i'm chris jansing live at msnbc headquarters in new york city. house republicans finally get their chance to be in charge, but the majority and new speaker kevin mccarthy will be tested right out of the gate. the latest on the rules package and the secret deals that could derail the new majority before it even gets started. plus fulton county grand jury investigating former president

trump has wrapped up its work. and delivered its final report to a judge. so what happens now? and when will we learn if any charges will be filed? we have a live report for you in a minute. and latest on prince harry, his new claims about his fight with his brother, his relationship with his father, the latest in a seemingly never ending parade of bombshells he is dropping on the royal family. but we start in the house where republicans are hoping to put the extraordinary spectacle of the drawn out speaker fight behind them and get to work. but the very first order of business which is voting on what is known as the rules package could track can chur the party all over again. that is because it includes several pages of secret deals that kevin mccarthy cut with far right republicans in order to get the job of speaker in the first place. and we won't find out until tonight whether all of the rest of the republican rank and file are on board. one republican tony gonzalez has

already said he will not vote for the package tonight. >> this rules package vote is not just about the rules. it is what is next week look like, what does next month look like. and i do being that there is an opportunity in the house for rank and file members to lead. the american public are counting on house republicans to be the one savior. if we can't get it right, it will be a nightmare after nightmare. >> and i want to bring in capitol hill correspondent ryan nobles. david jolly from florida and analyst and anna palmer is co-founder of punch bowl news. and so ryan, you have some new reporting on details of republicans gearing up for intense oversight of the biden administration. what can you tell us? >> it is no secret that there aren't many that believe much of the legislation that comes out of the house of represent tigss over the next two years will ultimately become law because democrats control the senate and

of course they control the white house. and so the one thing house republicans have is their oversight responsibility and they plan to use it in many different ways. almost every committee that the house of representatives has about be engaged in some overnight and much directed at the biden administration. as soon as the he had of this month we could see hearings begin on wide range of things, you including the covid virus, the role china is playing on a global stage and a variety of other things. and we're waiting to see exactly how this republican majority uses its subpoena power. for instance, the oversight committee which, power without the approval of the members of the other committee.

so they could bring potential subpoena targets. and of course we know that the oversight committee has said that they are interested in looking into the biden family's business dealings and whether or not there was any conflict of interest with joe biden either as president or vice president. so this is just an example of what the next two years will be like. and part of why they want to get the rules package done as quickly as possible because then it will set a stage to empower these committees to begin their investigations. >> so the rules package is a key part of punch bowl's reporting. it said that there is a secret three page addendum that mccarthy and his allies hashed out. and it includes concessions that mccarthy made in order to become speaker. three seats on the rules committee for conservatives, freezing spending at fiscal year 2022 levels, a debt ceiling strategy, coveted committee assignments and more.

and you suggest that there is even more coming. what can you tell us about this and the implications for the house functioning frankly? >> yeah, it is pretty wild when you consider the fact that part of this entire rules package is going to get voted on. tonight is not public. and there are expect takes that the remain as secret as long as possible, that this is really part of the delicate dance that we saw. now speaker kevin mccarthy engage in all of last week. but it just showcases i think how tenuous his leadership is, how much power these conservatives have can interest exerted and how they have be in investigations and rules committee, deciding everything about how and what will get on the house floor to these coveted committee assignments. shows you how much mccarthy had to give up to get the speaker ship. >> and so what does it mean for

the function of congress? >> yeah, there is one group within the republican caucus we really don't talk about much, and that is the 200 members who sat there and got rolled as well as kevin mccarthy got rolled. any one of them could have objected last week, but they agreed to go along with this and i think that is a telling posture. maybe we see some -- >> what does it tell us specifically? >> it tells us that the caucus is under such stress, if you will, in terms of fracturing that they cast their lot and said we'll just stick with mccarthy ashe gives away the store. and matt gaetz says that now the chair of the freedom caucus is more powerful than the house. and 200 members of congress allowed kevin to elevate freedom

