how he plans to expand democratic control in 2023 and how not to celebrate black history month. we will reveal our worst of the week contenders. i'm ayman mohyeldin, let's get started. let's start this hour with the breaking news of the night the united states has shot down the suspected surveillance balloon off the coast of south carolina. officials say a f 22 missile jet took up the balloon with a single air to air missile. at 2:39 eastern this afternoon. nbc's gary graham joins me now from washington, d. c.. with the latest. gary, it's good to have you with us. what do we know about that decision-making process to shut down this blue and the evidence to collect the debris? >> as you can imagine,, eamonn you get our learning that this whole process was a team effort, it was a multi agency effort. the faa turned off all the arrivals and departures from

wilmington airport from north carolina, from myrtle beach, from charleston. the air force is the one that shut down the balloon itself. and the navy and the coast guard were involved in the water getting the debris out of the water and bring it back to land. it was a debris field that was seven miles in diameters. it's definitely one of the reasons why they didn't do this over land because think about how difficult it would be to pick up all this debris from seven miles of land of houses, highways, of powerlines. so because this balloon was traveling for so long overland, u.s. officials tell nbc news that they have a good sense of what this balloon was doing and what this balloon was more importantly capable of doing. because that's a huge part of the surveillance gathering on our and on what china is doing here. so u.s. officials are very confident in that once the debris gets out of the water, they are able to look at some

more. the u.s. is going to learn even more about what is there. late tonight, i want to share a statement with you. china's out with a statement calling strong dissatisfaction and protest over the united states use of force to attack civilian unmanned air ships. and as you might expect, the united states is really not buying that at all. senior administration official is firing back in a statement with to nbc news in the last few minutes in, quote, this was a prc surveillance balloon. this surveillance balloon purposely traversed the united states in canada and we are confident it was seeking to monitor a sensitive military site. it's route over the united states near many potentially sensitive sites contradicts the prc government explanation that it is a weather balloon. they go on to say that this is not only prc surveillance balloon operating in the western hemisphere. there is a second balloon that was observe transiting central and south america and another prc surveillance balloon. they say that both balloons carry surveillance equipment not usually associated with standard meteorological activities or civilian research.

they are saying every thing china is trying to explain away with this balloon is incorrect. the united states is giving those facts. i'm stating the obvious here but this is doing some serious damage in the relationship between china and united states. >> one more think that is ratcheting up tensions between the two countries. live for us in washington d.c. this evening, gary, thank you. let's turn now to another focus for the biden administration. that is the national governors association. next week president biden will welcome governors from both parties to washington, d. c. for the end j.a. when they're meeting. the national governors association chair phil murphy is going to attend, he'll plenty to discuss what the president. including three tough election race is taking place later this year. i spoke with governor murphy earlier. his conversations with the united states president, and much more. >> governor phil murphy, chair

of the national governors association, sir, thank you so much for joining us. i wanted to actually start with your role leading the national governors association. tell us a little bit about what your priorities will be as you take over this position. >> good to be with you. the nga is i think one of the few bipartisan organizations that can get stuff done. and i can give you a bunch of examples. one i think embodies this. when you're the chair, you get to pick an initiative that is supported by both sides of the aisle. and i became chair last july, the initiative i chose was to strengthen meant though health among young people. with broad support across the governors from all corners. and you go around the country during the year of your chairmanship and you convene experts and other governors, stakeholders, and supporters to try to develop a playbook.

next july we will end up in atlantic city, new jersey and we will have god willing a playbook for all states to feed off of in terms of how to deal with strengthening the mental health of our kids which had been so impaired over the past several years. it's one example that i can give you. >> a very important one, and i know you're also the chair of the democratic governors association and you have a role in the elections on that front. there are three major gubernatorial elections this year. two of those seats are currently held by democrats. i know you have spoken about governor andy beshear in kentucky being one of the top priorities for you. talk about what you are hoping to do to get him reelected in this traditionally very red state. >> we have three great states, up kentucky, louisiana, mississippi. and the best year in his reelection in kentucky is priority number one. he's done an amazing job. he is broadly supported including by a good chunk of republicans.

