you from los angeles welcome to alex witt report, would be getting this hour o the investigation into donal trump's alleged hush money payments to film star tort stormy daniels he has been launching out on true to media today. he claims he will be arreste on tuesday clay calling th manhattan da office political. and calling for protests the manhattan da is declinin to comment but some spin campaign said th there has been no notification trump is rightly highlightin his innocence.
10:02 am
his defenders have rallied mos notably, kevin mccarthy ca called it an outrageous abus of power by the da democrats are concerned that his social media post coul lead to violence >> i am just so struck b remembering back this mornin to the two impeachments that i was involved and asked unite states senator of donald trump and remembering my republica colleagues, some of my republican colleagues saying oh they believe that donal trump has learned a lesson fro these experiences. and yet, here we have today hi sending out a message which is a clear signal to hi followers. and we know how dangerous that can be >> well, senior officials tell nbc news that law enforcemen agencies are indee coordinating securit arrangements around manhatta courthouse house in the even of an impossible indictment as early as next week trump's personal attorney says trump will follow ignored role procedures if he has t surrender. the hush money probe of course

just one of many crimina destinations currently underwa to donald trump. and indictment in any of these investigations would put the united states in uncharted territory. our correspondents are coverin this our analysts, as well. they are following all of this developing news for us and we welcome all of you to the conversation we go first to nbc's garrett hate, who is near mar-a-lago i west palm beach florida. garrett, what are you hearin from trump world about the former president saying that h is going to be arrested? >> well, alex, trump world has been preparing for thi possibility for weeks, if no months to try to take maximum political advantage of it. it is worth pointing out tha through trump social media pos this morning, his campaign has clarifies what is really nothing but news reports he doesn't have any advanced information about anything tha the gradually rga might be planning indeed, even his language is imprecise. he can't be arrested on tuesda in new york if he is not already indicted and they're so what we are kind of havin

to take a step back and keep the posture that everyone is preparing for both a legal standpoint and standpoint fo what that could mean now, as i said, donald trump has been priming priming the pump politically for this fo sometime what we have been seeing of th last few hours are his political allies stepping in and accusing the manhattan da' office of essentially being tool of federal la enforcement. to what the bide administration were going afte a political point opponent we saw that for kevi mccarthy's tweet that we could put back up on the screen whic is really an extraordinary political statement from the most pain powerful elected republican in the country. second in line to the whit house. someone to the presidency, rather someone who has not made i official presidential an endorsement in 2024. but here, making a statement that is almost done in kin contribution to donald trump b directing the house committees to investigate and active la enforcement investigation. democrats are viewing it a such eric swalwell a prominen

democrat from california who has been kind of a foil fo trump and mccarthy, responding to mccarthy's tweet describing it as mccarthy doing the bidding of his boss. former president donald trump. so alex, for me, as congressional correspondent an someone who covers the trump campaign, two worlds being folded into one here is really what we are seeing a national republican politica apparatus. at least that that is stil loyal to donald trump, kind of falling in line to defend thei man ahead of what could be a very busy week both legally an politically next week. >> yeah, i think you are spo on with that thank you very much, garrett hague from west palm beach i'd like to now bring in wes point msnbc legal analyst lisa rubin. security analyst, frank sulu sea. and on the phone, lega corresponded and host of the beach with ari melber, welcome all of you are, what is your reaction to trump's claim >> it is very significant. donald trump is taking the posture that he wants to pus

this forward in a way. that he is claiming he is no offering direct of evidence, but claiming, that he does expect indictment. that he will face indictment i new york and then calling as we hav reported, but carefully fo what he calls protests the specter of january six hangs over that. here in the news media we ar going to be careful about ho we are for those things. but it also should be noted, and people should understand the january six was donald trump's protest an insurrection against the rul of law and if there is an indictment. we are not reporting there i one, but if there is one and h is calling for something beyon peaceful engagement, again tha is an attack on the rule o law. so i think we're in significant moment i think there's a lot of indication that this is serious criminal probe that we have been reporting, including the confirmed offer of the for president to face that grandeur and yet we also are going to b very sober and wait and see, will there in the days or week ahead, be a charge or what w call a defamation.
