it is 10:00 a.m. in new york i'm lindsey reiser i'll be joined by the next few hours with my colleague jose diaz-balart on a extraordinary day in american history. donald trump in just a matter of hours is set to become the first former president to be arrested and face criminal charges. >> here in new york, outside the d.a.'s office, the feeling is that of anticipation protesters beginning to rally. mayor eric adams urging order

ahead of today's history-making arraignment set to begin at 2:15 p.m. eastern the case, of course, stemming on alleged hush money payment to adult film actress stormy daniels. the indictment will be unsealed later today. there are about 30 of them. >> and just like yesterday, from west palm beach, here to new york, every moment of trump's four-mile trip from trump tower in midtown to the courthouse in lower manhattan is almost certain to be exhaustedly documented however, as soon as trump enters that courtroom, it is going to be a whole different story overnight, the judge presiding over the case ruled that no cameras will be allowed in the courtroom during the proceedings. but cameras are not trump's attorney joe tacopina made the plans abundantly clear overnight, signaling the legal fight to come. >> we'll be pleading very loudly not guilty before the judge and then we'll go from there there is zero, zero chance where

donald trump is pleading to anything here. you are at the epicenter of it all what is it like down there >> it is unbelievable, really history in the making. much more so than it was yesterday to say the least the security presence here, jose, and lindsey, is overwhelming if we can show that, i want to walk folks through what we're seeing here. i'm on center street here in downtown manhattan behind me is a street called hogan place, where halfway down the block is where the former president of the united states around 1:30 p.m. or so will be making his way up into the building behind me that's, of course, after he leaves trump tower where we have dasha burns on the ground up there on the upper east side of

manhattan making his way downtown manhattan and that's around 2:15 p.m. and where things begin the security here is incredibly tight. just in front of me as well is the area in which many protesters are beginning to gather that rally beginning around 10:30 a.m. this morning. so we have a lot to get to, a lot of folks on hand to walk us through it our team of reporters and experts with us. nbc news correspondent darren haake is with us garrett, let's start with you. it is quite the beginning of what will happen today, a huge day, right walk us through what we know, and what we don't know about this. >> somewhat befitting of an unprecedented moment we throw that word around, but

it is really true. you laid out some of the choreography of what we know from when donald trump is expected to leave trump tower in the early afternoon, coming to entrance here at hogan place where we saw d.a. bragg arrive once he gets to the building, the choreography gets murky. he'll be processed we suspect he'll be fingerprinted. whether he has a mug shot taken is an open question. he'll come out on the 15th floor, work his way down the hallway where he may pass in front of a television camera, whether he chooses to speak there or not is not something we know for sure right now. he'll be arraigned this is a hearing that could last as little as 15 minutes we'll hear the charges, he'll have the opportunity to plead and he's out of here, trying to get back to laguardia, move quickly on the other side to mar-a-lago to try to make the most of this political moment. i think the other enormous question that we still don't have a good answer to is what is exactly in this indictment and when will the d.a.'s office decide to try to make that public, does it happen during the arraignment itself, does it

happen so mr. trump's lawyers get a chance to look at it the other piece of this that is very telling, we'll hear from d.a. alvin bragg in the afternoon, after the arraignment, the first time he's spoken publicly on this. there has been so much speculation about why he's chosen to take this case, why he chose to do so now, the types of charges he may put together and his response to the attack from the former president all questions on my mind as we head to the news conference in a few hours after the arraignment. >> trump's legal team has been signaling they're ready to fight and they'll go hard. what is the mood in the trump world this morning >> i can tell you right now things are fairly quiet outside of trump tower this is where the choreography will begin as the former president leaves his residence here in the next few hours what we know is that so far he has not yet posted this morning to his social media platform, a stark contrast from yesterday.

he was posting quite a lot pretty relentlessly, late into the night, attacking the manhattan d.a., saying that d.a. bragg should himself be indicted, also going after the prosecutor and the documents case, posting a lot of polls showing him ahead of his rivals and potential rivals in the republican primary in the 2024 election now, the trump legal team as you mentioned, they actually added a new member to their team in the 11th hour here, lawyer todd blanche, who, according to a biography from the firm that he just left in order to join trump's team in a bio removed from the website says he has represented clients who have faced grand jury subpoenas, criminal charges, regulatory inquiries and actions and internal investigations. he spent nine years as a prosecutor in the u.s. attorney's office for the southern district of new york. so, clearly a power player

