said yes, and costello is no coming in. cohen made news on last hour with alex smith was that he is going to be rebutting what costello said. there is a significant process here here's what cohen had to say t alex earlier this afternoon. >> i did receive a whole sle of phone calls from journalist asking me if i'm going to be back to the da's offic tomorrow as a rebuttal witness to whoever it is that they ar bringing their tomorrow, weather before the grand jur or just to meet with them fo an interview again, i'm not sure but, yes, was asked to make myself available and to be at the da' office tomorrow as a rebutta witness. >> talking about the process here in terms of what thes grand jurors have to do before

>> sure. if the reporting is correct, this really is something tha is relatively unique to ne york law, which is tha somebody who is the target of grand jury investigation has the right to ask the distric attorney to present certai exculpatory evidence to th grand jurors that can be in the form of a witness. what it appears is that, although donald trump wa invited to go into the granary himself and said no, sorry, i' in new york, there is a lot of background noise >> no problem. i am as well >> that witness appears to b robert costello. we don't know if he will i fact testify we also don't know if he wil be sort of the exculpatory

witness. if he in fact goes into th granary and provides exculpatory evidence we have now heard from michael cohen that he is available t potentially rebut that it is very unusual to have thi procedure. i do think that this may b something that slows down th ultimate presentation to the grand jury but, ultimately, as was just noted, the grand jurors only have to find probable caus with respect to any potentia crime. they can obviously weigh the credibility of michael cohen and any exculpatory evidence i there is any from mr. castella they will weigh that in an decide whether there i probable cause all of that, by the way, can happen very quickly, whether i can be all done tomorrow, we will have to wait and see. if it is not tomorrow, it also could be wednesday, apparently this grand jury sits two days weekon mondays and wednesdays. so i do think it is a strong

likelihood but obviously not a guarantee that we will see something this week, either on monday or wednesday. >> quickly, clarifying and thi witness from the trump cam will be in front of the gran jury, is that correct? >> yes it appears that the da has agreed to the request by the defense. it is not clear that the witness, mr. costello, i agreeing to testify but he wil be under oath and will b voluntary, meaning he is not being immunized in anyway. he has to assess whether he is willing to testify under oath, obviously that means there i the penalty of perjury if he were to say something that was not true it remains to be seen whethe in fact he will go in an testify under oath by all accounts, that appear to be what is going to happen. it is notable, however, that

donald trump, while his team i asking this witness to go into testify, donald trump himsel refused and declined to go in. he is really getting a surrogate to go in and say something that presumably will be derogatory with respect t mr. cohen and his credibility. >> what do you know of this mr costello the new york times reporting that the relationship betwee cohen and as well as donal trump and costello is no necessarily one that is new. they have known each other for quite some time, even at one point costello and cohen wer discussing attorney-client privilege. >> yeah. that is the thing that is quit interesting. it's not clear whether mr. costello and mr. cohen actuall formed an attorney clien relationship, in other words that mr. costello wa representing mr. cohen, or vic versa.

they are both lawyers. it's not clear they had an attorney client relationship even if they did, mr. cohe could waive that privilege there is some reason to thin that he has done that. mr. costello could be talkin about statements that were mad to mr. costello by mr. cohen that could happen. it is also, as noted, the case that mr. costello seems to hav close ties to rudy giuliani, steve bannon, and to the forme president himself. and, so he is aligned with people on the defense side i this matter. it is still very much an ope question as to what it is that donald trump and his tea thinks that mr. costello can say that would avoid a grand jury finding probable cause. it's a relatively low standard but, again, maybe there is som

information that is strong tha would give people second thoughts about whether t believe mr. cohen, and maybe it's worth reporting that mr cohen, even if you disbelieved him, there seems to be so much other evidence about the so-called hush money payment that mr. cohen has been very corroborated there is independent evidence, even if you put to the sid what mr. cohen is saying about this it's also the case tha somebody may have said something that is not true i the past and it doesn't mean they are lying about everything all of that is something tha will be explained to the grand jurors they will make an assessment about whether the proo presented by the da meets th standard of probable cause which, again, is much lowe than the preponderance of th evidence this is not a terribly hig standard people should remember, it's also very different if there i an indictment in the ultimat
