>> i'm alicia menendez, in for alex, and we begin tonight with the breaking news in the mar-a-lago classified documents investigation, abc news is reporting tonight that donald trump's legal team turned over yet another folder with classification markings to federal investigators. it was retreated, last month, from his mar-a-lago resort. the folders contents were, apparently, copied onto a laptop, which is important, because it marks the

first time that anyone has suggested that electronic copies were made of classified records and trump's possession. from the abc report, quote, trump attorney, james trust, turned over the classification markings to federal investigators, who also informed agents that it had been electronically copy to a laptop of a current trump aide. abc news learned, after the information was recovered, federal agents retrieved the laptop from the aid. the laptop was not retrieved on mar-a-lago grounds, the sources say. cnn tonight says, in addition to the folder, which was entitled, classified evening briefing, trump's team also handed over an unknown number of classified documents. it also reports, the aid, and owner of the laptop works for the save america pack. they copied the documents onto a thumb drive, and laptop, not realizing that they were classified. the phone drive, also, reportedly, given to investigators. i should say, nbc news has not re-confirmed

this reporting. it is customary for laptops and other electronics to be reviewed in circumstances such as this. four the first time, it raises the questions of classified materials, electronically, by trump in his inner circle. it is found in trump's possession, and it is made in january of last year after trump, finally, return to 15 documents of the national archives. outside, it was 184 documents of classified documents referring to matter to the fbi. a month later, june of 2022, after doj sent it subpoena, his legal team sent over 38 more classified documents. at the time, one trump lawyer certify, to the best of her knowledge, trump had no further classified documents in his possession. that was until august of 2022, when the doj suspect in the

trump did have more documents and that is retaining a search warrant, and that they covered 27 boxes from mar-a-lago. it was 103 classified documents. around thanksgiving, with two more classified documents, and west palm beach storage unit one in the president. it brings me today's news, and with the classification markings was copy to the laptop of a current trump aide. they come as fbi officials also confirmed, one more classified documented the indiana home former vice president mike pence after a five hour consensual search. all of this, happening as both men are gearing up to run in 2024. it is expected to do so inspiring. it comes major new developments involving both men

in the special counsel's investigation into january 6th, and trump's efforts to overturn the 2020 election. just yesterday we learned that subpoena for that investigation. it is a main witness in that probe, and is not far along in this investigation. not only was pence in charge of certifying the election for joe biden that day, and was in there for the building when they assaulted the capitol, and change that the vice president chanted that the vice president should be hung. he's also the best witness to confirm what his top aides already said, under oath. it is with trump, and his allies, pressuring both times to impede the countering of the electoral votes in an effort to keep trump in power. pence of course, well testified to that six committee, and with public interviews when they were reckless, not criminal. how will the former vice president respond of the

subpoena? cnn is reporting that they expected to claim some limits on sharing details with these conversations with trump. so, what happens next? joyce vance, four former u.s. attorney in the northern district of alabama, co-host that the sisters in law broadcasts. what a joy to have you at the table. >> it's nice to be with you, especially tonight. >> is the biggest surprise to you that the trump team willingly handed over the documents, or is the biggest surprise that some of it has been digitized? >> you know, it is still surprising that were being surprised. there has been a subpoena, there has been a search warrant, classified material impacting national security. you would expect cues two have already been returned at this point. i think it is shocking, there is still documentation lurking around out there. the reason one suspects it was turned over, is trump is now represented by jim trusty, a former doj lawyer,

someone who is able to search for the sort of material because he possesses the clearance. that has been reported, publicly. so, he what have known when he stumbled across, this or when it's came to this attention that it needed to be, immediately, return to the agency. but, ultimately, the real jaw dropper here is the first time they said that they see indications that the classified material was copied to an electronic media was compromised, either deliberately someone could have shared, it or perhaps it could've been hacked so i think think this is a juror magic new development for the national develop point of view. >> first, i want to talk about this legally. what does it change, legally? >> i do not think it changes anything, it is additional evidence that does not work in the former president's favor. after all this was recovered in mar-a-lago, when the doj executed a search warrant, it would've been very specific about the areas that they had

probable cause to search. where have the recovered from? were they removed from the areas that the doj searched? where they intermingled with the former president's personal items? a lot more questions, and a lot of the answers, bad for trump. >> if they are putting one document on a laptop, on a thumb drive, does it also raise the question that there are other documents that have been put on a thumb drive, on a laptop? >> it does. you need to worry about that, if you are the fbi, if you are the intelligence community. what else is out there? we have seen, with trump, in this case, what we know are at the tip of the iceberg. there is always more, but this is not always a situation like with president biden, or former first president -- vice president pence, where there is a consent search, conducted by the fbi. here, just trump's lawyers, turning things over, piecemeal. >> you talked about national security, so what is to say to