10:07 am
where things get very close an they don't charge. the new york times has adela today is reporting this quote, expected but sometimes things that ar expected don't happen. that said, alex, in summatio this is by far the most seriou we have seen both authoritie and the presidents side. the former presidents side ever get this close to wha sounds like -- preparation for possible indictment so we are definitely at different level than we were yesterday or year go >> you know, ari, i'm recallin a rather animated intervie that you did with joe tacopina trump's lawyer what did you learn in that interview, and did tha interview inform anything that we heard from donald trump today? >> i think what we learned fro mr. second pena and about th vigor and intensity of his pushback as well as how much they viewed new york da' theory of the case that there are chargeabl offenses really did to wha donald trump or his company ha
10:08 am
said or misled regarding the government basically, lying to th government or authorities in a way that might be illegal, i that they take this very seriously. and i would contrast that, alex, two times when we talk t people donald trump is a politician we talk to lawyers and aides and they don't feel that something is necessarily a existential threat or huge that i think mr. second pinot was clearly operating as a new yor trial lawyer, not just shall w say, a spokesman and i think that showed that a of this past week, they viewed this again as a very serious potential. and whether donald trump has been told internally, many for mr. second been on the other legal team, that this is likel or not, is what the lawyers sa he is operating on the lawyers as we reported earlier, but i want to emphasize right now, his lawyers are even saying hey, the statement doesn't mean tha it has been confirmed by the d side the ultimate and finally bases and will come from the government, and nowhere else
10:09 am
but the lawyers, in clarifying that are also dealing with a client who is guarding his words for indictment >> you mentioned client, and i comes to mind, wasn't there ar reports that joe tacopina wa going to be representing storm daniels in some shape or form? do you recall that ever? is that true, in the past? >> mr. second pena but the said that he discussed representing her so he would be the source on that, and that is on the recor confirmation from several year ago. but there is no indication tha he went ahead and did represen or so if you want to get into the weeds on the ethical rules, if you even engage potentiall representing someone sometimes then you're not supposed to be on the other side of that case but i have not seen a public confirmation that he actuall went forward and did represent or i definitely had one more wild piece to this. and let's remember, if the payments to miss daniel's part of the case against trump in
10:10 am
new york, we are talking about a case where the lawyer from miss daniels went to jail, the lawyer for mr. trump at th time mr. cohen went to jail. his replacement, mr. saka peña trying to blame the thrust o any crime that did occur on th former lawyer, mr. cohen it is what legally, alex, we would call a total mess. >> yeah, to say the. lisa thank you for that lisa has struggled on that so we will go to you now were you surprised by th announcement, lisa and from of legal perspective, what does it mean for trump to say that he will be arrested would somebody who's potentially being charged in a case like this, would that person be informed and kno beforehand >> they would likely know, alex, to some degree beforehand. particularly if they are ragin for a voluntary surrender. that having been said, whe trump uses the word arrest, he intends it in an incendiary way, and it doesn't necessarily mean, as ranking confirm, that the defendant is handcuffed an perp walked.
10:11 am
it can mean what happened with allen weisselberg where yo make arrangements to show up a new york criminal court and be books. that processing includes fingerprinting and photographing or a mugshot before and arraignment that is likely what trump is contemplating happening here judge i could mean a, as a spokesperson, confirme yesterday that if trump is indicted, he will voluntaril surrender to new yor authorities and come to ne york so trump may say this in anticipation that he needs t be in new york over the next coming days. but, that doesn't necessaril mean what we all think about when we think about an impending arrest >> yeah, interestingly frank in this rather unhinged post o truth social today, donald trump told his followers t quote, take back our nation. we have learned that new yor state court officers, secret service, fbi, joint task force of course the manhattan da's office, they are all plannin
10:12 am
security measures right now in the effect that that h discharge this week. if they are planning on taking on all of these precautions, what do you think th expectations are what are some of the safet concerns >> it is interesting we spent last week talking about bank failures and stress test on the banking industry t see if they can withstan various stressors. i think, alex, we are about to go through a different kind of stress test. meaning a stress test across law enforcement and for th rule of law and law and order. what do i mean by that this is not just a new yor -centric security threat o challenge. this is something that needs t be treated by law enforcement, writ large, nationwide and as something that they should be preparing for. why? because groups like th boogaloo boys are alread preparing for it they are already massing i private rooms and facebook and other platforms talking abou civil war. and with regard to trump pos in this morning, there's
10:13 am
