good monday morning. i'm lindsey reiser coming to you live from msnbc headquarters in new york. in about an hour, we'll see the president speak at an event honoring the civil rights icon. in the meantime there's growing frustration gripping the west wing. we learned over the weekend more classified pages were found at the president's delaware home. nbc news reports that according to sources the president is

irritated by the backlash and what he views as the probable sloppiness of his aides who packed his things when he left office. but the constant drip of new information is intensifying calls for transparency. and on the hill it's providing fuel more republicans hungry for investigations. in moments, the latest reporting from inside the white house and on capitol hill. and the unrelenting barrage of storms battering california has 7 million more people under flood was. half an inch of rain could fall per hour for people dealing with mudslides, buckled roads and homes submerged. in ukraine, the race to find remaining survivors after a russian strike destroyed an apartment building in dnipro. we are in the region with

concerns about russia's new military strategy. we start with more pains found from president biden's post obama years. nbc news reports that president biden is frustrated with the backlash. explain what we're learning and what's happening inside the white house right now. >> yeah. we saw congressional democrats voice their concerns about the white house's repeated delayed acknowledgments on the sunday shows yesterday, and now we're learning that president biden himself is growing more and more frustrated as backlash to these discoveries only continues to grow. he's frustrated by the sloppiness of former aides from when he was vice president. these aides that packed these

classified materials into these boxes that ended up in the penn biden center and at his home. he sees this as a missed opportunity to draw contrast between him and his predecessor. also the subject of a special council probe for the mishandling of classified documents because the white house, since this was first acknowledged, has said this is all a mistake, there was no malicious intent bringing these boxes to that private office, to his williams home. that president biden's lawyers did the right thing in immediately telling the national archives about these discoveries and turning these documents over to the justice department. the absence of that immediate and concise response from the white house has left the door open for republicans to really seize on this. they're really seeing it as the gift that keeps on giving, launching so many more probes into more details about these classified documents, more

probes this white house didn't see coming. they were expecting other ones like the withdrawal from troops and the afghanistan border crisis. this is something they'll have to deal with over the next few months and next two years as a thorn in this administration's side until republicans and the american people get answers from the white house. the president for his part ignored shouted questions from reporters when he was traveling in atlanta yesterday. he just landed back in d.c., and we now know he is not taking any questions right now on his way to deliver remarks on dr. martin luther king's legacy, the event he's expected to speak at in the next few minutes. >> you know the personal attorney to the president acknowledged that the legal team is unsure that all relevant documents and pages have been found. what are you hearing, if anything, about any potential plans to change how the white house has been addressing this

so far? >> well, already i think the white house has made a shift as of saturday morning. we reported through sources that had spoken to our reporting team that inside the white house, among his senior aides, among biden's personal lawyers and the white house's own lawyers, there was this belief starting in november, hey, let's not discuss this publicly, let's not share the details of this, let's let the department of justice do its work and keep this to ourselves for now. well, that doesn't work when you're the president of the united states because, as we all found out, it leaked. a new thing leaked, and then another thing leaked. those new things were was that there was a finding of records in his garage in december that had not been disclosed by the white house and then there was a discovery that, whoa, there was more information in a garage where he keeps his corvette and there's a great concern that while biden's case is so

different than trump's, he's not trying to hide this, he voluntarily turned the records over, called the investigators, totally different case, no obstruction charge that is possible that i can see here, but the problem is nobody is supposed to have these kinds of records, even a president, even a former vice president. it's going to be very hard for joe biden. on saturday, the white house began realizing that we can't keep these details to ourself anymore. this is the president of the united states, we have to give as much of an account as we can. i think there's a lot of anger by biden that this is a gift, a new year's gift to the republicans to try to create a false equivalency between the trump case and the biden case. biden obviously wants to continue to sound the message that holding classified records is really serious. there's the potential that donald trump gets charged with

obstruction. when biden himself had these records, sloppily packed as they may have been by his own aides, he has to continue to say mishandling classified records is really serious. >> the "new york times" notes that the document's inquiry puts a spotlight on biden's frenetic last days as vice president. the special counsel will have to reconstruct how a small number of classified documents made it to mr. biden's home in delaware and that private office in washington. how will this investigative work likely unfold? of course we've been reporting that there are already interviews under way, but what does this all entail? >> as you just noted, john loush, who was in charge of the preliminary phase of this investigation is understood to have interviewed multiple witnesses. we don't know how many. we know the identity of one of them, kathy chung, who was biden's executive assistant during his presidency. she now works for defense secretary lloyd austin.

