attack on the capitol city. president biden right now in mexico for the first time as president, getting ready to go one-on-one with the mexican leader as the politics over immigration top headlines. we're live in mexico city. also this hour, you've got the house getting ready to come into session. kevin mccarthy now officially in charge. trying to set the rules and set the tone for his term with the gavel. this hour, not all republicans on board for today's vote. even with some of the concessions mccarthy made. with our new reporting on what is being called an aggressive pace of gop-led investigations. plus, hundreds of people under arrest under violent protests of brazil's congress. supporters have recently ousted jir bolsonaro, storming the capitol building and why presidential extradition could be part of the conversation. i'm talking with a top national security official about that later on in the show. we have a ton to get to in the next hour. let's get startsed with nbc news white house correspondent monica alba traveling with the president in mexico city.

the president and first lazy set to meet with the mexican leader a couple of hours from now, part of the summit between president biden and his mexican and canadian counterparts. taking center stage, the migrant crisis at the southern border after president biden's first trip as president to the u.s./mexico border shall the administration rolling out new border restrictions. while in el paso you saw the president walking along part of the border fence and meeting workers at a migrant services center but not meeting with migrants themselves and the white house saying they were processed before he got there but he wasn't too far from migrants lining the streets. there is not just the humanitarian crisis, and the migrant crisis but fentanyl making its way to the u.s. from mexican drug cartels and trade issues on the table and talk us through the priorities and what is next. >> absolutely. some incredibly complicated issues that you just laid out there, hallie, all of them are going to be on the agenda. president biden often says that there is no substitute for face

to face discussion with the world leader and he's already had a whole bilateral's worth with obrador coming off air force one. and then another conversation with the mexican leader to talk about the issues. and at the top of the list, it would surprise no one, that mass migration and border policy, mexico plays a key role in anything the u.s. is trying to do of course with the southern neighbor and so in terms of the new policies that the president unveiled last week, it couldn't really be possible without mexico's cooperation. so the two men will be talking about how some of these new policies will work, because mexico, when some of these migrants from countries like nicaragua, cuba, haiti, and venezuela and expelled back to mexico, they need to be able to then process them before next steps. so is it possible that more of those numbers could go up, that there could be future agreements, that's one avenue

and connected to that, and this issue, this very human issue of human trafficking, is the issue of drug trafficking, and fentanyl. and we expect there's a possible counter-narcotics agreement that could come out between the two countries and that's something they will also be drilling down on the details. and behind the scenes, this is a white house that may encourage mexico to crack down more on the cartels. for the last few years, they have had a policy here known as hugs not bullets, trying to prioritize social welfare over really going after these drug lords, in a military fashion. that's something that has received a lot of criticism. and the u.s. may be trying to tell him more pointedly to work more to address that. so that's one potential area of cooperation here, hallie. and of course the two men will be talking about some of the other major challenges on the global stage when it comes to trade, when it comes to climate change, and when it comes to energy policies, specifically with the project that mexico really wants the u.s. help from.

if we pull back the curtain here a little bit in the so-called three amigos summit. last year was the first one in years with a hiatus during the trump administration and all about restoring relationships and today i'm told, and tomorrow, we'll focus more on actual tangible deliverables on things these countries can hopefully do together. hallie? >> monica alba in mexico city. thank you. we are talking more about the story later on in the show. let's talk about what is going down in the building, just near where i am here, a couple hours away from another test of house republicans unity, that is because you have the chamber set to take votes in a couple of hours on the rules package that puts in place, you know, what the procedures are going to be for this congressional current term this. feels like inside baseball, right? if you're like my god, are we going to be in the weeds on the rules package today, hallie, but we are a little bit because here's i would why, and speaker mccarthy, he gave a way a lot, to the ultra conservative members of the power to get the power and the title he has

wanted for years. and it shows, in this rules package that he hopes to get passed today. with me now is nbc news senior reporter garrett haake and eric crantor and former rnc communications director here with us as well. hello to both of you. garrett, does the rules committee vote typically even meet the bar for many msnbc live shots, i'm not sure it does, it sure does before, and as we talk about what is next for kevin mccarthy and what it he shows. talk us through it. >> it is a reality check how moiftd of the thing in the congress will go where a four-foot margin and a proven unruly conference. house republicans will have to have every vote potentially one that they sweat a little bit. the rules package typically includes a lot of basic stuff. this one for example rolls back some covid rules and moves votes back it a two-minute time frame and gets rid of proxy voting and

establishes several new select committees and includes the big concession that mccarthy made to conservatives to set the motion to vacate, the idea that any member could call for a vote to out of the speaker down to one vote and there is a host of policy pieces that appear to be riding alongside the text of the legislation of this rules package that have not been widely seen yet, so this is going to set the tone in many ways, for how this new republican conference is going to function, and a lot of the more moderate members appear to be, at least not a lot, some of the more moderate members appear to be somewhat nervous about what is in the bill -- [ technical difficulties ]. >> repeat the question. >> i don't know if i have dub. i'm hearing myself back. definitely a dead mic issue.

