more documents with classified markings were found at president biden's delaware home. today the president is set to travel to atlanta for a church service honoring martin luther king junior, the day before the federal holiday in his memory. we begin with white house correspondent allie raffa, traveling with the president in wilmington. good morning, ali. is there any word on whether the president will speak about this document probe today? >> katie, good morning. just to start out, this is not how the white house saw the run up to this trip playing out. as a plan for president biden to deliver these remarks at ebenezer baptist church in atlanta today to honor the legacy of dr. martin luther king. warren what would've been his 94th birthday. as you mentioned, this is coming less than 24 hours after we learned yesterday from statements when the white house council as well as president biden's personal lawyers that more classified materials were found at his wilmington home, just days ago. again, the white house went in

days before acknowledging these materials, a few hours after that news broke. president biden attended a church service yesterday here in wilmington. lee pool of reporters that were traveling with him was not able to ask about this. so you can imagine president biden's team are expecting just a bombardment of questions when they eventually do travel today. so for the white house is maintain this posture the overflowing any questions to the justice department, special counsel's office. in an effort to not appear like they are interfering in a way with this independent probe. that reaction has been criticize from both republicans and democrats. both of them agreeing that the white house's reaction to all of this could've been handled better. both of them saying that attorney general merrick garland made the right call, and pointing at the independent special counsel to investigate the mishandling of these documents. i want you to take a listen to a democratic congresswoman ilhan mueller ole miss had to say about it this morning.

>> anytime there is a deviants in regards to security protocols that should be taken seriously, it should be investigated. what i find interesting is that republicans who have defended trump after he literally stole classified documents refused to turn them over, lied about having. the made up some story about how he declassified them. hard to have his stuff raided in order for those documents to be found. are now only interested in investigating biden. >> katie, house and senate republicans on key committees have either pledged to overlapping probes to the mishandling of these classified documents. this is a legal battle, which biden was really not expecting just a week ago and president biden wasn't mexico for that summit we saw with the leaders of canada and mexico.

capitol hill with more. it looks like we are putting two major showdown. what are the expectations going into this big debate? >> good, morning. katie both sides are at a standoff, and that is because democrats, even frankly most republicans in congress, want a clean debt limit bill. then you have that group of republicans, mainly members of the house freedom caucus who made those concessions to the back room deal with kevin mccarthy to get him the speakership they negotiated with him over the death ceiling, saying that in order to get their support and raising the debt ceiling, which he needs, they were the murder the future spending that's been part of that lit. that happened simultaneously. the president as you just heard from ali is traveling, of course. the white house on friday said that he will not negotiate. he wants a clean debt limit raised. that signify with democrats, either. schumer and jeffries over in the house as, well saying they want that clean lip.

here's the problem already coming to fruition. you've danielle and making the opening play to congress, saying this upcoming thursday the 19th is when they expect to hit their default. expect to hit their debt limit. but they can use emergency measures to stretch that into june. she is giving an early warning to lawmakers, similar to what we saw in 2021. similar to this, 11th event, or in republicans were totally at the standoff with then president obama on these issues. it is a real problem because if republicans maintain their position in the house and maintain where they are, we could potentially have the default for the very first time. ruining america started for future borrowing, and ruining a lot of american jobs. this is a big issue playing out live on this holiday week. >> thank you julie tsirkin for all of that information. i know that you and others as well as us are looking at that very carefully. now we are going to turn to

california, where president biden has declared a major disaster. as storms continue to pound the west coast. at least 19 people have been killed since december, and one of the worst series of storms the state is overseeing. nbc news correspondent dana griffin has more. >> 27 million are under flood alert across the golden state, some places seeing rain up to eight inches. >> since there's, rain your car starting through the control. starting to float away. two feet are. left >> santa cruz county had emergency evacuations, tweeting for residents to please leave now. as the river began to quickly rise. crews had to close this road after a partially collapsed. meanwhile, on friday, a california officer saves to people stop in a car, teetering on the edge of a cliff. officers reminding people to drive only if necessary. some areas already seeing their

house announcement that more documents with classified markings were found at president biden's home in delaware. before that disclosure, some democrats were already frustrated by how the white house was handling the situation. nbc news reported the democrats were calling on the biden administration to be more forthcoming about it. quote, one democrat member of congress said he has heard nothing from the white house in terms of officials saying what happened. and he is not a loss to explain it to constituents. the white house declined comment for the report, one person did say that anybody

