and he said on the occasion of donald trump's impeachment, his second impeachment for trying to overturn the election in 2020. he said it exactly to -- it's an on mile still to hit for our country, it's especially odd when the same kevin mccarthy who once blamed iran for january the six is now saying a speaker he'd be willing to look into ways to expunge donald trump's impeachment. now, i do think it's important to remember today that even though donald trump hasn't yet been held criminally liable for january the 6th. the former president has still founded self and a deep well of legal trouble since he left office. we know that in the state of georgia the former presidents currently under criminal investigation for trying to cajole the georgia tech understated flipping the 2020 election results there. in his favor. there's also multiple ongoing criminal investigations into the former presidents businesses, just today, the trump organization was ordered to pay a steep financial penalty after the company was found guilty of felony tax

fraud. there's the ongoing justice department, the investigation into january the, six with a special counsel jack smith is investigating whether anyone committed a crime. by trying to disrupt the peaceful transfer of power, also under the special counsel's view, is of course the trump documents investigation. about whether donald trump mishandled classified information by storing a trove of top secret government documents at his florida beach club, and pretending they were his. now let's pause here for a second, as i'm sure you are well aware. it's recently been discovered, that the current president joe biden, also had several classified documents improperly kept at the office first thing tank. and at his delaware home. documents from the time he was vice president, right after -- joe biden's lawyers after discovering the documents at his office. a lead -- turned over the documents, and searched all of joe biden's offices and properties to make

sure there are no other classified documents, accidentally being stored. they're on donald trump's and, the federal government repeatedly asked trump's team to turn over classified documents they believe were being improperly how at mar-a-lago. donald trump resisted turning over those documents. to get them back, the justice department passer than with a search warrant. to secure that warrant, the fbi told the judge, that they expected to find evidence of obstruction. by the former president at mar-a-lago. , so let's stop comparing or equating biden and trump. but there is one other really important difference between these two stories. it's the reason why i want to spend a few minutes laying out all the different criminal investigations into donald trump right now. the difference being, only one of these two guys walks around every day carrying the stench of multiple criminal investigations. context matters. despite the vast false equivalency,'s attorney general merrick garland went out and appointed a special catholic to

was garlands hand force when he made the choice to put the matter first in the hands of a different -- john laotian, who recommended to garland that he appoint the special counsel. i wonder if he boxed him self into a corner. doesn't make sense to you given a lot of people saying, there's no evidence of any underlying criminality in the biden case. >> that's really the number one point, mehdi, people are saying what's, forests through once the law says damn unit to do, it it's very difficult for him not to but the ladder of the lie, is that you appoint someone when they're a criminal investigation is warranted. as you, said there's not a scintilla of evidence that biden has done anything wrong much less criminal. and if somebody has, if there's some sort of mid level staffer from his old office, you don't need a special counsel for that. my short answer is, he did it for political reasons. it doesn't make it bad, it

recommend nothing in the biden case. that could be wrong, because there's independent counsels. have a way of kind of go, becoming their own sort of story, branching out to others, et cetera. he's gonna take a long time i think to get a staff together. this could hover over the white house for a while. nevertheless, i think that garland anticipates will be in a position down the line to say i, did what her recommended, i did with smith recommended. and that will equate to trump charges and no biden charges. >> it's fascinating what you're seeing there about the likelihood. to be clear, you believe that appointing her to investigate biden -- increases not decreases the chance of jack smith recommending criminal charges against donald trump? >> i'd say it doesn't have any effect. when hopes it doesn't have any effect, but smith is already

well down the line. and there's a lot of reason to think this kind of reading the tea leaves that he's pointing in the direction of charges. i think the notion is that they're both -- separate victims if you. well that's a question that's provoking a lot of attention. doesn't make it more likely, less likely, i think it makes it neither one nor the other. but of, course the way things are going independently. >> harry, last question to, you just to be clear on the law here. all i heard about loss agatha -- from trump defenders, it's all about intent. you need to prove intent. and trump basically came out and infect -- my documents, to give them back to. me there's no evidence of intent on joe biden's part. >> there is not only no evidence of intent, there's no evidence of knowledge. i find it inconceivable that he's gonna be subject to criminal charges and for that reason, i think you need to say that this -- driven by more than the letter of the law.

>> yes, indeed. harry -- former u.s. attorney for the western district of pennsylvania, always a pleasure. joining us now is congressman eric swalwell, who served on the house intelligence committee in the 117th congress, democratic congressman from california, thanks for joining us. do you agree with the appointment of a special counsel in this biden classified documents investigation, you just heard harry lippman saying, that it was in a position from someone who claims not to be a political -- ? >> sure, mehdi, i do agree. to harry's point, i think you're gonna find that there's nothing there. it looks inadvertent, they're cooperating. treat them both the same. that's what we all want. i do also agree with your point though. that too often democrats want to stand so virtuous on mount olympus. i often tell folks that we fight with one hand tied behind our backs.

and it's the upper hand. and so, i think sometimes we think that by doing these exercises it's going to please republicans, it's not, my colleagues are attacking mr. hur, saying he used to work with chris way. who by the way, was appointed by george bush, and donald trump. >> don't forget, the person who famously went after trump robert mueller a lifelong republican. i'm glad you preemptive my next question. which was gonna be why democrats keep appointing red right wingers. let's talk about jim jordan, who wrote a letter to mary garland today announcing days lodging his own investigation into the house judiciary by the house judiciary pretty into the biden documents these are the same republicans who didn't care about documents up until a few hours ago. that's what they said before the biden documents were discovered, they don't care about improperly stored documents.

what's the real motivation, what do republicans get out of that? >> they're forming a law firm to defend riders at the capitol. they should call it interruption llc. that's what it looks like, mehdi. jim jordan doesn't care about documents he also doesn't care about voters because the message the voters sent this last election was that they want us to focus on delivering when it comes to lowering health care costs, investing infrastructure, keeping kids safe, and that they don't want -- rejected extremism all over the country. and then here they're doubling down on extremism. what you're gonna see is a three pronged approach, from democrats, one we're going to discredit jordan every step of the way. to make sure they have zero credibility. will debunk all of the lies thrown with the biden administration. we're gonna show that if we were in the majority what we'd -- health care, infrastructure, women's reproductive rights, protecting our kids.

why is the entire political world trading george santos and his lies as such an anomaly. why are we acted like he's that different to a whole host of other republican politicians. take former president trump, who lied about everything, not just the size of his rallies, or the election result, a personal. stuff santos style stop. for, example falsely claiming he was top of his class at walton business school, he wasn't. and inflating the size of as wealth and valuable. does he live more than 30,000 times while in office. former north carolina gop congressman madison cawthorn, remember, when he lied about getting into the naval academy. former georgia republic santa candidate, herschel walker, lied about being a police officer. most republicans that ran for statewide office last year publicly stated they believed the big lie, that trump actually won the 2020 election. i can go on and on. but you get the point. the maga lead republican party today is filled with cereal fabulous. and why wouldn't it be.