caucus chair to that stature. and now everything lives on this margin of five votes. so kevin has to find the goldie lox complain on everything and he is not going to be able to do that. he will have to work on question that's refuses to work with, and caucus will see the inability to move forward. >> and even if moderates go along with the rules package, but then you have all these other things that were pushed hard by the far right, they include according to your reporting tightening abortion restrictions, cutting defense spending, social programs, first of all, is it even clear that there is a point at which the republicans will break, what looks really iffy there, and is there any sign frankly that the republicans are setting themselves up to work with democrats on anything? >> certainly he won't see kevin mccarthy lead with the fact that he is going to have to work with

democrats on some of these things. but to ryan's point, a lot of the focus has been on the conservatives. right? in terms of investigations. what they want to do. but you are already starting to see some of the moderates upset with the fact that some of these early bills, three will be around abortion. and on -- this is not a moderate republicans that want to be talking about. and i think the biggest question, as much as the priorities are republican priorities, a lot of this is going to maybe pass in the house if it does pass at all, but it is not going anywhere in a democratically controlled senate. and so this is where the kind of just the blocking and tackling of keeping the lights on becomes very difficult for kevin mccarthy. that includes how do you kind of figure out keeping the government running, how do you figure out the debt ceiling. all of these things will be controversial. and we've seen disagreement

around defense spending. there is increasing scepticism of funding that is going to ukraine for instance. and so as this pressure to cut spending happens, it is not discretionary programs. there is only so much that they can cut there. and so this a big question that kevin mccarthy will have to figure out how to thread the needle on. >> and threads the needle, hard to imagine a needle that could be threaded anymore thinly. but to listen to a bunch of republicans, they just want to put it in the rear veer mirror and everything will work out. >> it is positive not negative, it is not weakening kevin mccarthy, it is providing the speaker with the tools he needs for republicans to go to the mat for the emergency person. >> sometimes it is messy, but that is how the founders intended it. they wanted real debate and input from all people and you

get a decision. >> let's remember that a little temporary conflict is necessary in this town in order to stop the town from rolling over the american people. >> and so the deal was made because of real input, david. they want to believe what happened last week was actually a good thing and will ultimately strengthen the republican party. do you buy that? >> no. a little counter messaging. similar when donald trump says he got more votes than anything in history but leaves out that he lost the election. there is no covering it up. but here is the danger in what mccarthy agreed to. it is not that more members got empowered, that is a good thing actually. the house has had a chokehold to having more say. but who constitutes that are the

same people that aided and abetted donald trump in the narrative of trying to steal the election. almost a quantitative problem that kevin has created. under nancy pelosi and paul ryan and john boehner, that was before the dangers of insurrection. kevin elevated a caucus insurrectionists. so they have a danger what n. what kevin gave away last week. >> all right. i aunt with a to go to brazil because the parallels to our own january 6 insurrection are inescapable before check out the images of thousands breaking in to buildings, smashing window, destroys equipment, ransacking offices.

claims of election fraud paving the way for what you are seeing .worst demonstrations the country has seen in decades. and today authorities are clearing a tent city belonging to anti-democracy protestors, arresting runs. and president de silva held an emergency cabinet meeting one day after supporters of his predecessor bolsonaro stormed other branches of government. and claiming that the election was rigged. guad venegas is following the situation there right now. what is going on there in brazil? >> reporter: we saw the image as today, president lula back in the capital. we first saw the crowds on sunday when the protestors came in and went into the government

buildings, congress, supreme court and palace. and the president was not there. the military has come in and they have detained hundreds. and they will remain. and lula has claimed take bolsonaro shares some of the responsibility. he left before the transition of power which happened january 1. and now it will be an investigation to look into the cause. de silva said he believed there were financers behind the protestors. and they have been ordered to clear any protesters around brazil thinking of joining the bolsonaro supporters. >> and congressman, there are obvious parallels to january 6.

