>> that maybe something was going on. >> you saw the two of them together a lot? she and james. >> i didn't see them as a couple. outwardly has a couple, even though you would see them together. >> rachel and james had more than todd and don and the neighbors to worry about. you are married to somebody else? >> i was. >> what did you do about that? what did you think about that? how troublesome was that for you? >> i wanted to get out of that marriage history as possible. because i wanted to be with rachel. >> so you told your wife? >> no, my wife discovered us. and we separated. >> you will perhaps not be surprised to hear that james his wife, angry and betrayed, made phone call to todd, who begged rachel ended with james, she in a rush of guilt and shame agreed.

her baby's bedroom. they found the couples three young children safe and sound across the street at the neighbor's house. todd had dropped him off there before the police arrived. soon, todd himself was sitting in an interview room at the sheriff's department. where he admitted, yes he killed rachel. but he said he had no choice. and then he told the police a harrowing story of rage and violence, and self-defense. the trouble began the night before, sunday night, as he was preparing early the next morning for work. rachel told him straight out, she was leaving him for james! >> she, went back to the arms of james. >> then, when todd went into the babies remit three in the morning where the babies were sleeping, they argued bitterly about custody of the children. >> i said, i'm not going to agree to you having the kids up here, and having primary custody. i'm gonna fight you on this.

and, she said, you know, i'm looking to have my boyfriend. how boyfriend is a big gun collector. >> as todd told it, as rachel said that, as she threatened for james to get rid of him, he overreacted and punched rachel. >> where did you hear? >> i had her in the right side of the face. >> after she had told you, basically, she would have her boyfriend take care of you. >> yeah, yeah. >> todd said he tried to apologize. >> i mean, i'm rubbing her back, and saying i'm sorry. you know? i'm sorry. >> but then he said, rachael turned around and attacked him! with a deadly weapon. >> she was coming at me with a

silver scissors. and i got hold of it. and there was a struggle. and we rolled off the bed. and, the struggle over the sister, i took some cuts on my hands trying to get them away from her. >> they wrestled on the bedroom floor, he said. just a couple of feet from the crib, where seventh month old alex was sleeping. and overweight, and out of shape, said todd. he was fighting for his life with his much fitter wife! >> it was a long, long, long, struggle. i don't know how long, but it was a long time. she's a very strong girl. an extremely strong girl. and she had me on bottom. and she was on top of me, and we were like, back and forth between bottom and top with the struggle over the scissors. >> then he said he finally overpowered her, got control of the scissors. >> i was then, able to turn around on her and give her some jabs. she was, she was, she was injured at this point.

but probably not seriously. >> uh huh. >> i poked are in the eye really hard. and got it a break free. >> he retreated he said, as quick as he could. >> and i got up and -- i got to my car and thought, i gotta get out here. oh my god, i don't -- get the children. get the children out of here. >> the two daughters were in the room, but baby alex was in the wounded rachel. starting at the garage, he made a decision. he had to protect his children. he would go back in and rescue them from rachel. >> i grabbed my motorcycle jacket at that point -- jacket at that point. and i rushed into the room. >> she must of been waiting, said todd, to pounce! he was, he told the police,

soon in the fight to the death to save his own life. >> i tripped and fell floored when i rushed into the room. she kicked me in the face. and then we got into another second struggle, adam, on the floor. and once i started to get the upper hand, i push the scissors and as far as i could. >> where was that? do you recall? >> in the throat. in their throat. i don't know how long? >> okay. why did you hold like that with the scissors? >> i knew if i like oh, i mean she still other hand on the scissors, i was also fearing for, you know, she was, it was the kill or killed type of situation. >> coming up, what's really happened in that bedroom?

