a close. the federal reserve has to choose between fighting inflation or propping up banks when it decides whether to raise interest rates today. i'm joined by a top obama white house economist. good day. i'm andrea mitchell in washington. the manhattan grand jury considering a potential indictment against former president donald trump. it was scheduled to meet today. they could have been meeting today. now we understand they are not meeting today. there's new reporting by abc news that prosecutors in jack smith's office have convinced a judge this washington that mr. trump misled his own te attorne about retention of classified materials. he ruled that a key trump attorney cannot invoke attorney/client privilege to avoid testifying. he has turned over his notes

about the classified documents. nbc news has not independently verified this. joining me now, garrett haake in new york, jonathan lemire, host of "way too early" and glen kirshner. garrett, take us through the latest, where we are in lower manhattan, the new reporter from "the new york times" that donald trump is ready for a public walk but jonathan deitz reporting the grand jury is not meeting today. >> reporter: just as we come on the air, our colleague reporting the grand jury won't meet today. it's worth reminding folks that these jury proceedings are conducted in secret. that includes the schedule. we know from past patterns this grand jury typically meets monday afternoons and wednesday

afternoons. but most of the time, we don't know for sure when they meet until afterwards. some of this can be based on witness availability. some is based on the availability of prosecutors or folks who need to be in the room. they have to make sure they have a quorum present to hear the evidence. we are working to find out more about the delay today and why the grand jury is not meeting today after they had a busy day monday, suggesting perhaps they were closer to the end of this probe than they were to the beginning. as for the reaction at mar-a-lago, i have not seen any to this decision not to have the grand jury meet today. i suspect, based on my other reporting, it will be welcomed by the former president. the reporting from "the new york times" that you mentioned, also reporting that i and my other colleagues have been able to do is the former president is conflicted about this. he may be personally uncomfortable with the idea of being indicted. nobody particularly wants to be fingerprinted. but he recognizes the political

opportunity it presents to rally his base to him, to be part of a spectacle, to be part of the biggest story on the planet, which the first ever indicment and arrest of a former president would qualify as if and when we get to that moment. it appeas we are another day off from that. after today after a lot of buildup and energy around the courthouse, it is quieter here today. the protests that have been over the last couple of days had fizzled out. the circus environment that follows the global media when we set up shop on a corner like this has fizzled out. we are back into a posture of waiting and wondering what, if anything, is going on on the fourth floor behind me. >> let's talk, as a former federal prosecutor, what the possibilities are. according to jonathan, our nbc news reporter, nbc in new york, the grand jury has been told not to come in today but to be on

standby for tomorrow, for thursday. we don't know whether they are working on their summation, the prosecutors, whether they are bringing in another witness. we have no way of knowing at what stage they are. they seem to be close to the finish, because they have brought in a rebuttal witness at the defense request. that was, of course, the attorney costello, trying to undermine the reporting of michael cohen. >> yeah, it does feel like they are wrapping up, andrea. i think the sure sign that they are at the end game of the grand jury investigation was really when they invited donald trump to appear. of course, he declined that invitation. instead, he offered up, in essence, a mouthpiece, a surrogate, robert costello who testified before the grand jury. i think that may have been a tactical blunder. in the event costello had any

truly damaging information about michael cohen's credibility or conduct, what the defense team has done is given the prosecutors a golden opportunity to drill down, to investigate anything costello said and to meet the force of it with perhaps a witness that can rebut what costello said. all of that now will be diffused before there's ever a trial. i think that's a win for the prosecutors. as you say, it may very well be that they have one or two witnesses left, either affirmative witnesses or rebuttal witnesses. then they will be in a position to ask the grand jury to vote out an indictment. it really involves reading the tea leaves at this point. >> reporting from "the new york times" about what the former president has told people at mar-a-lago, told associates about how he is looking forward to a perp, he is trying to decide how to smile, the

performance part of this, all political. possibly, we don't know, this is posturing, that he is distressed about it, but this is the way he handles crises like this and has turned it to his advantage. with the secret service handling all of this and minimizing his public exposure, what would happen during an arraignment, a mugshot and the rest? how much would he be -- he wouldn't be doing the classic perp walk as you would see. >> the secret service working with the nypd has plans. will he be arraigned at the courthouse or at an off-site location? nobody knows at the moment. it's the idea of fingerprinting and photographing which a perp walk is not going to happen