garrett, let me go to you. you laid that out. talk more broadly about what is next for the congress. you you and your team have been doing a lot of reporting regarding the investigatory steps now that republicans are fully in control of congress. a couple of the next key moments that we may see. >> as soon as this rules package does get passed tonight, i think we will see starting as early as tomorrow, the legislation start to move and the investigation start to move. the republicans have said that the first thing they want to pass is something that rescinds the funding for new irs agents that were provided for in the inflation reduction act. they see that as kind of an overpolicing thing. they want to get it done now. it won't pass the senate but they will pass it anyway as a messaging bill. on the investigation side, there are a lot of investigations that republicans are raring to get off the ground and some done by the new select committee i i was talking about, one on the origins of covid and another is on what they perceive to be the politicization and weaponization of the fbi and other federal law

enforcement agencies, and i think the big one that people have been keeping an eye on is on the biden family, and on hunter biden, and his business practices, and the head of the oversight committee is taking pains to see it is not an investigation of hunter biden and it is an investigation of joe biden and the families business practices and they dug into all of those things, and more or less as quickly as they can get the committees formed, and hallie, even today, the steering committee, the overarching republican leadership team was picking the last of their committee chairman and women so they can get this process kicked off as soon as possible. >> doug, i think i have you back here. i'll go to you. i may not in fact have doug back. we are going to take a quick break and try again on the other side of this. garrett haake, thank you. we will try to come back when we get the tech issue fixed. an update on the buffalo

to developing this hour, the former president of brazil is admitted to the hospital for abdominal pain according to his wife, it comes as here in washington, as the vice president kamala harris in about 35 minutes or so, is expected to swear in the new u.s. battery ambassador to brazil in a minute and all eyes on what if anything she says about the violent and extraordinary attack on the brazilian government and how the administration plans to respond. in brazil, the capitol is now occupied by federal forces. a regional government suffered and hundreds arrested after what you see on the screen, the storming of government buildings on sunday by bolsonaro supporters over false election conspiracy theories. sound familiar? president biden is condemning the attack with joint leaders of

mexico and canada and it is possible he could face pressure to do more with lawmakers calling on president biden to extradite bolsonaro back to brazil. he is expected to be in florida on a special visa for heads of state. mike memmoli is in mexico. there are threads to what is going on in the u.s. and brazil. and bolsonaro believed to be outside orlando essentially, the influence of far right figures that we know, domestically, people like steve bannon, et cetera on politics in brazil, give us the white house fuel and what we should expect to see as this moves forward. >> well, you have some discrete issues in the here and now, especially involving the visa issue, potential extradition with the white house, and for the most part, at least putting these questions off, for instance jake sullivan the national security adviser telling reporters in mexico city that he expects president biden will speak with president lula, that the u.s. stands ready to do whatever it can to help president lula and you know,

shore up democratic institutions, they said they believe those democratic institutions in brazil remain strong. we heard just in the last hour, from the state department briefing, a confirmation that yes, former president bolsonaro is here, in the u.s., on that special visa reserve for heads of government, and that as they laid it out there, is a process and n-place for individuals who come here with one visa, having about 30 days for instance to request a different immigration status or leave the country. and those are the granular issues that the white house has to confront and if you step back, this is an administration as you know halle, that is focused very significantly, we saw just on friday about, the threats to democracy, at home, and abroad and the president really guided his foreign policy about autocracies versus democracies and the importance of shoring up democracies around the world. and it is important to note, too, that the white house was watching the brfl brazilian election very closely, the initial election and the runoff, president biden placed a call very quickly to president-elect at the time, shortly after the

results came in, he sent a dell gration to brazil just in the last -- dell gration to brazil just in the last week to attend the inauguration and a decade ago when biden was vice president he traveled to brazil multiple times and that is a relationship that the white house is particularly focused on and you can expect it to continue. and i thought it was notable we saw not only a statement from the president but a statement from the three leaders who will be gathering here for the north american leader summit, the mexican president as well as the canadian prime minister. >> guad, over to you. no word yet on the conversation between president biden and the brazilian president and talk about where the investigation in brazil goes from here. >> hallie, well, the president has been informed the investigation is under way, as the military has regained the control of the capital and the minister of justice spoke an hour ago with more details about