they're adding as they go into what is expected to be an intense legal battle here, jose. >> well, we mentioned no cameras in the courtroom so we know there will be some still photographs that are allowed before the hearing talk to us about what the rules are for today's arraignment and what did the judge weigh in setting those rules? >> it is all about maintaining a fair trial for the defendant, whether the defendant is the former president of the united states or someone far less -- far less -- it is all about maintaining decorum in the courtroom. the general rule is you don't get cameras in the courtroom given the unprecedented nature of this, a media coalition including nbc petitioned to try to get access to be able to broadcast to be able to use cell phones in the courtroom, and unfortunately the judge did not grant that, but as you mentioned is going to be able to give us those still photographs which will be an iconic image of the former president, seated or standing at council table. that's just at the top of the arraignment, we won't be able to

be able to live broadcast anything that happens at the actual proceeding. >> guys, i want to bring it back to garrett over here we're getting a new tweet in from the former president. we expected this, right? lots of talk in the leadup to 2:15, talking about specifically the venue. >> look, what a difficult client donald trump can be for his attorneys. his tweet is another good example of this. his attorneys did what they could to turn down the speculation they might move for a change of venue. he's talking about the politics of new york city, saying it is not possible for him to get a fair trial here, it should be moved to -- he goes on to attack the judge, not by name in this case, but the only judge we're talking about, saying he's a trump hater, saying he makes accusations about the judge's family having worked for the biden campaign or vice president harris, the kind of thing we try

to fact check in real time i've not heard that before it is also the kind of thing that, i think, if you're an attorney for trump or somebody on his side of this, you wonder about the value of that. is this the kind of thing that -- is it a debate around a gag order or limitations on what he might be able to say during the trial, going after a judge is not something that any court takes kindly to, regardless whether it is a purely political commentary or more incendiary commentary so, another case of the former president inserting himself in a way that perhaps some attorneys may not find helpful. >> and, jose, think one of the major questions and i want to note obviously there is a lot happening behind us, we'll continue to hear folks yelling out, especially as the rally gets up and running here, keep that in mind if you're watching us here throughout the day, i think one of the kind of outlying questions that are outstanding here is, of course, what the -- is there any possibility there could be a real change of venue here when it comes to the trial.

maybe wondering if chuck rosenberg can weigh in on that >> yeah, i'm happy to. so, i think your instincts are exactly right. we tried a 9/11 conspirator in federal court in eastern district of virginia, alexlexand alexandria, three miles from the pentagon, and we were able to assemble a fair jury you're not looking for a jury who never heard of donald trump or stormy daniels or hush money payments you're not looking for a jury or jurors that have no opinions you're looking for jurors who can be fair, who can sit in a courtroom, listen to the evidence and follow the instructions of the judge. that's all you're looking for. and in the city with millions of people, the notion that you can't find fair jurors in manhattan is ludicrous so i think as i said, your instincts are exactly right. the trump team may move for a change of venue. i don't give that much chance of

success. >> and, chuck, speaking of the trump team, trump's lawyer tacopina said all three of trump's attorneys are going to be with them this morning during the arraignment. is that kind of standard operating procedure in cases like this? >> well, cases like this, right, jose, nothing is all that standard but i would say it this way, most defendants don't have multiple attorneys so they don't have multiple attorneys at an arraignment. if you do, sure, they're welcome. it doesn't make much of a diff difference these are incredibly routine, not all that interesting and quite brief. and so if mr. trump wants his entire legal team there today, great, he's more than welcome. i want to just go back to something laura said earlier, it is a really important point. the trial has to be fair and the judge has to make sure that he runs a dignified courtroom and decorum is important. it also has to be fair for the

government we care a lot about defendants' rights to a fair trial, of course, and properly so. but both parties are entitled to a fair trial the defendant and the government and this judge has the reputation for doing exactly that >> let's bring in msnbc legal analyst lisa rubin we know we're expected to learn the charges once this is all unsealed our sources say we can expect about 30 counts here what are you watching for? >> i'm looking for a number of things the first thing i'm looking for, are there any charges here beyond false records charges when the trump organization was indicted over almost two years ago, there were four felony false record counts there. however, the leading charge there was the scheme to defraud. and so one of the things people like me and laura will be looking for are all 30 of these charges predicated on a falsification of business records or is there a larger scheme to defraud conspiracy charge here that sort of is the

near where republican congresswoman marjorie taylor greene is planning to have a protest this hour. also joining us, former fbi assistant director for counterintelligence, frank figliuzzi. ron, to you here, what are you seeing where you are i see a lot of people behind you, but a lot of media. >> yeah, a lot of media. we're in a park across the street from the courthouse over in that direction. on this side you have trump supporters, you can see the red maga hats, you can see the flags for donald trump there is a small determined band of protesters, demonstrators and a lot of media we're in a very enclosed area in this park. the police have sort of corralled people in here and they're trying to keep the sides separated. on that side is trump. if you pan over on the other side over here, past this barrier, there are some supporters of antitrump demonstrators over there you can see the signs saying things like trump jails, we believe stormy daniels, that