and i think the reason is that he's focused on issues that matter in kentucky. kitchen table issues. look at that jobs he's brought. ford motor company, a great example. real focus on kitchen table job creation. taking care of working families. he's also had to deal with some awful natural disasters. tornadoes, flooding, and he's been masterful in the face of real challenges. john bel edwards of louisiana, he's a great governor but term limited. so we are in the process of stepping into his shoes. that will not be easy but that is a state we've proven as a party we can win. and i think we've got a real shot, the sleeper for me, is mississippi. a very unpopular governor, our candidate is likely to be brandon pressley, elvis's cousin, statewide elected, a guy with a lot of credentials who speaks again about the kitchen table.

so it's gonna be an exciting year. we will be playing aggressively in all three of the states. >> of course part of your role as national governors association chair as a conduit if you will between the white house and the governors of this country, your set to meet with president biden at the white house next week. what are you hoping to come out of that event? >> i am very excited about this. this is our annual winter meeting. it's been a little bit sideways the past several years because of the pandemic. but this is finally, we're full-on several days of meetings. including half a day with senior cabinet officials and other senior administration officials in the white house. dinner with the president and vice president. and their first lady and second gentleman. listen, the president understands government, probably unlike anybody else in this country. and while he was not a governor, he's lived in our shoes and so

many other respects. in fact i was just with him this past week with governor hochul in new york. kicking off a huge piece of the hudson tunnel projects that will finally update the tunnels under the hudson river. he's a guy who cares deeply, he understands that governors really matter. it's not either or federal governor -- he's been an incredible partner and in his administration over the past couple of years, so much of what has gone through congress that he signed has had a huge positive impact on the state. so i think it's a huge chance to but acknowledge, celebrate on the one hand, but also acknowledge we have a lot of work to do, as a country and as governors. >> let's talk about your states, the great state of new jersey. this week a federal judge block part of your states can carry law being enforced, temporarily

lifting the prohibition of carrying guns in public public parks, beaches or casinos. give me information about that. is your administration prepared to fight this ruling? >> very much so. my reaction is not happy but not surprised. we respect the judiciary, we don't agree with a conclusion. we will fight it, i promise you. this is the concealed carry law that we very carefully structured with our legislature so that if it into a u.s. supreme court ruling, which by the way, we also don't agree with. but we accept that it's the law of the land. i remain optimistic. and i'm happy to say that every casino in our state has affirmatively said they will communicate that guns are not allowed on the premises. which you are allowed to do, if there is a private property, you can communicate the signage, other forms of communication. so if your casino, bar,

restaurant, notwithstanding an adverse opinion from the federal bench, you can still take your own steps to keep guns off your premises. >> of course, america is still reeling from the death of tyre nichols. another killing of a black man at the hands of police. talk about the reforms that you have passed to tackle police use of force in your state, and whether or not there is anything that can be learned from that experience nationwide. >> we've done a lot and i've said a lot since this awful, ugly tragedy, tyre nichols should be alive and well as we speak here. every tragic moment like this, we look to the mirror and ask ourselves, can we learn? can we be better? and we spent and enormous amount of time and and edgy deepening the relations between law enforcement on the one hand and the communities they serve on the other. so we were early on body cameras, we now require members

of law enforcement to be licensed. we have an independent prosecutor law that i signed meaning that if there's a shooting in some form involving a law enforcement officer, or if there's a death of any kind, that automatically gets independently reviewed and it must end up in a grand jury. we put out some very explicit guidance on use of force and updated that for the first time in decades. so we've taken a whole lot of steps. we're not perfect. we remain on a journey. but, as you rightfully pointed out, when you see something awful like this, you've got a look in the mirror and ask yourself, are there other steps you can take, and we're doing that right now. >> let me get your thoughts on what's happening down south and florida. this week the college board announced that it had in effect watered down and advanced placement african american studies course.

