diaz-balart, and there are many people out there, including george santos, and marjorie taylor greene who per your reporting last hour showed up for a couple minutes surrounded by a lot of press. >> reporter: i was on camera with you guys and her suv pulled up and she was literally incased in press as they followed her into the park. i couldn't make a guess of how many folks were there. she was in the park for maybe five or ten minutes or so and then exited the park after a lot of commotion inside the park george santos was here as well and he was run out of the park we are three hours away from the beginning of the arraignment, about 2:15 eastern time, and we are expecting the former president at the united states to leave his residence, trump

tower, and likely to leave around 1:00 or 1:30. he will have security with him as he makes his way down here. more barricades behind me beginning to go up as i take a look behind me, you see all of the barricades were recently put in place, and more security in place as well, and then behind them barricades as well hogan place, that is the street directly behind me that's where the former president is going to be making his way into this building right here on my right, about halfway down the block so we will wait to see that there. initially we thought they would erect tents there, but there are no tents in place and it's likely we will see some portion of the president or his motorcade entering that area with us to talk about this and the expectations of the day as it plays out, msnbc

set for 2:15 eastern time. overnight we learned some of the specifics about how it's going to look, what the public will be able to see, and the judge in the case ruling there will not be video cameras in court but for a brief time there will be still cameras to be able to take still pictures, and there are cameras outside the courtroom, and it's unclear potentially the former president might make a statement before he heads in, and that could be the first indication we get as he goes in. before that we expect the former president to show up here. you see, as you mentioned, the streets are blocked off. after being here for several weeks, this is by far the most security and attention we have seen placed here, not just the security barricades or the assembled press, which there are certainly many of them, but a lot of new york police officers. a lot of attention here as the arraignment hour draws closer.

against him, and they are yelling and screaming at each other back and forth, and it's getting louder and louder. you can see there are police officers walking through the middle of it there have been no arrests or signs of any disorder, but when you talk to the trump people, they echo the things the president has said about how he can't get a fair trial, how this is a democratic city and they think they are here to support him. on the other side, of course, they think that an indictment is long overdue in addition to the republican officials that have shown up here, george santos as well as marjorie taylor greene, and on the other side there are a number of democratic politicians from new york who are here to show support for bragg, who received a number of death threats, and they are here to uphold the honor of the new york justice system. it's getting louder and louder

if you pan this way, you see a lot of trump supporters, and behind that is the street where trump will arrive, and where you are, that gives a sense of context and a vantage point. it's getting louder and louder a lot of media, protesters, and a lot of people that work here that are curious of what is going on it's a beautiful day, and quite a spectacle here in new york city >> what is donald trump going to be experiencing when he walks into that building, the d.a.'s office >> first, i am looking at that and i am shocked i was there for over 30 years, and never saw a scene like that. >> in 30 years >> in 30 years i am think about my caolleagues who are still down there and probably took the day off, and never saw it in 30 years, and even on 9/11, there were a lot of people and it was eerie

proforma, that will occur when the prosecutor is told please file and serve a copy of the indictment she or he will file that with the court and hand over the copies of the indictment to the defense attorneys. he will be formerly arraigned and assuming his attorneys decide not to give a big speech, they will request an adjournment so they can file motions -- >> how long does that process normally take? >> less than five minutes. less than five minutes it's very quick. any drama that will happen will happen outside of the courtroom. i can't imagine, even though it's donald trump, that he will speak. 99.9% of the defendants say absolutely nothing the only ones that speak are the ones that have issues and outbursts, so -- he won't speak. it will be his attorneys speaking it will be less than five minutes. >> as we continue to watch the live pictures, they are playing out here outside the courthouse. this is a complex case, and

given the nature of the case and who the defendant is, are you expecting a long detailed charging document, or are you expecting more of something like a speaking document, like a bare bones document >> normally you can see an indictment, a narrative, a story provided by the prosecutor to explain the facts, how did we get here there are media reports that there are 34 felonies in the indictment, and we don't know what they are and will have to wait until the afternoon we have seen the players, and in this instance, once this indictment is unsealed we will be able to see the specific statutes in the state of new york that bragg has alleged to have been violated by donald trump, and most importantly, what is the second crime, what

the focus of the trial that will ensue the timing of that, and when you were mayor, the black lives matter protests were ongoing in the city, and there were missteps by the nypd themselves what do you make of that and how do you avoid something like that going down over the next 24 or so as we have protests here in lower manhattan? >> on the first point, i feel there's a form of justice here that the place where donald trump is being held accountable is the place he evaded accountability many times before new york authorities were on to a number of other issues of donald trump as a private citizen for decades and never followed through, and bluntly, his power and wealth and connections probably had something to do with that. there's something powerful about being called to question in his hometown

how did the judge end up assigned to this case? >> a court spokeswoman said he got this case because he was assigned at random to over see the grand jury that indicted him. he is serious, smart and even tempered and brings to the job a set of life experiences much different than those of the defendant set to be arraignment before him today he was born in columbia, and moved to the united states when he was six and grew up in queens he got his first job carrying groceries for tips when he was nine years old he earned his way through college, and became a prosecutor in the manhattan d.a.'s office and later the state attorney general's office, and then bloomberg appointed him to the family court bench in 2006 and he was named a felony judge three years later. he is known as a judge that treats witnesses and defendants

