course, florida where former president donald trump is gearing up to fly to new york for his arraignment. a second hour of team coverage starting right now ♪ good morning it is 11:00 a.m. eastern, 8:00 a.m. pacific, i'm josé diaz-balart, in just about an hour, former president donald trump expected to leave mar-a-lago for new york city ahead of his arraignment tomorrow in the high profile hush money case sending shock waves through the political universe i'll be joined by my colleague yasmin vossoughian who is outside the manhattan d.a.'s office where police are ramping up security ahead of tomorrow's historic day. also this morning, at least 32 dead across the south and the midwest after yet another string of wild storms ripped through the country over the weekend decimating entire communities. we'll take you live to indiana, now bracing for more severe

weather. and this afternoon as his predecessor prepares for his day in court, president biden headed to minnesota to tout his economic agenda. he stayed quiet on trump's indictment could that change today? and later this hour, we're looking ahead to tonight's big game in houston. the university of connecticut, san diego state will face off in the final matchup of a march madness full of twists and turns. so in just about an hour from now, former president donald trump is expected to start his journey from here in florida to new york to be arraigned on charges connected to a hush money payment made to an adult film actress before the 2016 presidential election. these are live pictures coming to us. there is the airplane, the trump airplane in palm beach airport
8:02 am
i want to bring in my colleague yasmin vossoughian, who is on the other side of this story, outside the district attorney identifies in lower manhattan where trump will appear tomorrow, yasmin >> yeah, a lot of action happening behind me over the next 24 hours, specifically tomorrow morning security ramped up here ahead of the president's arrival to be booked, processed and arraigned as well. thousands of officers are going to be on duty in and around courthouse and the d.a.'s office as well. this is coming as we still don't know the full scope of those charges as the indictment is sealed nbc news has learned according to two sources familiar with the matter that trump is facing about 30 document fraud-related charges. nbc news has joined other news organizations in asking the judge to unseal the indictment and allow cameras inside that courtroom for tomorrow's proceedings. we're still waiting to hear a
8:03 am
decision on that as well with us to talk more about this, garrett haake with me outside the d.a.'s office here in lower manhattan, nbc news correspondent blayne alexander is in west palm beach, florida, as well. we also have a andrew weissmann, former fbi general counsel and a senior member of the moeller probe. he is an msnbc legal analyst garrett, if we will, right, reset things for us. we're watching florida, obviously. the former president likely to take off from there in the next hour or so at the noon hour. what's going to be happening here on the ground in the next 24 >> even now there are more discussions about how to properly secure this courthouse and the rest of lower manhattan for the former president against the possibility of what could be disruptive protests. there is a protest planned for tomorrow morning with marjorie taylor greene. that's moved up a couple of hours. now expected to start at 10:30 i suspect that move has been made to more closely coincide with when we expect mr. trump to
8:04 am
arrive for processing here when hegets to the courthouse, really essentially everything once he arrives that the building, you're going to see a tension between what i think the public wants to see, what news os have asked to see and what the secret service would like us to see they're going to take a very conservative approach to this. they do not want him to be publicly visible in the courthouse his detail will be with him when he gets fingerprinted, when he gets a dna swab taken, if he gets a mug shot taken, the secret service will be there for all of that. i think really what we'll see up until that arraignment, some desire by the form president to make this a political moment and a desire by the secret service to make sure this is done as safely as possible they don't want any screwups they're going to play it very conservative. >> the big story we've been talking about is what is the story this indictment is going to tell, right these 30 plus counts or so and as i just mentioned the judge making that decision if
8:05 am
that indictment's going to be unsealed earlier as media organizations have put that request in when are we going to hear anything about timing of that? >> typically defendants' attorneys want to see what the charges are. it's not the kind of thing that would be unveiled like on a game show in the courtroom. whether that happens this afternoon, we and other news organizations have asked for it to happen as soon as possible. our reporting on this has been, according to two sources familiar as you said, something like 30 charges centered around document fraud what we don't know is whether that's specifically related to the hush money, stormy daniels payments that we've covered so extensively or whether those charges go beyond that, perhaps the previous hush money payments alleged to have been paid to karen mcdougal, that playboy model, or perhaps something beyond this. the scope could be quite narrow, focused on just the stormy
8:06 am
