operate, a rules package. he's facing a major test from some in his party who are not happy with what he gave away. the latest from capitol hill in moments. president biden at the border not far from where migrants crossing into our country have been forced to sleep out in the streets. it's his first visit to the border since taking office as president. he's facing pressure from all sides to address an issue that congress has failed to deal with for two decades. >> i want him to do something about it finally for sure. i want to not just empty promises, i want him to actually do something. . >> is there any chance that lawmakers can find common ground to fix this growing humanitarian crisis. echoes of january 6th in brazil. more than 400 people have been arrested after supporters of former president jair bolsonaro stormed that country's congress. how bolsonaro who is in florida is reacting.

and more extreme weather out west. tens of millions of people bracing for heavy rain and more catastrophic flooding. it's on top of the storms that have already swept through the state leaving 100,000 people without power. more on that ahead. ♪♪ we start with the house getting back to business this afternoon and republicans looking at a big agenda now that they are in charge. ryan nobles is on capitol hill outside a steering committee meeting. also with me, jake sherman, brendan buck and steve israel of new york. he's now director of the cornell constitute of politics and global affairs.

rules packages typically get no attention in congress, but here we are. so why is this being mentioned and what's in this package? >> reporter: it is a lot different this time around, jose, in part because in order to win over the right wing of the republican party and the house of representatives, kevin mccarthy was forced to make a lot of concessions, many of which are going to be part of this rules package that's voted on later today. the most obvious example being this provision that would allow any member of congress to call for a vote to remove the speaker of the house and obviously with something that was mccarthy initially was not in favor of but then was kind of worn down by these consecutives and it's going to be adopted as part of the rules package tonight. a lot of other concessions that mccarthy made are being worked out in the steering committee meetings which is happening just down the hall from where i am right now. this is where they're going to feel out some of the key committees to some of the people

that were both mccarthy allies and potentially mccarthy opponents. you're 100% right. in general, these rules packages are just something they do to begin the work of the house. it is going to be a little bit different this time around. it's expected to pass, but there are already some moderates who are complaining about the concessions that mccarthy made, likely not enough to prevent the rules package from being passed, but this could be an example of what every single debate is going to be like going forward. we're always going to be counting the votes because the margin between republicans and democrats are so small in the house of representatives. >> punch bowl reports that moderate republicans feel like they need to stand up to gop leadership's catering to conservatives now or else they'll get steamrolled for the next two years. what are you hearing about that? >> yeah, i think that's the case. we wrote it, so i hope it's the

case. listen, there's a sense against republicans that they need to make a point. i think the leadership is arguing that this is not the time to make a point. if they don't get this rules package passed, mccarthy's speakership is in doubt and they can't begin the work of the house of representatives. i think they're going to pass this. this is going to be one of the big reoccurring themes in the house republican majority whether moderates are going to take a stand on issues whether they don't agree with conservatives on, abortion, immigration policy, the debt ceiling. all of this is going to be the subject of hot debate in republican circles for the next two years. >> i'm just wondering, this is something that you, of course, dealt with in your past. with republicans angling to vote on bills that will tighten abortion restrictions, potential defense spending cuts, as well as slashes to social programs. how do you think that these

issues are going to be dealt with both in the conference and throughout our country in this new era? >> yeah, jake makes a good point about moderates wanting to stand up for themselves and rarely doing so. i think you're going to see this congress start off with aggressive action. one of the things i'm concerned about is not necessarily what's in this rules package, i am concerned about that. it's some of the promises that kevin mccarthy had to make that go beyond what's in the rules. things that have to do with cutting spending, the debt limit, these are things that he's not just necessarily promising. he seems to be promising -- he's talking about huge dramatic cuts to spending. he's talking about a way that they're going to address the debt limit where i don't think they have the votes to do that in the house let alone get through the senate and through the white house. so i'm just wondering, what happens at that point? and i don't want -- some of these deals are a little ambiguous. they're handshake agreements. he seems to be promising he's

going to be able to accomplish some really aggressive things on the fiscal front and i don't know if these were promises that will try to run them through the house or get them into law. he's made promises that he's going to get some of these things into law, he's going to be in big trouble. there's almost no chance any of this stuff is going to get through the senate, let alone the house. i'm curious to see how that plays out going forward. a lot of big promises made. the ability to deliver on them is certainly in question. >> and the "new york times" notes restoring any semblance of order and structure to the consideration of spending bills will prove to be extremely difficult with conservative republicans in charge of the house and democrats controlling the senate and the white house. the new dynamic is more likely a prescription for shutdown or gridlock. the roots of dysfunction run deep, quote, the "new york times." what are the raw politics that house democrats can tap into now that they're in the minority?