it came after the course was criticized by another governor, republican governor ron desantis of florida who seems to be really doubling down on a lot of these culture war issues in this country. what do you make of this move? what do you think about this debate that is raging around african american studies in high schools? >> first of all, the college board got rolled. there's no other way to put it. i'm a former ambassador, a former diplomat, i'd like to be more diplomatic, but they got rolled. i think it's outrageous. governor desantis, i'm sure others, are trying to go down paths that all they do is divide us. all -- the only thing that will come out of this is division. and apparently, he thinks that's the smart political playbook. i take a different tack. we are actually expanding dramatically our african american ap curriculum in new jersey. we believe that our history ought to be told to our kids.

the good, the bad, and the ugly. most of it's good, by the way. we're proud to have that flag behind us. we are proud to live in the greatest nation on earth. but as president obama used to say, we wake up every morning trying to perfect our union. recognizing we are not perfect. our history is not perfect. new jersey's history as it relates to slavery, is particularly imperfect. our kids need to know, i think we're a stronger nation, and we're stronger as individuals if we've done all the facts. and i think that's the side of the history that we are on. >> i couldn't agree with you more. the more we, know the better we can be as a country. let's stay on education for a moment because you recently signed into law a bill requiring new jersey schools to teach media literacy to k through 12 students. that's interesting, what do you hope to achieve through this? >> i think it's the first of a nation. and we are really proud of

that. it's a non profit civics association, which i think is the only one of its kind in the nation which i want to give a lot of credit to. the really good thing about that bill that i signed and i think it's a statement about the fact that we can actually still come together as a country, is that it was bipartisan sponsored and supported. which i think is an important point. because when you hear media literacy, you're probably defaulting to that's one side of the aisle calling out fake news. it was actually both sides of the aisle acknowledging these fraught times in our nation, it's really important again that our kids understand we need to parse the real from the fake. and they need to understand the information coming at them, they're going to have the skills to be able to, as i say,

calendar will never be the same. democrats have voted overwhelmingly to remake the party's presidential nominating calendar embracing president biden's push for south carolina to be the first state to hold its contest in 2024. and we're placing iowa for greater calls of more racial and geographic diversity in the process. this move was only expected. but it does not guarantee that the calendar will be enacted as design. let me bring in erin haines, nbc political contributor and comedian chuck nice, chuck, good to see you in person.

i can't believe you braved the cold weather and made it into the studio. >> i'm getting really brave. >> hopefully it had heating. >> it did, not but that's okay. >> aaron, i'll start with you, president biden here said that he wanted these calendar changes to ensure that voters of color had a bigger voice in the process earlier on. do you think this will help deliver that? >> that's absolutely right, ayman. we know that south carolina delivered a victory for biden, generally black voters, and a lot of them were seeing this as a return on their investment. frankly from 2020. a lot of folks in our profession didn't necessarily have this one on their bingo cards coming in 2020. but here we are. look, i think i'm certainly one that does among us in the journalism class predicting that south carolina was gonna

be a turning point in the 2020 election because of the streets diversity and even though i what didn't do themselves any favors, if you remember that debacle that was the iowa caucuses, it's true that the south is emerging as politically significant because of the diversity because it is more reflective of the changing electorate. and frankly, the electorate that the democratic party is seeking to go after in a place where candidate should be investing early as a winning strategy. and that's not just for democrats though. georgia has also moved up. we saw what happened there in 2020, 2021, 2022. but to your point, new hampshire doesn't seem to be going down without a fight. but just because things feel haven't always been done in a certain way, that does not mean that the stay that way. that's a lesson of our country, that's a lesson of our democracy. >> absolutely, i agree with you. south carolina jim clyburn single-handedly changed things around. his endorsement change things around for president biden in 2020. i don't think anyone can deny