minus the fact that there is this yellow crime scene tape. and then you walk through that, and you walk through the doors. and the house is a complete disarray. kitchen is undone, baseboards missing all over the place. the house is not put together at all. >> -- and the garage, that -- , investigators found todd's mustang, rachel's as uv, a boat, and them w cycle and parts of a plane that needed referred sharing. and inside the house, a massive effort, they found something else to. something quite unexpected. blue box. in it? ashes. what? at the bottom of the box, a label that simply said, cremated remains of kathryn

winkler. and now suddenly, there were two mattis herself, what really happened in that bloodstained bedroom? the prosecutors listen to todd's version of events, and -- that was her job of course. but still, who else into house all what happened? there was no want to contradict the story. but then they investigators found that box of ashes. >> we realized there was another life. >> yes there was. todd had been married before, and clearly, the ex-wife was dead. so what happened to her? prosecutors said she would have to find out. and that, she said, had to follow a trail. that led to mid georgia. and gerald johnson. a judge now, but back in 99, a rookie detective. >> it really shocked me, that i

was getting a call from california. that a case that i worked and -- county. >> did you forget about that case? >> i actually, over the years, i have thought about the case many times. >> the case? an auto accident. in the fall of 99. an accident that killed the first misses winkler. kathy. >> i got a call that night. they told me that kathy was no longer with us. >> what was that like for you? >> it hurt. >> so many years later, carlisle still marks the last of his big sister, cathy. it's not over it. but then, kathy was also his mentor, his protector. his only true friend. they grew up in the air force base near tampa, florida. charles, painfully shy. kathy? growing structurally attack to.

-- they remember what a knockout she was. but that there was more to her than just that. >> she could have a choice of young man. she was beautiful. inside and out, it wasn't just exterior beauty. she was a beautiful girl, she decide the sweet, kind, caring personality. attracted to everyone. >> it was a small miracle, perhaps, that she -- that our friends. >> her mother left when they were young, her grandmother lived with her for a while. but she was the caretaker of versus siblings. she had a younger sister, younger brother. and kathy pretty much loved and cared for them. she was definitely the mom. >> except on weekends, when -- remembers snaking around the base, to get a glimpse of the two stars around there. no surprise, it would not show fighter priors. >> the man in the uniform.

all. >> they got weeks of data. but she appeared happy. so i didn't question it. >> she married her pilot, so i thought her fairytale was coming true. >> the air force sent tied to japan, soon after the wedding, it was an exhilarating time for kathy. getting married, heading off to live in an exotic place. >> kathy was excited to move to japan. she was going to be an english teacher. >> and later, as todd left the airport, kathy remembers has she was there for him as he figured out to do next. >> she was very -- at the fact that she was supporting him, and what career he was going to choose. >> it was a good time for todd. >> we did spend a year living with them. and todd had put on weight. i knew he wasn't working, he was depressed. >> but todd, always a knack for making money. and he figured it out. got into the booming wi-fi business. but pretty soon, kathy and todd

moved into a big house in georgia. with a vote, fancy cars, and of course, kathy, always nurturing. told her friend that she was ready to take the next step. >> i remember kathy calling me and telling me that they were living in -- , and she was excited about it. and they wanted to have faith. so i was excited for her, because i could see her with little kids. >> but, nine years and what looked like a happy marriage, it was yet to arrive. and so little did they know, that what was in that blue box, they never would. find out what happened. that discovery in that box, would bring -- all together across the country. to blue ridge mountains and georgia. to a campsite, high on the hill. hair was a lonely place, that had kept it secret long enough.

a twisting and turning a motion. in our interview, what i recall him saying is that when he came to himself, he was laying on the ground. outside of the vehicle. there was a huge fire. and he didn't know where his wife was. so. >> so he didn't remember the accident at all? >> he remembered a. >> but apparently -- >> that is correct. >> their way -- to about what sort of bug supposedly banned him. supposedly causing a reaction, so bad that he as kathy to rush him to a hospital. but when they asked to see the bug bite? >> he didn't know or the bag by it was, what biden. >> did know where it was? >> something serious enough to give him an allergic reaction that doesn't present anywhere is a bit odd. >> that was a big question in my mind. >> he told the cops back then, that he had a history of allergic reactions. always carried an epipen for

emergencies. yet didn't take that to the wilderness that weekend. >> that seems strange to you that he would go camping without an epipen? if he was subject to the sort of thing? >> it seems strange to me that we were spending so much time talking about bug bites. it was almost as if we were trying to steer away from the real issue, which was the fatality crash involving his wife. >> it also seems strange, he said, that by the time the campers sauteed. he explained no evidence of an allergic reaction. but -- and they told her, as they told us that they never forgot how strangely phony todd seemed when he arrived at the camp site that night. >> well, he was kind of play sobbing, i would say. it was horrible acting going on. >> it was unbelievable. >> they always wondered why and warm, southern nate was tied dressed in several layers of heavy cold-ing.

