santos. republican leaders refused to -- no matter how many times he's bizarre lies are exposed. and forget gas stoves. even more outrageous -- nothing burger involves a made-up story about a pregnant batman villain. ♪ ♪ ♪ it was in april 2010 that justice john paul stevens, after serving 34 years on the nation's highest court, announced his intention to retire in a letter to then president barack obama. the news, naturally, set washington into a tizzy, of all things. scotus usually do. overnight, every tom dick and harry had suggestions for who obama should name as a replacement. republicans got in on the action as well. even conservative republicans like the then long serving -- of utah. he proclaimed he had found the perfect candidate, a, quote,

consensus nominee, a small seat conservative, a jurist who would -- bipartisan support. quote, no question. the man was merrick garland. yes, merrick garland. the same merrick garland who, a few years later, in 2016, would be catapulted to superstardom within that liberal imagination after being rejected by mitch mcconnell and the senate gop as a nominee to fill not john paul stevens seat but antonin scalia's spot on the supreme court. you are forgiven if this slip to your mind. mcconnells smoke and mirrors routine has a way of fogging up the past -- that was not more obvious then with merrick garland who went from our inheritors small seats conservative strain trist to woke liberal pin-up almost on a level with rbg herself. you may be startled to hear that back in 2016, it wasn't garlands left-wing bias that was the top of the town, but his rather staunch habit of backing the blue, rolling in

favor of law enforcement compared to his colleagues on the bench. and fortunately, those are precisely the type of details that are lost in history, when you become a side character in a racist republican hatchet job on the country's first black president. in 2021, when joe biden tapped garland to serve as his attorney general, democrats were largely overcome with ugly. a little schadenfreude, even. and they were -- they weren't really because in the wake of the greatest organized attack on this country's democracy in over 100 years, what biden actually needed at the doj was a fighter. i scrap, or a muhammad ali in a suit. but he wasn't going to concern himself with the fake civility and that kabuki theater that has come to define d.c. bipartisan both sides-ism. is merrick garland a brilliant legal mind? undoubtedly. is he a man of principle? absolutely. is he the right person for this

moment? the fighter at the doj that we need? no. most certainly not. it's bad enough that he has slow walked in the accountability process when it comes to the organizers of the worst attack on our capital since 1812, to the point where even members of the congressional 16 kennedy are wondering why the doj under garland it was not moving faster against trump and his minions. this week was the week it became clear to anybody who had their doubts that a.g. garland is out of his depth and getting outplayed. by, now i'm sure you are familiar with the news that a handful of documents bearing classification markings were discovered by president biden's lawyers at his former office, in d.c., and his wilmington, delaware home. biden's lawyers immediately contacted at the white house counsel's office, reaching the national archive but i have the find. the president himself has expressed frustration with how the debacle has been received, as well as what has been called probably sloppiness, probable sloppiness, excuse me, by his own aides.

history logs to the residents. we want to know who had access to the biden center for diplomacy. this is the same type of investigation that the democrats were so outraged and demanded happen to president trump. >> oh, come on. this is the same bad faith james comer who didn't care about which wedding guests at mar-a-lago may have tripped over classified documents while partying at trump's resort home. the hypocrisy and bad faith of the modern gop should be clear to anybody paying attention. perhaps merrick garland just isn't -- his bizarre behavior on this story. consider the timeline. between february 9th 2022 when doj was informed by the national archives and records administration on mayra that the trump team maybe secretly keeping classified materials at mar-a-lago, and november 18th 2022 when merrick garland appointed jackson as a special counsel to investigate the

matter. 282 days have elapsed. 282. we can start with how on november the 4th 2022 the doj was contacted by merit and white house lawyers about the newly discovered when biden logs. by january 12th, 2023, this past thursday, he had signed the order of the special counsel. a mere 69 days later -- >> i'm confident that mr. hurt will carry out his responsibility in and even-handed and urgent matter and in accordance with the highest traditions of this department. >> 280 to slow, plotting days to investigate trump's blatant obstruction. a speedy 69 days looking into biden's sloppiness. in fact, just three days after cbs news broke the story of the biden docks, that's how fast garland moved with biden. maybe kevin mccarthy is right about a two tier justice system in america. one that helps the bad faith

republicans and one for everyone else. the pace of the inquiry is not the only difference, however. there's also the matter of who garland tasked to spearhead the job. for donald trump, garland hire jack smith, a literal war crimes prosecutor, a man respected and independent as they come. that mattered little to the former president and his allies, all of whom wasted little time in smearing the man as a terrorist and his wife as a partisan extremist. you might think garland learned the lesson of the jack smith appointment. no matter how independent the person you pick is, conservatives will cry by us. best to ignore them and do the right thing, right? wrong. that's not what garland did. when it came time to investigate biden's documents and criminal liability, first garland handed the job to the u.s. attorney for the northern district of illinois, john laos, a trump appointee. when he recommended a special counsel for biden, surprise, garland opted for another former trump appointee, robert