questioned the administration's response probably has not ever been the subject of a doj special counsel investigation. i know you have heard a lot of biden and trump comparisons this week. but keep this in mind. trump refused to immediately turn over hundreds of documents demanded to the national archives, eventually forcing the fbi to execute a search warrant at mar-a-lago. what a big difference from biden's lawyers finding the documents and immediately turning them over. to talk about this another big headline, he began this newly-, i'm glad to welcome to our show congressman richie torres. a democrat representing new york. congressman discipline to have you this. morning let's start with this question. are you satisfied with the communication that you have received from the white house about the document situation, and to do you think that the biden administration and biden itself have been forthcoming enough with the public being able to draw some of its concerns? >> i am fundamentally satisfied with the biden administration's

response. president biden's personal lawyers sound these classified documents. first at his private office and in his private home. and immediately reported them to martial archives. and has been cooperating with the department justice ever felt sense. by contrast, donald trump made every effort to obstruct justice at every turn. so for me, trump's obstruction of justice is the central factor that distinguishes his case from president biden. antiquated the two means comparing apples and oranges. >> congressman, are you okay with the idea that special counsel has been supposed to be looking to close if we don't remove the vote on president biden's office and at home? >> the pilot made the right decision and appointing the special counsel. whenever there is mishandling classified information, on the part of either a current or former president, there ought

to be a special counsel to ensure that everybody is held accountable. and the fact that the biden administration is willing to hold itself accountable is a mark of integrity. the kind of integrity that you would've never seen with the trump administration. you might recall that donald trump had general jeff sessions subjected to endless harassment in humiliation following the department of special counsel. and in the aftermath of the 2020 march, pressuring the justice department to interfere with the election. so the contrast between the two administrations cannot be more glaring. >> i want to move on to the new congress. by the, way congratulations on finally getting sworn in after five miserable days, i am sure. let's specifically focus on a washington report, congressman, the house for the consulting together a plan for potentially reaching the debt limit. what are you and other house democrats preparing to doing a

response? >> the point of those republican serves as a reminder that congress has been hijacked by the far-right. and the far-right insist on burning everything down, including the leadership of their own party and the full faith and credit of the united states. it was made crystal clear that there is nothing physically responsible for developing on the nation's debt. it's downgrading the nations credit rating. and easing the cost of, that it will only deep in the physical crisis. so it is completely irresponsible and unacceptable, and we need the more recent republicans to stand up to the extremes of their party. in theory, the majority of members of congress could file a petition to force a bill to the vote, which require 212 democrats plus six morrow help luckin's. the question, is are there

enough reasonable republicans have the courage to stand up to the extremes and support raising the debt limit? >> before i have to let you, go congressman, i don't stuck with george santos. how could you. not his many lies maybe catching up to him. you open an outspoken critic of that republican, calling on him to resign. filing an official ethics complaint and even introducing a new bill called the santos act. santa standing for a stop another non truthful office speaker. do you think in this era of extreme polarization between democrats and republicans that you can actually find some unity getting george santos out of congress? >> we are beginning to see bipartisanship. there are a number of local republicans who have come out in opposition to george santos. i have a simple rule. if you cannot be trusted to tell the truth about your name, then you cannot be trusted to serve in the united states congress. george santos has no choice but to resign, because his ability

to overturn trump's 2020 election loss in georgia concluded its investigation. in grand rapids recommendation included with the criminal charges should be filed, and if you have to be made public. but now in the hands of fulton county district attorney fani willis. there are a wide range of potential charges available to her. including those used for organized criminal activity. like. rico perhaps most concerning for, trump in light of us now infamous phone call for georgia secretary of state asking him to, quote, on the 11,000 8000 votes to defeat biden, georgia is a state law against, quote, criminal solicitation to commit election fraud. what can we expect now? joining me this morning is glenn keys fleming. she is the former guest district attorney and -- georgia's trump investigation. for those of you have not read, it i would urge you to get out there and actually read that report. because, glance there are part was just so comprehensive.

