from the justice department and its prosecutors, 30 gigabytes worth of more evidence from the committee's investigation has yet to be made public. the evidence, which fortunately is now in doj hands, could include text messages from lawmakers and even members of donald trump's own family, that news comes on the heels of a series of recent developments in the departments extensive criminal probe into january six. this week, the washington post received a copy of a wide-ranging subpoena sent to trump campaign officials last month from special counsel jack smith. the document seeks more than two dozen categories of information, including asking recipients to reveal if anyone other than themselves is paying for their legal representation. the doj also requests that information relating to various trump affiliated groups, voting machines and false election claims. in addition to these new subpoenas, sources tell abc news that just within the last few weeks, more individuals have been asked to appear

before federal grand jury, some for the second time. now, a source with direct knowledge of the matter describe the grand jury appearance as quote, far more intense than round one. and if that is the case, rudy giuliani may want to schedule some time to prep with his legal team. new york times reports the ex presidents lawyer received a grand jury subpoena for records related to his representation of trump, including documents that detailed payments he received. that is not all. another investigation in the team trump's plot to overturn the election just entered a new and critical phase this week. the fulton county special ranger grand jury -- in georgia's 2020 presidential election has now completed its work and a friend of the show and former u.s. attorney joyce vance describe the development is this, the first in a series of dominoes that need to fall in order for former president donald trump to see the inside of a georgia coat room.

it appears the ex president is certainly feeling the pressure. because in a ranch posted on social media site, trump complained about the man -- biden classified documents case, writing how company biden prosecutor is a nice guy? very friendly with democrats and rhinos alike, while my prosecutor is a radical left trump hating lunatic. now let's call this what it is, it is a desperate attempt by trump to deflect attention away from his own mounting legal issues by pointing the finger at biden and crying about a concocted double standard. but, the attention of the public and the intention of the investigators, those are two entirely different things. if trump had any hope to probe into president biden that will impact the status of his own doj investigation, well my advice is that he shouldn't hold his breath because this is what trump's former deputy -- rod rosenstein told chuck todd

let's begin by sunday night panel, -- host of crooked medias what a day podcast. susan del percio is a republican strategist and msnbc political analyst and also danny cevallos, he is an and msnbc legal analyst. great value three wish us on the show. danielle, start with you. some fear that the special counsel jim jackson's disappointment will slow down the investigation a little bit, but it appears to have at least have not the quite opposite effect. what do these most recent developments, particularly those wide ranging subpoenas, tell you about where the departments investigation is heading at this moment? >> the appointment of jack smith was always going to slow down the investigation in the sense that it had to be picked up by a new leader, the special counsel, from doj. now whether that involves walking over to -- and getting a flash drive, there are terabytes worth of documents, videos, text messages that need to be reviewed. each and every one, that

includes video if you are talking about january 6th and in the case of the mar-a-lago documents, of course documents communications all kinds of things. so, the special counsel has to review those things but given the subpoenas that we were seeing, they are moving relatively quickly and getting the information. now keep in mind january six committee put together a very interesting presentation, they educated us all over the summer months. but the doj and jack smith have powers that the january six committee simply never had. best example is subpoena power. yeah, congress kind of has subpoena power but in the last five years, can anyone say that our faith in congressional subpoena power hasn't been shaken? it has. because what we find out is that it is up to -- two enforce the subpoenas. doj enforces its subpoenas and it also cooperates with witnesses, it goes to people and says hey, you are in a little trouble, you can either talk to us and stay in a little

trouble or be in a ton of trouble and resist. so, and no surprise that any doj special counsel is going to move very quickly, because he has the power to do so. >> susan, based on how trump has reacted to the special counsel, do you believe that i chose or demonstrates that the president is somewhat scared or worried about the direction in which duck smith were. certainly the pace that with jack smith is moving with investigation? >> i think donald trump and has been concern since day one. before even the appointment of jack smith, but with jack smith does is cuts into the heart of the matter. in a certain way without the political noise behind it. and there is really two very different investigations that he is overseeing. the mar-a-lago documents and january six. that has to have donald trump going a little bit bonkers between the two.