merrick garland's moves this week? i feel like we live in an era where liberals, democrats have just internalized this republican attack on them as we must be biased, they say we are biased, we are biased, we've got to do something about this bias. >> i think it's time for merrick garland to go, to be blood. i think it's time for me to be attorney general of the united states of america, let's see if we can make that happen, i would charge donald trump on day one, mehdi. it's two years and nine days since the january 6th terrorist attack. merrick garland -- investigating donald trump, reporting we learned when cassidy hutchinson testified last july. look at brazil. bolsonaro, they open up an investigation into bolsonaro one week after the attack. that sends a message that we want to protect our democracy. we don't allow coups by former leaders to go unpunished. we are going to hold people accountable. merrick garland, my friend, he's not going to resign. -- investigating joe biden. the failure of maryland is not

this special counsel. it's not charging donald trump two years and nine days. what's the message to fellow americans? what trump could not have been that bad, because if it was that serious, i know it's not an episode of law in order, you could have enough resources to charge him in a year, a year and a half. two years later, the message to fellow americans is, what trump did in attempting a coup and inciting a terrorist act on our capitol wasn't that big of a deal. that's why merrick garland should go. >> jen, just returning back to the documents point, unless i'm mistaken, when it comes to this documents stir, there is no allegation or a clear evidence of underlying criminality when it comes to joe biden's clearly sloppy handling of classified documents, right? during the trump debacle last august at mar-a-lago, the search by the fbi, we were told again and again that you have to have intent to make a criminal case. there doesn't seem to be intent on biden's part, or even knowledge. on what basis did merrick garland appoint a special counsel? >> many, you are exactly right

on the lot. the mere possession of ten or whatever number of classified documents is not any kind of crime. in fact, the kinds of crimes donald trump was being investigated for related to obstruction because he was heightening or -- you asked what's going on here. i have to agree with dean. donald trump was a serial arsonist, crime after a crime that when he came into office, merrick garland could have investigated. the places burning. he sees one with of smoke and he thinks, let's call in the fire department. we have seen, and you put the dates up there, we have seen merrick garland act fast when it comes to democrats. sam bankman-fried, another example, in less than a month, we had that guy -- he was indicted, dated.

just today the washington post reported that the investment firm where santos work engaging with the sec calls a classic ponzi scheme, that defrauded -- excuse me, defrauding people out of millions of dollars. that company is no longer an operation. santos's lawyer claims he has no knowledge of any wrongdoing. for a man he was lied about everything from his education to his religion, to his net worth, that's rather hard to believe. now we are left asking where is santa's getting his money, including $700,000 he donated to his own congressional campaign. who knew about his lies and when did they know about it? the new york times reported that vulnerability researched -- his own campaign in late 2021 exposed the pattern of deception so startling and brazen that some members of his own team quit. two sources also told the times that the head of the main house gop super pac and a close ally of house speaker kevin mccarthy, he expressed his own concerns to lawmakers and donors behind the scenes that santos could be

exposed as a fraud. what did kevin mccarthy know and when did he know? it -- back with me now. dean, the new york times reports the chair of the main house republican -- was so concerned santos could be exposed as a -- also reports santos's own campaign team members quit after his lies were internally covered. why didn't any of these many republicans not tell any of us in 2022? is it just because mccarthy, the republican party, cynically needed his seat, his vote? >> you win, you've got it. that's it. that's all it is, mehdi. very simple. george santos is not just a self made man, he's a self made up man. i've never seen anyone like this in my life. the volleyball, i mean i'm glad he has -- we don't need that. we don't want it. he's not muslim. we've got enough challenges. you have now --

the last week, the national republican leadership, the brunt of his district came out and not just announced him, they called for action. they called for him to resign. i have never applauded republicans in my life, but i am. there is -- they will lose that seat if there's a special election. they know it. they don't care, they will lose power for principle -- we stand for something. kevin mccarthy, it doesn't matter. it is our at any cost all costs, kevin mccarthy denounced trump week after january 6th, two week later, this is the gop we are dealing with. >> indeed. to be clear, dean, if he did claim to be muslim, george santos, of course, he wouldn't say he was muslim, he would just say he means he is muslim -ish. santos, jen, is being investigated by local and federal prosecutors. you are a law professor. what criminal liability for someone like george santos accused of fraud, accused of

defrauding other people, accused of lying about his background, ponzi scheme's, the brazilians are investigating. what is his legal exposure here? >> at the federal level, some of this can be mail fraud and wire fraud as well as campaign finance fraud. mehdi, what bothers me the most is he is quite similar to donald trump in that this is a guy who, if the white-collar criminal laws had been enforced before he ran for office, he would never have been in office. he was working at that time, at that ponzi scheme in april. the sec brought broad churches -- charges, civil charges, they could have brought a criminal charge at the same time against the enterprise and even him. it is frustrating to me that we see this time and time again, that there is a correlation between people who want power at all costs and will lie and steal to get it, and now