>> first of all, let's understand that this is not a rules package. that is a summary of a hostage note. this is a list of concessions that kevin mccarthy had to make to liberate himself and become speaker. the minority does have tools, but it's -- you know, i was in the majority, i was in the minority. i was in the leadership. those cools will be wielded effectively by hakeem jeffries but it's not -- it false to the republicans to govern. after the election, we knew we had divided government. it's not only divided, but the republican caucus is divided between moderates and extremists. which means every time that kevin mccarthy has a slim vote, he's not only on a highwire, he's on a highwire with a grenade with a pin pulled out. even when we were in the minority, john boehner or paul ryan would call leader pelosi

and say, hey, we have a problem we need some votes. i'm not sure that kevin mccarthy is willing to allow those tools to allow the democratic caucus to help him govern because it would be so costly with his own base and conference. >> isn't that precisely what john boehner and paul ryan dealt with? their hands were tied in many ways by those differences. >> their hands were tied. and i would sit with leader pelosi where they would make calls on things like the debt ceiling or shutdowns and say, we're with you. we have a problem. we don't have the votes. we can't get to 218. and nancy pelosi's former was very simple, x plus y equals 218. you give me the votes, i'll add

the y and we'll get to 218. hakeem jeffries is ready to do that. he can do that. the question is, is kevin mccarthy ready and willing to do that? >> yeah, and i mean, house republicans are preparing a broad inquiry into the fbi. how could this go over with a large swath of americans, the fbi thing and other security institutions? >> they're going to have a hard time legislating. there's a lot of things that republicans want to do through bills that they're not going to be able to do. kevin mccarthy needs a release valve. he's going to have to compromise. despite what a lot of the numbers think that you never have to compromise, he's going to have to compromise. he's going to have to fold on some of these issues where they think they can get deep conservative outcomes. it's not going to happen. he doesn't have a lot of ability

to rein in these investigations. he's going to give the committee chairman a lot of leash to do whatever they want. this is where republicans have always overreached and joe biden, i think, is going to have a real opportunity to use it to his advantage. the american people are not interested in some of these crazy conspiracies about how the deep state is targeting republicans. but the conservative ecosystem talks about this so much, they have to answer. i don't think that mccarthy has an option to go down this road, but it creates a problem for him politically and joe biden will be the benefactor of it. >> thank you very much for being with us this morning. and we're following some breaking news in georgia. the fulton county grand jury investigating donald trump and others have completed its work. that according to a new filing obtained by nbc and first

reported by "the atlanta journal-constitution." blayne alexander joins me now by phone. good morning. what do we know? >> we know that after eight months, more than eight months of work, this special purpose grand jury has been dissolved. they wrote a report and submitted it. it's been approved by a panel of judges and now it's going to the next phase which means that report is officially going to go into the hands of the district attorney here in fulton county to determine the next steps. i think it's important, we've reported on this extensively over the past eight months that this jury has been in place. let's talk about what this report is, though. this is not a determination of who will be indicted or who will not. this body has subpoena power to investigate. the report now goes into the hands of the da and she will be the one to essentially determine what if any indictments are brought and what she will bring

before the regular grand jury in the months to come. that's the next phase. the biggest question, though, is what is in this report, how long is it? we know that over the course of eight months or so the more than two dozen members of the special grand jury heard from a number of witnesses, the governor of georgia, the attorney general here in the state, people who were very close in former president trump's inner circle, including senator lindsey graham, including rudy giuliani and a number of people who were very close with the former president. the big question is, what will come of that report? there's going to be a hearing on january 24th to determine whether or not that report will actually be made public in its entirety, in part, so that really people who have been watching this closely will kind of learn what happened behind closed doors, what did the special grand jury find out from hours and hours of questioning under oath that would likely inform the da as she goes forward and determines what if any indictments to bring in

this morning, president biden is in mexico city facing a slate of events with his fellow north american leaders and a major topic is certain to be the immigration and the humanitarian crisis at the u.s. and mexico border. biden made his first visit to the border as president yesterday. he's facing some criticism for not meeting with migrants. he's faced criticism from republicans for not visiting the border sooner.

