clubbed, tear gassed, and sick dogs on peaceful protesters marching against -- it was a solemn but crucial visit, especially given biden's teigen voters that played a large role in 2020. juxtapose that moment without congressional republicans exercised their power just this week. you have a perfect distillation of current american politics. consider in particular how the house oversight committee is gearing up for what critics are calling benghazi two point oh. it's a rash of investigations into far right fever dreams which are designed to attack the president and serve nothing more than the red meat and gop base. don't get me, wrong i'm not exactly shocked by all of this. i am disappointed, because kevin mccarthy did not have far-right firebrands like jim jordan or matt gates to share the where --

he didn't pick those guys. he handpicked kentucky congressman james comer. it's a guy who reported bipartisan backslapping, a so-called adult in the room. those were the phrases that the media used to describe representative comer. while he is not as loud or brash as jordan or gates, he's often been flying under the radar since he took over the chairmanship. we've been keeping an eye on him, and we need to dispel this notion of who he is. he's just as radical, just as far right, just as conspiracy driven as the other, louder house republican figures. just this week, cockburn decried the fact that he missed his chance to see president biden somebody, a veteran that died of brain cancer. being prosecuted and thrown in prison. despicable sentiments from an alleged adult in the room. last month, he basically suggested that the chinese signal -- was carrying a wuhan bioweapon,

said who's going to threaten tv provider direct tv if they didn't add back his favorite propaganda outlet, newsmax, to the lineup. he has repeatedly called for not just the fbi, not just the justice department, but for border security to be defunded and dismantled. forget about a wolf, james comer is a grenade launcher. he is such in sheep's clothing. let's be clear about that. joining me now democratic congressman of texas, a member of the house oversight committee. congressman, thank you so much for joining us. it's a pleasure to talk to, you and i want to get your general thoughts on this new chairman of the house oversight committee, because as we just outlined there, he's somebody that has been flying below the radar, not quite as bombastic in front of the cameras as a jim jordan or matt gates. what is your take? >> first of all, thank you so much for having me on. i hope you don't drill me as

hard as you grilled many hear about comics, but what is so tragic to me is the committee on house oversight used to be chaired in the past by a legendary chairman who could be ultimately held -- and grifters, enemies of democracy, and account people like jack brooks from texas who helped drive down the cost of government services when the corporate monopolies were doubling up all of the remaining contracts held. folks like nick or -- he used to have a committee, instead stepped on the little guy. they uncovered the truth sensitive obscured the truth. what we have been seeing in the committee has really been a smokescreen of white ring conspiracy theories that not only serve the larger corporate interests that are behind the modern-day gop, i will give just one example. comer recently entering -- the derailment of the train in

east palestine, which we should investigate. his investigation only included the administration. they should be included in those questions, but when we asked, the company that ultimately is responsible, we hear crickets. i think that's what's emblematic of this right-wing fearmongering as a smokescreen, ultimately for the corporate interest of the modern gop. >> the me get your reaction to what comer said, and specifically his vial remarks about beau biden. do you fear that they will be can -- on president biden ahead of the 2024 elections? this is the same playbook that the big guys you committees when it was kevin mccarthy is in the show. >> we are already seeing that every single week. and what is tragic about it is that there are american people suffering right now. there are real issues that we see across the country.

in texas, people's reproductive rights are being taken away. workers rights are being taken away. folks not sure if their kids are going to be safe in school, from gunman. and instead, what we have is this powerful committee that is supposed to be able to hold the government accountable, hold big corporations accountable, and they're being weaponized about a political campaign, the presidential race. it's like in texas, 53 people were found dead. immigrants coming to this country, trying to find a better life, women, kids as young as 13 years old, scorched to death in the back of a tractor trailer because they're hiding to try to come to this country to see kevin. and greg abbott, our governor, his public statement was not sadness or remorse, or wishing health for the few people that survived. it was these deaths are on biden. that is what we're continuing to see with chairman comer, trying to find any issue that he can point to president biden about, instead of turning the view towards the american people, and how it is that we