how many people will have to be interviewed by the special counsel is a mystery. i would suspect the circle will grow larger. it will entail interviewing anyone and everyone who had access to the vice president's personal office and files in the vice presidential residence at the end of that administration to people involved with the general services administration and getting the documents from a temporary holding place to the penn biden center and/or the wilmington residence. that circle will involve not only people who served biden when he was vice president, but people who are currently serving biden as president and folks that are among biden's personal lawyers, because they were, after all, the people who made this discovery on november 2nd and on december 20th and according to the white house and bob bauer earlier this week when that one page was found in a room adjacent to the garage in wilmington.

all those folks in addition to being counselled to biden privately are themselves now witnesses perhaps in the investigation. >> i want to play what speaker mccarthy and james comer said yesterday. >> congress has an independent constitutional obligation to oversee all aspects of the justice department. that includes special counsels as well. so, we will have a role in overseeing what's transpiring here. what's real concerning to me is how justice is applied, is it applied equally. >> we want to know the visitor logs to the residence. we want to know who had access to the biden center for diplomacy. >> visitor logs. take us through what republicans are already doing on the hill and where they're likely headed. >> yeah. this was always going to be the hallmark of this house majority, investigations and continuous oversight. they were anticipating over at

the white house that they were going to see multiple requests into things like the afghanistan withdrawal, how covid money was spent, all of that was expected. but in recent weeks it's clear that people on both sides, republican and democrat think this is a gift for republicans. it puts democrats in the space of having condemned former president trump for doing something that was similar, though very different in terms of the bstruction that was done, at the same time we watched them this weekend having to talk about and one democratic senator called this embarrassing for the white house because there was so much round condemnation of what trump did. on the other hand of this, i love that carol used the world false equivalency, that's the thing we'll see from republicans time and again here, the fact, for example, that chairman comer is asking for visitor logs for biden but not visitor logs regarding mar-a-lago and trump is a moment where republicans

stand to look hypocritical in their investigations here. as they take seriously what's going on with the president right now, they will also then have to take seriously what the former president of their party did and in many cases in worse fashion than what biden is doing now. there is a political gift element to this here, republicans trying to move forward and muddying the waters as they investigate on this in the house, but also the fact that the more they dig in on this, the more that there's going to be questions around what president trump did at the time as well. >> i want to play how democrats are reacting to the discovery of these documents. >> it's important that the justice department do its work relative to what we are learning. i think the administration is cooperating. they need to continue to cooperate. i think the most important thing is that we put processes in place so that this doesn't happen again. >> i don't think he had any choice but to appoint a special counsel. i think that special counsel will do the proper assessment.

i'd like to know what these documents were. >> president biden had these documents, that shouldn't have happened. it needs to be investigated. it is being investigated. >> that was on saturday, and she talked about this isn't good. in your reporting, any indication here that the white house will make any other pivots? in our first discussion at the top of the hour, you said it sounded like they had already pivoted a little bit with that announcement on saturday here of this other -- this new discovery of documents. but anything else they might be doing to make sure they don't lose democratic support or further frustrate members of his party? >> i don't think that there's an effort or worry about democratic support. i think there's an effort to create a consistent message, and the consistent message is -- to quote a great movie -- we're

cooperating here. i think that the other consistent message that they want to sound is that the mishandling or the retention of classified records and inappropriate retention of them is serious business. biden himself is privately telling aids that, you know, he's pretty disappointed about how all this went down. i think what's a worry for the white house is they don't know the totality of information. for example, if you have a box of records in your home after you're vice president that happened to be transferred there, it's really important to know did joe biden ever access those records in that timeframe? had he ever been aware of any markings that showed classification? did he have -- did he or anyone else who worked for him access this box of records? that's a worry, because it's an unknown at this moment. again, i want to emphasize that the facts we have to date show