sort of thing. we're waiting for marjorie taylor greene to arrive. we haven't seen her yet. there is a press conference scheduled for around -- shortly around 10:30, the bottom of the hour earlier representative george santos arrived, unsure why exactly he was here. he was met by a scrum of journalists trying to figure out what are you doing here, why are you here to support the president, what do you have to say. we tried to stop him here is when we tried to ask him why he was here. listen if you can. >> i'm here to support the president. >> why do you feel it is necessary to be here to support the president? >> because i want to >> so, that's all we got from him. he left and went down the street and said he wasn't coming back again. it is quite a scene out here i've been to a lot of protests, a lot of demonstrations, a lot of gatherings in new york city and this is quite something,

especially because we're in a park, an area surrounded by fencing. a lot of police on the perimeter here some in the crowd. but they got things separated. there is a barricade right through the middle of things, one side over there, the other side over here, this is a place in the middle where they come face to face, but so far it has been peaceful, it has been quiet, but we're expecting it to get much louder as the day goes on >> the new york city mayor singled out congresswoman marjorie taylor greene, when discussing security measures yesterday. take a listen. >> though we have no specific threats, people like marjorie taylor greene, who is known to spread misinformation and hate speech, she stated she's coming to town. while you're in town, be on your best behavior. >> greene responded on twitter saying the mayor was delusional and was trying to intimidate her. how are authorities sussing the

different threat levels that may be occurring throughout the city >> so the things that law enforcement will be looking for today and in the days moving forward, of course, obviously are -- is physical turnout so the numbers matter with regard to who turns out with greene's rally, which, by the way, the new york parks department put out a statement saying this is an unsanctioned, unpermitted event, that gives the police some authority if things go sideways with regard but secondly, if tensions flare up to the point of altercations between trump supporters and anti-trump people, there will be a close look at that if that happens, that needs to be put down by the police quickly because that is going to flare further emotions and then i told people, look, it is equally about what you see in terms of law enforcement presence and what you don't see. because what is going down behind the scenes is a massive

intelligence collection operation to try and pinpoint known violent extremists, whether they're traveling, who is talking, who is chatting on extremist chat rooms and private places on the internet there is an operation going on that likely starts measuring traffic by bus terminals, who is coming into the city, whether there has been people coming all week, flight manifests with the names of known subjects of fbi investigations and then i advise everyone that we're in for the long haul this is just the beginning of what could be a simmering security challenge as trump faces a protracted legal process. not only in new york, but perhaps later in georgia, and then later by the federal government so, this is a marathon, not a sprint, with regard to law enforcement. >> hey, frank, if you will, talk more about that coordination, right. that's what you're drawing down on, incredibly important, i think, to talk about as we're standing here. you're talking about nypd,

you're talking about intelligence gathering and then secret service as well harvey weinstein tried at the building behind me, but how is this different >> obviously we're going to hear the word unprecedented for a long time with regard to the legal challenges trump faces, but it is equally unpress cedend for law enforcement. if i had to pick a city in the country best equipped to handle this, this trial, this ongoing process, it would be new york. they know how to do it and the partnership there is strong the fbi's joint terrorism task force has literally last time i looked maybe 200 nypd detectives, very seasoned, under one roof with fbi and every one of the three letter agencies, state, county, local, federal. secret service layered on top of that adds extra security measures and then this massive intelligence effort across all the agencies, including homeland

security probably also in touch with the social media platforms because they are the first -- the first eyes on what is developing their algorithms saying we're seeing this, but not this, and passing that on to law enforcement, all of this critically important as we move forward. and, look, we're seeing already, we got to pay attention to any attacks on the judge, the grand jurors are already targeted online, who indicted trump and they want -- these guys want their identity, they want the identity already of the jury that is going to be selected in this case. we got to watch that and secure those folks as well. >> well, frank, real quick here, is there a possibility the judge would maintain security going forward if there are credible threats to his life? >> there is no question that i would start from day one with physical security on this judge. >> got it, thank you ron allen, thank you as well