was he perfecting himself from a fall that he knew he would cause? >> he had a lot of clothing on, and a toboggan had on. >> pulled over the air? >> yeah, i'm standing there in shorts and flip-flops. >> also, why did the accident help and on the one spot in the whole drive that had a long, straight drop. hundreds of miles into a deeper v. >> -- >> why did the toyota pick up a raft into flames? it would happen in the movies, but rarely in real life. why did it look like the fire had been burning for a long time? >> there is -- that side of the mountain. it was a big mountain. >> it had to have been burning for an hour to or two. >> probably closer to two. >> curiosities, why would he bring her up here to the very top of the mountain to go camping. an hours drive overedit tack, to the other campers further down the hill. according to kathy's family, she did not like camping at all.

so why would he bring her to the most remote, possible place? >> no one goes up there. unless you want to be really secluded. and that, said kathy's brother. was not what something that she would've wanted. >> did she like to go camping? >> she would rather be in a hotel anyway over that. knowing my sister. >> and for kathy's friends too. >> camping? cathy is not a camper. >> and there was this. >> i recall at some point, mr. winkler was saying. do you think i killed my wife? >> is that a question that an incident man where as? he wondered. but as the innocent man responded, he began thinking, todd's behavior seemed off. inappropriate. >> as i remember, the special agent said did you? and at that point he became very emotional. >> i can't believe, and he

changed his body language. his demeanor was just so over the top. >> but, though they may have had their suspicions back in 1999, suspicion alone did not make the death of kathy winkler, and what it was called at the time. an accident. insurance companies investigated, and paid out because they thought it was a real accident. and authorities there couldn't show that it wasn't a real accident. so why was it jessie you looking at it again? >> well, we know a lot more about todd at this point. we know a lot more about how he goes about getting what he wants. >> the moist that she learned about kathy's death, the more it seems to her that todd must have planned it all. just as the evidence here in california was telling her, that the killing of rachel winkler more than a decade later, was a case of history. todd winkler's history. repeating itself. but if she had some crusading

for his wife, rachel,'s murder. [inaudible] >> i just started pacing around the house. and said. you killed her. >> for those two years, todd maintained as he had from the beginning, that he killed rachael only to save his own life. to save himself, and his children. from jail, he and his family fought a losing battle with rachel's father, don, who won custody of those children. and here began atoning for the sense of his youth. by devoting himself to three little kids. eva, aerial, and alex. [inaudible] >> it was after all that that they held a trial. prosecutor liz that intended to play trey todd as a manipulative and devious man. who murdered not one wife, but to. but that was if she could

persuade a california judge to allow the old georgia case to be dusted off and brought back to life. >> i had to feel confident that i had the law behind me, and i felt that my very friend. i submitted the legal documents that supported that. >> and? she won. and so, september 2014, when todd winkler went on trial. charged with a first degree murder of his second wife, rachel. she could use the georgia story about first wife, kathy's death, 15 years earlier against him. and the defense? dismissed the georgia case out of hand. irrelevant, said todd's attorney. kathy wangler's death was thoroughly investigated, he said, and was not ruled a murder because it was not a murder. >> there is no evidence of anything other than an accident. >> todd's attorney was able to explain away the things that had raised suspicion. kathy's family was wrong, said the defense, she loved camping.

oh ranger who saw them making dinner, and the remote spot, so far out of any living soul. said they seemed happy. and the insurance money, remember that? that was it motive, just business as usual for a pair of upper middle class professionals. >> the insurance policy is about 1.1. and kathy had it at the time of the death, on the own life. he had 1.2 on his own life. >> kathy and todd were a young, upwardly mobile couple. life insurance was cheap, easy to get. they both had it. anyway, todd loved kathy. why else would he keep her ashes all these years? kathy's death, said the defense, had nothing whatever to do. of the events for which todd was on trial. the death of rachael winkler. and he wasn't in this case either. >> this is about a murder case, ladies and gentlemen. this is a self-defense case, and at most, it's a voluntary

manslaughter case. >> there were two good reasons to believe that, said the defense. the reason one? fence self-defense. as todd told the police that very first day. >> it was a killer be killed cardboard situation. >> he was a good guy, in a bad situation said his attorney. he worked hard, long hours to support rachel. he wanted to make her happy. he was a good dad. and for that, she cheated on him. threatened him. and then attacked with those scissors. at that point, todd told the police, she was a very unstable woman. >> her drinking, she started binge drinking. it was hard for the children. and she was just in a cycle of self destruction. >> and then todd's defense revealed this little gem. >> she signed up for california's sweetheart. which is an adult connection. you can judge for yourself what

