second impeachment for trying to overturn the election in 2020. he said it exactly to -- it's an odd mile stone to hit for our country, it's especially odd when the same kevin mccarthy who once blamed iran for january the six is now saying a speaker he'd be willing to look into ways to expunge donald trump's impeachment. now, i do think it's important to remember today that even though donald trump hasn't yet been held criminally liable for january the 6th. the former president has still founded self and a deep well of legal trouble since he left office. we know that in the state of georgia the former presidents currently under criminal investigation for trying to cajole the georgia tech understated flipping the 2020 election results there. in his favor. there's also multiple ongoing

criminal investigations into the former presidents businesses, just today, the trump organization was ordered to pay a steep financial penalty after the company was found guilty of felony tax fraud. there's the ongoing justice department, the investigation into january the, six with a special counsel jack smith is investigating whether anyone committed a crime. by trying to disrupt the peaceful transfer of power, also under the special counsel 's view, is of course the trump documents investigation. about whether donald trump mishandled classified information by storing a trove of top secret government documents at his florida beach club, and pretending they were his. now let's pause here for a second, as i'm sure you are well aware. it's recently been discovered, that the current president joe biden, also had several classified documents improperly kept at the office first thing tank. and at his delaware home. documents from the time he was vice president, right after -- joe biden's lawyers after

discovering the documents at his office. a lead -- turned over the documents, and searched all of joe biden's offices and properties to make sure there are no other classified documents, accidentally being stored. they're on donald trump's and, the federal government repeatedly asked trump's team to turn over classified documents they believe were being improperly how at mar-a-lago. donald trump resisted turning over those documents. to get them back, the justice department passer than with a search warrant. to secure that warrant, the fbi told the judge, that they expected to find evidence of obstruction. by the former president at mar-a-lago. , so let's stop comparing or equating biden and trump. but there is one other really important difference between these two stories. it's the reason why i want to spend a few minutes laying out all the different criminal investigations into donald trump right now. the difference being, only one of these two guys walks around

every day carrying the stench of multiple criminal investigations. context matters. despite the vast false equivalency,'s attorney general merrick garland went out and appointed a special catholic to investigate joe biden's -- classified. formation and that special counsel, isn't as any lawyer, oh no his name is robert -- a lifelong republican -- william rehnquist. he's attended federal society events, and was a trump administration appointee. that's the guy merrick arland pick to stick on joe biden. here's the thing, as hard as -- trying to be in partisan, as hard as he's trying to appear not treating joe biden any differently and the doj's treating donald. garland isn't actually treating them the same at all. more than a year and a half passes the national archives first raised the issue of -- for merrick garland got around to picking a special counsel to investigate further. it took garland 72 days to assign a special counsel to biden after biden's team first alerted the national archives. althe talking points memo points out, with its pick to investigate biden, garland carries on with a tradition of democrats and of this, picking

than rely on the swamp monster special counsel, they're running their own investigation. nearly knitted house judiciary chairman jim jordan announced today the first order of business for his committee will be investigating biden's handling of classified materials. short of putting donald trump himself in charge of running the biden investigation, there is no candidate merrick garland could pick that one set of five republicans or stop them from accusing the justice department of unfairly running these investigations. what was the point of garland picking one of their own guys? when will democrats stop trying to appease the right? because you can't. joining us now, harry lippman, former deputy assistant attorney general, and former u.s. attorney for the western district of pennsylvania. harry, thanks for being here tonight. my first question to you is, was garland's hand forced when he made the choice to put this first in the hands of a different trump appointee who recommended to garland he

appointed a special counsel? i wonder whether he kind of, you know, put a box in himself in the corner? does it make sense to you, given what people say, there's no evidence of any underlying criminality in the biden case? >> that's really the number one point. a lot of people are saying it's forced. it's true, when someone says you need to do, it it's very difficult for him not to. the letter of the law is that you will appoint someone when they are a criminal investigation is warranted. there is not a scintilla of evidence that biden has done anything wrong, much less criminal. if somebody has, if there is some sort of mid level staffer from his old office, you don't need a council for that. he did it for political reasons. that doesn't make it bad. it might have been it was all in all savvy and forced, but it wasn't by the book which is how we thought about garland in the

past. >> let me ask it straight, harry. if there was no investigation into trump and mar-a-lago right now, are there be in investigation into joe biden? >> i don't think so. it's a great point. on the other hand, of course, this is the hand he and the administration has been dealt. you are right, it's a hard charger and a staunch republican. on the other hand, there's so nothing there for biden. i think garland can anticipate, a subtext here that others really haven't remarked on so much, he is going to take the recommendations of the professionals he appoints. that means jack smith will, in short order, recommend charges at mar-a-lago, and will recommend nothing in the biden case. that could be wrong. there is independent councils that have a way of becoming

their own story branching out to others, et cetera. it's going to take a long time to get a stuff together. this could hover over the white house for a while. nevertheless, garland anticipates he will be in a position down the line to say i did what he recommended, i did what smith recommended, and that will equate to trump charges, no biden charges. >> it's interesting, first of all, fascinating, what you say about the likelihood. just to be clear you believe that appointing her to investigate biden increases, not decreases the chances of jack smith recommended criminal charges against trump. >> i'd say it doesn't have any effect. one hopes it doesn't have any effect, but smith is well down the line, and there is a lot of reason to think reading the tea leaves he has pointed in the direction of charges.