can serve them. it's really a disgrace. >> talk to me about how democrats are planning or can push back against the agenda of the oversight committee under the republican leadership. >> we can fall into the trap of trying to be in this council for the administration, instead you have to be a defense council for truth. i think we have to get the majority of the american people to believe. the committee hearings are just a partisan game, but there are actual elected officials looking at for them. for example, when we had that committee hearing on immigration, and there were so many books on his side of the aisle, talking about those undocumented immigrants bringing fentanyl into the country, and other invasion conspiracy theories. entirely not based on truth or reality in. we have to fight back with the

truth then talk about what we need to address things in our country and the public health crisis. we need to come out with real solutions and helping asylum seekers be part of this country and stabilize countries abroad. we have to put together a positive agenda for -- or people they believe that our real masters at the american people. >> i may ask you about your colleagues in the republican party in the home state of texas. they moved to formally singer's one of your republican congressman tony gonzales over his supports of the gun control legislation and same-sex marriage. your reaction to what is happening in your home state with this republican party? >> texas, when i think of texas, i don't think of greg abbott or the right-wing extremists that are against things like same-sex marriage were gun safety.

i think of folks like sarah weddington, the twentysomething year old lawyer who won roe v. wade and brought abortion rights to this country. that wasn't so long ago, it was a case one in texas. i think of the voting rights act, which president biden just went and celebrated as he crossed the bridge. that was signed into law by a texas governor. certainly not a perfect president, but somebody who just didn't sign the voting rights act, and also the civil rights act, also the fair housing act, who also brought us medicaid and had a start. my state is a state where the majority of people believe in something much different than the current existing ruling regime. what we need to be able to do is organize that majority back to our progressive roots. >> congressman, thank you so much for your time. we greatly appreciate your insights. and -- >> no problem at all. i won't bring up any comic book

abnormal, daniel moody, and former u.s. attorney in michigan law professor at the munich and msnbc legal analyst, margaret barbara mcquade. two great friends of this show. i'll start with, you jack smith. what does this say to you about the state of his investigation, and they are now focusing on trump lawyers. >> it sounds like they are really starting to get very close to the ultimate conclusion of an investigation in an ordinarily prosecution beginning at the outer level, circles getting smaller and smaller as they get closer to the target. and so talking with his lawyers, talking with mike pence, it suggests to me that they are very much closing in on donald trump himself. certainly there are some assertions of privilege that are going to cause some delay here. it does seem like the investigators are now closing in about as tight as they could be. >> danielle, what do you make of trump saying that he will continue to run, even if he is indicted. are we really surprised by that, will indictment make a

difference? a with republicans, and before american voters? >> he's going to use that as a fundraising tool, a man. he's going to be able to stand on a platform with all of the cameras looking at him, saying that this administration, this justice department is doing a witch hunt. he is going to be able to start out his constituents and their rage, saying that this is why we need him back in office so that he can get rid of corrupt people and department of justice, and the cia. he's going to use it as a talking point. this is the problem with merrick garland's justice department, and the fact that it has taken us two plus years to get to this place. we shouldn't even be here having the conversation about donald trump. donald trump should've been on trial at least one year ago. >> so many of the things that he's done over the past six years since entering public life have been unprecedented. legally speaking, what would it mean if trump is indicted while running?

or dare i say, reelected as president while he is being either investigated or possibly indicted. >> this is beyond unprecedented. it would be difficult to imagine, but not impossible. ordinarily, prosecutors tried to lie low during political pressure campaign season so they don't influence the outcome of a nobel election. but here, where this case is already been investigated for so long, i don't see that rule applying it, all i think they're just going to have to keep continuing on pace the way that they have, even once we begin the debate season, and then again the primary season. it could be very interesting if he is convicted or elected. there's nothing in the constitution that says that that can't happen. it would be a bizarre scenario, to have somebody who is elected president also under indictment or convicted of federal crimes. >> i was going to, say not definitely in my reading of the constitution, but you know better i do. nothing that i've read that would ever crossed this

threshold. >> it did not occur to the founders. >> i guess my question to you, daniel, would be what do you think could be more damning for donald trump when you look at all of the various legal fronts that he is exposed to right now? if any of them actually end up being damning, you have the classified documents, you have january six, you have the 2020 election lies, and now you have the manhattan da probing hush money. >> and a partridge in a pear tree. there are just so many cases against donald trump. i want to see one of them come to fruition, but i think that the most damning one is the one that fani willis has been doing in georgia. it's about election tampering and it's about election fraud. i think at the end of the day, to me that is the one that needs to move forward first. and then you have january 6th, and the documents that he stole. find me 11,740 something odd