it is. >> mary to a man that she had grown to hate, in an affair with a man that she was maybe thinking of cheating on. said the defense. she was conflicted, said todd's attorney. she was telling people that she was afraid of todd. and then, she truly didn't act like it here. todd and rachel looked happy. >> compared with this photograph taken in las vegas. a few days before rachael dad. >> but there was something out, said todd's attorney. and there was reason number two that rachel's death was not murder. and that was that at the time, he had a psychotic breakdown when rachael attacked him. his ability to understand what he was doing was diminished. why should a jury believe that? as you remember, rachel herself described todd as unstable at times. and defense presented evidence of what he said, was a history of psychotic episodes. the first one happened in asia, 20 years earlier, when he was married to kathy. and was flying with this

fighting samurai squadron. he was cat shopping, and -- he claimed amnesia, so the air force set him up for psychiatric tests. but then it got even more bizarre. and kathy called her friend tanya. >> she would telephone me and say, i'm in hawaii, todd had a mental breakdown. and so he is in as psychiatric facility. she had said to me that he escaped, and was in the wooded area. in hawaii for a week or two. and when he finally came out on the road, he said that he was a samurai warrior. >> back then, after months of psychiatric valuation he was diagnosed with dissociative disorder. an analysis that warped his view of reality. now what the air force wanted with a fighter pilot. >> and because of the events, and the determinations, by the air force psychiatry's he was

retired medically. with 50% disability. >> and it was that incident in amsterdam, remember? rachel told james about it. it happened just before he was due to make an important presentation at a conference. that time, he appeared to black out. became catatonic. ended up in the hospital. where they found nothing wrong with him, and released her. rachel told james that he faked the episode. here at the trial, a defense psychiatry has testified that todd suffered from real mental issues. dissociative disorder, conversion disorder. which meant he could be violent if he felt he was under attack. and that awful morning? -- she threatened to say car armed boyfriend on him. [inaudible] [inaudible] >> and then? >> she was coming at me with scissors. >> rachel's, that, done in self describe [inaudible]

watched as the defense argued that todd had no choice but to kill the woman they so. loved >> his state of mind is what you really need to pay careful attention to here. he knows that she will kill him. he knows that if he stops, if he doesn't end it right then, that it could end him. >> all very sad, said the defense. but not murder. and what would prosecutors say about that? simple. all that psychiatric stuff, she said, was fakery. todd winkler may have had, or feigned some disorder that got him out of the air force, she said. but he killed rachel. and it was murder. deliberate and planned, she said. committed by a man practice that getting away with things. >> good morning, ladies and gentlemen. this is a case about the mastermind. a manipulator. a murderer. this is a case about todd winkler, and how he brutally

murdered rachael went glare. his wife. mother of three's small children. >> todd when claire did not have to fend off a sizzle willing wife. and rachel could not be blamed of any mental condition either. any more than the death of another misses winkler in that dark woods so long ago. but as she began to tell that part of the story? watch what happened. >> she found, burned to death, in the bank where the car went. she burned them. under the summit. he was very fine, with a few minor scratches on him. [screaming] [screaming] >>

death. in the basement. >> just as a prosecutor was laying out her case in the killing of todd's wife rachel, an inexplicable outburst from todd. [screaming] [screaming] [screaming] >> bushy though?

and japanese, the way of the warrior. the honor based code of conduct of a samurai. why was todd winkler raving about it now? was this another psychotic episode? >> stop, stop. >> but of course, trial came to a screeching halt. amidst trial loomed. >> can we get the courtroom clear? >> but once order was restored, the judge allowed the prosecutor to continue. >> as i was saying, the defendant's former wife, kathy, went on a camping trip and disrupt embers six, of 1999 with the defendant. she dried in a fiery crash. the only wenceslas to the crime was in fact that affect that. >> where they parallels? you bet they, where said prosecutor suter. the death of kathy and rachel were both cold blooded calculated killings. >> he had now two wives where

he has been the one who has been the only witness. to a crime. >> but. she said based on what investigators found, the events at 3:00 in the morning and the california airpark were not hard to determine. and she prepared a theory of what happened that night. was horrific. one, todd opened rachel's laptop and found the -- working on with her boyfriend james. it disappeared from the place in the home. number two, he grabbed the scissors from a box kept on a shelf right above the computer. and three. >> i believe that he took a pair of scissors. and he went into that room with the intent to kill her. he attacked her while she was sleeping. stabbed her repeatedly in the face and the neck area. and i believe at that point, he thought he had killed her. and he left her for dead. >> then, said the prosecutor. as todd prepared to leave the house. he saw a light had been turned. on and the babies.