daniels matter, and individual charges related to individual payments or we could be talking about something much larger. the d.a. alvin bragg has said almost nothing about this. all we've heard from him have been his letters to members of congress who are trying to get information, telling them stay in your lane we're still working. >> and we want to know the connection that's being made to the federal crime. i know when that thing drops you're going to be poring through it for us. lane, we're keeping on eyes on florida where you are, talk to us >> reporter: yasmin, right now we are keeping all eyes on that bridge behind maine that is the bridge that the former president in a motorcade will have to travel over to leave his mar-a-lago residence and travel to palm beach international airport. now, it's a straight shot to the airport, only about ten minutes or so by car that's where he's going to hop on his private jet, his trump-branded airplane and begin that flight to new york. now, it's interesting, if you're driving around here in the west palm beach area, people here
8:07 am
know when the former president is in town that's because his jet is parked rather visibly at the airport. you can see it as you're driving by from the road as for his journey itself, he's going to be bookended by supporters that bridge that he's going to be kcrossing, we've seen about two to three dozen supporters. they've been playing music they've been waving flags. they've been cheering the former president every time they see his motorcade assing we know there are a dozen or so out there today waiting for him to make that trip across the bridge, and then at the airport, on the other end, there are a handful or so of supporters there. that's when he's going to get on the plane and go wheels up to laguardia. he's going to be bookended by supporters when he makes the short drive to the airport, but this entire process he's going to kind of be bookended by a familiar site, mar-a-lago. it's certainly notable that he's going to be returning here tomorrow evening to give his prime time address after the entire process plays out there
8:08 am
in new york. now, certainly we haven't seen much of the former president in the days since that indictment came down, but we've certainly heard from him there's been no shortage of comments from trump world. he's posted a number of times on his social media site, slamming the d.a., slamming the judge who's been assigned to this case, calling for a change in venue, declaring himself a totally innocent person. we've heard from his campaign, they're going to be essentially capitalizing on this just in the past two minutes or so, his campaign sent another email with the subject line i will be arrested, and certainly all eyes on how that process is going to play out as well. yasmin >> blayne was talking about president trump has taken to his social media website throughout the time, but this morning he demanded a change of venue, a different judge and the removal of manhattan district attorney alvin bragg. who decides, andrew, whether
8:09 am
there will be a change of venue, and how will that be decided >> well, a change of venue as opposed to a change of judge is a motion that a defendant through his counsel makes to the presiding judge. in this case it appears to be judge mershan. there are all sorts of reasons why you could have a sort of valid motion to change venue if, for instance, the location is so sat saturated -- >> well, we lost andrew for a very quick moment, but there is then the difference between a change of venue and then changing the judge yasmin, one of the things that's fascinating is how little this is in so many ways, how -- well,
8:10 am
we have -- we have andrew back, and yasmin, you want to just talk on this, how the steps that we're waiting to see are so, you know, essentially set in stone, but they're so different because it's really tissue-- it's a forr president. >> it's a former president, exactly right, jose, and andrew, you know, we keep talking about this because we use this word as garrett did at the top of the last hour, which is unprecedented because it really is and i think a lot of folks don't necessarily know what's going to happen here, especially by a former president, by the way, who's incredibly active on social media, right? i'm wondering as we're talking about this, the possible imposition of a gag order on him and really if he would even follow it if it was put in place. what is the likelihood, the possibility something like this could happen >> sure, so sorry about the technical difficulties so very quickly, with respect to change of venue, that's
8:11 am
definitely not something that's going to be decided quickly, nor is it likely to succeed because there's no other venue in the united states where this case is not getting publicity. the same issue arose when i was trying 20 years ago the enron case, and it went all the way to the supreme court on this venue issue and the court said everyone knows about enron there's nothing different about houston than anywhere else in the country. so there's no reason to change venue. i think that's the exact same analysis as here with respect to the gag order, there's two bases the court could have to issue a gag order. one is something that's called sort of free press fair trial rules, and that is that neither party, neither the government nor the defense is supposed to be sort of inflaming the potential jury pool. that's already happened, and as you can imagine the judge saying i'm going to put some limits on what you can say about the m
8:12 am