already a scattering o extremist talking about civi war, talking about warning governor desantis in florida that he should not allow extradition of the president the former president we have lawmakers like the house speaker already tellin us what his dance is going t be it is going to be combative, a protest type stance. we have trump already saying that he has a rally planned fo friday in waco texas, right on the cusp of the 30th anniversary of a deadl standoff between a religious cult and federal agents wher at least 75 people died, including three atf agents all of this is going to stress and test our system with regar to lessons learned from januar 6th. whether the fbi can gather intelligence, act on it, whether any gaps have been filled since january six tha will allow law enforcement t prevent any planned violence it is going to be a rollin test as we watch indictmen
10:14 am
after potential indictment against the former president >> ari, i'm curious your tag many have said that if the doj had been quicker to investigat trump or january six related crimes, we could've avoided situation like today where trump, on the threat o indictment, it's free to cal for a second insurrection. does this implicate merric garland for being to deliberative in his approach >> it is a great questio because of all the things that are being investigated it is quite striking that accordin to donald trump himself today, he is bracing for possible indictment on these new york issues which relate to payments. which are as best we know, misstatement, lies to th government which can b misdemeanors or felonies depending on how many they are another charged. and while those are serious, and many people get a real trouble for that, they are not the most legally serious thing
10:15 am
that trump has been unde investigation for for the last several years. i think it is very clear tha the justice department has moved more slowly than multipl other bodies the prosecutor in new york clearly, as well as the januar six committee which we know wa talking to people like the chief of staff in seeking th testimony of mike pence's aide and others long before the doj view that as a multi-par conspiracy so i think that we are bac today, alex, in a place that i guess as a nation, legally politically, and otherwise, we may have stepped away from for a little while the recent era. we are back to this question o whether donald trump will be successful in his quite brazen efforts to undermine the rul of law, to rattle the system i the way that it is supposed to work, to basically abuse disrupt, delay, and shake ou the legal system away from doing its job. and, again, as always i sa that separately from whether o not. there is evidence to try him o
10:16 am
convict him. he could be charged and stil not convicted. he could not be charged at all but the notion that what he is doing right now, and frank jus alluded to this, it is a quite out of the open. we lived through the insurrection everybody knows what waco is even if you're not a historian and you know what it means and someone like donald trump toda calls for people to gather t prevent that which would otherwise legally happen he is trying to abuse th following he has, and many o those people of course might innocently not understan exactly what is going on there are people who, afte january six that in court that they thought what they wer doing this legal it is not a good defense if yo break the law, alex, but it' weeks you how some of them may have been duped. when he is trying to do, and the test may be in a couple of days, how the united states of the nation a nonpartisan level rebuts this. because it clearly, as the new york times reported today, echoes january 6th efforts t stop that which might otherwis normally happen under the rule of law
10:17 am
>> yeah, i asked this question of two journeys i have the las hour new katyal and charles - i will ask you first, and have you follow-up ari. when you are a prosecutor da and you are thinking about winning charges agains someone. you want to do so with a narrative that's ability, right? you want to think that you hav got the backs, you are gonna b able to win this case, let alone what all we have at stak in this particular potential indictment against donal trump. give me a percentage chance, i you will, both of you. lisa, you first? as to how certain you thin alvin bragg's on what he i going to do. does he think that he has this 100% locked up, 95% certaint locked up, where do you thin this stands, give me the big picture? >> alex, i wish i had my kid magic eight ball right now t help answer your question. i would venture to same, and this is solely based on public reporting, because none of u know exactly what the dimensio of the charges are
10:18 am
that alvin bragg is somewher in the 80 to 90% realm and one of the reasons that say that is because, on on hand we understand that th theory of the case here mayb novel. it may be untested on the other hand, some of the perceived bowl abilities of th case have been bussed just i other ways i'm curious what ari thinks of this, as well but michael cohen who trump is counting on sort of beating up on michael cohen as a defense here and saying that he relied on cohen's advice, one of the things that the d has done is surround cohen wit a host of other people who participated in that plans t pay stormy daniels so that they don't have to b solely reliant on cohen. but at every step of other people who communicated with cohen, and with trump abou their plans. so that cohen is no longer the sole centerpiece of the theory of the case. >> okay, i get your poin there. how about you, ari keratin presidential curativ edge another number? >> i will pass on the question
10:19 am