nothing like the obstruction that was going on in team trump. you know, where donald trump, as we reported at the "washington post," where donald trump told one of his lawyers he wanted him to assert in february that all classified records had been returned. everything had been properly returned. that was just false on its face and that lawyer at the time refused to do so. later a lawyer for donald trump in june asserted that all of the classified records complied -- compliant with the subpoena had been returned. that also proved to be false. the fbi and the department of justice learned that by interviewing witnesses and coming in for basically a raid of his home in mar-a-lago. that couldn't be more different than what happened with joe biden. however, it remains serious. how in the world do records that are not supposed to be seen by foreign adversaries, records

ongoing deluge? >> overnight we saw a lot of rain. we were getting pelted here. as you can see, it's let up but we are seeing off and on drizzle right now. behind me, you can see some of the debris from the storm that's washed ashore here at capitola beach. it's been frustrating for people because this is the tenth atmospheric river storm that hit the area since christmas. california has needed the moisture because we've been in such a severe drought, it was just a little too much too soon. this has also been a deadly storm and a costly one. some believe this could range in the millions if not billions. crews are trying to clean up the area. we've had a lot of people at the beach trying to see some of the damage. even the capitola wharf behind me has a huge chunk that's been taken out by these 20-plus foot waves. we've seen the mudslides. there's one on highway 9 that will be shut down for several weeks because investigators

believe that the road is now compromised just because so much heavy debris has fallen on to it. here in capitola, a lot of the businesses along this beach front have boarded up because it's not safe. we spoke to one of those business owners about how frustrating this has been over the last few weeks. >> rain-wise, it wasn't quite as bad. wave-wise, it was bigger and probably the biggest i've seen down here. i've lived in this area my whole life as well, seen plenty of crazy storms. this one takes the cake for sure. >> now, the good news is this wave is expected to be the last severe storm for a while. january is expected to be pretty dry, which will help communities like this rebuild. >> dana griffin, thank you. let's get over to angie lassman with more on when the weather could let up. >> there is relief that could

happen for california. that fire hose will turn off. we have some rain to work through through our monday. here is what it looks like now. you can see that heavy rain that worked through san francisco earlier this morning, now shifted off to the east. we have heavy snow and rain in parts of the sierras. further to the south, los angeles into san diego, they'll deal with the on on-and-off rain through the day today, but eventually, yes, we will get a break from this. still, though, many millions, 7 million, to be exact, are under flood alerts through the day today. san francisco, monterey, up into chico, we don't have those alerts, but the flood watches and warnings are still out for many. here's what the accumulations look like. not crazy amounts of rain like we've seen, but anything on top of those saturated soils that we already have will be problematic. we could see some impressive rainfall rates as well, about a half inch per hour. again, any additional rain will make it troublesome for folks who have been dealing with days and really weeks of these flooding concerns.

how about the snowfall? we could see local amounts up to 36 inches in parts of the sierras. we move further to the east, near the four corners area, that's where that system will go next. we'll add on some heavy snow and those gusty winds as well. let's play it out for you going hour by hour. there are the lingering showers that will be problematic for folks through the day today. those whiteout conditions in the mountains, heavy snow and wind, that will be problematic as well. there it goes into parts of the four corners. that's where we'll see the heavy snow impacting folks in denver, albuquerque, new mexico, areas like that. moving through the rest of the week. things improve a lot. we deal with that strong storm, the last of it for california, though folks in washington and oregon could see another system work through. for california, drier time as we get into tuesday and into wednesday. there's the pause at your wednesday. the heavy snow threat moves further to the east, impacting folks in the plains and into parts of the great lakes and the

behold... all that talent! ♪ this is how we work now ♪ . this morning, rescuers are racing to try to reach any remaining survivors in the rubble of an apartment building struck by a russian missile in dnipro, ukraine. it's one of the deadliest attacks on civilians since the war began. so far, at least 40 people are confirmed dead. dozens more are injured, including children. matt bradley joins me from kyiv with more on the attack. i'm also joined by general ben hodges. matt, how are recovery efforts