merits of the case the second is more serious the second has to do with inciting violence. you cannot be out on bail and incite violence. there are two problems with that one, it is a crime and the second is when you're out on bail and you commit a crime, all sorts of bad things can happen to you including going to jail is so the same thing, by the way, happened with roger stone when he was prosecuted and he posted online a picture of the judge with a symbol of cross hairs on the photo, and the judge restricted roger stone's ability to post anything on social media because of his interest in inciting violence. so your point that donald trump may be hard to control, that may be true in the political realm, but when he is a defendant, which he will be tomorrow when he is arrested, he will be under court supervision. so if he doesn't control
8:13 am
himself, the judge take all sorts of action, and if he's inciting violence, the d.a. could also charge him with that crime. we'll be in a very different world tomorrow than today. fwar rgarrett haake, blayne alexander, and andrew weissmann, thank you very much. the former president is getting some political backup from his top 2024 rival, how ron desantis came to his defense and terrifying scenes across the south and midwest over the past few days. tornados just tore apart houses and picked up cars now another string of storms is on the way a full report on which parts of the country could see severe weather when we're back in just 60 seconds you're watching "josé diaz-balart reports" on msnbc. -can't hear you, jerry. -sorry. uh, yeah, can we get a system where when someone's bike is in the shop, then we could borrow someone else's? -no! -no! or you can get a quote

strike, stop recording and get to shelter that's a good bit of advice. nbc's jesse kirsch is in sullivan, indiana, where another round of severe weather is headed what's the status of rescue and cleanup from just over the weekend? >> yeah, jose, the estimate from the mayor here in this community outside of indianapolis is that we're talking about years of recovery you can see the cleanup is ongoing right now. construction equipment out here picking up piles of debris where homes and businesses once stood. you can see there are some roofs off, and then there are just piles of debris in other places. it's also people's belongings. look at this vehicle, we've seen this again and again in this neighborhood windows shattered. we've seen tree branches hanging out of vehicles. there's a sewing machine up against the side of this one, and again, it's just like this block after block. officials here tell us this is what it looks like for about 30 to 40 homes and businesses in this neighborhood in sullivan, indiana. this community had three people lose their lives in what the preliminary report from the
8:17 am
national weather service was an ef-3 tornado with 155 miles per hour wind gusts that swept through here on friday, and as you mentioned, there is now concern about a threat of more severe weather that is expected to be coming through the area tomorrow, and as i mentioned, we're looking at potentially years of cleanup in this community right now, something they do not need more of is severe weather coming through here jose, i just can't understate this, when you look out behind me, this is what we see for blocks in this neighborhood. this is the same scene again and again, some of the homes it seems like the homes that are maybe made out of stone or brick work or something like that may have fared better in the storm, and some of the buildings have portions of the roof that are still standing and others are just now leveled piles of debris we met a man yesterday who said he thought at that point yesterday he had taken everything he could. he is expecting hopefully to be able to rebuild here he says he has insurance
8:18 am
obviously there's some other people who may not have that kind of financial protection this is a community that is looking for support. officials here calling for monetary donations they've had a lot of food support, they don't need more of that right now they're looking for volunteers as well to help. i can just tell you looking at what we're seeing out here, jose, it's a long road ahead of recovery and more severe weather potentially on the way jose. >> yes, indeed, jesse kirsch, i thank you so much as he was just mentioning, a second wave is coming meteorologist michelle grossman is tracking it all what areas are you watching closely this morning >> this morning we're watching the south. we're watching the gulf coast. that's a whole different system that we're watching today. we had tornado warnings earlier today. we're seeing strong storms still. that will continue into tonight. then we're watching another powerful storm system. it's getting its act together in the west over the rockies bringing some snow lots of people, millions of americans under winter weather alerts 7 million people impacted, 38 million will be impacted by wind alerts we're going to see winds gusting
8:19 am
up to 60 miles per hour, on the cold side you can find the snow with that wind, we're going to see blizzard conditions in the dakotas, into portions of minnesota as well. on the warm side, we're looking at the chance for severe storms once again unfortunately, we are stuck on repeat there the storms i was talking about earlier where you're seeing the yellows, the reds, the oranges, and portions of the gulf coast state into the south. we're seeing really heavy rainfall that's bringing the potential for some flooding. but where you see the blue, that is the snow falling and that is our next powerful storm system that will bring severe weather tomorrow we have all the ingredients in place. we've had an active start to are april. we had an active end to march, and we really had an active weren't as well. we have a couple of things in place. we have a warm gulf, so the gulf of mexico is really good it's warmer than average that's feeding these storms, and that's really the gasoline for these storms now, out to the west we have a vigorous storm track we've seen that week after week, month after month in the west. that's continuing into the spring that's sort of speeding these
