the da alvin bragg. according to a senior law enforcement source, that letter is just one of several hundreds threats bragg and his office have received in the last few weeks. this comes as the years-long hush money probe into -- possible indictment, which we could learn more about next -- the grand jury is expected to reconvene on monday. as for trump, he appears to be capitalizing on the chaos -- waco, texas, right now. sources tell nbc that the ex president is keenly aware of the political opportunity created by a fight with bragg. trump has repeatedly tried to downplay the -- investigation -- witch hunt carried out by a political enemy. -- i asked legal experts ryan goodman and andrew weissmann -- this investigation is serious. -- ex president would like you to believe. just listen to what -- davis, the attorney for trump's former fixer michael cohen,

told my colleague symone sanders-townsend earlier today on this network. >> if this case goes forward -- and that still and if -- this case is about documents and indisputable -- case -- know what i know. >> also -- the case of so-called selective prosecution by a -- progressive da. in fact, prosecutors in new york have filed more than 100 felony counts for falsification of business record since -- took office. remember -- pleaded guilty, served time for his role in the hush money scheme. so, why should trump be treated any differently? -- play out -- against trump are not -- outside the norm. -- the thing that is required by the rule of law. to sum it up like this -- quote, in short, if mr. trump was asking for special treatment, his former job does not and should not immunize him from accountability that would be sought for anyone else. joining me now to discuss frank figliuzzi --

is that a preview of a legal argument that they're going to try to make? yes and no. i think that joe tacopina oh switch gears on the number of occasions as to the -- da brag -- pursues this -- in terms of -- indictment. i think that that is one of the most straightforward routes that they will respond with, primarily because at this point we don't necessarily know the clear legal case that bragg will use. and so if he does -- campaign finance violations -- that is probably one of the ways that he will fight it. the other route that they may likely take is that they may claim that this is government pressure because he has also floated that in the public sphere as well. it could be either or. but it would not surprise me -- particularly given what he's talking about citing the -- >> so, frank, even as all this is going on, even after these death threats came to life, you had trump threatening to attack

da brag, an investigation on social media platform -- take us behind the scenes. how are law enforcement officials figuring out -- hundreds of threats -- into the da's office may actually be credible? >> what i'm hearing is that at least half a dozen of these hundreds of threats that have come into either the da's office or the da himself are considered prosecutable, legit threats to life, very serious charges that they can identify where they are coming from, even federal charges that they -- or email or -- this is serious business here. and unfortunately it's only just begun. remember, we have trump driving the narrative a week ago today announcing he was going to be indicted. it never happened. he's running the show right now. and this -- what it's doing is, it's giving all kinds of time for his

followers and -- followers amongst them to decide -- plan, organize and make threats. the indictment hasn't even come down yet, if it's going to. and that means this is just a sneak preview. tonight, even as we speak, trump continues to attack not only the da but the charges that might be coming themselves. he's actually, again, very inaccurately claiming that the federal government is directing brag to do it. that's just not how the system works. his followers seem to be eating that up. so, this is going to be a stress test. it's room for -- test in the law enforcement community. you are going to see a national -- come together -- plans for the plastic terrorists and plans to violently protest what's happening. but again, read through the fulton county charges -- federal charges if they come -- and -- really in an unprecedented security mode. >> -- i'm going to leap back to you,

michelle goldberg. i want to ask you about something that frank said, which is you do have the former president on stage in waco, texas. a lot of this is -- sources telling nbc news that it's, quote, -- mentality now permeates mar-a-lago and -- have been able -- to turn a possibility diamond into a political -- short to be testing that -- impact -- this tonight. i wonder if you think it is -- or if it is something more? >> so, i think it's important to remember that this is the 30th anniversary of the -- in waco, which has a huge place in the right wing imagination. it was something that helped inspire the bombing of the oklahoma city federal building. for people who sort of are willing to -- an action against the federal government, the killings in waco are sort of seen as a touchstone in terms of government tyranny. and so i think -- what we've seen is that trump