would not go near the florida governor, a man that supports policies that critics have called homophobic, like the don't say gay bill. xenophobic, like his shipping of migrants from texas to martha's vineyard, and racist, like his watering down of the ap african studies program. this policy run counter to everything that chuck schumer says he believes. he does not have a problem with facing the prime minister of a far-right government like israel. when that includes homophobic ministers calling for the ethnic cleansing of palestinian villages, while trains were -- so extreme is this israeli government thousands of israelis have been demonstrating its plans to overhaul the country's independent judiciary. and still, leaders schumer traveled to israel admits this climate and pledged his, quote, fullest support to a government that is taking increasingly extreme far-right actions. so leader schumer, i ask you this tonight. who are you?

to do predictions. but a democrat may not have to debate him, because i assume donald trump will do that with ron desantis. i think he will go scorched earth and desantis, and i think that he is a deeply overrated figure right now. republicans are pumping him up, but he's got a glass jaw. you only have to watch the gubernatorial debate, where chris actually landed some blows, just asking the simple question, are you going to run for president? he looked like a deer in the headlights, he's a guy that has a glass xia, he outsources his attacks to his press office online. i think that he crumbles pretty quickly if you go on the attack. congressman eric swalwell said to me to my show, fight them on their side of the field. that's what democrats need to do against somebody like desantis. keep them on the defensive, go on the offense. >> and speaking of democrats, i want to play this for you that newsom put out last, year calling him out directly. watch. >> it's independence day. let's talk about what's going

on in america. freedom, it's under attack in your state. you republican leaders, they're banning books, making it harder to vote. the restricting speech and classrooms, even criminalizing women and doctors. i urge all of you, join the fight. or join us in california, where we still believe in freedom, freedom of speech, freedom to choose, and the freedom to love. don't let them take your freedom. >> a powerful ad i would argue there. is this not what you called for in the book? being blunt, being direct. why are democrats not being more forcefully gavin newsom? >> 100%, amen. i love that ad when it came out last summer. and what he's been doing in terms of digging desantis and abbott and others, have join us in california where we still believe in freedom. it's a very powerful line. it's taking this word, the concept that he is hijacked, and reclaiming it. i say in the book, when you're losing an argument or if you're on the defensive, refrain the argument in your favor, so that you're fighting on the terrain that you want to fight on, why

using concepts and words that you want to choose, and you want to define. that's what he does. democrats just handed over. big swaths of the political debate, whether it be crime fighting, freedom, all kinds of issues that they've decided to take back. to answer your question, why are more democrats doing it? that's a 64,000 dollar questions. democrats have for far too long have a technocratic approach for politics, they need a more emotion laden politics motion. >> it's not just desantis, it's also his henchmen. you have to get the gop, state senator jason bird or, who's proposing a bill that would require bloggers who write about high state officials, people like ron desantis, to register with the state. surprisingly, this got so much backlash that even newt gingrich says that the bill should be withdrawn immediately. when you've lost him, and i use a line that you like to use, when you lose him, what do you

what is that say? >> indeed. it also tells you that even a stopped clock is right twice a day. the idea of registering, that something needs outside of the kremlin. i think putin is done something similar. i said before, desantis is the american oil ban, and he wants to shut down debate, he must muzzle the media, he wants to censor universities. one of the reasons i wrote this book about winning every argument, should you want to win every argument, not a very argumentative person, you live in an america where you can stay away. you can't keep your head down. you want to protect american democracy, then you have to step up and have those debates and not allow anybody to shut down those debates. donald trump comes up quite a lot in that book, other general strategies for debating liars? or is trump a special case? >> trump is certainly a step petal case. nobody lies like him, even in the cpac space last night, daniel dae on the other network, cnn, put together 24 or 23 lies,