that. but to your point, not everyone in the dnc is necessarily happy about. the folks in the new hampshire dmc say i think this will only hurt president biden in our popular purple battleground state. what do you think of that, chuck? >> you know it might be. there might be a little bit of a backlash to what he is done. it might seem a little transactional. but like errin just said, you know, that's what happens when you deliver for a candidate, you want that candidate to turn around and deliver for you. and that's what happened with south carolina. now new hampshire, listen, they are very diverse as well. there are blonde white people, there are brunette white people, there are somewhat ton white people. i love new hampshire. but the real deal is that they -- i don't think he should have done this -- does it really benefit him? which is why might be a very cool move because this doesn't benefit him. if he's running again, someone is going to primary him? so where does he benefit in this? maybe he's just doing what he

said he was gonna do. promise kept. >> errin, do you think that the dnc is gonna be united's behind this when you see some of the divisions that have emerged like folks from new hampshire saying the president might be overplaying his hand with folks in the south? >> i think that's going to be interesting to see. i think that you do have democrats certainly in 2020 and and for years before that saying that the party should be more reflective of the country and the electorate. so this is a move, frankly that does kind of speak to that iowa new hampshire frankly not particularly diverse states. and when those states were chosen to be first in the nation, the country looked a lot different than it does now. the vote that just happened in this winter meeting, if that's any indication there is a lot of support for changing this primary calendar, but as you said, ayman. this is far from being a done deal.

about the victims of conflict. >> let's talk about the gop double standard here for a moment. that was minnesota congresswoman ilhan omar moments before house republicans voted to remove her from the house foreign affairs committee. earlier in the week, house republicans from across the political spectrum expressed concern about setting such a controversial precedent. and after the deed was done, one republican admitted it was the, quote, stupidest vote in the world. and yet, all of the republicans who voiced their authorization to the vote still voted to remove congresswoman omar from the committee. that's because the party of so-called free speech champions was upset. they were upset with some poorly chosen offensive statements that congresswoman once made. we are not trying to minimize those statements. they were wrong. but omar apologized for those statements, unequivocally. numerous times. and she admitted that she

evoked dangerous antisemitic tropes. she took responsibility. she atones. and then she changed her ways. and the statements that so angered republicans were all made years ago. evidence of the change. but republicans, they don't really care about that. which is surprising because members of their party have made remarks similar to or even worse than ilhan omar, and they made that more recently than. her including speaker mccarthy who accused three jewish men in 2018 of trying to, quote, by the midterm elections. and of course, paul gosar, who once spoke at a so-called pro hitler white nationalist event and followed that up by posting a video showing himself murdering congresswoman alexandria ocasio-cortez. but of course marjorie taylor greene who famously rang about jewish space lasers. and then there is donald trump

who has a long and storied history of making antisemitic statements like repeatedly evoking the jewish dual loyalty trump. and just a couple of months ago, trump dined with a known holocaust denier. so here's my real question, why? why are republicans in congress so obsessed with demonizing congresswoman ilhan omar in particular when scores of lawmakers, on both sides of the aisle, have made antisemitic remarks in the past? why is conservative news media so obsessed with attacking congresswoman omar despite her repeated apologies? retired jewish congressman john yarmouth said this week that he knows congresswoman omar is not antisemitic. rather her past remarks, though ill-advised, were rooted in the desire to call out policies of the israeli government. what's more, he said that he himself has echoed many of the criticisms that congresswoman omar has made of israel and no one ever accused him of being anti-semitic. so why is congresswoman omar

being treated so differently? she has an idea. >> it is no accident that members of the republican party accused the first black president barack obama of being a secret muslim. it is no accident that former president donald trump lead a birther movement that falsely claimed that he was born in kenya. because to them, falsely labeling the first and only president of the united states of america, a muslim, an african immigrant somehow made him less american. well, i am muslim. i am an immigrant. and interestingly, from africa. >> congresswoman omar is being treated differently by republicans because she is different from what republicans have come to accept as american. she practices a different faith,