going in dnipro? are we seeing more russian air strikes today? >> we have not seen that many more russian air strikes but we've seen them throughout the country over the weekend. now, the rescue effort is apparently still going on, though it sounds as though rescue workers have more or less given up hope of finding anyone else alive. a warning to viewers, some may find some of these images disturbing. >> reporter: ukrainian rescue workers still racing against the clock. struggling to reach the last wounded survivors of this terrifying attack. is there anybody alive, this man shouts? this is what was left after a russian missile slammed into this apartment building on saturday in dnipro, killing 40 people and injuring 75 more, including 14 children. a government adviser sharing what he says is the grief of a sister whose sibling was killed in the attack. my 15-year-old, super smart, super talented, super funny

sister is gone. some 46 people remain missing. this woman told ukraine's channel 11, may you be cursed by all mothers' tears. some survivors were being pulled out of the wreckage as of yesterday, fueling hopes that more would be found, but now dnipro's mayor says the time for hope may be over. i think the chances of saving people are minimal, he said. may god help us find several of them. on saturday, britain became the first country to announce it will give western battle tanks to ukraine. such weapons could be crucial for ukraine as it ekes out its first real victory in months. last week, russia said it had taken the east ukrainian town of soledard. the russian attacks remain relentless. all this as this war is close to

entering its second year. >> and we are hearing now that washington is offering expanded training for ukrainian soldiers. they're also coming under some pressure to offer battle tanks just like britain did over the weekend. but washington so far has called giving tanks to ukraine a bridge too far that they won't cross. >> thank you. lieutenant general, what does the civilian attack signal about russia's strategy here? are you concerned about the frequency of these kinds of attacks? >> well, of course i'm concerned about the number of innocent people that are being murdered every week right in front of our eyes. i mean, this -- the number of civilians who have been killed now, there's more than we lost on 9/11 when the twin towers were hit. so, russia clearly is acting like a terrorist state, and i think the international community has got to start war crimes tribunals and hold these

people accountable and every russian should know they'll have to pay a price. >> the associated press reports the u.s. military is beginning new expanded combat training for ukrainian troops, and mark milley said this will be key to helping ukraine regain territory. at the same time we're seeing russia staging exercises today with belarus. what could the training in the u.s. look like? how will that help ukrainian forces? >> of course the training in the u.s. is primarily for patriot crew members that will be happening at fort sill, the combined arms training where they learn to put tanks, infantry vehicles and everything altogether into an armored formation, i think that will be happening here in europe. look, crimea is the key. i wish that the chairman, who i have great respect for, i wish they would talk about helping ukraine win, and they need to

believe ukraine can win. they need to provide long-range precision items that will make crimea not a sanctuary for russians who can sit back and watch missiles against civilian targets. we have to talk in terms of winning not just helping ukraine recover territory. >> thank you for your time. nepal is observing a day of memorial today after a plane crash in the himalayans. at least 69 people were killed. search teams recovered the flight data and cockpit voice recorders from the crash site earlier today. officials are still not saying what caused the crash. what are they saying this morning? >> yeah, it's early on in this investigation, of course, but those two recorders, the flight

data recorder and the cockpit voice recorder are key in this investigation. investigators say that both are in good condition. they also have some other clues to go on. they have video from a witness who was on the ground, who saw that plane as it was coming in to land. we see these clear blue skies in nepal and then the plane tilting quite dramatically and then you hear an explosion. one of the airport officials in pokhara where this plane was set to land told the associated press that the crew requested a different runway in the moments before that plane crash, but it's not clear why. there's another disturbing clue, this video, some of our viewers may find it difficult to watch, it's video from inside the plane as it's coming in to land. one of the passengers who was a tourist, was recording, was livestreaming his family says on

to his facebook page as that plane was coming in to land. the reason it's important is because you can see that there's no sign of panic, none of the passengers seem to be in any way upset. there's no announcements about an emergency. we're only showing you a short snippet of this video. as it continues, you hear a loud bang, and then you see flames. this plane wreckage is in a really difficult area. it's in a ravine, about 1,000 feet down. it's a tough place for search and rescue crews to work. they're still looking for at least two, possibly three people who were on board that plane. they've had to call off the search for the day. they hope to resume tomorrow. conditions are difficult on the ground. >> kelly, such a tragedy. thank you. turning to italy where the most wanted man in the country, the godfather is now in custody

