unidentified object has been shot and by the united states military. this, time it's over canada. the prime minister justin trudeau announced yesterday that an unidentified cylindrical object was being trapped over canada's yukon territory. he treated that canadian and u.s. aircraft scrambling to respond. the u.s. heads to successfully strike the artifact. the readout of biden's phone call with the canadian prime minister. the white house, said quote, earlier today president biden spoke with prime minister trudeau on the unidentified object in north american airspace. the object was closely tracked by north american aerospace defense command over the last 24 hours. and the president has been continually briefed on the national security team since the object was detected. and abundance of caution, the recommendation of the military, president biden and prime minister trudeau authorized visit to be taken down. canadian forces will now recover and analyze the

wreckage. but at this, time it's purpose and origin are unclear. the u.s. is still searching the area in northern alaska where another high altitude object was shot down on friday. pentagon officials say the object was first spotted on thursday, traveling north east across the state. it has been described is about the size of a small car. there are no new details about the origin, capabilities or purpose of this flying, objects either. but u.s. officials are fairly certain that the first object struck down last week was a chinese surveillance balloon. the chinese airship was taken down off the coast of south carolina last saturday. the state department says the balloon carried the devices to intercept sensitive communications. u.s. is still in the process of salvaging and analyzing the debris. last, night u.s. military also scrambled fighter jets in montana to investigate the radar anomaly, which briefly closed federal airspace.

however, no object was detected. wow. joining me now to discuss this all is laura -- defense reporter for politico. laura, what is going on? this is the third unidentified objects shot down in one. week what is the mood inside the pentagon right? now is a really bit trigger-happy or people freaking out? >> in the pentagon officials are on high alert and they have been for the past two weeks. this is just the latest installment, like he, said of this drama where you've had three different objects that we shot down. the first one that is worth going back to who is what is known as a chinese spy balloon. that is what the administration said from the beginning. and they actually tracked over alaska first. there are some key differences i wanted to point out between that object and the other objects that we've seen. one is that it was flying so high, flying at 60,000 feet

which is high above commercial air traffic. and then these two objects that were also shot down were flying at 40,000 feet, which is imposing a risk to commercial air traffic. another difference is that when you're with a spy balloon came from. we said from the beginning that it was from china. we said from the beginning that it was a spy balloon. it had surveillance equipment on it. and so it actually traverse to the entire united states before we managed to shoot it down off the coast of the carolinas. and that was two weeks ago. so that is what is really contributing to the mood in the pentagon, with everyone being on really high alert and hypervigilance. that may be part of the reason why you are seeing these instances come up now and again. >> let's get super granular. i'm gonna give you a rapid fire succession of questions here. i want you to basically help the team the process by which we track entry down these objects. when you say machine are used to track these objects?

>> what we are using in this space is ground surveillance radar, in particular. and what happened with these objects was that it was first detected with the ground. radar and that entered a wide area of space to sort of break it down. and then what happened is that once that anomaly was detected, then we sent up fighter jets to check it out. so we're on friday -- >> when we see call the suppose fighter jets? >> usually it is the commander of command, general glenn vanherck. typically. but in this environment, actually what happened with the first one was that he made the call not to shoot it down because it did not pose a threat to in anyway. and then use this other two systems to come online and none of that but we are in this environment of being hyper vigilance. so he likely present before even taking the shot himself and then there was a question

about what to do. that's why the system is different than it typically would be. >> two quick closing, questions why the f 1:22? >> that is actually a really good question because i've not been particularly good answer to, but i think i know a little bit the reason. there's newer stealth fighter jets. there's a sideliner missile on it. with those, times it only took a single missile on those balloons. it's also the military's most advanced fighter jet technologically. it is stealthy in the case of the first balloon, if there was any equipment on the balloon, that equipment would not be able to potentially see the f-22 coming and does not appear on a radar. and of course it is a very very expensive fighter jet. >>, that's my last question, laura. how much to these emissions

cost, roughly? do we know? >> it is hard to put in exact price. anna but i would estimate at least hundreds of thousands of dollars. the missile itself is about $400,000. the f-22s of high time is maybe, 30 $40,000 an hour when you factor in a jet fuel and things like that. and, then of course, the chinese spy balloon controversy nice it's across a whole week. we spent tens of thousands of dollars tracking as with, for example, the u2 spy plane another fighter. jets other fighter jets in the package to. when you add all that up there's 100 thousands of dollars, maybe even close to 1 million. >> the world's most expensive balloon. laura sullivan, thank you. so reporter politico, where they appreciate your insights on. this switching gears a little bit. after a period of relative silence, we have new details regarding both aspects of special counsel jack smith's investigation of donald trump. just days after smith's subpoena, former vice president mike pence, nbc news has