everybody. up until right now everything we know about the manhattan grand jury indictment of donald trump has been largely the product of guesswork. that is all about to change. court watchers, critics, supporters of the former president can put long held assumptions to rest when the indictment is finally unsealed joining us to talk about this and what we can expect to learn in the next couple of hours, ken dilanian and "new york times" investigative reporter suzanne craig. thank you for joining us ken, lead us off, if you will. nbc news, are there crimes unknown to the public? what do we know so far that leaves open that possibility >> yeah, that's the biggest question here, we have been reporting for days on what we believe are the contours of this case the falsification of business records, the improper accounting for those hush money payments to stormy daniels, they were described as legal fees on the books of the trump organization,

that's false everyone agrees that's false so that's technically a misdemeanor, the falsification of business records. it becomes a felony if it was done to conceal another crime and it is widely believed that other crime could be the crime of an illegal campaign contribution under federal law a tricky and complicated business there but the big question really is are there other things that we haven't considered or that we're not reporting are in this indictment there was a whole other parallel investigation into whether the trump organization used fraudulent business practices in a way of valued properties and there was a whole trial about that, and the trump organization as a company was convicted, but no criminal charges have been brought so far against any individuals regarding that, other than the cfo allen weisselberg who pleaded guilty so does any of that bleed into this indictment? has the d.a. decided to add any of those issues to this indictment there is another hush money case that we don't talk about as much, but involving karen mcdougal, remember the national

enquirer, the publisher paid $150,000 in a catch and kill scenario to make her story go away around the time of the election and the federal election commission decreed that was an illegal campaign contribution. does any of that get into this indictment those are the big questions and then i guess one other question is there anything we haven't considered that isn't even on the list that's what we'll be watching for. >> what are you going to be looking for? there are so many potential issues that could be included in here, there could be very few issues included in this 30-plus indictment what are you looking for >> well, i think one thing when you have an indictment come down, they're technically bare bones. they lay out all the elements required to show that the elements of the crime. and in this case, and i think this is probably what bragg is going to go, you're going to have more of a speaking indictment, reads more like a story and they'll lay out in

detail what happened we saw that with allen weisselberg in the trump organization there was a lot more detail in it and that is sort of what i'm wondering they're going to do. alvin bragg, he's heading into a bruising fight and he has to prove this case. if he does go that route, it is going to be fascinating to see the details of it. we know there was a hush money payment and that legal fees were allegedly improperly accounted for. what company were those -- where was that in the books? trump has a number of companies, where was that put off things like that are what i'm going to be looking for. it is the story, you know, of this case and then what corroborated the evidence do they have. we know michael cohen is going to be a key witness. whether the records, the telephone records, the bank records, all the documentation that they have, i have a feeling they're going to be laying that out and that's what i'm going to be looking for today. >> you had the distinction of

meeting trump's legal team in court, sued for $100 million over reporting on pieces of his tax records. few have taken as deep a dive into trump's financials as you have do you expect his tax records will come into play, and if it is a speaking indictment, the story you're talking about, how much detail will we see about that >> i think that the tax records may touch on it, i think the real details are more the corroborating evidence, the documentation that they need to show, things like michael cohen, when did he talk to donald trump in the days surrounding this, is there voice recordings, are there just phone records, did michael cohen or others who were in the middle of this and who knew about the payment, did they text other people and did they talk about it with other people, say their spouses, their kids, their friends, when you're going through this in the middle of the campaign, you may send a note to someone saying you're not going to leave what just happened

manafort and igor thuman he made the decision after much thought and consideration and that it was, quote, an opportunity i should not pass up back here with us now is nbc legal analyst lisa rubin and former prosecutor charles coleman. thank you for being with us on this historic morning. the fact that someone would, blanche specifically, resign from his firm to take a case, is that unusual what does that tell you? >> it says a lot, but i think when you're talking about attorneys it is not necessarily what we say, but it is what we don't say. i think that's the interesting thing about his decision in this case to leave his firm in order to represent donald trump. the fact he's hired a beefed up legal staff at this point is not necessarily anything to be alarmed about, particularly when you look at his background and look at the different things that blanche has done throughout his career he is the guy for the job. the federal experience, the white collar experience and the combination of those things are something that donald trump doesn't necessarily have at the

level that he may need not only with his case in manhattan, but also with the other different investigations that he's dealing with at the federal level. >> trump has been outspoken about the judge who has been assigned to preside over this case, juan merchan he says the court hates him. he has presided over two tax fraud cases involving trump's real estate firm, involving allen weisselberg. how is a judge chosen for something like this? >> judges generally are chosen to preside over an arraignment the new york court has a spokesperson who said judge merchan was chosen for this at random and the new york court system, the arraigning judge typically follows that case to trial. so, here, it may just be an accident of the draw >> hey, guys, quickly. i'm sorry, i was looking over to my right for a moment, there was a lot of activity going on