and, that we just heard from georgia and there are grand jury that they finished their were, donald trump is just spinning out right now because he should be concerned. >> danny, let me just come back to really quickly about jack smith here and the headwinds. the new york times piece delves into what they described as unique headwinds that jack smith faces. this new republican house majority, and now the recent disclosures of president biden's retention of classified documents. could these circumstances complicate smith's mission? do you see them being a factor in how he goes about his job? >> a biden documents, yes. but for a very specific reason. if asked, i suspect jack smith and every other federal prosecutor would say look, facts that don't relate to my investigation don't government mastication. i am conducting an independent investigation, my only standard is whether or not i can prove criminal charges to the

standard of beyond reasonable doubt. now, that would be the textbook answer. but the political answer is, of course. these, this biden document fiasco affects jack smith's investigation. first, all eyes are now on him because they are asking the same question you are. how will you view this in your investigation? and there is a legal point to be made here and it is that prosecutors must consider, like factual circumstances. whether it is in deciding to charge someone or even all the way to the end, the sentencing. the theory is that like -- deserves like punishment. so in a sense jack smith now not only politically but in a sense illegally, has to keep his eye on what happens with his i guess, parallel universe special counsel. -- who is investigating the biden documents. >> i would argue though, the only difference, a few differences is that jack smith can also and should be

investigating obstruction of justice. i would argue that that is not the case with robert and into the biden investigation because biden has not demonstrated, at least as we know in public, any obstruction of justice where is in trump's case, there was a subpoena that was saying hey, hand over these national archives documents and he refused to do it. juanita, let me bring you into this conversation. james comer, the new chair of the house committee on oversight, called on the white house to release biden's wilmington residents visitor logs. thousands of guests pass through trump's mar-a-lago residents just feet away from top secret records and we have never heard a peep from him about anyone wanting to see the visitor logs from mar-a-lago. will the committee be putting in requests for those logs? and just bogging down and muddying the water between these two investigations? >> now you know that committee is not going to request anything from trump. like they requested from biden, i thought chrissy is front and center and we shouldn't expect anything different from republicans because of course

they are latching on to this as an opportunity to try and draw criticism, to the biden administration which was their mandate coming into this kong friends. but i fully expect the senator to move forward with this i, don't expect the white house to do anything but comply as they have been this entire time. right? the intention behind this, the proactive response that we have seen from the biden administration is what we need to continue to emphasize here. they are the ones who contracted the archives. they're the ones who handed things over to the doj. they are the ones who made the calls as soon as biden's personal attorney found the paperwork. that is what i think needs to be front and center as we discussed this. because this danny was talking about, likeness or similarity in investigations, there is not much. we have hundreds of documents on trump side, 20 maybe on biden's side. if biden administration contacting the authorities proactively, got trump ignoring court orders and subpoenas prompting an fbi search. i think that is critical here.

conservatives, maybe not at the ballot box but certainly at the courts. i mean, just look at the records. supreme court's most recent term is arguably its most consequential in decades, with blockbuster rulings on abortion, guns and religion illustrating how it's expanded conservative majority is willing to bullies its power with far reaching impact on every day americans and american society. the case is heard this term could have just as much of an impact. this week, the court heard impact that could undercut the appeal for -- workers to strike and stop authority from the need for national labor relations board. let's go back here a moment. senate democrats maintain an

>> turning me now is in a heizer, a senior correspondent for a box and author of the book the agenda, how republican core is reaching a america. ian, great to have you on the show. thanks for making time for. us so make the argument for us, talk about your rationale here the justices kagan and sotomayor should consider retiring now as opposed to waiting whenever they are ready to. >> okay, seems like we may have lost a connection to the end. we will try to establish that. but essentially the argument -- hopefully will be gettable to get him is the argument that in the two-year span they have to appoint justices that could perhaps be of younger age and that would give them the longevity to serve on the core. until the republicans at least in these to your windows see how the politics of it plays out. hopefully we will get that connection with the and reestablish so he can join us. but we do want to bring in our

panel to discuss that one, edith, susan and deniece of all us is she with us. you know, the argument that is being made is that with the republicans potentially taking over the senate and who knows what happens on the presidential fight, on the presidential front, this will be the only chance that democrats have to have to -- longevity to withstand the republican pressure on the courts. susan, i'll start with you. what do you think of that rational? >> i just think it is kind of political and it is somewhat dangerous given how we think of the supreme court. right now frankly, it is not that i disagree with those two voices i kind of like having them there, especially with the way the court is built out right now. but, it is something that i think is going to get a lot of pushback from other democrats. there is a logic to the argument, but i think that it is going to bother a lot of

people to ask these two women to step down instead of you know, staying on that of when there is someone else who could potentially, who they are going to put on in their. place. >> i think the argument would be justices that are perhaps younger and therefore would serve on the court longer, since ages always a factor. i think people think of ruth bader ginsburg at the time when there was some calls for her to step down and how that sea ended up going to a republican and of course the republicans when it comes to confirming justices don't play fair ball, we saw what they did with mayor garland and so politics is a major factor, juanita. what do you think of the argument that someone like edith is making that the justices should consider retiring during the next two years and giving justices with perhaps greater longevity on the court. , i mean when you think about the two justices in particular though they are relatively young and they are healthy so i don't think they represent the same concerns as something like