you? what is your biggest fear? >> classified documents all have the ability to damage national securities, if they fall into the wrong hands. so, part of what we don't know yet in this new recording is what kind of documents were digitized. the top secret information tends to be the sort of things that if it is released could do grave damage to the national security. so, depending on what was involved here, and of course, the fbi now has the computer system drives. one of the things that they will look for in their forensic investigation is whether they will be shared further. whether it was any sort of hacking that compromise them. there is a lot of potential in here. >> trump news, this talk about the pence, news do you think he complies? >> interesting question. sometimes, as a prosecutor, you would send someone, what we call a friendly subpoena. >> is it have a heart, and ex and oh's on it? >> essentially, you are saying, you are going to come in and testify. you're going to believe that mike

pence might have want to subpoena before he testified, and could walk a narrow tightrope, there is some other indication is going to fight some portion of testimony. so, when you think about it, this is someone who did not testify the january six subcommittee. he led them on a little bit of the dance in till the very end when he said, no, i will not testify. there is a public servant, of a vice president, two things that he might want the american people to know the truth. hillary clinton did that for 11, brutal hours, in the benghazi hearings. we did not see anything like that for mike pence. it's interesting to see how they handle this. >> the fact that he is called trump's actions reckless, but not criminal. i wonder if you think that is a line he would reiterate, should he choose to testify to a grand jury? >> that is why they are going for their testimony, and when pence made those comments in last december, when he was reckless,

not criminal, that is the sort of political conclusion you might draw. it's not up to mike pence to decide whether the former presidents actions were criminal. so, he is a fact witness, and it's as if he observed bank robbery. prosecutors want to put him in the grand jury what to say, what's involved, what's happened. here, where pence got those very likely is there was an effort to recruit him for conspiracy, to interfere with the government. prosecutors are entitled to get all of the details, and then prosecutors, and a jury, can draw the conclusion about whether anything criminal happened. >> i don't think you have to be clairvoyant to know that trump's team, will likely, claim executive privilege and i wonder if you think you know that from them, or if you hear from pence's team. >> because this happens in the context of a grand jury proceeding, any sort of challenge like that will, likely, proceed in the form of a sealed court proceeding. first, the judge who oversees the grand jury in

the district of columbia, houses in the circuit court, and i know some folks suggested that there will be a lot of delay, the trump will play his usual delay game. so, i think, it will not be as long as some people are concerned it might be. many of pence's aides have, already, testified. their testimony, implementing similar executive privilege type issues, and is likely to me that some of the grand jury the, seal reporting we have seen, that some of those considerations involves the same issues. the courts may dispense with it quickly, and pence may be in front of a grand journey sooner rather than later. >> how the fbi are finding an additional document and pence's discussion during this consensual search. when you think this leaves garland? does the doj end up with the special counsel's? >> the special counsel regulations say that you should appoint a special council if there is something criminal to

investigate. so far no evidence of criminality with mike pence, of course, that is true for president biden. the council there is a point of political appearances, and you don't have to continue to make the same mistake, there is no need to appoint a special counsel for mike pence. >> i'm always happy to have you, but to have you in person on a night like this, what a treat. thank you. >> thank you. >> i want to bring into the conversation, yahoo politics reporter, he is the author of the biography of the former vice president p.e.d. and power, mike pence in the taking of the white house thank you so much for being here. you are right, the subpoena could complicate pence's decision to run for president. tell me how? >> yes, this is something that could potentially shake off, january 6th. still, you saw him talk about it at length, in his own memoir, for the first time. you see it on the wall street journal op-ed where he talked about his anger, he describes trump's actions as reckless, the problem with that, and the same problem you had with

sending his former chief of staff, former advisor, marc short, former outside counsel craig jacob's to testified to that january 6th committee, which is that, all of it is under oath. a book is not under oath. it's like the rest of the trump era administration looks so it's some of which are still coming out. he cannot avoid it, and i will tell you this, the subpoena, really, you can shirk a house subpoena and, you can run out the clock, and hope that the chamber flips. >> tommy, you are talking a purely legal teams, which i appreciate, but i think we both know that there is a political calculus going on here. as you have pence looking towards 2024, talk to me about the extent that you think it is weighing on his decision-making. >> well, he is hedging so much

on this. in the last few years, we have to talk for the last 11 years, talking with his folks. but, in the last two years in particular about this issue with him. so, what you saw when he was campaigning in the midterms, was he was trying to talk forward, talk past, talk about the future of the party, and he just can't. he is such a seminal figure in this historic attack on the capitol. in an attempt to overturn the election. so, i think, when we talk with republicans who are not either former pence aides, or not part of his team, they don't get sucked into this like this wish casting that they have around pence, and his people, in january. you either take it ahead, or you don't.