what happened and how the protesters were able to enter these building, the presidential palace, congress, and of course, supreme court buildings and it will take some time for them to find out. now lula has also indicated that there could be financiers behind the individuals that arrived in this area. there have been reports, from reports on the ground that buses were used to bus some of the protesters, so of course, all of that is under way. and it is very important, and as mike was mentioning, to see the support that is coming from international leaders, we saw president biden, and justin trudeau, in mexico, sending a joint statement, and from also around the world, the secretary of the u.n., the president of france, and other leaders have shown their support for lula, very important, as he goes on the first days of his presidency, he has only been the president for a few days when this happened so it is very important for brazil to move forward with the investigation, and the full support from the international community, and we will see more details being revealed as they continue making

revelations and they had 400 people arrested and today we know more than 1,000 have been detained and the military continues to detain others after the supreme court ordered the military to disband any protests happening around the country, supporting bolsonaro, hallie. >> guad, thank you very much. >> mike memoli, thank yous a well. breaking news we told you a couple of minutes ago with damar hamlin released from the hospital and back in buffalo and doctors and teammates travelled with him at the airport and confirmed to be doing well and landed in buffalo. kathy park was there. it is incredible, the doctors say they are thrill and proud to be able to report this news, it is a major milestone in damar hamlin's recovery, a week after so many people witnessed what happened to him and praying for him and thinking about him and praying for him all this time. >> hallie, that is absolutely

right. and this is ernl is the news that we have been waiting for and cause you us offguard because we were anticipating to get an update on his condition but we didn't exactly realize he would be released from the hospital. let me become-track a little bit. the doctors here at uc medical center said he met a lot of the key milestones and transported to the buffalo area, they did not say exactly where he was transported to, but he met a lot of those key milestones and he has shown progress ever since that onfield emergency on monday evening. on friday, i can tell you the doctors were able to remove his breathing tube and over the weekend, he was live tweeting during the game. he was in high spirits. but also was very aware of the fact that the country was rooting for him. football fans all over the country were rooting for him. and outside of the uc medical center right now, and there are signs and posters and well wishes and this outpost here, this has been growing each and every day. and just a few moments ago,

reporters have had an opportunity to ask questions to the physicians who have been monitoring damar ham lynn and they ask, hey, is there any chance he could potentially be on the football field. that is still to be determined at this point. right now, he is under the watch of a different care team. but they are hopeful, obviously, and we also know that his neurological function is still intact. just a couple of days ago we're told that his neurological function is excellent. and obviously, he's doing well, in that regard, but he is weak because he did have to travel to buffalo today. but they said it is normal considering what he is going through, but the news that we have been looking forward to hearing has been an emotional rollercoaster, and ever since that emergency on monday, and i think the teammates, especially, they were just shaken when they saw him collapse, in front of him, and then it turned to relief when they got the good news, when things started to turn around and then of course, that incredible game, and how can he would not talk about that game, this is a story book game,

where just a few seconds into that game, you had that incredible touch dols down and then you saw number three, just afterwhere, jaefr where around the stadium. and his recovery is still ongoing, a long road to recovery and we will be monitoring any sort of updates but that's the latest from here. damar hamlin released from uc medical center and transferred to another facility in buffalo, new york. >> it is incredible he is back in buffalo and this news is coming to us. there is still a long road to recovery, a major milestone but more to come. can you talk to us about what doctors describe as the next steps for damar ham lynn now that he is there. >> that's a great question. and one of the reporters had asked that question, and now, he is under the care of a different medical team some of the they're kind of deferring those questions to them, so like i said, it is still tbd where he has been transported to, but it

back with some of the new updates on the former brazilian president who supporters stormed government buildings there with bolsonaro's wife reported he is hospitalized and there are reports he is in florida. there are new questions facing the biden administration over the issue of potential extradition. what would happen, how would that work, who is talking to who about it, and what is up with bolsonaro's visa? listen to what we just heard from the state department spokesperson not too long ago. >> generally speaking, if someone entered the united states on a visa, which is essentially a diplomatic visa for foreign diplomats or heads of state, a visa holder, if a

visa hold ser no longer engaged in official business on behalf of their government, it is incumbent on that visa holder to depart the u.s., or to request a change to another immigration status within 30 days. >> i want to bring in now from mexico city, john kirby, coordination for strategic communications at the national security council. admiral kirby, good to see you back on the show. thank you you for being with us. i have some questions for you obviously about your trip to mexico and everything the president is doing there, but let me start with what is going on in brazil and the questions it that are surrounding us here. first of all, his wife has said that her husband bolsonaro is in the hospital and is the u.s. monitoring his condition and his whereabouts and what can you share? >> well, we're aware of the reports certainly that his spouse has put out there. we're not in a position where we can independently verify the veracity of those reports or his exact whereabouts.