learned that trump's lawyers are expected to intervene in the matter. smith wants pence to turn over documents as well as testimony regarding the trump team's efforts to overturn the results of the 2020 election. trump's legal team is now looking to prevent that from happening, claiming executive privilege over that information. pence is a subpoena is arguing we will significant development since smith took over the justice department investigations. in the three months sense, the focus has been on the january six investigation. shifted towards these scheme to have fake electors falsely claim that trump won a race. meanwhile, the efforts to issue government records from trump's possession appear to be still ongoing. a senior law enforcement official tells nbc news that trump's legal team recently turned over an additional folder bearing classified markings. discover that the former president's mar-a-lago home. i patiently, the guardian reported last night that the department of justice actually

subpoenaed trump to return the folder, which was mark, quote, classified even in the briefing. according to the guardian this was not found at mar-a-lago. they recently found 46 empty folders with classification markings in trump's possession. this is not exactly an outlier. they discovered came during the search in mar-a-lago, which could after months of discussions and negotiations with trump's team to return records and material that he took when taking office. additionally, abc news is reporting was in possession of a laptop belonging to a current trump aide, after one of trump's attorneys told investigators that the folder had been electronically copy to that computer. joining me now to discuss, >> she's a former attorney for the eastern district of, michigan professor at law. school also never cbc legal analyst.

an executive, privilege they can recommended something we, protected it is the president, they saw the, president who controls. it that is one strike against donald trump. executive privilege only a qualified privilege. since there is a greater interest in the privilege must yield. there's our stronger case for that to yield and give way based on the nixon case. where the supreme court said the grand jury investigation is in greater need than protection of the privilege materials. i expect that this will delay the turning over of documents in the testimony of mike pence. but all timidly,, doj will prevail and get that testimony. >> david, to you, could the doj must have expected trump to take this action. they made on the before. walk us through how this gets litigated. and are you with barbara? do you think this is a little trends of success to succeed?

>> i do think it has very little. trans will have the same court of appeals in atlanta. this claim of executive privilege. i agree with barbara. a criminal persecution of anyone, including a former presidents, is more important than wanting to keep personal conversations as a deliberations, private in the white house. mike pence is arguably witness to a crime. i think that with the testimony regarding, 2a6s interesting focus -- a key element for work under conviction is that knowing donald trump had lost, election. -- knowing that the loss. election in terms of mike, pans macron said i do not have the constitutional authority to overturn the results of this election. on the space, it is just an absurd idea. that the current vice president

chose to -- not the american. people it's an interesting development, and i think personally there is obviously issues of trump handing back documents. if donald is going to be tried, anything it should be -- a sort of outrageous act of the presidency. >> let me just push back and pick up on, that. david very quickly. -- mike pence told me i do not have the constitutional authority. i have this lawyer over here who said he did. therefore, my intent was not -- for anything. and it was too exhausted constitution options. he has legal look wiggle room or no? >> you are absolutely right, and that is the key here. prosecutors want to have a strongest -- possible in under sainte-rose mindset.

no such an obvious case engine and a long ago. this is the challenge. i mean either people who knew his state of mind, johnny mark meadows and rudy giuliani, so far refusing to cooperate as far as we know. the prosecutors. that firsthand evidence of what trump's thinking and saying during that time is critical. and they should testify. john dean did, the american people deserve. it's and frustrated with eastman and giuliani said meadows. >> let's pick up on. that but to what degree can pence provide that testimony. and i can say that theoretically was there but can you give possible deniability but trump's mind that? moment let's say that that's gonna go forward with testifying. and trump's team wants to litigate this issue of executive privilege. will pence be stopped for doing so even if --