monica alba is traveling with the president in mexico city. we're joined by former president of the latino victory project, former senior adviser to the biden campaign and an msnbc political contributor. what's on the president's agenda today? >> reporter: jose, first off, the president will be meeting with his mexican counterpart president obrador and the two will have a lot to discuss. at the top of the list likely, what president biden saw for himself for the first time up close as president yesterday when he was in el paso, he, of course, wanted to go in the words of the white house to assess the situation, to encounter what he has been described to by all of his aides as this major humanitarian crisis and a problem really that he has talked about in these terms of inheriting but, of course, wanting to do something more to solve it. so president biden will be talking about how mexico is

helping with this issue in terms of some of the migrants who are now going to be expelled back to this country when they reach the u.s. border, but also some new pathways for migrants from those countries, cuba, haiti, nicaragua and venezuela which is where you're seeing more of the migration some from. a couple of years ago, that wasn't the case. it was more from mexico and the northern triangle. as we've seen this very important shift, the president will be talking about how they can improve that and the context and backdrop to all of that, this isn't just a major migration challenge, but there's also a human trafficking element, a drug trafficking element. fentanyl will be on the agenda when these leaders speak today. they will be talking for an extended amount of time this evening before then heading to a dinner with the canadian prime minister justin trudeau and the three amigos as they're sometimes called will get

together and talk about all of the issues that are confronting all of north america before having the summit where they will discuss many of these incredibly difficult and complicated topics in addition to things like climate change, like an energy policy, mexico really wants the united states' help when it comes to a major solar project that's closer to the southern border. that's something he's going to be asking president biden for help with as well as a potential counter trafficking program. >> can you put into perspective and context how important this trip is for the president. >> thank you for having me. it's good to see you. it's important from a policy perspective. this is the first visit to mexico by a united states president in nine years. you talk about the surging trade between the u.s., mexico and

canada but also migration. seeing air force one land in el paso, texas, what a critically important visit that was for the city, the reason and for the president to see firsthand what's happening on the border. this has been a priority from the president from day one on his very first day in office. he introduced a bill seeking immigration reform. they've been hyperfocused on this for some time. contrast that with what you're seeing on the screen. greg abbott has been using these moments as a political stunt versus what the administration is doing, really trying to build regional stability in the region, to address irregular migration and address it here at home. on that point, jose, just minutes ago, the three leaders issued a joint statement condemning the january attacks on brazil's democracy. you've been reporting on that. they condemned those attacks saying they stand with brazil as it looks to safeguard its

democracy. those are the sorts of things that are going to come up in these critical conversations. and the last point here is the manifest that is with the president. you have secretary blinken, secretary romando. you have secretary mayorkas. so high-level meetings. >> using your political expertise, you have such profound knowledge of this, the white house dismissed calls to visit the border by saying it would be a political stunt. when is it a political stunt and when is it not a political stunt? >> i would say when you're going to actually get some work done which is what we're seeing now. think about this. you've got migrants who are at the border, many traveling for their lives. i don't want to lose the humanity here. our country is a very welcoming

country. the inscription on the statue of liberty means something. when jill biden visited to the border, she crossed the border and fed immigrants christmas dinner. versus taking migrants and put them on a bus and dropped them in front of the vice president's house in 18 degree weather. that's a stunt. >> do you think he should have met with migrants there in el paso? >> he's met with migrants many times. and i've had the great pleasure of think -- >> do you think he should have done it now? >> i can't speak for him now. i no longer work for the president. his staff that are with him including very senior staff are from the border region. there's a deep and profound understanding of the situation that migrants are undertaking because of the experience of the folks around him. including secretary mayorkas there. his family are refugees

themselves from cuba. and he -- i will tell you, under the obama/biden administration is the one who was driving the daca protections for dreamers. this is a staff and leadership that cares so much about. >> thank you for being with us this morning. and we're just talking about this, brazil's president lula da silva met with his cabinet just hours after it and other government buildings were attacked by thousands of supporters of the country's former president, jair bolsonaro. it was a scene reminiscent of january 6th in washington. so far, more than 400 people have been arrested, more than 1,400 people are being detained. overnight bolsonaro tweeted that invasions of public buildings are outside the law. bolsonaro has in the past been accused of fueling election misinformation after his election loss last year. guad venegas joins us from miami outside the brazil consulate

there with more on the fallout. good morning. >> reporter: good morning, jose. so as you mention, hundreds have been arrested. we're following reports out of brazil. we know that the supreme court ordered the military to dismantle any protest in favor of bolsonaro across brazil so there's a lot happening. the president has indicated that they have control of brazil, they have control of the capital. a lot of the images we're seeing is from yesterday when thousands arrived. they broke into the presidential palace, the congress building as well as the supreme court building and, you know, this -- the riots that happened yesterday, the protesting, all of it could be something difficult for lula da silva to deal with because bolsonaro, the former president, had left brazil before that transition of power and a lot of his followers have been upset. but today, there's response from the international community, leaders from across the world are showing their support for

