to take off. i think it's timely, number one, for takeoff, we're watching the trump parade, as donald trump heads to new york. lifting off to new york for about a two-hour flight to laguardia airport. then, he'll hit that rush hour traffic, but something tells me his motorcade will be able to get through with the secret service fore and aft they will get to the group of protesters waiting for him i thank you, david jolly, and vaughn hill yard, and everyone who has helped us today, of course, we'll have a lot more continuing breaking news coverage all day on this extraordinary spectacle it is. and some would say a sad day in history for all sides for donald trump, the former president of the united states, heading to

new york chris jansing picks up our coverage right now good day i'm chris jansing live at msnbc head quarters in new york city this is where donald trump is headed right now, we're watching from the airport, west palm beach, florida, you saw it right here literally just seconds ago, donald trump departing from manhattan. the start of a whirlwind 36 hours in the city where trump bit his empire and once held court. he's now heading into court, as the first indicted ex-president. former president trump, as we said, taking off, a trip he's probably made hundreds of times, but never, of course, like this. his arraignment, the first of its kind in american history, will take place just over 25 hours from now in the meantime, everything is heightened from the political and legal stakes, to the security across lower manhattan. maybe especially to the anticipation surrounding exactly what's in the trump indictment

itself i want to bring in nbc's garrett haake. charlie savage, "the new york times," and joyce vance. university of alabama and msnbc analyst. joyce, can i get, someone involved in the legal process for a long time, your thoughts as we saw that plane emblazoned with the trump logo, carrying the former president of the united states, to the first ever indictment >> it's not unheard of it in our country to indict political figures. but usually, when they're indicted, even those who fight the charges display some shame and some remorse for the conduct that they've engaged in. what sets trump apart in a very real way is the way he's handling this. he fundraises off of boorish

behavior he in many way celebrates conduct that we're about to find out, whether a jury will believe it's criminal or not so this entire display of theater that trump is going to try to rally around his appearance in court tomorrow is something that trump needed to be guarded against this is private citizen trump. he is not above the law. he needs to face the consequences of the criminal justice system like any other american would this is a very real moment of reckoning in our modern day history. we will find out what our system and what the american people and political structure are made of. >> garrett, joyce is right, this is a moment of reckoning give us the latest of his plans once he arrives where you are in new york >> reporter: well, he's expected to land in laguardia, in a couple of hours, make his way into the nypd motorcade there

and to trump tower, where he's expected to stay the night we don't expect to see him again once he arrived at trump tower then to the courthouse behind me and to joyce's point he'll face the consequences but it won't be like that of any other new yorker who might be coming to the courthouse to face arraignment. we've learned in a source, some with knowledge of the direct process. he will be fingerprinted he will not have a dna swab take he may still have a bit of a mug shot taken and great change has been taken to make sure he's not widely exposed publicly at this time either at or around the courthouse he'll be dropped off at a sidence transin between two government owned buildings, he'll be kept largely out of the public view. when he's in front of judge ron

marchand, who is going to read the charges against him. could be the first time that we learn the charges against him, although i think we'll learn sometime in the morning. and mr. trump is going to make a quick exit from new york city, to try to get back to mar-a-lago to make remarks to supporters. i was interested to learn that he is traveling with virtually his entire senior campaign trust. this is not officially a campaign trip, but i think it speaks to everything what we know how donald trump has in intertwined his political life and personal life. with all of the top aides from his arraignment and turn this moment of legal jeopardy for him personally and one of political opportunity for the 2024 election campaign. >> joyce, to the point we may learn something about this indictment tomorrow morning, what are you going to be looking for that says, okay, this is why alvin bragg felt he could bring this case? >> right so, i guess that will be the big

question tomorrow. did something change that altered alvin bragg's calculus and caused him to seek an indictment in this case? and we really won't know until we see the indictment. of course, it has to be unsealed before it can be discussed in open court so, we know that that's coming it could, i suppose, come today. tomorrow morning is far more likely and at that point, the question will be, is it the charges that everyone is anticipating the falsification of business records that's amped the status of the concealment of other crimes or does alvin bragg is something coming, perhaps something involving david pecker, one of the witnesses before the grand jury and the "national enquirer's" catch and kill team to keep stories out of the public eye or could it be something that none of us have quite anticipated yet. >> charlie, trump's attorneys

keep saying everything is on the taken when it comes to defending the former president what do we know about their strategy, and how much do you think is still up in the air >> well, we've gotten a bit of a mixed signal from some of his attorneys who will say, well, we're going to move right ahead and try to get him acquitted right away maybe this case won't even get to trial but also that they're going to try to challenge everything they can. and they're going to litigate a whole slew of issues before there can be a trial i think that we'll probably see more of the latter that has been donald trump's litigation strategy his entire life he's been involved in numerous lawsuits both as developer and leading into president and of course, he's been the subject of criminal investigation before. over and over again, he goes back to the same playbook which is delay, delay, delay, to try to find any issue he can that can be separately litigated, argued about, briefed, and then