a repeat or ginsburg it. like you said, they do not play fair when it comes to the supreme court appointments so when it comes to the democratic argument -- should be more front and center then calling on healthy progressive voices on the court to resign or step down. that is the better alternative here and so i would urge the need to and adopt some of the republican practices as far as modifying rules here to make sure our basic rights and basic tenants of the country are protected. >> so danny, to juanita's point here. she brings out a good point about expanding the court, that should be the play they should be trying to make. in fact, there was in the previous house allowed if you will, chorus from some certainly in the fall -- calling on an expansion of the court so do you see the expansion of the court as being a feasible option here to course correct given how

conservative it is and how muscular this current court is with its conservative majority? >> the problem with expansion of the court is what is good for the goose is good for the gander and in a few years another majority might take over and say let's get a few more so we can add the majority in there doesn't appear to be an end in sight so maybe i'm crying wolf and maybe i'm being too alarmist. or maybe i am just old fashion and i think the supreme court should stay at the number it is that but just a thought about retirements, there is a kind of ageism actually built into the justice jiri act, justices i should say, can retire with olds -- if they've served for over ten years and if the combined years of service and their age equals 80. why do i bring that up? because the judiciary act contemplates a kind of ageism, in other words it was an act so

that justices would, even if they are pointed for life, decide for whatever reason, maybe they feel they are getting old or maybe political reasons, to step down. the incentive would be that they would get full pay so i think people have gone beyond that like clarence thomas i expect could retire tomorrow get full pay. and he chooses to stay on but make no mistake about it, the judiciary act has long encouraged justices to retire and this for political reasons isn't a push bit that big of a trump. >> i dare i say, i wonder what clarence thomas is staying on the court after all these years we will have to leave it at lap but don't -- when we come back. our apologies to ian highs are in to our audience for not being able to reestablish connection with him, hopefully we will try to get him back on the show in a recent, in a future date. up next, a top republican says, george santos could be expelled from congress. we will have more on that after the break. the break. plus. unlike some others,

the market when that is what they're moving forward with. the fact that kevin mccarthy went through such death. it just shows that when i went into the pass, i was not exaggerating. what is frustrating is that he was going to take a large segment of the population and our economy down with them, if this is what they try to do. and so, what i'm looking forward to is how hard is kevin mccarthy going to hold on to this? knowing that every single member of the republican caucus can step forward in a motion if he doesn't follow through. for those low income individuals that you mentioned at the top, the faa which we know already had a calamity last week. so, i'm just watching to see how this pans out. >> susan you have some republicans that said this plan won't work. you, no one expert said it

could quote call into question the way the republicans are trying to trade off with. we need huge spending cuts, it's absurd. we it's not looking for an extension for more spending to pay more debt. the republicans are thinking that they can be clever. when they can prioritize. first of all, it's not workable. we it's been reported in several places that the mechanism that they want in place does not exist. we now politically, this is just dumb. after we saw last week the fact they don't have their act together and they can't govern

themselves. it is going to be very clear to the american public that they are the ones responsible. they cannot win this fight. no one's gonna think for a minute that joe biden is against having a negotiation. considering that is what he spent his last two years in office talking about. building bridges, working together to get things done. lastly, you have 18 members of congress who want to get reelected in joe biden districts with that is going to be something to watch. to see how much pressure they using? i've been stunned. we how much they have acquiesced to 20 land masses. there were 200 that had the same boat. >> i think mccarthy's gonna look like he's playing for this. but in the, and it won't happen. >> we when needed, this could be a major messaging opportunity for democrats. is this a political fight that they want to be having in public? obviously, given the fact that

republicans are gonna potentially stonewall any effort to raise the debt ceiling. >> as we have seen so far, democrats have jumped at every opportunity to call out the ridiculousness coming from the gop this past week. it was the antiabortion, bills the anti worker language. with the anti-ethics language in the rules package. i see it as the same fair game, it will really just draw yet another contrast for the american public. which parties actually here to help you? which parties actually here to prioritize the needs of this country? which party is here to make things better. how do we familiar eight situations, versus worst number every individual here. for a nation at large, we weaved emphasize what we talked about as far as who loses the fuss type of bill advances. and i'm talking about those low income individuals. those students, the faa.
