and now the evidence is turned over to a regular criminal grand jury which, i think, i not an ideal situation because this second grand jury presumably, will not be hearin the testimony from the witnesses directly, but will in fact, be reviewin transcripts and such so, it's a knob construct. it's a construct that came about partly through the legislature and partly through case law so, it's not necessarily the construct that the legislature envisioned but that's what they have. so, if there is an indictment, if that indictment include donald trump, and if the manhattan da indites donal trump -- which, donald trump said, is going to happen on tuesday - he will have the unusual situation of facing tw prosecutions at the same tim in different states. and it's important for folks t realize that states are thei own sovereign. this is not run by the department of justice in washington they are their own sovereign with their own state laws, their own rules.

having this hush money paid. and i don't think it is fair i this situation to criticiz alvin bragg, for going through the case, where he has the stronger evidence. because when you have potential case against a forme president of the united states you know that you can't take a case where the odds ar significant, that you are goin to lose that case. so, i would not criticize hi for going for the smaller case >> brittany, i mentioned it at of the top of the show - supporters believe this migh strengthen trump's hand. what do you make of this being used to his political advantag among republicans and among hi base, to help his candidacy in 2024 >> i am sadly terrified that they could be correct. i mean, this is why you leak information that is not actual information. because it doesn't seem to b based on any evidence or facts but we know that facts don't really matter to donald trump.

behavior that he is not very deliberate and not intentional but his acton's wind up bein extremely strategic. and that is the kind o dangerous psychology that we have tried to warn against and danger, again, is not diagnosis, but a critica aspect that we need to comment on and we need to be aware of. that, given his mental impairments and -- that he has had, the current situation of being charged wit a relatively common but usuall misdemeanor offense actually has the danger of propelling him to garnering even more support than he had before that is what people in his dangerous psychological stat do he has been active in the news