but we're certainly seeing those reports. we obviously have no reason to believe that he is not outside, that he is outside the united states in any way. >> do you believe that he is not outside the u.s., right? just so i'm clear. >> i'm sorry, i got a little tongue-tied there. we don't have any indication to think that he has left the united states. let me put it that way. >> got it. what do we know about, and i know you're got going to get into specifics about visas so i will be careful how i ask it. if there is in fact an issue with bolsonaro overstaying his visa and not taking appropriate action, do you believe this administration would take moves to expel him from the country and if brazil asks, would the u.s. extradite him? >> i don't want to get into hypotheticals and there certainly hasn't been, and we're not aware of extradition requests for bolsonaro and as the state department put, it we can't talk about his particular visa situation by law, but if somebody were to come in on an aid visa as ned very much

succinctly put it, the responsibility is on the visa holder to meet the requirements under that visa, in this case, it would be doing official work. >> and do you know if former president bolsonaro has met those requirements? >> again, i can't talk about individual visa cases. and i'm not going to talk about mr. bolsonaro's situation specifically. >> let me ask you this, i know there has been some discussion a few hours ago of president biden and president lul a having a conversation about what has happened in brazil. have they had that conversation yet? has the phone call been scheduled? >> there has been no communication directly between president lula and president biden, clearly if and when it is appropriate for the two of them to talk, the president would certainly be willing to have that conversation. you heard him say very, very clearly, both the reporters while we were on the ground in el paso, as well as in various statements, that we condemn this

violence, this political violence in brazil and we certainly stand in support, full support for brazil's democratic institutions, and in support of president lula. >> to that end, and there is real concern i think inside the administration about the parallels that we saw, as it relates to threats to democracy, from for example, january 6th so on that end, two questions for you, do you believe, does this administration believe that former president boelgs naro played a role in inciting his supporters? >> president lula has called for an investigation. and i think we're going to let that play out right now. i think it's important to let the brazilian authorities take a look at this appropriately, and determine, you know, if someone is responsible, and who that might be and at what level. they'll have our complete support going forward. >> has brazil raised any concerns about the potential role of americans in inciting violence and perhaps somebody like steve bannon? >> i'm not aware of any concerns raised by the brazilians specifically with respect to any

kind of american support for this. again, they have launched an investigation. we're going to let them proceed with that, and you know, if there is anything that they might need from us, to support them, and the work of that investigation, clearly we would do that but i'm not aware of any discussions along that line. >> so to be clear then, is the u.s. doing any of its own kind of investigation or agreed to any kind of investigation into a potential link to americans and the u.s. citizens here or is that something not on the table for this administration? >> no, there's no active u.s.-only investigation here, and we haven't been asked by the brazilians to assist with theirs. this is their investigation. and we want to respect that process. and let them work through it. >> okay. let me ask you about the reason why you are of course in mexico city coming to us live from mexico. ahead of this trip, peter nick class is writing from nbc news.com, the three amigos, the camaraderie has appeared to fade and the post-trump honeymoon

appears to have ended. and how does it make it difficult to work together on trade and fentanyl, et cetera. >> the president goes into the summit very, very confident that it is going to be a very good comprehensive set of discussions, on some very key issue, migration, drug trafficking, certainly clean energy and sustainable resilient supply chain, and there's a lot to cover in just the next 24 to 36 hours, and the president is looking forward to that and he has good relationships with both leaders, confident that, you know, he will be able to really sort of work through some of these issues, across the continent, and make sure that we can advance our cooperation going forward. >> earlier in the show, before you joined us, we talked about the humanitarian crisis at the boarder, and that is obviously another key issue for president biden. republicans have been formally in charge at the house of representatives for something like 72 hours now. does the administration see any reason for optimistic, for policy or legislative solutions on immigration coming from this congress? >> we certainly believe that that is the best way forward, is