appealed if he loses to run out the clock. in this case, running out the clock would be keeping this from becoming a guilty verdict, if it comes to that. or a spectacle of the actual trial, until we get much closer or even past the 2024 election >> i wonder if you're hearing anything, charlie, between donald trump and this set of attorneys? i've heard joe tacopina literally speaking of the judge, and contradicting his client tacopina said it's too early to even discuss that. is that the difference between one looking at the legal part of it, the other the political? or have you heard anything of disagreements between trump and his team >> we have reported that some members of trudge's team are not particularly happy with tacopina, much how much of that is just the backstabbing type

situation as opposed to something specific about him is still yet to be seen he, of course, is thinking about going into court and arguing before a judge and wanting to have everything most strategically helpful to him in that situation trump always approaches these things as much as being about public relations and sending a political message to the broader public, as about actual argument that might succeed in a courtroom. and i think that's probably the explanation for the gap there in messaging. >> yeah, joyce, trump has been attacking judge marchand online saying the judge hates him among other things the former manhattan d.a. cy vance talked about that on "meet the press. i want to play it. >> i would be mindful of not permitting some other offense like obstruction of government which is interfering by threat or otherwise the operation of government and i thing that could take what perhaps we think is not the

strongest case when you add a count like that, put it in front of a jury and change the jury's mind about the severity of the case >> is he right, joyce? is there a chance trump puts himself in further legal jeopardy i mean, he almost can't wait to get back to mar-a-lago and speak to the american people tomorrow night safer he's arraigned >> so, his lawyers will give him advice that will be very similar to the statements that we heard from cy vance, they will talk to him about the line that he cannot talk. he cannot threaten the judge, he cannot do anything under the oga statute that might amount to interference, with the public official with that whether or not trump can do that remains to be seen he's often his own worst enemy in this regard and much of what is used against him in criminal proceedings, or even in the political arena,

tend to be words that come out of his own mouth so, i think, tonight, we'll be in for a sort of public viewing about whether the former president will be able to muster self-control when he speaks at mar-a-lago it would be a very high barrier for him to cross over into territory where a prosecution would be considered. the same, i think, is true about a gag order, because of the first amendment implications but with trump anything is possible >> so, i also want to ask you something else cy vance said, joyce. part of the critics say that this case could have been brought much earlier but others act it out saying they didn't have the goods but cy vance said actually that's not the reason. here's what he said. >> we learned from the southern district of new york, they asked to us stand down by stand down, i mean, they were communicating they had this ongoing investigation and they wished that we put our efforts

on hold, while they completed their investigation. and so, for the course of probably more than a year and a half, that's what we did i was surprised, after michel cohen pleaded guilty that the investigation from the southern issue did not go forward. >> we should point out that fdny was part of the jurisdiction of donald trump what do you make of what he said there? >> you know, this is a little bit of a bombshell because there's been reporting under bill barr, prosecutors in the southern district of new york were told they could not investigate further after michael cohen pled guilty. that would be consistent with the office of legal counsel memo that prohibited prosecutors from indicting with a memo. and the reporting is that barr

prohibited that. but is utterly mind-boggling here is the apparent contradiction when cy vance was told to stand down with his investigation. it's not unusual for federal prosecutors to communicate with state and local partners when they have a case we like to be complete to make sure that people aren't stepping on other cases federal prosecutions quogo more quickly and there are reasons to let the feds go first when they're occupying that space so it's not unusual that cy vance would step down. he is rightly surprised that the feds don't pick up the case after they plead guilty. there's certainly more answers in this regard >> joyce vance, charlie savage, anthk you both so is trump's plan of turn

one of the big questions for fo tomorrow's arraignment, you just heard joyce mention this whether it's considered a gag order. if so it could be a huge strategy surrounding the indictment which includes plans to speak tomorrow night once he gets back to mar-a-lago. i want to bring in nbc's vaughn hillyard, and robert gibbs from the obama administration and an msnbc analyst. what can you tell us, vaughn, about trump's plans, his campaign plans, to try to take what is definitely a legal challenge and make it work for them politically >> reporter: right, at this point, chris, we're expecting them to arrive back here in

about 24 hours from now, when he will return to mar-a-lago after the arraignment. he will use mar-a-lago, his private club, his private residence, for back drama for the remarks 8:15 eastern time. that's the same presidential bid. and donald trump is trying to make him this a political advantageous event for him he did not want to get indicted. the reality is that's what happened for donald trump two things at once, right? naivety to the general election, not only voting him down in 2020 but voting down trump-backed candidates in 2022 but trump believes he has strong backing in the republican party. if he can force that hand, it may force ron desantis and mike pence to come to his defense in the next 24 hours he's going to do that. there's a quinnipiac poll that

said 75% republicans said if donald trump were disqualified politically, that should not be held against him that is where you see, he's raised according to his campaign more than $5 million since thursday night when that indictment came down and going to expect him to try to make a prime time spectacle of this tomorrow night here, trying to undercut anybody that is in his way. chris, last year, he effectively vanished the likes of liz cheney and adam kinzinger and republicans who tried to come after him in investigation among republican voters, and it worked this time, a little different because he's dealing with the justice system, at the same time, he sees political advantage to beat them in the republican electorate, ahead just a couple months away from new hampshire, south carolina and beyond >> i mean, robert, let's not kid ourselves from the time he came down that escalator, we have

seen donald trump's ability to pull a rabbit out of a hat when it comes to politics, for someone who has never done politics before. do you think he can take, $5 million is not something to be dismissive about, but do you think he can take this and turn it to political advantage? do you see it? >> well, chris, i think it depends on the audience with which you're asking that question about, right? we've seen the quinnipiac poll and we've seen other polls within the last 48 hours that show support and consolidating among support of republican voters and that is, if he continues to run for president, as i assume he will, that's the first door or gate that he's got to get through. the question i have in the republican party is what happens starting tomorrow when the details of that indictment come out. what happens -- how does that age? did it age well?