calls the protest -- protest -- protest -- and -- respond. half a dozen people, maybe, at trump tower. a lot of people who might have planned such a protest are either in prison or under indictment because of january 6th. there's worry among the -- right among entrapment and alike and so things like having failed to rile people up the first time he's just going more and more gasoline on the fire -- increasingly explicit -- >> -- , can you pick up where michelle goldberg picked -- full back the curtain for us. if you are a security expert and you know the exact crowd he is looking to -- what are you doing behind the scenes to track that chatter? >> so, west assured, the law enforcement community and federal dhs and fbi is

listening tonight to see if he truly is using the kinds of language that incites violence. and they are also looking online at extremist chat rooms, various private places where people feel free to speak. and they are watching the response to this. are they responding about this? and what are they? saying there's even research that -- to be done about what exactly the trump team decide -- to pick waco -- tonight -- with lieutenant governor in the crowd -- texas -- saying that, does he plan -- selective waco together with the symbolism is absolutely troubling. because there's a lifeline laterally from the cult and waco that tragically stood -- had a standoff with federal agents, a deadly standoff, 75 or more people killed, including the federal agents -- there's a direct line between that event and two years later, a guy named timothy mcvay blowing up the federal building in oklahoma city. timothy mcvay attended the

standoff. he was there in waco in 1993 and he blows up the federal building in oklahoma city exactly two years later to the day. so, we know that this kind of event -- anti government -- can incite horrible violence. troubles trump is there tonight -- >> charles f. coleman, we have a grand jury set to take up this matter -- go back to something frank said -- there's also georgia. -- two investigations. how do you see new york fitting in the bigger picture? >> i think new york will be the first domino to fall. and -- instructed to other law enforcement officials. -- prosecutors, how to move forward once you get an indictment. so it's critical to understand the first half, is that you have to -- we are not there yet. i expect we will see movement on that this week. but it's also important to understand, alicia menendez --

chief mark meadows -- must testify before grand jury investigating efforts to overturn the 2020 election. judge beryl howell rejected the trump argument -- allowed him to block the testimony. just the latest -- to the ex presidents claim of privilege. on friday trump lawyer evan corcoran testified for over three hours in front of a grand jury investigating -- corcoran was forced to return for questioning after beryl howell tonight's claims of attorney client privilege, citing the crime fraud exception. he was also told to hand over more legal documents to investigators, leaving him with notes, invoices and transcriptions of personal audio recordings. it is clear trump wanted to keep that information private, since he immediately appealed howell's ruling. however, that appeal was quickly rejected. so quickly that it left some questioning if new information,

possibly related to national security, could have excited -- we will bring our panel back. and we will start, charles, -- is east women in washington, apparently, on executive privilege -- trump expected to appeal based on -- thus far. do you think it holds? >> i think that the ruling will hold, because the executive privilege is -- he had when he is president, he is no longer president. the privilege belongs to joe biden, who has consistently waited. this is not an issue that i think courts are going to allow trump to hide behind when you are talking about the investigation and prosecution of what happened on january 6th. it's another point that i want to make on this. mark meadows is really, really important to actually tying everything together. to the extent that prosecutors would be able to get any information out of him, he is the one person we have actually heard a little bit from mike pence in the public. >> -- >> correct, right? mark mike pence is the -- have not heard anything from.

and to the extent prosecutors are able to get information out of him, that will be vital toward moving forward in terms of deciding what charges donald trump may face ryan january 6th and what happened there. >> i agree with charles that -- other officials ordered to testify include the former director of national intelligence, john ratcliffe, ex national security adviser, robert o'brien, ken cuccinelli. your -- of how vital that testimony could prove to be in the doj's case? >> we are now as close as we are going to get to trump. we are talking about the associates aides and appointees who surrounded trump and, particularly mark meadows, you will recall from january six committee testimony, for example, cassidy hutchinson's testimony, mark meadows literally in the room, people trying to all day, to something with the president, what's

happening on the sixth? what's going on? he knew. we just need to understand the extent to which him and these others you just mentioned are going to be loyalists to trump, a going to obfuscate, hinder, obstruct or whether they are going to finally realize that their own criminal exposure is facing them now in the they've got a decision to make about whether they are going to be part of criminal charges or cooperate and i have to -- i'm not very optimistic in these are the names you just rattled off for the most part of extreme loyalists and in fact mark meadows's -- aspirations to continue on to another administration with some form. and so we are about to see whether the prosecution really can get what they need from these folks and additional folks and that's going to tip the scales. whether they cooperate or not and cooperating with this inquiry. we don't know where this is