of a number, but it's a grea question that was awesome with myself and here i am not answering it >> well, i'm flattered thank. you because you are good lawyer, ari. >> well, i think alex is askin a great question and the reason i don't want to put a number and it is because i want to be very careful abou where we are in our standard and our reporting. so i will think through th evidence i think we have which is, there is no disput that donald trump was offere the opportunity to go into the grand jury his team did not deny that as soon as we learned that that puts it to me over certain line that it is very advanced it would be odd, not impossible, but odd after all this to make that offer and then back completely down. indeed barring a good reason for that in the typical case would make people wonder wha exactly the prosecutor was trying to do there so, that combined with the sheer number of witnesses wh have now moved into the gran jury, suggests that they are filling issuing up a case. whether that case lands soon
10:20 am
with indicting donald trump, o some other theory of the case. , that could indict othe people, reindict the trump board with those convicted o instead of crimes. there are other technica possibilities, alex, but the evidence a cruise to the d moving towards donald trump as a potential personal defended, and not something else so that is why i say it is about the loss i can give number >> okay, no. all. good last question to you, frank. we have been giving what w learned from january 6th, ho to address things in a preventative way, and how to deal with things should they become erupted what are you most concerne about, going forward if indeed, donald trump's call for people to protest turned violent or at least large-scale? >> so, january six was clearly a wake up call on the domestic terror side we need to b ourselves as a threat. what am i most concerned with? i think -- gets it be that yeah we have a threat that is us here
10:21 am
the problem that i am concerne about is the tools there is nothing that ha changed in terms o investigative tools, and techniques, or strategies here no new authorities have been provided we still don't have a domestic terrorist law. we still don't have the abilit to wiretap, insert undercove agents and sources in preventative mode. only until we understand the violence is being planned, tha leaves law enforcement behin the curb that is what keeps us going. >> okay, what a panel to get this hour going. thank you all three so much. first of all, you are even lower time for joining us on the phone. and then of course, in, person lisa and frank i appreciate you all joining me, now someone else i appreciate congress min ted lieu. he is also vice chair of the house democratic caucus. welcome. so, let's get into this. if what trump said becomes reality next week, and we se the first ever indictment of a former president in a criminal case, what kind of impact do you think this is going to have?
10:22 am
>> thank you, alex, for your question let me first just say that america, no one is above the law. not the former president, no his neighbors, not his attorneys, and certainly not the for president himself. at the same time, like all americans, donald trump is entitled to a presumption of innocence in a court of law if he's indicted, prosecutors will have to sho beyond a reasonable doubt to a judge or jury their case and the american people will see the evidence which is why what speake mccarthy posted today was so outrageous he is attacking the da and prejudge in the case without even knowing what the charge are or what the evidence is. we should let law enforcemen do their jobs, and we should let the judicial process work. >> so, in that truth socia media post, trump called for protests do you have concerns of unrest i mean, does it remind you a all of his tweets before the january 6th riot when he wrote
10:23 am
big protests in d.c. engine 86 be there, will be wild we >> as impeachment manager for the second house impeachment it is very clear t me exactly what donald trump i doing. at the same time, in, americ we have first amendment rights people are free to exercis their first amendment rights but if you engage in a riot, o assault other people, or d property damage, like th january six rioters did, the you will be prosecuted >> flat out. there you go how about the manhattan monies had hash many probe. this is one of man convalescing actions in the fa president. that includes a win in georgia where we just learned of another phone call between trump and a state lawmaker about convening a specia session to overturn th election results of 2020 there's also the new cnn reporting on one of the specia counsel designation to trump or at least two dozen people from mar-a-lago resort staff t members of trump's inner circl there.
10:24 am
they have been subpoenaed to testify in front of a federa grand jury on the classified documents case is this now the era of accountability is this coming for forme president trump on multipl fronts will any of these othe investigations bring indictments? >> again, we should let la enforcement do their jobs an don't and let the judicial process do its work. in new york, i know that there is a pretty serious case where basically with all of th reporting, trump in th organization was lying t banks. they manhattan da, it look like, declined to prosecut that case. so, the manhattan da's makin decisions based on the evidence and he goes forward with thi hush money case, then it would seem like he is doing it based on the evidence. and i trust law enforcement an prosecutors. i also notes that michael cohen, donald trump's former attorney went to prison partly for th exact same conduct and issue which is being involved in these hush money payments.