but i know that you in the other authors drawn to that before the conclusion of this grand jury's investigation. so i wanted to ask you based on your experience as a prosecutor, and frankly everything you know about this case, can we expect to see a trump indictment of the fulton county in the next few months? >> i think it is the big question. the report itself was based on the evidence that was available in the pelvic realm. i'm quite sure the fulton county's d.a.'s office has significantly more information and evidence than what we as outsiders may have. once the report outlines, just based on what has been publicly reported, there is a substantial likelihood of possible charges on several different types of car accidents, including those in the election code, like you mentioned. >> one, in just over a week we, all as an america, could learn a lot about trump's oversee overturn the 2020 election when the judge will decide on

january 24th rather the grand jury report should be made public. most of us do know that grinder is operate in secrecy and confidentiality. in your opinion, what are the chances that the public will ultimately people to read that report? ? >> this is a special grand jury, it is a little different from the regular grand jury in a couple of ways. one is this to report that at least in my experience has become public. in past instances. and, again the special grand jury has asked that the report we made public. but the regular grand jury's deliberations and things are usually not publicly known. and so that really is the next step. the d.a.'s office now has at least some recommendations from the grand jury. and we don't know what they, are as you mentioned. but to the extent they recommend that she pursue charges, she will go to a regular grand jury, offering them a bill of indictment. and see they will decide if there is sufficient evidence of

crimes to move forward. and actually, a true bill. formally present charges against certain defendants. >> and based upon that distinction, with a difference as you describe between a special grand jury that has been doing the investigation so far, and a regular grand jury which we know actually meets on tuesdays and fulton county and january 24th, is a tuesday. >> it is. >> explain to our viewers whether or not, if the special fund-raise recommendations are not to pursue charges, is fani willis or an irregular grand jury necessarily bound by those recommendations? >> she is not necessarily bound. but again, that would present some challenges, because basically a small group of residents has heard some of the best evidence that she can present. and if they decide the charges are not appropriate, it's okay to go to the two would go against that recommendation. almost there were some pretty

compelling reasons. it will be interesting to see what is in the report. interesting to see what and when fani makes a move to bring charges, as you mentioned, the grand rights on tuesdays, i choose to send friday so she could do it later that week. but there is also the question, as you know from your own experience, that is soon as she filed a could be that some defendants will seek a trial demand. so rather than have that filed in the middle of the term, but she mike may wait until the beginning of the new term. she is a full timeline to be able to honor that demand. as opposed to it being cut down by 20% if she files it here in january. >> i have a minute left. i do want to ask you about one looming consideration, what you are nine hours a prosecutor. it's not always a bit of probable cause, have been on all fours the elements of a crime. you to consider juries and the

possibility of jury nullification. you also donald trump already announcing he is running for president again in 2024. do you think that factors into the calculus for dea fani willis in terms of bringing an indictment? >> i think it is something that is in the back of the mind of every prosecutor. but it never rises to the level where you would fail to pursue charges. again, our draw of when i was a former district attorney it is your job to follow the evidence. so if there is evidence of a crime, which is occurring, it is your job to presented to the grand jury and let them decide. sometimes you win those, cases sometimes you don't. but you never fail to move forward for fear of losing. >> when keys fleming, you're gonna come back because you're gonna, have foreshore, a lot to talk about. because i think the indictment is gonna be coming for donald. trump thank you for joining, us appreciate having you here. >> my honor. thank you. >>, and coming up, we'll

mention of inflation. one mention of jobs. two mentions of the economy. and 20 different mentions of investigations. is this all that we as americans are going to expect from the house gop anymore? basically political investigations instead of actual governance? >> yes. yes. this is what the politics of grievance, the burn it all down freedom insurrection caucus style approach to governing, looks, like katie. and i think it is important that we reflect on what congressman waltz just said about his time in the tea party caucus. he came to the sobering and i think hurricane collusion that it was a mistake to hold the debt ceiling hostage. when you to reflect upon what the implications of that are. this is not just something that, we'll, if it happened it would be a problem. this would be catastrophic for the american economy. in our history and our 246 plus

year history, we have never defaulted on the debt. this would represent 6 million jobs lost within a matter of weeks if not months. and something like 14 trillion dollars in wealth which would evaporate and be erased from the nation. think about the implications of that. we are talking about going straight into potential global depression as a result of this. and i think, katie, the question is on the table now. should we start to consider the house republican majority, the nation's number one national security threat, because the starts of brinkmanship politics is exactly the type of threat that we look at and wonder, on trying to prevent from happening. the applications for national security and global stability are profound. that is why i think right now it is incumbent on the biden administration to start going through every single member of that republican caucus and