even though some of the plays are the same including steve bannon who called them patriots, i'm talking about the brazilian folks, former president bolsonaro's son posted this from bannon back in november. >> look at the streets of brazil, look at the great patriots of brazil that lot of danger to themselves have come forward in the streets of brazil. these are the people saying no, you didn't follow the constitution, you used these machines, you used the judiciary to shut us down in the media. and we're not going to tolerate it. it will be very interesting to see how it plays out. >> and he has not shied away from his words or his actions involving january 6. and he seems to actively be trying to do the same elsewhere. what do you make of it? >> steve bannon has been a leading voice acknowledging that the trump movement is part of a

larger international movement creating instability around the globe. he's been honest about that. and that is the danger. there is danger in violence, there is an injury to our republican and democracies around the world. but the goal is instability. it was about creating instability. and that is the problem. the through-line to what we saw last week, this new committee house republicans have about the weaponization of the federal government, it is about stoking instability domestically in the united states. that is the dangerous thread between what we saw in brazil, what we're seeing in the u.s. and around the globe. >> david, guad venegas, thank you. and the consequences for january 6 rioters continue including a trial just now getting under way for the man seen in one of the most famous images from that day.

jury selection for 61-year-old richard barnett of arkansas, he is the man here with his boots up on nancy pelosi's desk, is beginning. opening statements are expected as soon as tomorrow. barnett is facing eight charges including obstruction of an official proceeding, theft of government property and entering and remaining in a restricted billion or grounds with a deadly or dangerous weapon. prosecutors say he carried a stun gun. special grand jury investigating donald trump and others for their attempts to overturn the 2020 election in georgia is done with its work. so when will we learn what they found? that is next. and president biden trying to tackle immigration issues in mexico, what is at stake for today's big meeting with next's president and justin trudeau. and prince harry's bombshell memoir about the hit -- that hit the shelves after revealing he's had no contact with his brother or his father for a while. we'll dig into drama with a

more now on the breaking news outof georgia, the fulton count grand just tied up the investigation into donald trump. the question, whether the former president and his allies made coordinated efforts to interfere with the state's 2020 election

results. and the grand jury also heard from people like rudy giuliani, senator lindsey graham and trump's former chief of staff mark meadows. georgia state elected officials testified as well, governor brian kemp and secretary of state raffensperger. the d.a. will ultimately decide how to proceed. a spokesperson for the d.a. has declined to comment to nbc news. i want to bring in blayne alexander from atlanta and also former federal prosecutor paul butler. so blaine, can we expect the report to be made public? >> reporter: that is the big question. and that is something that we're hoping to find out in good b. about two weeks. there is a hearing set for january 24 whether or not it will be made public and in its entirety or redacted. there is certainly a lot of

interest in kind of arguing as to whether or not this should be made public. we know that the d.a.'s office will make her case. also members of the media can make cases as well, the newspaper of record here has already made it clear that they plan to fight for it to be made public. and what i think is important to mention, the special grand jury itself voted they said that they believe that it should be made public. so that is what will be argued in a hearing in about two weeks or so. but as for what happens next, it is important to remind viewers why the grand jury was convene, it was to investigate. they don't have the power to issue indictments but rather what we'll see in the report really will be a summary of the more than 8 months worth of testimony, of sworn testimony and bikely recommendation so is whether there should be charges filed. and i also want to point out remember that was now infamous phone call from then president

trump to the secretary of state demanding that he find enough votes to overturn the election results here in georgia. but since then, we have seen this investigation widen far beyond that and we also know that there have been dozens of people who have come forward, testified under oath. so certainly a lot of people will be watching closely to see what is in that report. >> yeah, and paul, what in your mind is the heart of this case, what will the grand jury have to believe for possible charges and if there is an indictment, what do you think they would have needed to have found? >> so in georgia it is a crime to interfere with a state election. and based on everything that we know from what has been reported, it seems clear that the former president and people like mark meadows and rudy giuliani actively tried to shift the vote in georgia to donald

trump even though he lost the election. and so a lot of what might become public from the grand jury testimony, we already know from other sources. so really this is a decision for fani willis, whether she wants to move forward from what would be a historic first prosecution of a former president. >> yeah, no legal precedence at all. county grand jury, a former president. so what are the next steps for the d.a., what do you think are the things she needs to take into consideration? you don't want to go into a case like this unless you feel pretty darn sure that you can win it. >> you have to win. and the problem is there is no guarantee that you would. now, of course a jury in atlanta would be different from a jury in other jurisdictions that might be more favorable to the president or give him credit like the judge in florida tried to do because he was president. but still, this would be an

unprecedented case. and so the judge -- sorry, the district attorney will want to make sure that she has all of the evidence that she needs to persuade a jury beyond a reasonable duty if she decides to bring the charges. i don't think that there will be a whole lot of coordination with federal investigation including with the special council jack smith. i think that they will probably talk. but i think especially the feds will be reluctant to reveal their cards to the local district attorney. >> paul butler, blayne alexander, thank you both. and critical meeting with president from mexico, the stakes and what hopes to accomplish next. mexico, the stakes and what hopes to accomplish next.