8:20 am
storms along that's why we're stuck on repeat and will continue to be stuck on are repeat we don't see that break in the near future. this is what we're looking at in terms of tomorrow, we really need to be concerned about this. we need to heed all the warnings these are the places where we saw the severe storms that jesse showed us over the weekend we're looking at potential significant powerful storms, ef-2 or greater. those are winds of 111 miles per hour at minimum. could be higher than that if we do get stronger storms we could see some long tracking tornados as well, and just like the past two weekends, these will start in the evening and could continue into the nighttime hours. so nocturnal tornados are doubly as dangerous so for today, we're looking at the snow in the rockies, snow into the plains tomorrow and we're looking for the chance of that severe storm. we're going to continue to watch oaf over the next 24 hours >> just so dangerous, and the whole thing of the evening tornados is just terrifying. michelle, thank you. and i want to head back to

for tomorrow, but these barriers, obviously behind me still in place, and major security presence. so as we're talking about former president donald trump, we're also keeping our eye on president biden as well who's onboard air force one right now making his way to minneapolis to tout his administration's economic policies. biden is looking to highlight his investing in americans plan, which includinging investing in clean energy and manufacturing across the country the president so far has given no comment about his predecessor and potential 2024 opponent donald trump facing his arraignment tomorrow morning joining us to talk about this is nbc white house correspondent, monica alba. obviously president biden has been asked numerous times since this arraignment dropped his comments on former president donald trump, as yet he has said no comment any plan for what you're hearing from the white house to address it >> reporter: i don't expect this strategy to shift, yasmin.
8:47 am
i think president biden has really made a concerted effort here not to comment on any ongoing criminal or legal proceedings as it relates to his predecessor, and we shouldn't expect that to change. this is a white house that has really taken pain staking moves to try not to ever give the appearance of interference or weighing in on anything as it relates to law enforcement activity, as it relates to the department of the justice and of course the multiple probes and investigations that are zeroing in on former president trump this case is no different, but something that the white house has been commenting on a little bit from a hypothetical standpoint, and we did just get a little bit more from white house national security spokesman john kirby on this is this possibility of large scale protests that could perhaps turn violent. the white house saying they're going to urge anybody who's considering protests to do so peacefully they say that they're in touch with local and state authorities on any protests that may pop up around the court or anywhere
8:48 am
else around the country, and those conversations will keep going, but again, they're hoping nothing gets to the point where they would need to get more involved, so they're hoping none of that happens in the next 24 to 48 hours, but they have to closely monitor the situation as well this is a white house that really is going to across the board continue not to comment, not to weigh in here, to let this process really play out i'm told and watch it, but the president will be in minnesota today focusing on that investing in america tour at a power generation facility. this is part of a 20-state tour that the administration is doing this week. they will try to keep the focus on that as of course so many eyes are watching what's happening where you are in new york city, yasmin. >> talk more about that, monica, if you will, right the messaging the president wants to get across when it comes to investing in america tour, especially amidst the multiple banking fail where you ares we've seen in this country the last couple of weeks, some of the job numbers and the
8:49 am
persistent fear of inflation in this country's future. excuse me, recession, i should say in this country's future >> sure, and we have seen the president do this last week, for instance, at a semi conductor manufacturing facility where he was talking about critical chips that go into electric vehicles today. he will be in the twin cities, again talking about manufacturing, the first lady is on the road the next couple of days, the vice president back from that trip to africa will be doing the same, and this is really some of these themes that the president highlighted in the state of the union, when it comes to implementation of legislation that the administration was able to pass in the last couple of years. so when we're talking about the chips act, when we're talking about the inflation reduction act, other major bipartisan infrastructure law initiatives when you look at all of the things, this is now the year of implementation i think you can expect the president to continue to talk about that, to try and draw a contrast with republicans all as this major conversation continues around the debt