there really is no tightrope to walk here for him. you just kind of pick one. >> let's talk about what little rope there is, you have cnn reporting that mike pence's lawyers my claim limits to what they say about his conversations with trump. i wonder how you talk to pence to respond to the subpoena, and specifically, whether or not his team tries to put guardrails around him? >> it is going to be a lot harder this time, he was able to send that cut outs to the house committee, and greg short and jacobs. you really can't do that here. as joyce was talking about earlier, will the executive privilege play out? will it be a long running thing? all things yet to be seen, but this is a federal grand jury, and it is not a house committee. you can't run out the clock. probably not as well as this one. i think the biggest thing

for him, is it keeps him tied, politically, to january 6th. that is something where, if you look at the base, that hard maga plurality that we still see bowing behind trump, and to some degree, desantis. they do not like that. well, let's look to the other side. let's look to the suburban republicans, let's look to the moderates, the former establishment types, the people who are never trump, maybe they were slowly coming back to the party, the less that trump wields influence. pence loses them to. it is shrinking his lane for 2024. which was already very narrow to begin, with this does not help them, basically it ties a millstone around his neck. >> so, given how late that is, is there any doubt in your mind that mike pence will run for president? >> well, you know, a

couple of days ago i would have told you, it's probably 99. 9% guaranteed, but it arguably has been running for president in the shadow camp, we've all talked with nikki haley, and the rest of them. but, i do not know how much this changes the calculus, it just narrows things further. i talk to someone who worked for him a while ago, and they are making a point that pence has been going to the main churches. heading the isle of south carolina access. trying to play, and shore up his valid -- evangelical support. trying to win it back in court. and you see a lot of that on the ticket back in 2016. but he was making the point that for pence to when, you can't just lean on evangelicals. you have to grow. and he is not growing. so, what january 6th does is it shrinks his base. it shrinks it back, and pulls them backward.

reasonable threat at the safety this is a billion flights. and out of the caution and the recommendation of the pentagon, president biden ordered the military to down the object. >> that was white house counsel security spokesman, retired admiral john kirby. confirmed today, another mysterious object has been shut down over u.s. territory. it comes a week after chinese spy balloon was discovered spying over the united states, was eventually shut down by the u.s. military. panic on officials will not confirm today, whether or not this new object was also a balloon, and what his country of origin was. we do know that the second object was notably smaller than the chinese spy balloon from last week was. it was about the size of a car, and was also flying in a different altitude. when that made a potential threat to civilian aircraft. we return to the nbc news pentagon, and national security correspondent, courtney qb. courtney, thank you for being with us. what more can you tell us about the

second flying object that was shot down? >> well, not much more. they were shot down only about 24 hours after the u.s. military first detected at. they mentioned it was flying at a slightly lower altitude. this was, probably, one of the reasons the pentagon recommended, and the president concurred to shut this thing down. it is a potential threat to civilian aircraft, and also u.s. aircraft they may be flying up in the area. it was in the last week and a half that whatever this object was smaller, they had a significantly smaller payload. this would, also, give the potential to bring it down, because it would have a much smaller debris field on the ground. the bigger this object is, if you blow it up, especially if it breaks into pieces, potentially, it spreads out over a further area. the third reason is, as opposed to the balloon they were tracking

last week, where they watched it as it came the andalusian's, down through canada, and into idaho, there was a short stretch a period where it was over an area that was determined it could injure, or even worse, printable on the ground, or infrastructure. in this case, they were able to take this down when it was over frozen water, so there was a high degree of confidence that no one would be heard on the ground. one thing i find interesting that they learn to be today, and it was here with last week's balloon. it was moving south, southeast, the the whole time. we're told, according to the pentagon, today this was moving northeast. and some officials say that it may have actually been blowing with away, and as opposed to being maneuver toward driven. those are the questions we were asking, trying to get an answer to. i understand that the u.s. government is saying that they do not know where this belongs to, or have a whole

identification. but the one thing i want to remind viewers is they knew pretty quickly, that they detected the balloon last week, and it belongs to the chinese. but a surveillance aspect, and it stands to reason that they would have answers to that with that about this one as well. >> it was so much more in their object. any indication that was already in the air when the u. s. shot down the first one. >> no, and that was one of my questions. because initially before we know exactly how big it was, we were just hearing that it was a small object in the air. you may remember that last week when we first learned about the and norma spy balloon that was flying over the u.s., there was some concern that one of the things that they're doing is dropping smaller objects. it it's things that could be more difficult, smaller objects heard the text. my first question was, was this