does it age poorly i think there's a lot of details paying a porn star that aren't going to go over terribly well that conservative, evangelical republican primary voters. they haven't really had to think through this case in a long time i think the challenge for trump, long term, what he does to strengthen hold of his base almost assuredly alienates swing voters and energizes democratic voters i think we've seen the polling show, again as vaughn pointed out, people concerned about having somebody that's been indicted running for president i think, again, what he might be able to maximize with a republican primary audience is almost certainly going to hurt him long-term with a swing electorate a general election electorate, like he would face, were he to be the nominee but i think the real thing is, nobody really knows, we're guessing a little bit what might be or might be not be in this.

i think that will all begin to unfold tomorrow morning as we unseal the indictment. >> one of the things we've talked about, robert, sometimes, we're flummoxed by the idea how supportive the people who are either running against him or planning against him, have been in this fight. but not all of them because former arkansas governor asa hutchinson just jumped in the race and he talked to andrea within the last hour. here's what he said. >> you got to have somebody who has independence to suburban voters i don't think donald trump is that person. we need to say that clearly and campaign on that basis >> is there a win here i know we keep asking this question, but i don't think we've talked about it with asa hutchinson is he the guy that delivered that message >> well, he certainly doesn't appearal afraid to deliver that message. i think that's the beginning of it we've talked about it, chris, i continue to be surprised that

republicans that are running against trump are rallying around trump i don't understand how they think they're going to go and take this nomination from the former president, if they rally behind him and provide the type of support that you've seen. i think what will be interesting, my question is, do people begin to follow asa hutchinson or do they think let asa hutchinson run into the breach and suffer those consequences, but begin to sort of seed the ground for the larger argument that others are going to make. it is really hard for me to understand, ultimately, how somebody wins this nomination without sketching out the deficiencies of donald trump whether it's with swing voters, whether it's with personal conduct, whether it's the conduct of his family or all of those -- all of the above, somebody's going to have to take this from donald trump and if they rally around him, the impact will be exactly what we've seen in some of this

needs to evaluate the strength ever alvin bragg's case to tell them how the evidence shakes out, especially given trump and his allies' penchant for spreading disinformation as with the media, will they express the outcome of the case if they can't see it for themselves as a former prosecutor in the d.a.'s office how compelling do you find that argument >> we as a country have a history of open courts unfortunately, for new york state, our state's highest court, there is a rule that says no electronic media, like tv cameras, can be present in a court where witnesses can testify. and that's a pretty black letter law. no question that it's outdated no question that there's, as you said, a public interest, particularly in a case like

this, all aspects of the media covering a trial but i'm just not sure how judge marchand works around a rule that's so black and white. so, again, nothing to do with how compelling the argument is, unfortunately. you know, there's not a lot of wiggle room, i think >> so, given the fact that there is proposed legislation that is being considered right now, if that doesn't change, what's the best case scenario, in terms of the public seeing, hearing what's happening inside? >> so, the best case scenario, is that in all likelihood, judge marchand is going to grant an application by media organizations to permit still photographs in the court and to have photographers being able to photograph the proceedings. at least the pretrial proceedings. whether they're permitted to actually participate and take pictures actually a trial of witnesses,

that's probably is not going to happen sand it there may be an action that allows cameras to be set up outside of the courtroom but beyond that, for the short term, it's going to be pretty much what you get, unfortunately, in a new york state court, which is under these circumstances, reporters in the courtroom taking notes. and photographers taking pictures, but no actual video cameras or a live feed >> so, as i take you back to the debate going on in albany, eugene, the arguments against cameras in the courtroom have typically been it begs for lawyers and witnesses to showboat it turns trials into circuses. how strong is that argument? >> well, you know, in the general case, i suppose, you could make that argument in this case, this is going to be a circus, whether there are cameras in the courtroom or not. so if there's a trial of donald trump, it's going to be a

circumci circus, and the question is whether we get to see it live or we have to read breathless reports from literally breathless reporters who are dashing in and out, and coming up to the cameras to explain what just happened and it sounds, given the state of the law right now, like that's where we're going to be, unless things dramatically change between now and the trial would start. >> i want to ask you about something else, as we think about the trump logo plane that is flying from mar-a-lago to new york right now you know, trump long considered manhattan kind of his personal triumph. i guess as sinatra would sing, he made it here. now that the associated press points out that the place of trump is delivering its comeuppance. and former donald trump supporter chris christie -- >> all of this from the trump