looks like any second now he's go going to be coming out of those doors heading into that vehicle so we'll be keeping a close watch on this as we see apparently some secret service agents just outside the door there. and yeah any minute now any second now we'll probably see the former president coming out as we see the secret service agent there just walking past our screen we're going to keep a very close watch on this, but i want to just wrap things up in some way. talk about these incredible games that we've been seeing we're actually one game away from wrapping up what has been an electrifying march madness. overnight, louisiana state university won their first womens basketball title after taking down a dominant iowa and their star, caitlin clark, who had an historic tournament tonight, the uconn huskers will take on san diego state which secured their spot in the final after an incredible buzzer beater joining us tonight from the site

average of more than 20 points nothing by single edits. they've won all five games by double digits. the teams in modern history to reach the championship game having won every game before by double digits, four of the five finished the job in the national title game went on to cut down one exception, it was here in houston where i'm standing seven years ago, north carolina lost on the buzzer beater to villanova. san diego state, meanwhile, they've won their last two by a point. they're a seven and a half point underdog the one solace, we're looking at the biggest long shots here. three of them. three teams were bigger underdogs than san diego state came into this game and won it outright so wouldn't it be fitting after the month we've had if we have one more big upset in the title game, jose >> steve kornacki, who crams more information into a white board than anybody live. thank you, my friend new details coming out in

justice department have collected fresh evidence claiming to possible obstruction by trump in the probe into top secret documents found at mar-a-lago nbc has not independently confirmed this reporting joining us now, perry stein for the "washington post" who has part of the team who broke that story. thank you very much for being with us. what have you been able to learn about this evidence special counsel jack smith has collected in connection with a document investigation? >> thanks, yes thanks so much for having me we have found that the, we have reported that the investigation seems to be looking at obstruction at least as part of it and they have found evidence that trump personally perhaps looked through boxes, these government boxes, after the government with a subpoena asked for them back. that happened in between the time that they asked for the documents back through a subpoena in may and between when
8:58 am
they actually searched his property through that search warrant in august. so that suggests that perhaps he was personally looking through these materials to say did he want to keep some or not we don't know if he took any back through that process, but that is what the latest reporting suggests >> what does this suggest about potential position, special counsel and current investigation, where it's going? >> yeah, i mean, it suggests it moving that they have been doing a lot of work. i know there's a lot of other investigations going on, but it suggests this is moving forward. we don't know when it will conclude but it suggests that they have been moving and they do seem to be building a case on obstruction or collecting evidence to potentially build a trump case on obstruction. >> tell us if you can about the

tick- tiktok of the former president we've been looking at these pictures from mar-a-lago, taking off heading to new york. what are you learning detail wise about the expectations with the travel >> so what we know is this is a separate investigation that he's going to new york for these new york charges what we were talking about before at mar-a-lago is the federal investigation, but what we know is that trump is supposed to be taking off today from mar-a-lago to go to new york because on tuesday, so tomorrow afternoon, he has what we expect to be his arraignment here in in this recent indictment from new york on, and this has to do with the, we believe it has to do with the 2016 payment to stormy daniels perhaps hush money for this alleged affair that is what we think he is appearing for tomorrow, but he is scheduled to have an arraignment hearing tomorrow afternoon in new york. >> thank you so very much for being with us and as we continue

to look at these live pictures from just outside mar-a-lago, he's going to be leaving that gate, crossing that bridge to a very short drive to palm beach, west palm beach airport where his plane is on stand by we've been watching that as well but it's kind of important to take a step back and just realize the historic nature of this just the unprecedented nature of what we're seeing happen >> again, it's a lot of firsts we are going to be seeing a lot of firsts over the next 24 hours. i think at the end of the day, we can only do so much reporting then it's just a wait and see moment i think for this country as all eyes are going to be trained on the building behind me seeing a former president of the united states walk in to that building and be arraigned. we're waiting for the counts to be released. hopefully later on today depending on tha
