the justice department and served as a lead prosecutor fo robert mueller's special counsel investigation. andrew, this is an invitatio to trump to testify. it is not a subpoena compellin that testimony can you explain why this invitation to trump to testify indicates that an indictment i likely imminent? >> absolutely. so it is nice to have the ny actually meeting there t start. and you called it to order so i think your term invitatio has really been important. there is an oddity of new york law which is that if you are subpoenaed to testify before the grand jury, that is, you get an actual subpoena that is a legal document, that require you to come to the grand jur and testify. but if you do that you are given what is called transactional immunity the you are given immunity wit respect to the transaction you testify about. so there is no way that if you were thinking of indicting the

former president that he would give him a subpoena, and thu trigger transactional immunity instead, as a matter of sort o due process they are giving hi an opportunity and a invitation, a voluntary reques which he can either take up or not. to come and tell the grand jur his side of the story. it is highly unlikely that h is going to do that. i have been a defense lawyer there was no way i would recommend this to a client lik donald trump and we have a good sense tha he won't do this from the fact that he asserted the fifth amendment repeatedly in a civi case brought by the attorney general, letitia james and then finally to really get to your point, melissa which is this the kind of thin we do just before we make th final decision about whether t bring charges or not this is very much an in stag development. and honestly if you weren' contemplating charges yo wouldn't be making this offe to donald trump if you thought

and so that filing of fals business records is misdemeanor. in order for that to be felony, you have to be able to show that the false business records were done to aid and abet or cover up some othe crime. whether it is a felony or misdemeanor. but you need some other crime. and there are a lot of issue there. we don't know yet what other crime the da might be thinking of it could be some sort of election fraud it could be a federal offense, in which case you have an issu about whether the stat misdemeanor contemplated a federal charge being that sort of predicate to jack up misdemeanor to a felony. this is where it does feelin like the nyu faculty room, because it is quite in the weeds. the bottom line is we don' really know yet what exactly the theory will be that the da is going to use. >> while there is a lo obviously going on in th manhattan da's office.