bare minimum that he told last night. he's on a different level in terms of his volume, and i have a chapter in his -- trying to overwhelm you with lies and distractions, how you can stop that. but separately when it comes to life and general, what i say in the book is be prepared, bring your receipts, have your evidence, have your one liner to discredit your opponent, and don't be afraid to go ad hominem. if you're dealing with a liar, it's your job to tell the audience watching that that person has a bad track record when it comes to honesty. you can't trust that person. say, don't be afraid to say it. >> who do you think is one of the best debaters out there right now? one of the best public speakers out there right now anywhere? >> somebody that i mentioned in the book that i've always had a soft but where is elizabeth warren, she brings receipts every time. i will always say that in 60 seconds on the stage in las vegas, she saved america -- by taking it down in 59 seconds. she won a debate scholarship

friend george santos. the house ethics committee has opened their own investigation into the congressman, his finances are already the subject of several law enforcement probes. the committee said they would try to determine whether santos violated conflict of interest laws, failed to properly fill out his financial disclosure forms, or engage in any other unlawful activity during his 2022 campaign. they will also look into a sexual misconduct allegation by perspective congressional aide. his office tweeted that he is fully cooperating with the investigation, and of course this comes as fellow new york and gop congressman daniel esposito is pitching a bill that would prevent his colleague from profiting off of his campaign lies. that would essentially mean no book deals, no paid speeches, no tv royalties for george santos. let's bring back our panel. i'll start with you on this round. we're going to get to the serious step in the moment. but i do have to ask you first, how disappointed are you that

you will not be able to get your hands on any forthcoming santos merchandise or self published book if that bill becomes law? but >> i think it's pretty much the political in a delphi, it's just wild to me. but again, it's probably the smartest piece of legislation that a republican has put out in quite some time. i don't think that he should be able to make money off of his lies, which is exactly what he's trying to do. >> do you think it can realistically past? >> it's the smartest bill, i agree with you. >> no, i don't think it's going to get past. they don't pass anything meaningful. but i do think that the fact that it was offered out, it makes a lot of sense because we should be questioning, why should he be able to get a network special, the untalented mr. ripley, and make millions of his lies? i think it's shouldn't be like that. >> we've outlined what the

house ethics committee will be looking into. congress cannot bring charges against santos, but could their findings help in the criminal investigation? i guess in some ways, isn't that the same question the are asking about january the 6th? they can have their findings but ultimately it has to be some other body that brings these charges. >> absolutely. but sometimes it's helpful to have a body like a congressional committee investigating something in hand over their findings as a roadmap for prosecutors, but more often than not, they get in the way. they would more likely just prefer to do their own investigation without having to share the stage with other people asking questions in perhaps a less skillful way. either way, their investigations are underway. the house can ultimately provide a number of different penalties against george santos, which can reprimand and censure from committees and even congress. but prosecutors, federal and state prosecutors could be investigating some of the same things with former more serious

congress consequences. >> how significant is that the gop has laid accused -- looking into these allegations against santos? it's not often that jury the gop looks at that, but i'm also not confident that they're going to do a thorough job, and i would consider some of this as a bit of a dog and pony show, just to kind of deflect a little bit. >> it is a little bit of both. i do wish that they were going to investigate with a kind of way that they're putting into hunter biden's laptop, and the other nonsense that they've put out there. i do think that george santos is a real embarrassment. they have a lot of embarrassing characters in their midst right now, but i think george santos, it really takes the cake here in terms of the volleyball, to his mother, to 9/11, nothing that has come out of this man's mouth has been the truth, and so the people of his district have no idea who they elected. i do think that that is problematic. >> to danielle's point, i've literally lost track of how

many different lies and how many investigations are out there. do you expect that we will see more investigations popping up with santos? he's only two months into his term, he's already the subject of multiple probes. >> george santos has become something of a punchline. but it's somebody that we laugh out because of the absurdity of it all. the real victims here are the people that voted for him, for the people to give him money in order to support his campaign. those people have been defrauded in one way or another, and they're being defrauded every day that he stays in office. they elected somebody that does not exist, a fictionalized version of george santos. and so i think that it is likely that we're going to see criminal investigations, as well as this ethics investigation. one where the other, it seems like he is unlikely to finish his term in congress. >> barbara, i'm so glad you made that point. we might lose sight of the fact that if he has become a punching bag, and the bite of a lot of jokes, but he's also somebody that has defrauded his constituents, one where the other. danielle, barbara mcquade,