10:25 am
>> okay. i want to get to a tangentiall relate to the issue here as we turn to some new reaction on the republican-led subcommitte investigation into the january six committee. the panels democratic rankin member, nova torres, had thi to say on msnbc. take a listen. >> if representative watermelo continues down thi ill-conceived path t investigate the investigators, and failing to focus on th attention that we need to move on to right now. and that is, how do we wor together to best secure th u.s. capital, the grounds wher we work, and where so many millions of people attend ever single year to visit with thei offices or just to take a tour we of course you are impeachmen manager in donald trump' second trial that was centered on the dinne six attack so you have this investigative efforts. that's followed by some even
10:26 am
more robust efforts of the select committee what's is this republica effort to investigate th committee all about? what do they hope to accomplish? >> so, luck. when democrats were in control we passed a bipartisan a infrastructure law to really rebuild roads, bridges, an highways take let out of, water and put broadband internet everywhere. when republicans gain control, what did they do well, they held tw congressional hearings complaining about twitter. and now, they want t investigate the january si committee, which is quit ridiculous because this very obvious thing happen engineering six which is the capitol was attacked and if they really want to kee on pushing that issue, they ar welcome to you but it is just gonna result in more videos of the capital being attacked it's gonna result in mor people seeing again that the former president incited tha insurrection and so if, republicans want to keep undoing the stupid of estimations, they are free t and the democrats are going to put the house a year and a yea
10:27 am
to half. >> let me tap into you experience on the foreig affairs committee given th fact that chinese president xi is traveling to moscow o monday meeting with vladimir putin. i'm curious your read on wha this state visit is about? what kind of insights you have >> well, first, of all blenrep eaton's has now been issued an arrest warrant by th international criminal court for being a war criminal the russian federation launche an invasion of ukraine the russian federation under the orders of lottery putin ha engaged in multiple war crimes and i think the chines president has to be very careful when he visits a war criminal, and he is currentl siding with a country that i weak, their military has bee shown to be far weaker tha anyone ever imagined and, the economy of california for example is twice as larg as the economy of russia so i don't really understand why china would want t associate themselves with this

news that was stormy daniels back in 2016 interest is growing for th former president as he proclaimed on his social media platform, he'll be arrested on tuesday. that comes as law enforcemen is preparing for a possibl indictment as early as nex week in the manhattan da's investigation to the storm daniels hush money case. that is according to fiv senior officials familiar with the preparations joining me now is stephani grisham, former white hous press secretary an communications director fo president trump. and chief of staff to firs lady melania trump she is also the author of th book, i'll take your questions now. what i saw at the trump whit house. stephanie, good to have yo back in the. broadcast let's get into this this truth social post, w are waiting to see of course o donald trump is arrested, but, it is his post straight out of the trump playbook why is he making thi announcement does he want to see protests does he believe that isn't somewhere beneficial to him? >> i think so i mean, first of all, as yo and gus have already signed, w don't know what is going t
10:32 am
happen his own team has put out a statement that was contrary to what the former president said this morning saying that they haven't bee formally told anything but, yes, i think the purpos was to get his supporters rile up i think that he wants to try t cause a scene and maybe he i thinking in his mind that that will make the prosecutor change their mind and if the want to actually go through th stress and all the issues that come with donald trump we >> given how well you kno her, how do you think melania' reaction to her husband' potential indictments in thi particular, the stormy daniels case i'm curious what you saw whe that situation first erupted and what you have seen since then by the way, one observer has suggested that donald was more afraid melania's reaction than anyone else's. >> yeah, i would agree with. that this morning when thi news kind of started to hit, i have to say, she is the firs person i thought of. and of course, their young son who is a minor and i just, thought there'

still this family there that will also be affected in these are people i felt close to a one point. she always had the attitude of this is his problem but, he ca take care. about which i really alway admired and respected. i don't think i could've had that kind of attitude. but i am sure that he she ha that same attitude right now you know, this is your problem i think she's probably stickin kind of far from him i think she's doing her ow thing, as she always does. so honestly, i think you are right to you i know you are right tha he always was afraid of her. he would call me all the tim in the stormy daniels his head to ask me if we were going t respond or if we were going to say anything, because of cours the east wing was known fo putting out statements whether or not the west wing like to so we he was always nervous an asking me, how is our wonderfu first lady doing which was code for issue reall mad? we >> i, agree there is a famil that can be suffering as a result of this and it is difficult for them t