going. but the judge has decided, look, executive privilege doesn't count here and in the case of these attorneys i seek a crime occurring in the evidence i'm looking at and i'm not going to buy the idea of attorney-client privilege either. >> -- most of the -- exits names in -- they did testify before the january six committee. but notably -- social media accounts -- snubbed subpoenas so -- i do think something that would be interesting here should we -- testimony -- some ways biden -- participate in the january 6th commission hearings. i wonder which new details you think we could learn from these and also i wonder if you share franks pessimism about how these may proceed. >> well, i think that they are going to have to. talk it's one thing to ignore a -- can't ignore a court order in the same way. look, i think that the january

6th -- we all thought we sort of knew what happened on january 6th going into the january 6th hearings, so it's a lot of exasperation and impatience, people thinking that there was not going to be much new here. and it was so much new. i think that with donald trump, very rarely, of being -- usually -- you never kind of hear -- we never hear investigations into donald trump that makes you think -- weren't as serious as you might have thought. it's kind of always worse than you -- and so you have to assume that the reason that mark meadows is fighting so fiercely not to have to testify is because, if he does testify, it will result in him kind of burning bridges with his only prospect to power. >> and then of course we have corcoran which was like, a week. >> a week -- >> it's been a very long week. -- all had our eyes on manhattan, and then there was all of this

action in the jacks mitt investigation. if you are not covered by attorney client privilege, what kind of -- open them up to -- able to share? >> the most important thing in this context is that he can talk about communications that he had with his client, which his client told him, and what his client asked him to do. because you have a crime fraud exemption, which is now pierced the almost ironclad protection of what the attorney client privilege has intended to do, now they're can be inquiry into what they talked about, notes about what you made, notes what you made about what they talked about, anything that recorded those things, whether it is actually recording or they are things that you wrote down contemporaneously. all that stuff is fair game. and that's usually the type of thing that the client will not want the public to see, which is why you hire a liar lawyer. he was -- going on. what you don't retain a lawyer for his to be able to commit crimes. and that's what donald trump right now is facing and why his

attorney has to go for before this grand joy to turn over these communications and actually talk to -- >> an import distinction for anyone considering hiring an attorney. frank, much has been said about the remarkable speed of the road -- in this case. scott anderson, senior editor at the law fair block, said one explanation that could cause an accelerated timeline is that the doj could have been presented evidence that there may still -- still -- be classified information in trump's hands and that corcoran's testimony could help them recover it. i wonder where you make of that. >> yeah. there have been various sources that have told the media, that informal with the investigation regarding the documents, that they have no degree of confidence, that they've got all the documents. they don't. and so i think it's a safe bet that in part the judge is being driven by evidence she is hearing from the prosecution that they don't know that there is more documents, or even worse, that they have valid

reason to believe that there are additional documents -- they just don't know where they are or what has been done with them. i think that would accelerate the unprecedented midnight deadline -- >> midnight six i am -- >> -- prosecution. you know that prosecutor -- up all night preparing their response to the defense. so, yeah we've, got a judge who is absolutely driven by the facts and circumstances. and i think the timing reflects that. >> i've got to tell you, i have been, for the first time since i chose not to law go to law school, have been sort of regretting it, given the amount of legalese that we all talk about. that six a.m. deadline made me think twice about that regret. very happy to sleep corcoran in court -- mike pence's testimony, regarding his dealings with trump around january 6th. and mike pence, i've got to tell you, michelle goldberg, a sort of continues to astound me, right? here he is -- you put it all in a book. but then he does not want to

talk about 18 court, likely, mostly, out of political motivation. >> i would say we don't know that he put it all in the book. >> they are enough, fair enough. and so i think he's been tryng to walk this fine line of separating himself from trump without alienating the trump -ish base. i think it's a huge project tat mike pence is obviously never going to be president -- but mike pence doesn't realize that. and so he still -- he shows more honor than other people in trump circle, that's a low bar. but he still -- he hasn't totally burned his bridges yet. and pretty soon he's going to sort of have no choice to tell the full story. >> michelle goldberg, a wonderful catch on my colloquial use of his putting it all in the book. charles f. coleman, and frank figliuzzi, thank you all so much for getting us started. coming up, congresswoman madeleine dean is here to