the public that mr. santos was spinning an elaborate web of deceits. joining me now is ali vitali back with us and msnbc political analyst, susan delpersio. is there indication we could see more fallout on the hill? >> that's been the question since congress came back into town after the 1st of the year. as republicans try to push forward with their house majority, they want the hallmark of that to be investigations and oversight, they're well on their way to moving forward on those fronts. even as they do so, there's a consistent question of what about george santos, will you call on him to resign? republican leaders have said they'll let this process play out, in part because it's hard to kick out a member of congress. you need a two-third majority

vote on the floor. they're keen so see what revelations come forward and if there are any on the legal and campaign finance front that will force their hand, but there's also the political considerations to this. he would talked so much about the thin majority that republicans have right now. they don't want to throw that majority into further flux by putting this to a special election in new york when this would be seen as a referendum against santos, a referendum against republicans and it could give democrats another seat. we've seen what thin majorities mean, it means every person in that majority has a stronger voice. kevin mccarthy would like to keep it where it is, you would imagine. that's one of the other reasons why we're not hearing republican leadership clamoring for this, even as we end last week with the same number that we start this week with, eight republicans saying santos should resign. >> let's turn to the "new york times" reporting. the times writes rather than

denounce santos publicly, the republicans looked the other way. if this is the case, susan, what would you say to some of those republicans who are suspicious but looked the other way? what needs to change to prevent someone like santos from falling through the cracks again? >> my guess is initially -- i'm not making excuses for george santos by any stretch of the imagination, is that initially no one thought santos would win. it was not a republican-leaning district the way it was drawn. they thought he was a bit of a nut job. in that study they talk about a vulnerability study being done on santos, and it said that that made people very uncomfortable, what they found out in that research. that tells me the democrats did not think of him as much of a threat because they would have found out the same information as well if they did that opposition research on george santos. now it's a matter of who is speaking up.

you have the county speaking up, the state speaking up. what's important about the state, it's one of -- one of those freshmen congressmen is the state party gop chairman. it's unusual to have state leadership in washington not follow the lead of state and local leadership. this is clearly what ali pointed to, it's all about numbers and all about having mccarthy holding on to power. >> to your point, robert zimmerman who ran against santos, it's not clear why more wasn't done with that information. susan, before we let you go, there's new reporting from the "washington post" about his background. they say he worked for a company in florida called harbor city capital. it's no longer in operation. the s.e.c. accused it of running a classic ponzi scheme. the s.e.c. complaint froze the company's assets. he's denied alleged wrongdoing.

weekend for fans celebrating the university of georgia football team and their second national championship. but celebrations have turned to shock and sadness. one of the team's offensive linemen, devin willock and team staffer chandler lecroy were killed in a car accident hours after the parade celebrating their win. >> reporter: this is just a stunning emotional whiplash. on saturday afternoon, members of the football team and fans were gathered in the stadium to celebrate this team's second straight national championship, only hours later one of those players, devin willock was gone. now this site has become a place for people to leave flowers and tributes in his honor. investigators are working to determine what caused this crash as so many people are mourning these two young lives. he was a fixture on the field during georgia's undefeated season. and helped the bulldogs clinch a second straight national

championship. now the football world and beyond mourning the sudden tragic death of offensive lineman devin willock killed in a weekend car accident. 20-year-old willock was riding near uga's campus early sunday morning when the vehicle left the roadway, striking two power poles and several trees. he died at the scene. also killed, the driver. 24-year-old chandler lecroy. two others who were with the football program survived. >> all of a sudden outside, i hear this crash. the power goes out. >> reporter: cecily lives nearby and called 911. she went outside and saw the car. >> i don't think there was a single piece of it that was still in one piece. it was crumbled like tin foil. >> reporter: a tragedy deepened only by the timing. hours earlier he joined his