deal with all of this bill is gonna be social media post which he wrot today. which, is protests, take our nation back. if donald trump is indicted, how much will it inflame his supporters i mean, are you worried abou unrest, stephanie? or have some grown tired of hi same old excuses, same old rhetoric well the legal system just continues to follow the law. >> yeah, so i think i'm in the minority right now that of course it is going to enrage his most ardent supporters, hi most extreme supporters. he can do no wrong in thei eyes but i really believe this is going to be yet anothe reminder of the baggag potential corruption that come with donald trump. and i think people have to remember that the voters spoke in 2020 when biden was elected and they spoke in 22 in th midterms when, you, know there was no red wave like everybody was predicting so, i am up the opinion that this won't help him. he only thinks about his bas supporters though. so he is not thinking about th left-leaning republicans out
10:35 am
there that i think, again, i just think this is another reminder of who he is and what you get. >> when it comes to the 2024 presidential race, there's a new poll out that shows donald trump is widened his lead over florida governor ron desantis. 46 to 32%. however, the poll also finds biden leading trump 49 to 45%. he might still be the leader o the republican party, but does he stand a chance in the general election >> well,, again i think that they are in the minority everybody thinks tha indictments are going to sea the deal and get on th nomination i disagree with that i think it is actually what we should be looking at is th fact that the desantis has those numbers when he hasn't even announced yet i think that if he were to get in the race formally, thos numbers would close up ver quickly. i don't believe that he should be running i think that if he really love this country as much as he say he does, he should look at the poll numbers with biden. he is not going to beat hi

again. and we don't need another ru like that in this country. >> but, given the chance fac that donald trump said tha even if you were to ge indicted, arrested, anything he is going to continue hi campaign, how long do you thin it would be for your prediction, which you say is in th minority but i know there ar people who would agree wit you. to drop out of the race or t be booted out of the rac because voters have said w don't want you >> he will never drop out of the race he will not drop out of th race he will just have to lose. and then of course there wil be excuses that come that th republican primary was rigge in some way as well. >> hang. on stephanie, you really think he is going to allow himself t lose because you know, the wors thing in the world for donal trump is to be called a loser. >> correct but he doesn't believe that. he is surrounded by people i used to be one of them, wh just tell him what he wants to hear he really believes that hi base will pull him through now, this depends on who all joins the. race don't get me, wrong if it becomes a crowded primary,
10:37 am
you've got a chance of winning but, no, he will double down i triple down and i don't thin he will average opt out. >> absolutely right. the prevailing wisdom is tha in a larger field it would benefit him. let me ask you about something that has been dominating speculation relative to donald trump. reports of impossible vp pick, those being according to axios kari lake who is among fou women that trump i considering. the others being let's see nikki haley, serhiy huckabee sanders, chrissy - nbc news also reported tha marjorie taylor greene i getting to be trump's ppp. or any of these choice realistic for being runnin mates, and what he eve announced a pick before winnin the nomination wouldn't that kind of admi that he needs the support, and then he would have to show the spotlight early? >> that's a good question. i don't have an answer for that of the four women that he said first, my, i always have thought it was going to be kar

lake i worked with her extensivel when i lived in arizona and sh was a news anchor. she's got everything that he likes. she is excellent on tv, she's former news anchor, she is a complete trump sycophant with, and she to lost an election in arizona. so i think that they would b able to really go around the country talking about election integrity. i think that sarah wants to sa the governor of her state. i really believe that in her and marjorie taylor greene o course is gunning for that position that doesn't surprise me a all. i don't think he would selec her though i think kari lake is who h would choose >> last question, and this i asking you to get inside o donald trump's mind to which i say good luck with that. but the question is, what do you think will be going throug his mind if indeed he gets indicted, if indeed he potentially is in handcuffs. what will he be thinking >> i mean, i think deep down h