something that could've been dropped by the previous balloon. i was told by u.s. officials there is no indication that that was the case. it's an excellent question we're hearing more and more, ever since the first closure a little over a week from now about the chinese spy balloon, we're learning more and more about these instances of all sorts of them all over the world. it is a fair question that you don't have that answer yet, and another thing that we found fascinating about today's disclosure is that they did, like they did last week. the u.s. military sent f-22s up. why? because it is a dual purpose here. it has these very advanced sensors and radars, that they could get up close to this object, get a sense of what it, is but it also has the sensibility to take it out. it has aimed missiles at, it which is ultimately what they used to shoot it down. so, it's always been

featuring promises in schools across the sunshine state. we've seen the state's department of education project math textbooks, and the way the states deem problematic. the states university already canceling courses a florida might consider indoctrination. we have seen elementary school classrooms, libraries, papered over with construction papers so that teachers can avoid felony charges for displaying books that the state determines to woke. i want to do that on camera. woke. governor ron desantis so-called stop woke policies has a never ending quest to vanquish a critical theory rates when mike dungeons and dragons. they said, it was seeing some of those culture war results may begin to seep into high school classrooms across the country. the new york times says that desantis was is in frequent contact for a year, as it develops its first advanced place from african american studies programs. the times published a

florida department of education letter to the college board, describing the discussions of florida officials had with the college board. it was warning the college board that it would refuse to offer an ap class unless it offered portions of the curriculum that violated regulation requirement and instruction on required topics of factual, objective, and may not suppress, or distort, significant historical events. florida said the college board acknowledged and would make some revisions. on february forced the board released the final framework for the course which, largely, removed some of the concepts that florida found objectionable. things like, get ready for it. intersectionality, mass incarceration, and reparations. the college board claimed that the revisions had nothing to do with florida that rejected the course before the final version of the course was public. joining us now it is from nevada, a congressional chair

from the black caucus. congressman, i know you are not from florida, you are from nevada, but i thought this was relevant for two reasons. one, this is now what was taught nationally, and it would seem was, at least, changed to some degree, based on what ron desantis, and legislators in florida wanted. this may be their guy, come 2024. so, what he imagines is not going to be contained to florida, it could be a vision for the nation. >> it's not the vision that we embrace, the congressional black caucus rejects the attempts by ron desantis, or other governors to wipe out black history, which is a part of american history. as we celebrate black history month, it is important that we instill the true meaning of what it means to share that history with everyone. black students, as well as non-black students. several members of the congressional black caucus, joyce beatty, jamal bowman, and

quasi-and who may release the package of bills themselves, promoting the importance of african american history as a part of american history. we will be, proactively, advancing those policies this congress. >> as a student of history myself, as a mother of two daughters, granted, they are young, so not here yet, i just wonder if, without learning intersectionality, without learning about the history of incarceration in this country, without learning about the concept of reparations, whether or not you can understand race, and racism in this country, whether or not you can understand systems, and structures in this country, that have been built on a racist foundation, and whether or not you can understand something like a conversation we're having today about policing in america? >> look, ron desantis, and others like him, are ideologues, who are trying to divide america. rather than bringing us together, to share the unique experiences, culture, and history, that we contribute to making america great. black america, immigrants, from all over the world, have made

america what it is today. we are not going to tolerate the discriminatory policies of ron desantis, or any other governor in the country, who attempts to deny our true history. >> talk to me about the conversation your having on capitol hill around police report. what do you think, is actually, possible, given the congress who are operating in? >> what is great about this week is that president biden used this moment of the state of the union speech to speak to the spirit, to the hearts, of american people around public safety, and accountability. we believe, bad policing has no place, like any american city, and we believe that while promoting the culture of policing, and face the community safer. i would think the parents of tyre nichols,

who were there in the gallery who heard the president speak of the importance of transparency, accountability, and standards, and that is what the congressional black caucus is working to promote in a bipartisan way. >> they want a provision added, that would require officers to intervene. a provision added to the george floyd officer policing act, requiring offers sirs to intervene when they witness misconduct. do you think it is possible? >> it's a basic standard. it won't force went, and first responders is bearing in memphis that watch that meeting occur, and nothing to intervene. it is now looking among others, and it is going to pass meaningful reform to keep all communities safe. this is not a black, brown, or white issue, it is not a democrat or republican issue.