unless the president has his own. you will not see him in handcuffs unless he brings his own. that's the reality of the fact, the extent of that courtesy of then he will be surrounded by secret service. here we are at the moment. the nypd, secret service will handle this as they always do in an appropriate fashion. we will have to wait and see. as far as the barriers that are going up, nypd today had almost a dozen mobile forces in and around the area. they are reducing those numbers to let them return to regular patrol. there's no intelligence of any planned demonstrations. they are watching that closely. they would be more concerned with a lone wolf action rather than large demonstrations around this event. >> let's talk about what's happening in mar-a-lago. the mix of the "new york times"

reporting, social media posts from trump, unique reactions from someone facing serious legal difficulties in a number of venues. >> yeah. we have never been here before. he would be the first former president to be charged with a crime. i think it's safe to say he does not want to be around it. donald trump spent his life as a new york celebrity developer and, of course, once he moved into politics, doing he cannot to face legal issues. saying how afraid he was of it. this is likely bluster right now. there are people in his circle who think that an indictment might be, in the short-term, politically good news. his poll numbers might go up. they are bragging to reporters about how much fund-raising they will be able to do after it. i don't think to the commissioner's point, he won't be in handcuffs. if he is able to leak his mugshot, that will be on a t-shirt.

real panic and alarm and also anger and trying to condemn the manhattan d.a.'s office suggests it's a biased witch hunt and the like, but it's clear we are not getting an indictment today, this is only one of the legal matters that face this president, the former president, with georgia, mar-a-lago documents and january 6 on the horizon. hard to see if any of those would help him in a general election. >> speaking of that, starting with abc and other reports as well surrounding what the district judge has done in -- we have not confirmed this. accepting preliminary evidence that trump misled his own attorneys about the classified materials saying that they were all being turned over and that affidavit when they weren't more

than 100 found during a search. could this be a game changer on the obstruction issue? since they also have mr. corcoran's notes, according to these reports, of what happened and what mr. trump told him. >> andrea, it could be. there's an interesting parallel emerging. in new york, one of donald trump's former lawyers is prepared to testify against him and has already given grand jury testimony incriminating donald trump. we move down to washington, d.c., and it looks like another one of donald trump's lawyers is on the verge of being ordered to give testimony that it looks like would incriminate donald trump. that's sort of where the parallels end. michael cohen has some real credibility challenges, not surprisingly when the prosecutors use somebody who is complicit in the very crime about which he is testifying. that is stock and trade for prosecutors, using those kind of

cooperating or cooperator-esque witnesses. in washington, you have corcoran who may have to testify his client misled him. that constitutes potentially obstructing justice and a false statement to government. that would be a very strong criminal charge against donald trump potentially. >> more serious than the potential charges that we think are being contemplated in new york city, in lower manhattan. it's all in play. it's not going to happen today. we don't know what's going to happen tomorrow. we're going day by day. it may never happen. there may never be an indictment. we should always say that. thanks so much. coming up, brothers in arms. a three-day summit between the leaders of china and russia saying that china is doubling down on support for vladimir putin.

china's president wrapped up his three-day state visit to moscow today in an unusual gesture vladimir putin walking xi to his car. xi told putin that russia and china are driving changes the world is seeing for the first time in 100 years. no real peace plan for ukraine emerged from the talks. russia carried out more strikes in eastern south ukraine today. secretary of state blinken is on capitol hill testifying about the war, first at a budget hearing today. it was a lot about china's relationship with russia. lindsey graham, republican from south carolina, questioning the secretary. >> the meeting with china and putin, would you consider that a marriage of convenience or a

strategic alliance? >> perhaps a combination of both. i think you have -- you do have a partnership. remember, as you know, right before the russian aggression, they talked about a partnership with no limits. >> let's break that down a bit here with no limits. the world is trying to put a cap on russian oil, the western world. >> that's correct. >> china just agreed to buy oil as much as russia can supply, not at the cap price. >> we will see what price they actually buy it. >> joining me is senator jeff merkley. thank you very much for being with us. "the new york times" is reporting that china has sold russia more than $12 million in drones since russia's invasion. as a result of xi's state visit that concluded, it seems clear china will increase its economic efforts to prop up russia. do you think they will be deterred by the threat of sanctions from crossing the line and providing lethal aid?