investigation, well back in 2019, donald trump predicted that prosecutor john durham's probe into the russia investigation would unveil, quote, at the crime of the century. fast forward four years and as far as i am aware, no deep state plot has been exposed. now, house democrats are urging the justice departments independent inspector general to open an investigation into that inquiry, citing, quote, alarming disclosures made at a recent bombshell new york times article. that report details how the pro became roiled by internal dissent and ethical disputes as it went unsuccessfully down that and at the debt and. all while trump attorney bill barr continued to push misleading narratives of his progress. republicans have gone on and on about how they came to use their newfound power to rein in what they called and weaponization of the justice

department. well, i think i know one place where they could start. let's bring back our saturday night panel, errin, i'll start with you at this one. democrats are the minority in the house. they cannot convene an oversight investigation into this, however, they do have control in the senate. on monday, chairman of the judiciary committee, said he would hold oversight hearings into durham's inquiries and other aspects of how the trump administration handled and used the justice department. how do you expect this to play this out? you think the democrats will be as nasty as republicans are when it comes to these types of investigations? >> ayman, i can't speak for what the tone will be but if durham was not found of wrongdoing as related to the russia probe, what was he doing? that's what dick durbin wants to know and so those are some of the questions that maybe asked on the senate side. to your point, the years long

investigation really showed that there was no there there, and it did nothing to dispute the reality that we know that russia did interfere in the 2016 election, and durham's probe lasted longer than the actual investigation into russia. so what was that about? why was that necessary? the american people and american taxpayers deserve an answer to that. this whole thing has been quite the saga, ayman, and while it did not produce the welcome that the former president and attorney general wanted, there may yet be more unanswered questions here. the new york times is staying on that. >> you bring up a good point because the new york times revealed that barr and durham never disclosed there inquiry expanded in the fall of 2019 based on a tip from battalion officials, which led to a criminal investigation into the suspicious financial dealings related to donald trump himself. the specifics of the tip and how they handled the investigation, as he said, it remains unclear. but in the end, durham brought no charges over it. what is your reaction to that?

>> i think that is interesting particularly in the time of reporting that also talks about how the relationship between durham and barr evolved over the course of this investigation. durham, somebody who was brought in at the beginning of this as respected and independent but really had such a reverence for this office, and even as you saw members of the team in fighting between themselves in the investigation, some people resigning, the times reporting seems to indicate that their relationship between barr and durham evolved over the course of the last few years, and so what impact did that have on his thinking, on what charges were when brought. these are the questions that can come up in a senate probe, for sure. >> what do you make of this, chuck? durham has been investigating

this for four years. the report has not come out. the conspiracy world, where donald trump and his followers want to live in, it does not matter what the results are. as long as the report does not come out, they can spin whatever narrative they want. >> yeah, it comes back to just say that there was this behavior, and will take care of the rest. that's out donald trump handles everything, and what durham and bill barr knows, everyone knows, it does not make a difference. the moment you are not saying what he wants you to say, he turns on you. you're in on it. you're not part of the conspiracy. they got to you. that's the whole game plan, and it seems to work. it must work because he still pulling it off. i just love the fact that he was like, we will investigate the investigators, and then, the investigators, go by the way, we need to investigate us because we have stuff about you. [laughter] >> republicans love deep state conspiracies, right? so when the deep state, there is something nefarious that emerges about what they were

doing, they suddenly go quiet,, and you don't hear anyone say, we need to get to the bottom of it. they suddenly become standard bearers of double standards. >> we talk about weaponizing the department of justice, come on, do we really need this to let us know that that was the case? >> look at all the things that bill barr did on behalf of donald trump, the things that definitely were questionable, if not a complete breach a protocol when it comes to the way the department of justice is supposed to behave -- look at the mueller report, the so-called preface to the report, come on, he's the -- you can't be mad -- that's the way he handles everything. >> the problem is, they made the department of justice, at least one under president trump, his personal law firm, so now you have all these investigations that are trying to clean up and figure out and which one was politically motivated and actually based on law. >> the answer is all of them.