it is a public safety and accountability issue, and all americans should agree that every community deserves to be safe. >> with that frame, what does that look like legislatively? >> first, it looks like having the data that supports information. for example, in memphis, the use of force was used three times more on black residents, then white residents. that is appalling, but that is information that we have because they collected the data. there are 18,000 police departments across the country, we need that data on a national basis, so that we can have transparency. secondly, we need accountability. the lion's share of police officers to put on the police officers every day that put on their uniform every day do a good job. they should go home at the end of the day, just like we want our children to come home at the end of the day. so we want accountability for the bad actors, and finally we want to instill better standards. so that people cannot move from

and this is not his first time running in with the commission, just a few weeks ago the fcc raised questions over his campaign experience, those asked by the justice department to hold off on any actions against him. the fcc requires those who spent more than $5,000 in the candidacy, to register within 16 days for the threshold. commission sent to santos earlier this week and is in previous elections of the cycle, was contributions and expenditures, and the 2024 candidacy in excess of $5,000. thus, meeting the definition of candidate. the fcc has asked congressman santos to declare by march 14th, whether he is running for reelection in 2024, or disavow in spending funds. but whether or not he will last in congress through 2024, it remains to be seen. just yesterday, house democrats filed this resolution would expel from congress, setting

everything. 9/11, the holocaust, the lgbtq massacre, the police shooting, his career, his education, the office is under investigation for multiple financial obligations, financial fraud. so if we're not going to expel george santos, who do we expel. this is someone who we don't even know who he is. kevin mccarthy should be ashamed of supporting him, of giving him access to classified information, which he now has. so, we are serious about expelling him, and we are starting to get interest from republicans as well. >> and that brings me to my next question, because i want you to go with me through this thought exercise. you have at least eight republicans, who have already called on him to resign. three congressman from new york support his expulsion. if, and i understand this is a big, if if it was brought to a vote do you think that the you have enough votes to pass? >> i think we're going to try to build that case. first and foremost, first he's

going to the house ethics committee which is the next step. then it will be heard there. we're going to wait and see if we move this onto the floor if they choose to not move on the floor. we're going to try to force a vote. we think that there are enough republicans to get that done on the floor. then it's going to be up to house republicans, to see if they are going to stand with a serial liar and fraudster, or try to be someone in that represents the constituents. his constituents have been very clear, they want him out. every republican i've talked to wants him out as well, besides maybe kevin mccarthy, for his own speakership. we're going to do everything we can to force a vote, and put republicans on the record to see if they actually support this person, and we don't even know what his actual real name is. >> to your point, he is a serial liar, he is allegedly still lying. in his axios interview he said that said that senator offered him words of encouragement and told him to hang in there, buddy, ahead of the state of the union. but then you are sinema

spokesperson telling msnbc that the comment was a lie. help us understand, what are the repercussions are there for a member of congress who lies about things as small as that, and as big as who they are. >> first there's a couple of things, the house committee is doing a serious job of investigating all of his possible crimes, and so it's very clear that he's committed financial crimes, finance violations. that's been clear, that will come out, i think he's going to be held accountable for his crimes, and the congress can hold him accountable by expelling him now, in addition of course, there is absolutely no way that santos is going to get reelected, he actually holds on to that period of time. we have asked for his resignation, now they're trying to expel him. but there are multiple ways that he is going to have to open up his lies, and frankly, those lies can come down on him. he's done some horrific things.

clearly, we don't know where any of the money that he got from his campaign, came from. he's told multiple stories about his business background, and we don't know which names he's used in the past that are actually his. this isn't just a small embellishment, maybe getting a couple of dates wrong, this is a serious fraud. >> indeed. there is reporting from the washington post today a republican congressman of florida suggesting that she may have also embellish details about her life's. she went on fox news, she denied allegations. she claims she has documents that support her claims. let's just back out, this is a member of congress that says that she believes that donald trump won the 2020 election. she's a person that was endorsed by donald trump, somebody that set the standard for dishonesty. i want to ask you about a bigger picture, congressman what happens to our politics? what happens to our legislative bodies? what happens to the democracy if there is just no consequence for lying?

>> i think that's really a shame, i think, first of all we have a lot to owe the situation that we are into donald trump. donald trump is a liar in chief, he's the conman-in-chief. he's allowed all of this to be okay in large part for the american public, and with his base. i think these lies are beginning to expand across the caucus. among different members of congress. they must decide that it is a place of truth, facts, and science prevail. and donald trump has done his best to destroy all of those. now you're seeing folks like george santos, and others lie, and then continue on. these kinds of lies exist with donald trump, they would be out of congress, they would be resigning. i think it's really a shame for the institution, and quite frankly, there are so many republicans on the other side of the aisle that all agree. they discuss that, and are ashamed, like mitt romney and