>> certainly, what we are seeing is china saying that they will be an economic partner and they are going to expand that part partnership, which is the wrong way to go. what we saw in that three-day meeting was a three-day bro fest celebrating authoritarian power. putin attempted to grab the ukraine. here is xi who not only ran over the top of hong kong's liberties and rights guaranteed by their agreement with great britain, they are planning and considering the possibility of military force against taiwan. two leaders flexing their muscles and celebrating authoritarian power in a way that should be a concern. >> what are the exchanges --

they discussed not to declare russia is a state-sponsor of terror. it would make it very difficult to get to negotiations with them. they have other ways of sanctioning them. the senate voted 100-0 in favor of that designation. this is the way senator graham tried to hammer away at secretary blinken on that. let's watch. >> are you aware that the congress 100-0 -- which is pretty rare around here -- supported the idea of declaring russia a state sponsor of u.s. terrorism under u.s. law? >> yeah. we have multiple designations that focus on russia's war crimes, atrocities, et cetera. it brings with it potentially some unintended consequences. >> here is my question. are you going to designate russia a state -- >> what we have been doing as you know is working with you to look at a new designation that

would go to -- >> but we sort of failed in that endeavor. >> he was not happy at all about mexico. the secretary was on the spot on a number of things. what do you think that the u.s. should do with regard to china? >> certainly, we need to be prepared for a very long competition with china. china's projection in its belt and road initiative is going to create influence around the world. it already is. china sees itself expanding more. we have to certainly be present in the world to keep advocating for the vision of democracy, the vision of people contending with their own future. what scares me about china is we have seen what a massively

primary. he is all over the "the new york post." he did this big interview. it's clear -- do you know anything about the timing? >> reporter: that's the open question. especially when you look at all of the folks who were on the list. they are going to iowa, new hampshire, south carolina, all these other places. clearly, trying to stoke early speculation. for desantis, we see him putting out a book. he is laying the groundwork in the obvious ways we know how to look for. it wasn't immediately illuminating in that interview anything new about the timing. his advisers and himself have said he is focussed on the near-term florida legislative session. when you hear the way he talks about it -- you heard it in the clip you played. he talks about florida, what he has been able to do, not just in

terms of turning it more red and the tangible policies that he has been able to take from just red meat talking points to turn them into the foundation of republican and conservative ideology in the state of florida from a policy perspective. in the short-term, he is looking to build on that. in the long-term, i think late spring, early summer, that's my expectation on any kind of announcement if he does it. >> it's a dig at donald trump and the criticism that you were covering in florida that he has been a loser on a number of campaigns and there's a division in the party. another potential 2024 hopeful, senator tim scott of south carolina, inching closer to a decision. what do you think is happening there? >> reporter: hope is springing eternal for a lot of these hopefuls. especially as we see them all continuing to inch closer, which in scott's terms is what his advisors are saying to us. sources saying he is inching closer to a decision, especially

when you look at the calendar for a week in april a few weeks from now. they will go back to iowa, back to new hampshire. he is from south carolina. it's what he is doing in south carolina on the 14th and 15th that's drawing some attention. the fact that he is having a gathering of donors there. they will be asked to put their money toward something, an open question about what that is. he is mulling a bit as well. >> going against nikki haley. ali, thanks so much to you. joining us now is former congresswoman donna edwards, and charlie sykes. charlie, looking at this republican field as it's beginning to shape up, donald trump in mar-a-lago waiting for the next legal shoe to drop, how do you assess the bravado we are seeing from him and the confidence from desantis? >> it is interesting what desantis is doing. he is obviously walking a tightrope here, trying to take