lula da silva as moments ago you mentioned now there's a statement, a joint statement coming from all the north american leaders, president joe biden, president obrador from mexico, and justin trudeau from canada issued a statement showing their support calling this an attack on democracy, and indicating that they look forward to working with lula da silva, the new president of brazil. something which is very important. lula da silva had been sworn in on january 1st. they're in the initial stages of their government. this is good news for him for his government, to have that support coming from the international community. meanwhile, jair bolsonaro had appeared on videos, jose, here in florida, videos on social media shows him taking videos with supporters in the orlando area. that's the last we know of him. he did issue statements through twitter saying that he did not agree with breaking into government buildings. somewhat of an ambiguous

determine what, if any, portion of the completed report will be made public. we reached out to the fulton county da as well as other offices. they're not commenting yet. former president trump has referred to this before as, quote, a witch-hunt. joining us now is lisa rubin. good morning. we're likely not to know anything until the january 24th hearing. grand juries are not authorized to issue indictments. explain the next steps. >> jose, "the atlanta journal-constitution" did a great job last week of laying it out. the special grand jury that was convened here did not have the power to indict. what it had the power to do was investigate and issue a report. and last week we thought that the grand jury was in the process of wrapping its work up. that a report was still weeks in the making, perhaps. what we know today is that

report has been issued and shared with the chief judge of fulton county and many of his colleagues. and they have now dissolved the grand jury. the grand jury has done its work to its satisfaction, and the next steps are twofold. one, for the judge to decide whether that report should be made available to the public, and, two, and more importantly, for fulton county district attorney to determine whether she is going to proceed to an indictment by convening an ordinary grand jury, jose. >> talk to me about that. what legal weight does a grand jury report carry with it? >> so this is a really special circumstance and i hate to use the word special too much. but in georgia, there's a mechanism for a special grand jury to do basically a deeper, more widespread investigation than would ordinarily be done. that grand jury by statute has

the power to issue a report with recommendations in it and those recommendations should weigh fairly heavily on the fulton county district attorney's office. but it is not a grand jury that has the capacity to indict itself. what the fulton county da can do with that report, though, is use it as support for proceeding to an indictment. and, jose, as you might know, last week, former president trump sort of went on the offensive against about ruby freeman who was awarded the presidential citizens award last week. she was an election worker who was wrongly accused of tampering ballots. one of the things that might have been going on, president trump might have understand that the report was issued, that the fulton county special grand jury had completed its work and he might understand something about those recommendations that isn't yet understood by us, the

public. >> lisa rubin, thank you so much. really interesting. appreciate it. 32 million people on the west coast are facing some sort of flood watch or warning right now. the national weather service, warns california is in the path of a relentless parade of sigh cyclones to come this week. over the weekend, strong wind knocked over trees and power lines and in some places leaving more than 100,000 people without power in the state. marissa para is in central california with the latest. >> reporter: the wind and the rain has been relentless. i want to show you why that matters. take a look at this, it doesn't look very much like a beach right now. if you pan over here, this is a sea of debris and needless to say, this is not what this normally looks like. what you have to remember is that this is all washed up from the last storm, this has been a place that has just been pummelled by rain over the last

week. we talked about the bomb cyclone last week and i want to show you some of the residual damage from that. take a look. these are restaurants here, these are popular for people who live here, for tourists. when you look over here, obviously it is now sectioned off. what you cannot see on the other side of where this fencing is is broken windows, broken glass. the waves were so high, the water was at such a high level that logs and trees were being thrown into the businesses. so obviously those have now been closed off. if you look further out in the distance, we know that we've shown you this before. this is a big, big sign of how strong those winds and waves were. look at the peer, the wharf over there, just cut right down the middle, washed away. that big chunk of it. so when we're talking about the damage, the impact of the rain that we're continuing to get, that is on top of what we've already seen. so when we look at this debris, this isn't just here. this is in a lot of part of

santa cruz mountains. when you have creeks, when you have rivers that are cresting and overflowing, you're going to have pressure points when you have dams, makeshift dams that are being formed as a result of debris just like this. so, jose, we understand that president biden has approved the emergency declaration for the state of california. we also understand that parts of california, like the county that we are in, are under evacuation warnings. this is not a place that has an evacuation order just yet, but there are evacuation orders happening around places like rivers that are already cresting. something that's very concerning for people here, particularly emergency officials, is those rivers are rising at rates much faster than they expected. jose, we're expecting more rain on the way on top of all the winds, toppling down more trees, on top of the fact that this soil is not used to this type of rain. it is very vulnerable right now. so there is the concern of