-- joining us now, eric swalwell, who served on the house intelligence committee, the 117th congress. democratic congressman from california, thank you for joining us tonight, congressman. do you agree with the appointment of a special counsel in this biden classified documents investigation? you heard harry litman say it was a political position from someone who claims not to be political, merrick garland. >> sure, 90. i agree, and also, to harry's point, i think you're going to find that there is nothing there. it looks inadvertent, they are cooperating, treated about the same. i think that's what we all want. i do agree with your point that too often democrats want to stand so virtuous on mount olympus, i tell folks we fight with one hand tied behind our, back and it's usually the upper hand. so, sometimes, we think that, by doing, you know, these exercises, it's going to please republicans. it's not. republican colleagues are

attacking mr. her saying that he used to work with chris wray, who, by the, way was appointed by george bush and donald trump. >> yeah, don't forget the person who famously went after trump, he hates robert mueller also, a lifelong republican. you preempted my next question, which was going to be why do democrats keep appointing right wingers? let's talk about another right-wing, chair of the house committee, jim jordan, who wrote a letter to merrick garland today, announcing he is launching his own investigation into the house judiciary, by the house judiciary committee, into the biden documents. these are the same republicans, same jim jordan who didn't care about documents up until, you know, a few hours ago. that's what they said before the biden documents were discovered, they don't care about improperly stored documents. what is the real motivation for the jorden investigation? what do republicans get out of that? >> they are forming a law form to defend rioters at the capitol. they should call it

insurrection llc, because that's what it looks like, mehdi. you said jim jordan doesn't care about documents. he doesn't care about voters. the message the voters sent this last election was they want us to focus on delivering when it comes to lowering health care costs, investing in infrastructure, keeping your kids safe, and schools. they don't want extremism, and they rejected extremism all over the country. they, here, are doubling down on extremism. you will see a three pronged approach from democrats. one, we are going to discredit jordan every step along the way to show they have zero credibility. we're going to debunk all of the lies, thrown of the biden administration, and show that, if we were in the majority, what we do on those core issues i laid out, health care, infrastructure, omens reproductive rights, protecting our kids. that will be a waning message. >> congressman, how could you say they're not focused on issues americans care about when they are focused on the existential threat to our gas

congressman george santos's campaign spending, there are a lot of fishing expenses. there's that $40,000 spent on air travel in a local election. there is the 30,000 dollar spent on hotels in places like tennessee, virginia, texas, florida, california, kansas, michigan. in a local, new york election. the $11,000 that appears to have paid for santos's own rent during his campaign. the expenses of santos that campaign finance experts say raised flags are the more than 30 expenses that came out to a total of $199.99. a convenient single penny short of the 200 dollar threshold where the fcc requires you to keep proceeds to preview spent the campaign money how you claimed. most of these 199 dollar and 99 something expenses claim to be from places like best buy or staples, or uber, where there's

an infinite number of possibilities as to exactly what santos or his team were buying, or how far his drive was. seven of those miraculously hundred a 99 dollar and 99 cent charges were supposedly at this italian restaurant in a little neck, queens. what are the odds of getting that exact tab there thanks to some intrepid reporting by alexander simon? we know they're not good, last night alex, he ate dinner at this restaurant with the explicit target of trying to get a bill there of $109.99. santos style. as orders of all lives and choices and squash blossoms and pasta and a martini were not because that's what he wanted to eat, but because he was specifically crafting his order to get as close as possible to that magic number on the santos bill. even with that much effort, alex could not do it. his bill came out to $194.89, and with tip, it blew well past 200 dollar fec threshold.

i watched a call the accountable dot has filed a complaint against george santos with the fcc alleging he used campaign funds for personal expenses. that's a second complaint filed against sent us this week. that comes on top of eight of his republicans in congress calling him to resign this week. and his local republican party telling him explicitly he's not welcome to any of their events, and they want him to resign as well. that's well and good. here's what i don't quite get. why is the entire political world treating george santos and his lies as such an anomaly? why are we acting like key is that different to a whole host of other republican politicians? take former president trump who lied about everything, not just the size of his rallies, or the election result, but personal stuff. santos style stuff. for example, falsely claiming he was top of his class at the business school. he wasn't. inflating the size of his wealth, the value of his properties. i literally lied more than

