she's in sullivan, - where the storms have killed a least five people. unbelievable destruction acros the country with these tornadoes. a lot of folks saying, what is going on especially when they experienc what happened behind you >> yeah, yasmin. three people in the sullivan area, we are told by officials five more probably in the stat of indiana that lost their lives. i can tell you the numbers are kind of remarkably low when yo look at the devastation. this was a neighborhood. you can see some homes hav roof damage. others, properties are jus littered with debris you can see this home has some of its roof, about half it roof, almost, sheared away other buildings had their roof completely gone, beams protruding from inside the - the porches bent in. i met a man a short time ago who said he raced downstairs t the basement he was there for a handful o minutes, two or three minute before he heard the tornad overhead he says he then stepped out as

the storm passed and saw the aftermath. all these devastation, about 3 to 40 homes, according t officials, in this neighborhood 200 homes more broadly in this community of sullivan. an hour in 15 minutes from indianapolis for context o where we are in the state of indiana. the national weather service i preliminarily saying this wa an ef3 tornado that came through with 155 mil per hour wind gusts. you can just see and this was neighborhood there are still some homes standing a trees, and their branche were sheared off trunks at this point this is what mother nature can do unfortunately, this area i bracing for more severe weather, potentially, on tuesday, yasmin >> jesse courage for us, thank you, jesse we appreciate it former president donald trum already saying he will deliver remarks live from mar-a-lago tuesday night. following his arraignment on criminal charges nbc's vaughn hillyard is nea mar-a-lago as we've been following, the former president -

lines like - federalism, attorney wor product and the list goes on and on and but more importantly the obvious attempt to try and intimidate mr. brag an potentially the grand jury now that the indictment is out there and they have change their strategy to simply attacking it as a witch hunt that should not have bee undertaken and that he should b prosecuting other cases. but certainly within his - texas size it discretion i this way, we will see what the charges are. shortly, when they are unveile and unsealed but so far he has been on lega ground and the republica attacks have been predictabl but misguided. >> so, could they compel d bragg to testify before th house by subpoenaing him and as brag have a case to refuse that subpoena considering they are still inside this investigation an

possibly trial in the near future >> yeah. it is a pretty interesting question in a variety of respects i don't think congress shoul exercise this discretion a power in this way at this time because it looks like an obvious attempt to disrupt a ongoing criminal prosecution congress does have subpoen power, if it is aimed at enacting legislation or fo legislative purposes i have seen them strain to try and fit into that but i thin at the end of the day it reall is just an effort to try and punish him for exercising th power that new york voters hav given him. and the grand jury as well >> i think a lot of folks were surprised that david bragg cam forward first with thi indictment i think a lot of people though it was going to come from fani willis into fulton county, obviously we still haven't heard where that stands, her a ongoing investigation with especially counsel -

adam schiff told my counsel -- that he feels as if i had th doj been more aggressive - those charges would have com first. does it matter with comes first? or do you think he has a point there? >> i don't know that it matters, which charges are brough forth. i think what will matter first is which goes to trial and whether there are convictions. if there is a conviction in on of the first trials, regardles of which one it is, i can se it as a game-changer for a lot of the attacks on thes prosecutions as being partisan because at that point there ar confirmed and ratified by jury of his peers in whichever jurisdiction that happens. so you know, there are a lot o hand - at the end of the day, the bottom line is just what doe the jury do? >> - could be zika simultaneous trials go down we know jack smith is a little bit more behind the vehicl when it comes to the investigation, but if we hea --

everybody. the pieces are in motion for what is shaping up to be a historic week, to say th least. the former president is set to fly in new york city tomorro ahead of his arraignment the new york - mobilizing all of its officers in uniform in anticipation o protests even the secret service sendin dozens of agents to ensure the security of trump's trouble. i want to bring in nbc justice intelligent -- to talk more about this. so, if you will, can you kin of take us through the play by play the embassies of how this is all expected to play out we know a lot of things coul change between now and then. >> sure, yasmin. we learned today that th

former president intends t give a speech of some kind a mar-a-lago tomorrow night, around 8:15. that is before he is set to fly, we believe, that night, to new york city, spend the night there and then he would leav around one in the afternoo from trump tower, is residents and drive down in a motorcad to lower manhattan, where he will turn himself into the district attorney's office and he will be booked. but we have never seen a booking like this. it is very likely that the entire building will be cleare and searched by the secret service, because that is wha happens to happen when a forme president goes anywhere. you will be accompanied at all times by his secret servic detail but he will also, we are told, go through the norm or procedures of someone when the arrested, or when they tur themselves in, which is they will be fingerprinted. dna swabs will be taken. in the mugshot, photograph taken. normally, the defendants are handcuffed throughout this process. it seems like it is unclea

whether that is going to happen, particularly, it probabl doesn't need to happen in -- aren't secret service agent. but that is where it is. and then, you know, normally a that point in the process, defendants can be held over, placed in jail for some period of time. until the arraignment before a judge, we don't think that wil happen in this case, but h will be arraigned. he will be taken before a judg and then at that point, yasmin the indictment will be unseale and everyone will see exactl the nature of, and the specifi -- criminal charges >> two things for sure do we know he is getting amo shot i know there is some - mugshot. first and foremost, and then w know there's also -- fox news, making some pretty bold claims. what was he saying >> yeah. the mugshot thing i think is u in the air, you are absolutely right. i don't think we will know for sure, there is never been a -- territory. in terms of trustee, james

trusty's a former federa prosecutor he rarely makes public appearances. so, i took note of his appearance on fox news thi morning, where he wasn't announcing this new your cas and saying all of the things that trump's other lawyers hav been saying. he also took a shot at the justice department, both a merrick garland and that president biden. he suggested that merric garland gave a press conferenc celebrating the fbi search o mar-a-lago, which is not factual. he gave a news conference to talk about the legal process i that case, after trump reveale the search and spent day attacking -- he also said that bide unleashed the justic department on former president trump, which look, is just not true there is nothing that supports that i think it is important to point the stuff out. we are in a climate right no where a lot of people ar criticizing how former president trump has been treated, or accusing various aspects of the justice syste to be political, but i kno from my reporting that whateve you want to say about thes

that is how the number gets so high but what i'm going to be looking for is the felon requires that you are doin this in order to conceal a crime. so i am trying to understand what is the crime that alvin bragg is actually charging him or alleging that he was trying to conceal with his falsify -- >> the felony. -- >> so for a while, it wa floated that it was going to b a motion of campaign finance violations so i am really going to be looking for what is the extr stuff, where is that extra - >> do you think it will be different than campaign finance? do you think it will b something different? >> i believe it will be th campaign finance that is also where i a watching that is the part of the actual charges, that makes the lega theory a little dicey. i think that people have talke about that they may no understand why people ar concerned about brag pursuin this route, so i am curious to see, as a formal prosecutor, how to get there with th campaign finance violations, given that we are talking abou a federal campaign being enforced at the state level.

>> i've so many questions fo you. is there a possibility thi trial could be moved as th trump attorneys want >> in a lot of ways, yes and no they are lawyers he is a -- not president trump. they are going to engage a bunch of different - some work, some may not. i expect them to try to do everything from trying t dismiss this in addition t trying to move the venue, to a number of other movers tha they will pull throughout th course of this prosecution and like i said, some of the mesa be successful i don't think it is going to b a matter of all or nothing for either side. and it is going to be awhile before we see anything - >> 16 months from when the indictment came down from th pro trump again -- began. trump is all about delay, delay, delay. push, push push we could be looking a 2024 -- possibly winning the nominatio -- trial. if he is found guilty, he coul be a felon running for president of the united states