some shots at donald trump without alienating the base. this is the hardest thing in republican politics. how do you criticize donald trump without being exiled from maga? we are starting to see the initial pokes. it's interesting he chose he would give that interview to piers morgan who is not the toughest interviewer in the world. listening to what desantis is saying, he is prepared to double down on his snarky comments, implying i am not the sleaze in this race. moving to the right of donald trump on covid, saying he would have fired anthony fauci. what we don't know is whether ron desantis has a glass jaw. how will trump world and trump react to an opponent who might

actually take some shots at him? that didn't really happen early on in 2016. it might happen this time. again, i think some republicans may be realizing that if you are going to beat. >> daymeon: -- donald trump, you can't go around him, you have to go through him. >> the trump campaign is preparing for a new normal, running under indictment, to be clear, he has not been indicted but the team is going after d.a. bragg. >> anticipating it won't just be new york and alvin bragg but it might be georgia, jack smith. there are a lot of looming legal hurdles for donald trump. i'm not surprised that the team is trying to prepare for how you do that as an indicted former president.

what i know is that donald trump is extremely good at taking advantage of any situation. i think he will -- he may not welcome the indictment, but he is going to use this as a way to raise money, as a way to rally his base. already you see elected republicans who are gathering around trump, attacking bragg on his behalf. it doesn't leave a lot of space for somebody like desantis to casually attack trump. that's been fascinating to me, watching desantis dance around, not saying his name, requiring a lot of reading between the lines. but at some point or other, these opponents of trump are going to have to stand out, hit him hard and trump is going to have to figure out a way that he can distance himself in some ways from these indictments or

potential legal hurdles and run a presidential campaign. >> not mentioning him by name and trying not to directly attack donald trump, he slyly the other day, at a news conference, twice mentioned the salacious aspects of the whole case involving stormy daniels. charlie, other republicans are going against bragg. you wrote about that. let me quote what you have written. the gop hostage crisis is well into its eighth year. the party is consumed by how vigorously it has to rally to trump's defense. instead of using the opportunity to distance themselves from trump. >> right. it's not going to change. it's just the beginning. they rallied around trump even before the grand jury came down with any indictments, before we know what the prosecutors is

the banking sector is bracing for the fed's interest rate decision later today as regulators are walking a tightrope between trying to cool inflation by continuing to raise rates without further destabilizing the banking system when they lowered the value of investments, contributing to the collapse of svb. the dow is down after rallying tuesday when janet yellen tried to calm fears about instability and contagion. >> let me be clear, the government's recent actions have demonstrated our commitment to take the necessary steps to ensure the depositors' savings and the banking system remains safe. >> bank stocks did rally afterwards.

joining me is professor jason furman. he is the chair of the white house counsel of the economic advisors in the obama administration. i don't know -- we will know in a couple of hours whether the fed will raise rates or stand pat with a tough statement signaling they are committed to fighting inflation. what do you think the fed should do? >> i think what the fed should do and i think what the market thinks they will do is raise rates by 25 basis points. that's lower than they probably would have done absent the collapse of silicon valley bank. it looked like they were on pace in light of the increased inflation rates we have seen lately, in light of the very hot economy we have seen lately, to step that up to 50. they are not going to do that. the big thing as you said is, how do they communicate? i have suspense on that question.

>> how do you think they should be balancing the fight against inflation? should they take their foot off the brake for a while given the instability in the market and the possibility that what's happening with the banks is going to have an affect on slowing down loans, making it harder for people to invest and the economy? >> demand is too high. inflation is too high. a lot of banks are in the process of cutting back their lending right now. that means the fed may not need to raise rates as much as it expected because banks will do a lot of the job on their own. that being said, i do think the fed needs to make it clear that their job is not to rescue the financial system by cutting rates. their job is to set rates in order to control inflation. then they have other tools,

tools like lending facilities, if the financial system needs liquidity assistance. >> the ceo of jp morgan chase has been leading talks, after talks with janet yellen and the fed, about getting those other 11 banks to join in supporting first republic bank, which was in trouble. now they apparently need to get more people to kick in money. is this raising fears about other mid-sized banks? >> absolutely. there's fears about other mid-sized banks. part is similar business models and similar challenges. as you said at the beginning, when interest rates go up, some of the asset value goes down. some is psychological contagion that the treasury and fed have done a good job of containing. deposits are returning to some of the banks as there are more