legislative solutions, as on day one, the president put forth an immigration reform package, that congress is yet to act on, that would add more resources for the border, for security, and certainly provide additional legal pathways for migrants to seek citizenship in the united states. and it is a fullsome package. we would like to see congress move on. that if the republican opposition is serious about doing what we all can do as a government to deal with the situation down at the border, then we would ask them to take another look at that reform legislation, and act on it. >> john kirby, live for us there from mexico city, it is good to see you as always here on the show. thank you. i'm sure we will be talking again in the days to come, appreciate it. turning now to the georgia where the investigation of 2020 election interference in fulton county has officially wrapped up. the findings are on the way to the d.a. the grand jury was created to look into what former president trump did, to look into what trump allies did, after the legit 020 election where of

course joe biden won the state of georgia. because it is a special grand jury, they're not the ones coming up with indictments, that is for d.a. fani willis and another regular grand jury to decide. the special grand jury, as you've seen reported here in dribs and drabs over the last many number of months, we've seen people come in and talk with them, right? testimony from people like former chief of staff mark meadows, rudy giuliani, the governor brian kemp, blayne alexander has followed all of it and i can hear everybody coming in and oust courthouse in fulton county and joined by former state prosecutor in new york and msnbc legal analyst. talk about the next steps here. so much of the ball is in d.a. willis's court, right? >> it is squarely in her court, hallie. and that's who we're going to be watching closely. i think that the question of course is will she bring forth any charges in this, and perhaps more notably, will former president donald trump be on the referring end of any potential charges. now, a spokesperson for the

d.a.'s office tells me today they're not commenting on this right now but a source familiar with the process says the dafrmd and her team will get a first look at the report and the question remains will anybody else get the report and will that report ultimately become public. that is the question before a judge in two weeks time, during a hearing on january 24th. and it is something that, you know, we know that we're going to hear from the d.a., and her team at that time and we're going to hear from members of the media who are going to be arguing to make that public, but this is also something, the contends of that report, that could give some insight into which way this will go next. remember, this is just going to be a summary of this very robust investigation, that this body has been come biling piling over the last months or so, bringing in people one by one in the building behind he and we are seeing some recommendations as to which way the d.a. should go and to make a point, the d.a. has made it clear, she is not shy of this. and if evidence points to a crime, she will bring an indictment on this, hallie.

>> so tell us about the time line here. >> right. so as we have heard, the d.a. is going to start looking at that report probably today. but of course, her prosecutors were working with this special grand jury throughout its long investigation. on the way to this report. so she likely knows everything about the substance that is in it. if it recommends charges against donald trump, and others, then she has said, i think she will very quickly move to a regular grand jury and ask them to vote on those charges, which is to say to indict trump and whoever else is recommended for criminal indictment in this report. and i think that she can move through that pretty quickly. my guess is that that will happen at around the same time that she makes her arguments in two weeks' time about what should become public from this

even more accusations, about lies with george santos, this time involving money, involving his campaign finances. not long after being sworn into congress, a watch dog group, not long after santos was sworn into congress, a watch dog group is filing a formal complaint with the ftc and eek tom what they say is, in their word, the mountain of lies santos told about his life while running for office and we are learning from cnbc, a member of the santos political team impersonated kevin mccarthy's chief of staff with emails and phone calls during the last two election cycles to raise money for the

community. >> yeah. advocates in texas have told me that they expect things to get a lot worse before they get better. so even if these bills don't pass, they say they still have an impact. a recent national survey from the trevor project found that 85% of trans and non-binary youth across the country said this has negatively impacted their mental health. advocates have told me that these bills will continue to other trans people including adults who face higher rates of violence and homelessness. even just the debate created by these bills has a negative impact. >> is there any momentum in the other direction against these anti-trans bills that seems to be picking up steam? >> yes, yes. states such as california and illinois have tried to -- they have passed bills that would create a sanctuary for trans youth and parents. so trans youth could go to these

ambassadors, and often none of them are the kind of news making event that this could be. ambassador bagley was confirmed on december 14th, so nearly a month ago. only now that this swearing in is scheduled. the other interesting thing is that the vice president's office is telegraphing that he will make some prepared remarks here about the situation in brazil. that is different, right? these are typically events where we see the vice president swear in the ambassador, take a picture and move on. so this is part of the effort to stand with brazil, to shore up the democratic institutions there, express their confidence that president lula is managing this very delicate situation, and just as we talk about january 8th in brazil and the parallels to january 6th here two years ago, a reminder of what we saw at the white house on that two-year anniversary, with congress not having any