for some house republicans, they love to complain about -- the federal government. for the gop it is rules for the not for me. jim jordan james comey and brian, south the trails of the house committee oversight administration committees respectively. at the manhattan da alvin bragg to testify before congress, regarding any potential indictment of donald trump in his hush money probe. his team sent a scathing letter in response, reminding the publicans that they're interested in the case only started after, quote, donald trump wanted a false expectation he would be arrested. the da's office also pointed out and pending criminal cases are beyond congresses restriction. and -- such challenges.

our next step, democratic congressman madeleine dean of pennsylvania, she sits on the house judiciary committee and she is one of the health managers in the second impeachment of donald trump. congressman, thank you so much for being here. hours ago the house gop chairman responded to brags, letter arguing, quote, the judiciary committee is examining whether legislative reforms are necessary to insulate former and current presidents from politically motivated prosecution by state and local officials. so i assume, congresswoman, but they will use that same standard for president biden and he's out of office, no? >> oh i am sure not. as they don't even bother to answer their own subpoenas. so we will see what rabbit hole this will go down. you, know i was thinking, alicia, number, one thank you for having me on tonight. but i was thinking about a statement that president biden made recently to the new york times. talking about the genius of american democracy. our independent and strong institutions. checks and balances.

and independent judiciary. for the application of the rule of law. what do you see in the three committee chairs who are trying to drag brag in and they will not be successful is really the command of the person in charge. which is speaker mccarthy. it was he who told all of them, call brag in. we have to look at this persecution. we have to investigate the investigation. that is not how the rule of law works, that is not how institutions are to operate. we have to be separate. and it is a shameful display by mccarthy, and these chairman. i'm gonna tell you to that my experience now any 118th congress, -- by just a few roads, just five. has been very unsettling. and i mean unsettling for the republican caucus. they cannot get this right,

they cannot -- it is to document about her governing body. and just very harmful to the american public. and if it weren't carnival like, you know, it could be just entertainment. but it is much more than that. it is desperate, it is dangerous, as you have seen with the death threats against anybody who goes against the former president. >> to that point, brad just sent out a tweet a few minutes ago responding to jim jordan, saying, quote, we evaluate cases about jurisdiction based on the facts, the law, and the evidence. it is not appropriate for congress to interfere with pending local investigations. it's unprecedented degree by federal elected officials into an ongoing matter serves only to hinder, disrupt, and undermine legitimate work of our dedicated prosecutors. as always, we will continue to follow the facts and be guided by the rule of law and everything we do. congressman, i take it, your

massive point here. they are not actually focused on any of the issues that americans care about. and they are not actually getting into thee business, even with the things they want for. voters and said they are mostly interested inside shows. and shenanigans. but physically as it relates to the rule of law, what is the danger in what jim jordan, kevin mccarthy and others are doing when it comes to alvin bragg? >> it is so many layers of obstruction. an independent attempt, -- at a state or a federal level. it is not congress controlled to investigate an ongoing investigation. and all of this, of course, is to try to insulate the former president from his wrongdoing and from prosecution for his wrongdoing. that cannot stand. that cannot be the america that we enjoy. and that is not healthy for the

republican party. mr. trump must be held to account for his wrongdoing. and that is to trivialize the hush money payments, do not forget when that took place, that took place days before the election. and i think in about 48 hours, any revelation of the tapes where he talks so grotesquely about what he does two women, strangers to him. grabbing them inappropriately, kissing them without being asked or without any kind of appropriate behavior. they were in a free fall. this kind of hush money payment is extraordinarily relevant. >> an interesting dynamic playing out which is that your colleagues, your republican colleagues in the house come to his defense, carrying through -- much quieter over on the senate side. and i wonder, spending a good deal of your time on capitol hill, if you can talk us through epidemic looks like? >> you are right, it is hush.