ron. >> so that's when he then goes, gets his motorcycle jacket on for padding, for protection. bangs on the door. finds her. in that corner. >> towering? >> towering. >> try to save her own life? >> correct. >> he knew -- >> baby alex's once it was examined. and you know that there are drip blood, like droplet blood, up on top of that onesie. that is how we know that rachel was holding that baby. >> then todd came back. >> she is in the corner there, she kicks at him. >> did not stop him. >> he -- up to her body, he takes the scissors. and gems them into her neck. and he sits there and lays there on top of her. as she slowly dies. >> after that, for several

hours, todd cleaned up. said the prosecutor. then took his kids to the neighbor's house. and then? after dropping the kids at the neighbors, but before the cops arrived. he took the time to cut his hands. to make it look as if he had been attacked by rachel. how did they know that the cuts were self inflicted? the neighbor said, his hands weren't cut when he dropped off the kids. and then, the prosecutor told the jury about the ashes. kathy's ashes. which rachel discovered months before she was killed. >> and learned how there had been a crash and he had no injuries. and she had died. rachel was upset by this. and said, is this how i'm gonna turn out? and the reply was, you're not going to get in my way are you? >> rachel knew she was in danger. said the prosecutor. as the young woman had already told her closest friends and

family. >> and they said to rachael, if you divorce me, you will end up like my last wife. she did. >> after 13 days of testimony. the germany got the case. they were out one day. >> we the jury, and panel, in the action. of defendant when claire, guilty of first degree murder. >> no operates this time. no breakdown. the former fighter pilot sat quietly and listened. he got 26 years to life. it was over for todd. but not for anyone else. not really. as james white's daughter caitlin told us. >> i was told that monsters don't exist. my parents always told me that. after going through that trial, and seeing what i had to say. i can tell you with absolute certainty that is 110%. false he is a monster. >> and rachel's men?

weren't surprised to hear that james has his own idea of what justice might be. >> if you have any thoughts about what would happen if the justice system did not look after todd in a way that would seem reasonable to you? >> he would've been dealt with. >> by whom? >> may. >> they could've put years in prison for life. >> we would've both went missing. he and i would've gone down together. i'm not gonna shoot him, i would kill him. due to him, what he did to rachael. >> tim, the man who failed to commit and then watch the love of his life go on to the terrible and. has his own way of taking revenge. mostly on him self. >> a tragic love story from your point of view? >> it. is it. is >> this is the woman that you could've spent the rest of your life with? >> very easily could, yes.

i should've pulled the trigger when i had that chance. i blew it. i did not give her the ring earlier. >> you're still playing for? it >> yeah. that's a tough one. >> different kind of thinking, across the country. among the friends of that other mrs. wynne glare. the one who's death on a lonely mountain road is still officially labeled accidents. >> this is a beautiful woman who had, who had gave so much. was sold nurturing, and carrying. i don't think that there has been justice for kathy. i think about kathy's death all the time. >> about whether she could have somehow done more. to prevent the same death. the murder of rachael winkler. >> my heart breaks for those children. i wish i could hug them all and tell them i'm so sorry that i did not press harder. to make them reopen this case. or be that strong person that i

was. i'm apologize. >> and someday, said don had failed, she will find the words to tell the story to rachael's children. aerial, alex, and eva. >> this whole story is a mixture of murder and blood, and failings, and jesus, and heaven, and god. and some real craziness to. it but that is the character of my life. and some of rachel's life, and it's just kind of life in general. >> in the meantime, he said, he's trying to be the kind of parents that he wasn't with his own children. that is now. for rachel. >> i believe it is my destiny to raise them. i intend to do that. with god's help. ♪ ♪ ♪