inside gop circles about how to sharpen the tone from some of his potential rivals in terms of a timeline could we see this during the debates? that's going to be an opportunity for some of the candidates to define themselves more clearly and take the gloves off a little bit as you know, going after trump is risky, and his poll numbers only increased in recent days. there's no guarantee this will happen, but it's a distinct possibility, again, because of 2016, there's a lot of concern about repeating those perceived mistakes of the past you will see them make the argument that in a general, he holds a lot of baggage, particularly if we see more indictments, they will try and make the case that he just has too much baggage to be an election candidate >> we have no idea what things will look like, josé, inside of a year from now. >> thank you i want to continue our

conversation and bring in a democratic congressman from california, a member of the house oversight committee. appreciate your time what is your response to the president's comments surrounding this case? >> josé, i agree with the president that the law enforcement process will play itself out i have faith in that i hope we don't make the same mistake in 2016 where we just start covering trump's trial and trump's scandals and we focus still on the school shootings in tennessee and the president's message of bringing manufacturing jobs back and lowering prices, and that's what the american people want to talk about. i fear if this becomes a trump spectacle 24/7 on cable news, he will benefit the same way he did in 2016. >> congressman, i do want to talk about what is happening behind me, because the manhattan d.a., alvin bragg, dismissing

questions from your colleagues seeking more information about the investigation. it seems like where the republicans in the house are committed to interviewing and seeking testimony from folks like the manhattan d.a. along with, of course, folks inside the biden administration >> that's going to back fire on my colleagues on the oversight committee. my seven years in congress i never once spoke out about what the local district attorney in my district should do, whether he should charge somebody, not charge somebody on a case. members of congress should not be commenting or interfering in the legal process and let it play out if the former president is not guilty, i have faith in the process that the judge, the jury, that process will play out. i guess if you believe in the american judicial process, let it play out. members of congress don't add anything by intervening. >> congressman, the process may play out with this request

itself, which the d.a.'s office has called it an unprecedented inquiry into a local prosecution. are you concerned, in, in fact, we do get to the point where alvin bragg is spelled to testify that it sets a press department neither political party would want >> i am concerned that congress could try to influence any prosecutor, whether that's a d.a., whether that's a u.s. attorney that should be a separate branch of government. we learned this in elementary school, there are three separate branches of government, you have congress that makes the laws, and you have the president and executives that enforce it and then a separate judicial branch and let them be separate the process -- i believe in the process, i believe the president is -- so far he is complying with the process, and he will get to make his case, his lawyers will make their case and i believe justice will be

welcome back 54 past the hour as we finish up, we want to take a moment to reflect on this historic nature of what's happening today as we witness a critical moment in this country's democracy and our history. in just over two hours from now, former president donald trump, the only president to ever be criminally charged, will appear in front of a judge to be arr arraigned. i want to bring in jonathan alter to talk about this expand on this moment for us we are awaiting the arrival of donald trump in two hours from now. >> as everybody knows, this is totally unprecedented in our history. but it is not out of character

for our history. i think it's really important to understand that what's happening today is very much in line with what the founders envisioned so they had provisions for impeachment for dealing with crimes that were commitedted bya president in office. they very much believed that because we don't have a king in this country that when you leave office, you are subject to the law like any other person. in the constitution, they have these provisions for fair trials, for the right against self-incrimination so donald trump can exercise his fifth amendment privilege if he wants. there's nothing in there that says, you are not supposed to prosecute somebody after they leave office if you have

indications that crimes have been committed so for the republicans to say that this is somehow this crazy thing that we are interfering in a presidential election, we should let the people decide, not have the courts decide, that's the unamerican argument all over this country for decades, literally hundreds of years, local prosecutors have gone after politicians who are seeking re-election or even in public office for crimes they believe may have been committed. so what alvin bragg is doing is very, very much in the american tradition. >> jonathan, there have been times in which presidents have come close to this moment. some in recent history how do you reflect on this moment and its impact? >> so probably the best

comparison would be former president nixon who in 1974, after he resigned office, was under criminal prosecution his successor, president gerald ford, pardoned him that was very controversial at the time and has continued to be controversial. that was a decision that was within the power of the president. i don't think anybody is expecting, you know, any kind of -- first of all, these are local crimes so president biden's pardon power wouldn't even be applicable here. i think the larger point in recognizing the history making nature of this is that this is just the american system working as it was intended to work, which is to give the defendant

the presumption of innocence, to give him a fair trial, and to let justice proceed without any intervention from another branch the people who are really out of order here are the members of congress who think it's somehow their role to intrude on this local prosecution. >> jonathan alter, thank you so much appreciate it. seven years in the making when the alleged hush money payment was initially made i think we're going to remember where we were at the moment in which you saw the former president of the united states, donald trump, walking into that courtroom behind me, which is happening in about two hours or so after he makes his way from trump tower on the upper east side on fifth avenue the press here, it's unbelievable i'm sure around the world folks are going to wake up tomorrow morning with a picture of the former president of the united states on the front cover of
