optic, even if in the long run it's not going to make a difference as a former prosecutor, i ca tell you that something of thi nature is not something fo prosecutions that ar outstanding moving forward what it does is gives them the presumption the justice system has not worked properly fo these people o insurrectionists, for th people who sought to overthrow the united states government so, from the public perception not only when you're talking about this, but you're addin on to it, for example, the conversation we are just havin about tucker carlson, cherry picking the narrative around january 6th. it makes the job of prosecutor who's looking t continue prosecuting and holding those accountable, those insurrectionists have no yet had trouble, much more difficult, much more challenging, because i ultimately biases the court of public opinion, in a way tha is not fair. >> speaking of charles, charles, a new york times article today is arguing that the lega jeopardy fox news face

regarding the dominion defamation lawsuit is far from clear. lawyers involved in this cas are reportedly saying th explosive private messages b fox figures might never be introduced as evidence when th case goes to trial next month. my question to you, why? why wouldn't those messages no in the public domain, by the way, why would they not be admissible do you think fox wil ultimately be held liable? >> well, alex, to answer you questions in reverse i think fox is ultimately goin to figured a way to settle thi case out of court. i do think this is a stage and discovery where people are trying to assess what is the level of exposure that all the parties have, how deep doe this rabbit hole go? in reverse, one of the thing that allows them to settle it little bit less than what it i they might face in terms o being in front of a jury getting a judgment on trial, it's the notion that everythin that comes into discovery does not come in during evidence, there are various cases for. that could be relevance, thi is prejudicial, could be a

number of different argument that are made as to why is something that is discovered during the discovery process ultimately is not subject to admission during trial what we're going to see is we're going to see a summary judgment motion. a motion attempting to dismiss the case from the defense that the conclusion of discovery, and then we're going to see decision made by the judge a to whether dominion can move forward after that summary judgment is filed. after that decision is made, i the judge does allow the cas to move four to trial, what suspect is at that point, fo will then come to th negotiations table looking t sell i don't know whether we'll see a verdict holding it accountable, but i do think fo is not going to get out of thi case without paying a pretty penny. >> yeah, with an nda attache to a, no doubt let me ask you quickly, charles, -- inviting donald trump to testify -- hush money payment during th presidential campaign in 2016, why not just subpoena him? i mean, you know, why not just subpoena him >> straightforward answer, alex,
