbott there a moment ago. greg abbott has used this unfortunately as a political stunt.

different ends of the political spectrum. he will call in advance. they will ask for protocol from the governor to be there,. and other leaders. and i will tell you that it is a little bit, it's a weird juxtaposition where you have the president of the united states, who has worked so hard with this administration to solve the problem and pass immigration reform to protect dreamers and rush resources to the border and on the other side you have a governor who quite frankly is using stunts to -- for his own presidential ambition. i imagine it was somewhat of an awkward engagement. but that's what happens when you land in a place like that. >> we're just watching the video again and it appears the president did receive more than one piece of paper and was looking through it in the brief moments he had with the governor there. what can be done now? i was just reflecting with the

stories we're following. information in the murders of the four idaho university students. enough at a bit released ahead of the suspect's first hearing and idaho. police say phone records show the suspect cell phone was in the area of the murder scene in the morning following the crime. brian kohberger made his first court appearance since being extradited to state on thursday, what the judge ordered him to be held without bail. he's been charged with four counts of first degree murder and burglary. hundreds of thousands of californians woke up this morning without power in their homes after torrential downpours, and high winds. battering the northern part of the state, the national weather service is warning of relentless parades of cyclones in the coming days. a rare word to be heard in that part of the state. a flood watch has been issued for a large loss of northern and central california. three people are hospitalized after a two seater plane made an emergency landing on a highway near las vegas. police say mechanical issues forced the highway landing.

he did the same a year ago when we had the first anniversary and i think he wants to assure the public one of the things the justice department's policy manual says is you ordinarily should not eat their conform nor deny the existence of an investigation because it might put people under a shadow of skepticism. but there is an exception to that will, what necessary, to assure the public, the public is aware that there has been some sort of serious crime. you must assure them that the justice department is on the job and looking into it. i think that is why he uses that anniversary to remind the public, that there is -- there still on the job, and no doubt he has said before, they're looking into everyone responsible, and that has to include people who are not at the capital on january 6th. who may have been involved in the planning. >> and with that, inconsistent with that very thought, barbara, there's reporting that special counsel jack smith has added to longtime associate to specialize in public corruption cases. what have you heard about that? and what do you make of it?

>> yeah. i think this is a good addition. certainly he inherited some of the people who are already working on those cases which. makes a lot of sense. you don't want to disrupt things and start over with a fresh new team. but no doubt to worked in public corruption. he was the head of the public integrity section for many years. and one of the prosecutors comes out of that section. so no doubt he's got people he's worked with. he knows to be good prosecutors. he knows to be reliable, hard workers, and you want to add those people to his team. i think public irruption is the right way to frame. this because even though you might be using -- looking at things like inciting an insurrection, which robert rarely charged, this case really is about public corruption. people in positions of power who abuse that power, to advance their own personal agendas. and so, i think prosecutors who have had that kind of work understand the complexities, the defenses, and also the extreme public pressure that is likely to come from a defendant when they're charged. how to tune out that noise, and navigate the media space as well as the case itself.

>> you know, barbara, we don't have a series of hard targets on the timeline necessarily, but if there were to be one that you are kind of just watching and you're feeling what is next do you think that you would suggest folks to watch on a timetable to this investigation? >> one thing i would expect to see richard's very soon, i would expect to see charges against some of the lower level people that the justice department might want to flip. so people that may be in the inner circle, or on the next ring. people like ken klukowski, some of these names that have come up, during the 26th hearing. kenneth she's burrow. people affiliated with john eastman or jeffrey clark, in an effort to work your way up the chain. in terms of a timeframe, i think we need to see something in the first quarter of 2023. and maybe the ultimate charges by the first half of this year. that is because of looking at the other end. there's gonna be a new administration in january 2020.

five that could bring with it a president trump or a president from some other member of republican party. that person would then have the power to shut down this investigation. so i think you need to make sure this case is charged. and well on its way to trial before we get to that point. and i think that means charging this case before if there are charges to be made before the middle part of this year. >> middle part of this year. and what also comes to mind immediately is, the presidential elections. starting how early, and how long you have to calculate these especially coming from merrick garland, what he's doing, and how he telegraph city. how do you put that into the timeline? does that mean by the end of this year? really gonna make major steps, and what might those major steps be? >> i think if you're gonna charge this case, it's gotta come this year. and i think that charges even by many, are certainly the justice department has those elections here, the policy, you that says ordinarily, pop -- prosecutors should not take steps for the purpose of influencing any election. they read that probably to