meaningful reform appears to be slinging with a congress unlikely to make moves towards compromise and democrats with their own internal disagreements. gabe guttierez is in el paso, mike memoli is in the president with mexico city. and also joining us president and ceo of voto latino and political analyst. so gabe, there has been a surge in migrants, new records set, migrants sleeping on the streets. what is the reaction to the president's visit and are you hearing any hopefulness that something can be resolved and thins can get better? >> reporter: well, there is a lot of skepticism that something can be done in the short term.g? >> reporter: well, there is a lot of skepticism that something can be done in the short term. some are thankful that president biden visited the border, but other local officials say that this is too little too late. and advocacy texas governor greg

abbott said essentially that, that the president should have come here much earlier. but besides politicians, we have spoken with volunteers here as well as a former city official as well who is so frustrated at what has transpired over the last couple of months, this record number of migrants who have arrived here. but the white house says that number of illegal border crossings in el paso has dropped by some 70% since mid-december. but here with some local reactions to the president's visit. >> i see the way that people are living in the streets, i see the fear that they have. and, you know, we are a civilized society. we need to do more. >> i've never seen this before. this is unprecedented for the city of el paso. they have done zero to prevent this. i think that they are trying to

cover bullet wounds with band aids. >> reporter: and of course immigration is such a complex issue that has stymied administrations from both political parties. but what you see behind me is something that really is the face of this humanitarian crisis. there are still igrant that are sleeping in the streets and have been for quite some time. even though the numbers were less than mid-december, there is a lot of skepticism about any potential solution to this humanitarian crisis anytime soon. >> so in just a couple hours president biden is scheduled to meet with the mexico president and also justin trudeau. realistically, what does the president think that he can achieve? >> reporter: it is interesting because for this white house immigration really felt like the back burner issue. but now starting with the announcement of some of the

policies that the president rolled out, seeing the border for the first time as president, and now these meetings in mexico, the white house is hoping to illustrate and inform both the challenges and solutions to this migration issue that she are facing about. and we know the president got a kick start on some of the conversations with the mexicans from last night when the motorcade went from there to downtown, the white house noting that as part of the policies the mexican government is stepping to the plate agreeing to take in some of the 30,000 migrants a month from haiti, nicaragua, cuba, that the u.s. government is expelling under the new policies that the president rolled out. they say this is the ground work for future agreements in which mexico can do even more. but also worth noting that canada, we don't think of them having a role in migration, but

this is an issue that spans the hemisphere. and all the leaders have a roelg roll to play. so perhaps canada can play a role with the haitian migrants. but the white house often points on uts that this relationship is not just about migration. there are some other thorny issues that they will be discussing from trade, building on the usmca agreement that president trump brought into force, but also some of the fallout effects from the "inflation reduction act" as it relates to clean energy incentives. and obviously a lot more do as it relates to fentanyl which is a related issue to the border crisis but one that the white house is hoping to impress upon the mexican government to do more to crack down on that spread over the course of the meetings here in the next couple days. >> mike and gabe, thank you so much. and maria, i feel like we've been talking about this for decades. maybe we have.

first, what is your reaction to seeing president biden make the trip finally for a lot of people, finally, to the border, but how concerning do you see the situation right now on the ground in el paso? >> you nailed it, this is a humanitarian crisis, this is not an immigration issue. so it is good that the president goes there. it is more to pacify i'll be honest the republicans and progressives and that is why he's going. but is it the right timing and for the right purpose. we don't need a photo-op, we need solutions. and it comes to a point in our american policy where we need to decouple issue of the immigration reform that the original eight led by mccain, marco rubio was part of the conversations, to deal with the people at the border. and those conversations have been sidelined, and a consequence, a fallout of neglect in the western

