i am richard louis in fo yasmin vossoughian coming to you live from 30 rock >> and i am garrett haake an west palm beach, florida not far from mar-a-lago from where donald trump rock th political world today saying h was going to be arrested o tuesday. as i've been noting throughout the day, though his own lega team says they haven't gotte any word that that i definitely going to happen the manhattan da has commented on trump's post, which h admits a striven by medi reports he has seen and heard. trump's pronouncement toda should not come as a surpris given just how much she ha been wrapping up the rhetori this past week >> our enemies are desperate t stop us because they know that we are the only ones who can stop them and they know it ver strongly the radical left democrats are using their prosecutors to try and steal another election >> all right garrett, you will join us throughout this hour a
12:02 pm
we continue to talk about trum and his tweet or as his messag was put out on social media, let's start with you on your reporting and what you have on the latest on that we >> well richard, this is no come as a surprise to donald trump or to his advisors they have been told it's their understanding that they believ he is going to be indicted i the future they haven't been told that by the da himself where we are written right now is essentially a holding pattern with the forme president doing the adul equivalent of a double dog adair to the new york district attorney to in fact follow through on this ground durin bass station it has been going on behin closed doors and actually issu an indictment. we don't know if or when tha is going to be coming, and w know the political fallout has already gotten we are seeing it from capito hill where some of the nation' top republicans have indicated they will go to bat for th former president we may soon see it around th country. the other sort of team developing today is from the former president, calling fo protest. first on his own behalf and on
12:03 pm
of the first truth social post familiar this morning and then later in the day on behalf o kind of all of these other issues that he is tried to put at the front of his campaign and they named president biden later in the day but h suggested the protests shoul be about what is going on in this country and not jus what's happening to him. it is a part of the mix that makes up this version of donal trump's campaign part personal grievance, par policy i think we will see over the next week perhaps longer the former president really lean into the idea that he is being attacked because of th political threat he believes h poses to president biden, to democrats. it's a fascinating and truly unprecedented and perhaps even politically or possibly trul dangerous fear that we wil head into richard, a lot o questions that's aloft to be answered we will try to get to some o them this hour >> speak into garrett as you know and you have been reporting on, this and new yor city right, now the manhatta criminal court is alread preparing for the possibilit of an indictment for forme president trump. nbc george solis has more from outside of the courthouse fo
12:04 pm
us >> yesterday in new york it is business as usual but we kno that behind the scenes there i a lot of talking and a lot o planning going on. should the former president be indicted as early as next week we do know he likely won't enter to the front doors of th courthouse here and lower mean hatton inside we'll enter through the district attorney's office flanked by media and onlookers on both sides. we do know that local state an federal agencies are all holding several courts meeting at this time looking at ever possibility for any security risks that could potentially arise show this indictment com as early as next week. nbc has reached out to all o these agencies, all of the declining to comment at this time and of course securit concerns, more rampant with th president using this on social media platforms. it's the call for protests should he be indicted. again as early as next week. we know there is a lot o moving parts to of course stay on top of it and bring you the latest as it becomes available back to you. >> all right george, thank you
12:05 pm
for that i also want to bring a new yor times investigative reporter suzanne craig. suzanne, what do you know in your reporting at the moment will it happen on tuesday, wil it happen on thursday, wha will be the reaction and wha are you seeing >> i was gonna say this is a heart of pool as it's colleg basketball right now you know we don't know, and yo don't even really know what to read into the social media pos that former president donald trump put out this morning he may know something, he ma not know something we do know that this i marching towards what look like an indictment you've had a grand jury sittin and they have been hearing witnesses and been building up you saw michael cohen come i at the end of that he was pretty close to the end if not the end of the process. we don't know if they have voted to return an indictmen but all of the timing look like it could be next week and he is going to be the former president will be notified because you will have to trave to new york. that door sure looks familiar.
12:06 pm
i've covered trials before and he will be if he comes, in h will be brought in and i would imagine you know just thinking back to what happened to allen weisselberg. his former cfo when he was arrested, he is brought in and he is, photographing are printed, he goes through a process where he is arrested and then he goes into the cour and he is a rain there is obviously unprecedented because it is former president, he will have his own security coming in secret service that seems to be that it wil be a protocol that likely will be followed that will be similar to what othe high-profile people have bee arrested go through. >> suzanne, you have bee covering this case since befor it was the case right? since alicia sort of a scandalous story that starte to emerge in 2016 and 2017 how do you handicapped the relative strength of wha prosecutors maybe puttin together here? the star witness we've bee showing on his screen as michael cohen has been convicted of lying to congress >> right, i think they wil

move forward with this, yo have to imagine and i ca imagine they don't have strong case. you hear that in some ways it' untested, it will be a mr. meaner that will go up to felony because that will tie i other behavior it will go on with i think and they will have to have a stron case or they wouldn't be bringing it. you heard them say it's been a lot of, talk it's a big deal and it is a big deal and the said that about the same, th case that was brought agains the trump organization where there was executives accused o taking perks and other thing that they did not pay taxes on it and people minimize that. that was a serious, case thi is a serious case. and you will keep hearin though the rhetoric that it's misdemeanor, it's not a bi deal but it is there is no understanding ho huge this is >> suzanne, assuming it is soon, what were the recent turning points we would discussed couple just now again with michael cohen coming in fo