>> i'll take that one first. so the person actually has executive privilege, joe biden, wants to serve executive privilege, he could prevent pence from testifying, even if pence wanted to. in this instance where we have a former president who has this residual privilege, i think he can succeed in delaying it. i think the only thing that is open for litigation is narrowing the scope of testimony to make sure it only relates to that which the jury is investigating, crimes. it is not delving further into other matters. for, example we saw lindsey graham try to use the speech into plate clause to prevent his testimony before the grand jury in georgia. in the court, there, they said of course you have to testify. now the da, do not go asking questions beyond the scope of the investigations, and things you may have said before of the senate. and they said, sure we never planned to do that anyway. i imagine a similar narrowing

of issues which occurred in this case and that litigation. but i think they're going to say i do not want to ask him about other stuff anyway. that is the china policy. i want to ask about january six. look at. they're in terms of what questions to ask mike pence, i think there are a number of theories of liability with donald trump here, and then cleanest one is conspiracy to defraud the united states. that is, the mental state there would be on you a lost the election, and the physical acts would be pressuring mike pence to fork histories as vice president. telling, him do not certify the election. and that is something the only mike pence really can talk about, about what happened between the two of them behind closed doors. >> right, fair enough, i just want to quickly turn to the other element of this, of the trump legal problems. david, just as per the trump investigation of the classified documents, january six, still a problem for the former president. it's been more than two years since trump left office. we're still finding folders, and other materials.

plus we have new reports that there may have been digital copies of at least some of the government materials that he had in his possession. this, all in the loop of joe biden and mike pence discovering classified documents at their homes, just focusing on the trump investigation specifically, how do you see that playing out? obviously the issue here is different than pence and biden, because it's a matter of obstruction. and now we're still getting more documents over, is that -- it's trump more valuable vulnerable on that front? then january 6th? >> i think,,, i'm not sure, to be frank with you, i'm curious to see who's cooperating with january 6th. there's a stronger case, obstructing the turn of those documents, there's a longer effort with the fbi, and the justice department asked for them back. and trump said no. those inventories presented by his lawyer. everything is going to be handed over. but it hasn't happened.

of difficulty finding abortion access? what would it mean if you could no longer get this abortion medication? >> this is another step in the direction of an entire national ban. for those that claim that they just want to turn the power over to the states we know that yet again we cannot trust the words that are coming out of so many of our republican friends mautz. because they say one thing and they do and support another. and so i don't even think that they really care much about citizens. they know that our governor is competing to be the worst between him and desantis and they know that he will continually push an agenda that does not align with the ideals of most texans. but what they're trying to do now is pushing to tire ban, they want to control those states have made a decision, to still allow abortion access, and the other thing about this is for people to be so pro-life,

i wish they would understand that we are saving lives right now. you talk about a fetus, a fetus is not considered a life at the point of conception. >> a group of democratic attorneys general from across the country have signed a briefing revoking this drug's approval will have devastating consequences for all americans. how do you think this brief will help i mean obviously needs to work its way through the court system. but do you think there's enough political attention on the issue right now? >> i think people are keeping the pressure up as it relates to reproductive access and rights. the problem we have when we have federal judges is that they're pointing for life. that is one of those things when they never have to feel the effects of their decisions. so i don't know if it really matters. this is why we're getting terrible opinions in this supreme court because they

don't have to care and they don't have to face the music for the devastating actions they take on the bench. that is one of my concerns. i feel like this was brought in texas, and brought before the judge is because they absolutely believe that. even if they're not friendly, they know the fifth circuit is not the best circuit to bring in an opinion like this. and let's talk about this other issue that is really annoying the heck out of me. it's the fact that republicans, for whatever reason, they completely disrespect science at this, point and facts. they don't care about. it they will say one thing and do another. we know the facts are on our side. we know the science is on our side. but it will completely ignored an arc like it doesn't exist. and replace it with their opinions. >> let's talk a little bit about what happens if in fact the suit goes against the democratic attorneys general, and medication abortion is

essentially outlawed. already, on the garden of texas, we've seen the restriction of abortion rights. what is the reality for someone seeking an abortion in that scenario if this case got against abortion rights? >> it's devastating. we know the cost of this medication is a lot less than, say, going and getting a procedure. we also know that so many of our clinics that are still open throughout this country, they are overrun right now. because you have people who are fleeing other states, that have denied abortion access. and so, this was only other avenue that so many of those women had to be able to seek abortion access and reproductive health in the sense that they wanted to. and, it's a very private thing. that's what new york group of, this is about privacy. and so we know it's a lot more private if you're able to order

your medication online and receive it at home chiraz and they're not seeking the access they need, they have to go, and feel documentation, be seen by other people, potentially be harassed, at some of those clinics, if they can even get there. and we know that financially, so many women that seek abortion access is a financial decision. they know, that they can't simply afford a child. and so, now we are making it even more cumbersome to actually access this care. and the final point that i will make on this is specifically in the state of texas, we know that we lead when it comes to the maternal mortality rate of african american women. that will have a specific and intentional and direct impact on minorities in this country. not just in the state, because we know that when they do add end -- up having to carry children,