mudslides which we already know has shutdown several highways around here. this is really expected to get worse before it gets better. >> thank you so much. a virginia elementary school will remain closed this week after a shocking shooting inside a classroom. police say a 6-year-old student shot and injured his first grade teacher last friday. they say it was not an accidental shooting. the teacher is in serious condition this hour, stable condition, but serious, according to authorities. catie beck is in newport news, virginia. what other details have we learned about this. this is a 6-year-old child. >> reporter: it's shocking, jose. and the details are still illusive at this point. there are still a lot of unanswered questions when it comes to how the 6-year-old got a firearm, how he knew how to use it, and what was the altercation that led to this shooting with the teacher. those are questions that we have

not had city officials or school officials answer yet. we're hoping to get more information later this afternoon potentially at a press conference around 4:00. so we will stay tuned for that and see what details emerge. there's a great deal of shock and sadness in this community about how this happened and the impact it's going to have on the students that were in the school test. we actually just witnessed a parent, grandparent, pastor group of folks meeting here on the school playground. they were having a prayer group to sort of pray for those students impacted widely by what has happened. not just the one student involved, but also the students that were in the school, in the classroom, were in hiding during this time. these are young kids, elementary school kids and the peers of a first grader who witnessed this violence. and the pastor we spoke to said this is a darkness and this is a violence that they shouldn't have exposure too yet. this is something they shouldn't be dealing with. they shouldn't have to

what do we know about his condition this morning? >> hi, jose. no matter what team you are rooting for, football fans near and far are all rooting for damar hamlin and his for his speedy recovery. and doctors are saying that each and every day he's showing progress. he's off that breathing tube. he's able to communicate, talk to family and friends. as you mentioned, we should be getting an update on his condition. but in the last 24 hours, it appears he's been very active on social media. live tweeting during the bills game yesterday afternoon and it was an incredible game. he's also showing his appreciation and gratitude for the outpouring of support that he's receiving all across the country. and we've been planted here in front of the medical center for a couple of days now. here in cincinnati, i can tell you that the love, you can see it and feel it all across the city. yesterday ahead of the bengals/ravens matchup, we had a

>> reporter: good morning, jose. this is a new york federal reserves monthly survey out for december. it showed that the one-year inflation outlook declined to 5%. down from the previous month and representing the lowest level in a year and a half. you saw household spending expectations tumble a full percentage point to 5.9%, the lowest level in just over a year. keep in mind, consumers still expect gas prices to rise 4% over next year, they expect food to jump 7.5%. but even those figures, all of these numbers, they represent a slowing rate of increases. now why an outlook like this matters? consumers, such a big part of the economy, consumer spending, but economists will tell you that the expectations for inflation factor heavily into its future trajectory because it is something that influences the behavior of companies when they're thinking about raising prices and thus influences workers who might be looking to do things like go out on strike

mount sinai in manhattan. others reached deals. some as late as yesterday afternoon. vaughn hilliard joins us from new york with more on how the hospitals are handling this. vaughn, good morning. >> reporter: good morning, jose. negotiations broke down in the middle of the morning. these are two prominent hospitals. this is the crosshairs of when you are talking about workers, nurses in this particular situation in the aftermath of the pandemic. the nurses association is making the case that no longer is this a time for, in their words, applause for being pandemic heroes, but now it's a time for a fair contract. those negotiations broke down here and you are looking at about 7,000 potential nurses who are not going into these two hospital facilities today. of course, there is the implications of what this means for the care. the ambulances are being rerouted to other hospitals in the city. elective procedures have been

canceled here. the city mayor is now saying he is looking for not only private and public agencies to try to backfill the care. listen to gisele rodriguez, one new mother here at the hospital who actually switched medical facilities. take a listen. >> it's been hard because it's not, you know, of course, i'm focused on her and her well being, but also healing after going through major surgery myself. all the nurses that were taking care of her did exceptional work, they were amazing. i just feel that the lack of communication and transparency being a new mom is really, like, unsettling. >> reporter: jose, the nurses are making the case this is not just about pay, but the well being of those very patients inside of these medical facilities. i was talking with a nurse here who has been a nurse in new york city for 41 years. she said this morning is the first time she has ever gone on