hemisphere. the last 30 years, we haven't had a serious conversation of what will we do in latin america. the last time we had this conversation was really around nafta and that had a whole bunch of underpinnings. but what we're seeing is the result of a combination of narco violence, environmental crisis and fallout from covid. the least reported news that the covid pandemic hit latin america hardest after almost 30 years of progress, all of a sudden close to 16 million middle class lat latin americans were found below the poverty line. and that is the consequence. and so as i see the president having conversations with trudeau and the president of mexico, what he is emphasizing that this is a north american issue, it absolutely is. because if we have in-sdablts stability that we're seeing in

brazil and other parts, it will be a fault line between the border crisis and much more. so this is the beginning of a bigger wave if we don't figure out what is our strategy for the western hemisphere. and my hope is coming out of these conversation that's says that we have to couple the immigration crisis and these are the residual effects of the covid pandemic and the narco trafficking and the climate crisis. >> how do you get that done. democrats are not all united. they talk about the use of title 42, there is disagreement with that, you have a new republican leadership coming in on the house. what realistically can joe biden do to start at least to address this problem which again has plagued republican and democratic administrations for a very long time? >> so i think the biggest

challenge, and this is where i'll be controversial, i think that we need to decouple title 42 from the 1 1 billion undocumented immigrants where the original conversation started. we have to decouple foreign and domestic issues. number two, having a conversation that biden did very well when we were in -- when we decided to support ukraine with the russian invasion, he communicated exactly why there was going to be investment, why we needed to make sure that we were protecting that democracy. he does a kufl job understanding and explaining that to the american people. and he needs to do the exact same thing with what exactly is happening in latin america. but what americans now, when we talk about immigration reform, all we think of is the crisis at the border and that is the end result of a larger problem. >> maria, always great to have you on the program. and california now bracing for relentless bomb cyclones help hundreds of thousands

right now 7,000 nurses at two of new york's biggest moments are on strike over pay and staffing. the nurses rejected a roughly 19% pay increase ignoring calls from governor hochul to avoid the strike. and it is causing major headaches as the hospitals have to move patients and scale back other services at a time when other hospitals post-pandemic are already understaffed. and meantime communities in california are bracing for a parade of cyclone starting today after torrential downpours and high winds knocked out power to more than 100,000 people over the weekend. and these communiies are in for

a one-two punch with heavy rain and risk of flooding and mudslides. marissa, what are you seeing and what is about to come? >> reporter: yeah, so in terms of what the wind and rain can do to the community, i just want to show you what it is has already done. you look at this fence not only bent, but there can kelp stuck in the middle of it. so the rain has created such high levels that it has already brought water to where it doesn't normally go to. and i want to show you one of the biggest concerns as we pan around. so capitola beach normally right behind me, instead littered with debris. is this all logs, these are trees that have been fallen, carried out to sea. and this is posing a big problem when it comes to the rivers already cresting. and i want to take you to the pier, this is a wharf partially washed away from the last bomb cyclone.

and that is so important to remember because these are communities that have already been hit so hard in the last week. these businesses over here, some of them had logs go straight into their window because the water was so high that it carried the logs straight into their businesses. and so top of that, they were flooded. we saw how high the water level got. and you have residents in serious danger because the next big concern aside from what you expect from water, right, you have downed trees and power line, but we're in an area that is vulnerable, it is not used to this much rain. and on top of that, we saw the wildfires that created a situation where now we're going to see more mudslides because the areas were cleared of the trees and the vegetation that might have made that a little more difficult than it is right now. so around us, we have several different highways that are closed off because of mudslides and because of downed trees. but there are areas around here

where there is a concern that we so's more of that. so when we talked about the debris, what we're seeing in some parts of various rivers around here, there is a bridge not that far away from here, there are crews that are on stand by and they have the machines and the tools in place to take apart the dam that might a rise as a result of the debris, but there are evacuation orders and warnings in different parts of santa cruz mountains. and we're in a warning where we are. but there are parts that are being evacuated as a result of an order. so right now it depends on where you are, but in terms of the threat here, all of the things that come with wind and rain especially in a place like california, the real concerns are going to be flooding and landslides and mudslides have you also. >> you and your crew stay safe. prince harry's explosive book, the revealing interviews already making waves. and i'll speak with a royal