testifying they instead follow th atlantic da timeline with th report coming out from tha grand chery. months ago yet no indictment handed out yet we don't know timing wise ho long it will take and that has taken a while but we do know the history is any guide tha in new york, when the gran jury returns and indictmen than it usually charges follow fairly quickly after what we have seen is that it's interesting because the gran jury, it's been going on for a while and what the da has been trying to do in this case it i they have michael cohen is the main witness who is the main point of contact and has don time for this, for the hus money payment. they have been building a case around what he knows and the have been trying to ge documents together, trying t button it up and it may be phone records that they have it could be text message between the main parties o could be something like michae cohen had a conversation wit
12:09 pm
donald trump and he turned around and texted, let's say texted a member of his famil that if you'll not believe wha happened at the office today it is crazy hush money payment he may have mentioned it i attacks. they will be going through and getting as much documentatio as they can together and then, secondly they are looking fo cooperating witnesses. people who back up his story about what happened. that is why they're brough another individuals wh potentially were a witness t this >> suzanne, thanks for joining us from the new york times suzanne craig. >> and now i want to bring i glenn kirschner, and bisson bc legal analyst and former prosecutor let's just take a step bac here and we talk about how unusual the situation is and kind of complex legal security environment that maybe president in lower manhattan later this week. >> yes, carrot the securit issues i think just got more dramatic quite frankly as result of donald trump's post.
12:10 pm
it is so reminiscent of what h did on january 6th after sor of summoning people to d.c. on january 6th, telling them yo know come to d.c., we will b wild he then you know riled them up telling them that if they don' fight like hell, they won' have a country anymore he then directed them to the capital and told them to go an take action. stop the steal, stop the certification as what he was communicating. the fact that he used the word steel which was a lie, actuall helps prove his corrupt intent but now he is gone and done it again. he has said i will be arrested on tuesday, we don't know if that's a fact or an alternativ fact at this point that is what he said i will be arrested on tuesday, i will be in manhattan and he' been directed his supporters t protest, take back our nation. his words. when it comes to inciting a,

lawlessness, donald trump ha priors he did it on january 6th and b this most recent, post it look like he has done it again. that may very well oppose some really significant securit issues for a law enforcement authorities in new york. >> gland what do you think about this idea that - >> can i jump in there glenn glenn i want to jump in, you think it's important to poin out though, look protest in an of itself, demonstration is protected first amendment righ here so i think you, know we should be careful granted you mentioned donald trump's priors and they ar clear. i was in the capitol on januar 6th. i know the difference between protests and a rider and insurrection but you know if there's a protest, the peopl hanging signs out in front o the courthouse, that could b just as much about donald trum trying to make this into a political spectacle as a legal or some kind of violent one. i just think we should mak that point clear richard, will hand back to you. >> all right, gland you want t respond to that? >> i do garrett, i appreciat that and i think everybody

12:13 pm
for example, if you ar falsifying business records an furtherance of other crimes or to cover-up other, crimes or t facilitate other crimes. whether they are campaig finance crimes in violation of new york law, perhaps even i violation of federal law i there are attacks crimes attached to these hush money payments because there wer falsely taken on both federa and state tax returns as business expenses. i think it will be a much more robust indictment than just misdemeanor falsification of business records >> well, and how of thes public post by the forme president complicated what the da has to accomplish over th next couple of days if indee he is taking an indictment o thinks he is close he has effectively been dare by donald trump to show th goods. if you are working behind th scenes of the courthouse downtown, or the prosecutors office downtown in manhattan right now, how much more challenging is your job?
12:14 pm
how do you proceed over th next 48 hours or so? >> you know he has complicated matter certainly in the safety and security front the security of the, public th security of everyone who works in the courthouse. that is problematic with respect to legal, the lega angle. this post doesn't really impac the legal proceedings or how the district attorney migh proceed to trial here is what it does do, i think it was a miscalculatio by trump to kind of put this out there because had he not put that out there garrett, suspect he would've walked int court. he would've been arraigned o the indictment with is just th judge putting him on notice of what he will have to defen against a neighbor of ubly would've been released on hi own recognizance maybe with some travel restrictions, maybe the judg would order him not to trave overseas if the judge wanted t be really forward leaning. perhaps the judge could orde
12:15 pm
him to surrender his passport. now, the fact that he posted something that is so similar t what he posted in advance of january 6th, i think the conversation may turn to whether there are now reason to talk about the safety, th danger to the community that donald trump would pose if you were released. i don't suspect he will be detained pending trial i think he has bought himself little bit more trouble from the judge will preside over hi arraignment. >> glad we could do a whol other hour on what is bein discussed right now at youtube and facebook and twitter, al of them of all recently give donald trump's megaphone bac there which they all took away after january 6th. they might be questioning thos decisions now but we have go to move on with the rest of ou broadcast. so glenn kershner, msnbc legal analyst, thank you so much for your expertise today >> not to worry garrett, not t worry glenn, they will both be with us all throughout the res of the hour. we will dig into more of these