30,000 times while in office. former north carolina gop congressman madison -- remember him? he lied about getting into the u.s. naval academy. former georgia republican senator candidate herschel walker, he lied about being a police officer. mostly hope with kids that run for statewide office last year have stated they believed the big lie that trump somehow actually won the 2020 election. i could really go on and on, but you get the point. the maga lead republican party today is filled with cereal populists. why wouldn't it be? it's the logical end point of being a party in hawk to one donald shea trump. tonight, the new york times is out with new reporting that as early as november of 2021, a small circle of republican campaigners found out santos's back story was riddled with lies. the times reports that, in december 2021, santos's -- emergency call to present mr. santos with a choice, bow out of the racist dignity, or stay

in under escalating democrats turn up the same information and use it to destroy his political and personal future. when santos refused to resign, most of his team quit. that was a year before santos got elected to congress. somehow, none of the republicans were in the know that he was a fraud. they thought it to be a good idea to speak up. that says less about santos and more about the state of the republican party. in the words of my friend, george santos is right where he belongs. joining us now, columnist for the daily beast writer, thank you for being with us. let's get a reaction tonight's reporting in the times that at least a small circle of new york republicans knew that santos was a fraud and a liar, for over a year, and didn't say anything? >> like i said, the awesome sensational and ventilate george santos also known as, i think, alexander doubler, and spartacus and batman. the former president of estonia,

the processional -- humanitarian george santos, right where he belongs, mehdi, because yes, even though a few of his colleagues, especially from nassau county have asked for him to resign, we know kevin mccarthy, the house majority leader, the spineless amoeba of a man, earlier this week, said, hey, nobody is perfect, right, when asked about santas, he said, until proven guilty. mccarthy needs that slim for a vote majority. if george santos, a man who lied about being jewish, lied about his being married to a woman, lied about his mother dying in 9/11, in addition to having investigations both at the federal and local level, he says, why should i quit? i'm following in the footsteps of the leader of the maga party, and yes, even though he has weakened, donald trump is still the leader, who, by the way, as you said, lied more than 30,000 times as president and, by the way, i should say this, not just lies, but committed fraud, just this week, trump organization has to give 1.6 million. trump university, trump foundation. if they still follow donald trump as the leader of maga, if i'm george santos, i'm like,

like i said, they need his vote. there is a slim war vote majority. it's not just this investigation that new york times article you pointed out in the beginning also says this company called the red stone nobody can find, by the way, mehdi, just check millions of dollars from republican donors. it has not filed with the fcc, they don't know where that money really has gone. that investigation could expose george santos to criminal liability. like you said, these republicans, a small influential group of republicans, according to the new york times, knew about, this yet kept quiet. if they kept quiet about donald trump, a violent insurrectionists, who was impeached twice, a man who lies with his every breath, why would george santos resign when they still followed trump? earlier this week, kevin mccarthy think matt gaetz and donald trump, the man who literally he may lead to him in public and held up the vote for 15 rounds. i don't see him resigning unless there is a criminal investigation, perhaps an indictment, and a conviction.

smith. he made sure to add in his favor line at the end of his tantrum, quote, election in all caps, rigged -- least acquit -- his rampant in america. and cost of the election. and he's pushing that lie over two years after the presidents election. and that he very clearly lost. you almost have to admire his message discipline about how dishonest his message -- there are two things you need to know about the 2020 election. one, despite what republicans would like you to think. there was no widespread systematic rampant voter fraud that would've changed the result. and number two, the small random cases of voter fraud that do keep coming up, while, they seem to have been committed by republicans. how could we forget the nevada republican voter who said he founded sickening to learn that someone had casted a ballot is diseased wife's name. the trump supporter story became a rallying cry for the trump campaign and the gop. turns, out the republican voter himself ended up getting charged with two counts of voter fraud forecasting a ballot in his wife's name. that man typical to voting more

casting his wife's mail-in for -- wait for it -- for donald trump. while shenanigans from the 2020 election are still coming to light, we're learning a few more recent ones. we learned this, week a former state republican election official pleaded guilty to illegally using voters personal information to obtain absentee ballots in 2021. that's also known as voter fraud. the indictment describes the scheme in which the former official allegedly had voter sign an envelope, that was supposed to hold a completed ballot and then, he would, according to the, indictment filled out the ballot and submit them. this is the republican who is tasked with being the election commissioner for a county in upstate new york. you can assume he knows how elections are supposed to work. he's the second republican official in the same county, to plead guilty connection to a voter fraud's game you can't make this stuff up. a local republican councilwoman pleaded guilty to identity
