do certain things regardin donald trump how do you arrest someone an charge him and keep him safe who is under guard with th secret service already and so there are several concerns, logistical concerns, that will have to be thought about, how to get him safely into the building, how to ge him down the hall, et cetera and so i don't know necessaril how important it is. you have to fingerprint him. that for sure, because the have to generate a rap sheet and a nice at number, but th mugshot, that is usually use in case he flees the jurisdiction and obviously there are enough pictures of him, we don't need to have his mark shot. and frankly, knowing, him if somehow they would leak th mugshot and use that to thei advantage as a campaign. so it's not really necessary just like handcuffing him isn' really necessary so they will do the things w have to do to keep them safe and to process the information

but i don't know that you have to do absolutely everything in this particular case >> how often does there exists a special treatment type o thing? you look at the notoriety of somebody i also understand by the way i trump's case that i believ that they are going to b adjourning a lot of the courts that we would be hearing cases from, because they want to hel vacate that building >> yeah, i heard that too. the building normally has mayb ten or 12 trials going o simultaneously throughout th courthouse, and on the halls there. but they are going to keep the regular maintenance. you have a right to be arraigned and 24 hours if yo are arrested and new york city in particular, and tha arraignment proceeding wil continue but the other trials, the othe matters, my understanding is that they will stop at lunchtime so that they can hea this case, which started to 15 so that they can keep some control over who is in and out of the building, because

frankly, they have to keep him safe too and so, that is one concern, but also there to keep everybody else safe, and he' already been calling for death and destruction and violence and he asked the judge he has not directly threaten the judge, but he's done in th way that he does it, and h makes racist comments, makin sure that he adds the judge' middle name one manuel marchand i've known judge marchand fo three decades, i don't know it is middle name is, i never use his middle name, but he want to make sure that he gets that in there just like when he calls alvin bragg, who i african american, calls him an animal he just has these racist trope that he likes to - >> it's disgusting >> it's disgusting and i think it's his way of trying t incite violence, frankly so the secret service becaus of him really have to make sur that they keep everybody safe, and they have to go throug these extraordinary measures because largely of the actions of him, donald trump himself >> i know that you've been par

of charging decisions fo decades, and so let's play and listen together with trump's lawyer says about the number o counts expected in thi indictment here it is >> if it is correct, it mean that they take on each transaction, each track, eac payment, each entry amid a second charge. i think it's all going to rise and fall on the issue of thi settlement agreement a very legal, very commo settlement agreement, and ho it applies to campaign finance laws >> joe tacopina on to somethin there, do you think that i correct on why there might b that many camps? >> so each, it has been widely reported again that there ar 11 different payments made, an each payment had its own invoice. and i checkmate, and it had business injury that was written. each one of those would be a separate charge of falsifying business records so if there were 11 payments and with three different thing that happened in each one, i would imagine 33 counts with

respect to each of those i addition to that, there' potentially a sweeping conspiracy charge that i think we can expect here, see here they would talk about this conspiracy to influence th election by doing catch an kill, whether it is with karen mcdougal and stormy daniels. i think we should wait and loo for that, because i think that that is a possibility sinc there was a conspiracy her between vile, trump michae cohen, and david pecker to a least. >> so what category would conspiracy fall under, if that were one of the charges? would that be a felony, or a misdemeanor. how would that play out? >> so interestingly, in ne york, there are differen levels of felonies and cost felonies, that the highest i class egophonies are the lowest this is a class eat velvety. so it is the lowest felony, th falsifying of business records where there is no mandator jail time, but you could serve up to four years the conspiracy to commit a cos -y felony in new york is

actually a misdemeanor it is an eight misdemeanor and so although would be the lowest charge if it is charged in some ways, i think it is on of the more important charges, because it allows much mor evidence come and, and a muc larger timeframe of informatio to come and. this case is much more tha just i wrote this track, and put this business entry. and to tell those stories of why it is a crime, you have to put in context, and conspiracy charge ensures th ability to put that context and, and tells a story that we coul all see exactly what their theory is. >> how long might this take to go to trial? could there be some sort of bargaining for lesser charges? what is the likelihood that it could be dismissed >> you have to think tha trump's team is going to throw everything they can possibly d to delay the trial >> absolutely, they're going t try to delay the trial

we know that because that is trump's legal playbook exactly, that is his playbook, to delay he's going to try. the good news is that we hav the judge, he is an excellen judge knows how to keep contro of his courtroom he's not going to put up wit that but there will be some adjournments and some delay if you follow the normal course because he is entitled to make motions, which he will there are several motions that he is already signaled that he will make. he will say this is beyond the statute of limitations he will say that whatever crim the prosecution is using is no eligible to elevate this fro one misdemeanor to a felony. he will make other motions i'm sure he will make a motion regardin the efficiency of the gran jury there will be lots and lots of motions that he will make. the statute of limitations, he will do that because a felon in new york is a - this happened more than five years ago. there are some legal ways to

pause that statute the prosecution is relying o that he will want to challenge th reliance on that >> a couple of questions here. will this fall into the 2024 campaign season. will that be something tha judge marchand would say, gott take a pause because of th political interpretation of al of this. finally, do you think it may have crossed trump's minds o those of his attorney that h thinks, if i get into the whit house, i can get all these charges dismissed because i'm top dog, right could a president dismisse charges against himself if the unthinkable happened and he wa reelected to the oval office >> no, actually. what he can do is he can pardo himself for any federal crim that he has committed. all of the stuff that jack mitt is looking at, all of the

mar-a-lago documents case, the january 6th insurrection case, he can pardon himself or another republican if he i elected can pardon him he can make those cases go awa and that is done you cannot pardon a stat prosecutor this case and the other case that i anticipate to be coming soon as well as the other manhattan da investigation that is still remains open, that may or ma not be brought those are very important, he cannot pardon himself for thos matters. as your other question, is the judge going to pause this for presidential election? i have no way of answering tha question because this is truly unprecedented. i just don't know what a judge will do. there is nothing to look bac on the say oh, this is wha they've done in the past >> when you figure out, in com back and see us. it is going to mess with you weekend. very good to see you, thank yo

so much. also new today, reports that o trump is using news of his indictment to ramp u fundraising in the 24 hour since the manhattan da announced charges. trump's campaign says it reached $4 million joining me now, bowman, deputy editor for the nbc new political unit welcome, $4 million in a day it has a lot of money. how did he do it who is donating to him that is certainly a lot of money even for trump who is prolific fund raiser some figures that the trum campaign shared last night, suppose front of me, they said about a quarter of those donor were first-time donors who, th average donation was aroun $34. we of course can't confirm those numbers, we will be able to get a better sense of i when he files his report two weeks from today but it certainly shows that th campaign is trying to send a message that this is helping their campaign, not hurtin them it is winning the ne supporters, energizing their current supporters and so yes,

we certainly have seen trump taking advantage of this he has sent out several fund raising emails, even the - >> it all fairness, those site are doing that because in your article you point out that democrats and republicans ar trying to capitalize off the indictment what kind of strategies are th using and what side has been more successful at it? >> that is correct, that i been really interesting to see these pictures coming from bot sides. but it is not necessaril surprising that is because trump has been the best fund-raiser for - we have seen an explosion in a democratic fund raising in the last couple of election cycles that is because these smal dollar grassroots donors focus on giving $5, $10 a month, but they activate them they've been looking for summe to channel the energy, that is been going to democratic campaigns. we will have to see when the fundraising reports are file and who raised the most here it is important to note that yesterday was the final day of
