and now the evidence is turned over to a regular criminal grand jury which, i think, i not an ideal situation because this second grand jury presumably, will not be hearin the testimony from the witnesses directly, but will in fact, be reviewin transcripts and such so, it's a knob construct. it's a construct that came about partly through the legislature and partly through case law so, it's not necessarily the construct that the legislature envisioned but that's what they have. so, if there is an indictment, if that indictment include donald trump, and if the manhattan da indites donal trump -- which, donald trump said, is going to happen on tuesday - he will have the unusual situation of facing tw prosecutions at the same tim in different states. and it's important for folks t realize that states are thei own sovereign. this is not run by the department of justice in washington they are their own sovereign with their own state laws, their own rules.

particularly fraud prosecutors when you are looking at what i call, a big defendant. that's a significant defended. i don't think anyone can say that the former president is not a significant defendant. you sometimes have what yo might characterize as potential big case and you sometimes have a potential smaller case and i will tell you that without exception, the large cases are the cases that are more difficult to prove. the more complicated the allegations, the harder -- the more potential defense there are. and sometimes, you have smaller case, where the fact and the evidence are jus staring you in the face. and they are just undeniable and i think that is what alvin bragg has here he has got the documents he has the check with trump' signature on it. he's got the testimony o michael cohen and of storm daniels. he has, apparently corroborating testimony from others who were vehicles i

having this hush money paid. and i don't think it is fair i this situation to criticiz alvin bragg, for going through the case, where he has the stronger evidence. because when you have potential case against a forme president of the united states you know that you can't take a case where the odds ar significant, that you are goin to lose that case. so, i would not criticize hi for going for the smaller case >> brittany, i mentioned it at of the top of the show - supporters believe this migh strengthen trump's hand. what do you make of this being used to his political advantag among republicans and among hi base, to help his candidacy in 2024 >> i am sadly terrified that they could be correct. i mean, this is why you leak information that is not actual information. because it doesn't seem to b based on any evidence or facts but we know that facts don't really matter to donald trump.

and they don't matter to man of his supporters. look, january 6th was practice he figured out how to make the truth sound like a lie, how to use that lie to rally his base and incite violence and to mak sure that that army wa positioned to defend his power his so-called riches and anything else he might wan them to defend at his beck and call and this particular loomin case seems to be no different. these are folks who have mad it clear that they seem to b excited by the idea of following somebody who is rebel without a cause or a clue because the idea that he could evade accountability and somehow manage and master hi own fate gives them the idea that they might be able to a well, irrespective of what i actually true or fair or just. so, unfortunately, i think the may absolutely be right. and i am worried about the fac that too many people are not ready for exactly this kind of

think was going through trump' mind when he posted on his social media site this morning was his motivation deliberat or reactive, do you think? >> well, first of all, thank you for having me. when it comes to donald trum psychology - and i'm glad you made th disclaimer that i do not mak diagnoses, and my colleagues have not either, and that we only tried to comment on his psychological aspects that there are a consequence to public safety and public health. as for the tweet this mornin -- and he certainly put himself i the news, to get all the pundits speaking about his charges -- he has certainly done that i as intentional away as one can in his mental state. we know from his pattern o

behavior that he is not very deliberate and not intentional but his acton's wind up bein extremely strategic. and that is the kind o dangerous psychology that we have tried to warn against and danger, again, is not diagnosis, but a critica aspect that we need to comment on and we need to be aware of. that, given his mental impairments and -- that he has had, the current situation of being charged wit a relatively common but usuall misdemeanor offense actually has the danger of propelling him to garnering even more support than he had before that is what people in his dangerous psychological stat do he has been active in the news

outlining a lot of his issues. i think a lot of our viewers are very familiar with a lot o the allegations against donald trump and his missteps and mismanagement and allege crimes over the years. but i want to ask you abou something he said today -- again, we don't want to repeat exactly what trump said in his post but he did call on his supporters to protest. and some are making th comparison to his now infamous and dangerous call for actio after the 2020 election. why do you think he is returning to this tactic despite the fact that it got him in trouble in january of 2020 >> i'm not sure he will se january 2021 as having gotte himself in trouble i think he will see it as success, really. because he was able to push th boundaries a bit further in fact, he probably onl regret is that he did not go far enough, that he was no able to excite and incite hi

followers enough to be able to create enough chaos that h could call martial law and so, i think what i commonly misunderstood is that when he is being threatene with criminal charges, or he i in fear of being indicted, h will intimidate everyone he will threaten the country with civil war and try t incite violence, all the while pretending to be a man o peace. but we should not be afraid of his threats. what we need to do is to proceed with commensurat consequences to his crimes from a psychological perspective, the worst thing you can do with a dangerou individual is to bring n

consequences it's actually critical that we bring federal charges in order to contain his dangerous behavior and bad influences. and that is how we contain dangerous individuals. there is as much a psychological need for these charges as there are legal need. in fact, i think it's more so psychological issue. because his impairments and hi dangers have foremost been psychological. it's only by virtue of his position that his psychologica dangers have - into social, cultural, political and civic dangers. and the fact that we are not discussing his psychological dangers as the foremost concer is of concern. because, in fact, unless w address the psychologica dangers, none of the other dangers can be contained

abortion pills set to go int effect july 1st. back with me again are brittan packnett cunningham and alaina beverly. brittany, i will start with yo on this and this news out of wyoming. a near total abortion ban is already, as we've mentioned -- outlaw abortion pills in the states that have them -- but in wyoming, the abortion ban was blocked by the courts. is this the governor's way o trying to push an abortion ban through? and what kind of message doe it send as we await for this ruling in texas? >> it's not only thi governor's attempt to try to circumvent the courts and move forward with a near total or total abortion ban across th state. this is also about testing different pathways to ba abortion across the country. look, the gop has been ver clear for the last 50 year that this was their goal they have organized and rallie people around the single issue

of stopping abortion and acces to it for five decades they have nominated judges, as you've said. they've recruited volunteers and canvassers and candidates. this has been the way that the have built a so-called conservative agenda an conservative party, a so-calle religious right, based on this single agenda for the last fiv decades, once again. so, this is all about making sure that there are many options for governors and fo mayors, for folks in state legislatures to figure out a way forward irrespective o what the courts say, of what the people say so, it is going to be up t congress to make sure that the actually enshrine the right to an abortion in federal statute there are millions of people across this country who though through difficult challenges to show up at the ballot box to make sure that the right to an abortion was protected. and it's high time tha congress actually ensure tha

privacy and being able to carr out their reproductive rights. and this has very racialized component to it, in that african american women are 39% of the women who take advantag of abortions and reproductive rights an that access -- but also, and this has ver real financial and healt consequences for african american women in particular we vote are two and a half times more likely to suffer maternal death in pregnancy. in partly because of structura barriers within the health car delivery system in the way tha we are treated when we go an seek care. so, this is an important lif or death situation for women all across the country but women of color i particular, and the africa american community i particular - this judge, in rolling back th approval of mifepristone would be rolling back the approval o two decades of fda approval fo
