right now china's president xi jinping is hosting a state visit for france's president emanual macron, and it's not a visit they want to upset diplomatically, so there is the kperktation there'll be continued tension over this perhaps into next week >> thank you for your reporting. that does it for me this busy hour i'll see you back here tomorrow. jose dias reports start right now. and good morning i'm jose diaz-balart this morning new fallout in the political universe as trump goes from former u.s. president to criminal defendant after being arraigned in a new york hush money case we'll break down the unsealed indictment and the legal questions that remain still to be answered. democratic congressman bennie thompson who was the chairman of the january 6th special committee will join us

with more. >> happening right now in missouri search and rescue efforts are happening as a massive tornado ripped through the state. plus, what you need to know about what's being calleded the most consequential election in the year liberals have a won of the supreme court in a major battleground state that could shape the 2024 race. and in chicago a win for progressives in the highly watched mayoral race and just hours from now a high profile meeting between house speaker mccarthy and the president of taiwan despite warnings from beijing. how the chinese government is responding coming up this morning former president donald trump is plotting his next legal steps one day after becoming the first american president ever to appear in court as a criminal defendant. trump is accused of falsifying
8:02 am
business records as part of what prosecutors say is an illegal conspiracy to undermine the 2016 election manhattan district attorney alvin bragg says hush money payments were made to two women and a former doorman of trump tower to keep potentially damaging stories out of the news >> that is exactly what this case is about. 34 false statements made to cover up other crimes. these are felony crimes in new york state no matter who you are. >> hours after he pleaded not guilty in a new york courtroom, the former president lashed out at the investigations and the investigators in a speech at his mar-a-lago club in florida trump's comments came after the judge asked both sides to, quote, please refrain from making comments or engaging in conduct that has the potential to incite violence, create civil unrest, or jeopardize the safety

of any individual. one of trump's attorneys defended his comments on the "today" show earlier today >> it's not an attack on the judge or certainly his family. no one is suggesting anything should happen to the judge or his family, and president trump's comments did not in any way, shape, or form incite violence joining us now vaughn hilliard, gabe gutierrez, susan, republican strategist and msnbc political analyst, and charge coleman, civil rights attorney and also msnbc legal analyst gabe, you were able to watch what was going on in that courtroom from a room right beside >> we were in that room right beside that courtroom and were able to see a head on video feed of all the president's actions it was just incredible do see the former president of the united states facing these charges plead not guilty in his own voice. now, we walked through heavy
8:04 am
security to get into the courthouse on the first floor there's a metal detector, another metal detector on the 15th floor as the president walked into the courtroom he was flanked by those secret service agents. it was just incredible, and this arraignment, jose, we expect it to be 5, 10 minutes or so of formality even it was nlgunlike any arraignment i've ever seen donald trump's defense counsel even jokingly said as much when he got up to speak because the prosecution started blasting the defense -- the defendant for making these comments that potentially according to the prosecution could have jeopardized those proceedings. the comments before, it threats as they saw it to d.a. alvin bragg as well as to the judge. that was a huge back and forth with that. they also bought up the potential for conflict of interest and joe tacopina and
8:05 am
allegations he may have had conversations with stormy daniels. tacopina for his part came back and said he never spoke with her, never took on her case. and then they discussed the proceedings and what's to come, motions, discovery over the next coming months. and then the prosecution wanted the trial date of january 2024, right smack in the middle of a heated presidential election donald trump's lawyers said that's not really relitzic we'd like a little bit more time, potentially into the spring all of that, this proceeding lasted a little more than hour, jose >> from that proceeding the former president left, got out at ludpardia airport and went to mar-a-lago that's where exactly vaughn hilliard was you were actually inside mar-a-lago when the former president spoke last night how was that >> reporter: right, just six hours separated his arraignment in lower manhattan from his
8:06 am
arraignment. for donald trump so much of his address was not only hitting this particular case but the special counsel jack smith's investigation, fani willis' in fulton county. for donald trump it's the lack of defense from donald trump on specific allegations or the specific statement of facts that were laid out by alvin bragg in that indictment yesterday. instead there was a broader attack on the near prosecution of him, suggesting that the charges are being brought against him for political purposes i want to let you hear from donald trump himself we play part of these remarks for the purpose of understanding millions of americans were tuned into this on various right-wing outlets here last night, and that this is their version they are hearing from donald trump. take a listen. >> everybody said this is not really an indictment, there's
8:07 am
nothing here my lirs came to me and said there's nothing here, they're not even saying what you did the criminal is the district attorney because he illegally leaked massive amounts of grand jury information which he should be prosecuted or at a minimum he should resign. >> reporter: now ultimately it'll be up to the prosecutor alvin bragg to lay out his case and it'll be up to a jury whether to convict him or not. but what you heard from donald trump last night was a pure attack on the character of the prosecutor and an attack on the judge overseeing his case suggesting he's trump hating there is no evidence of that donald trump suggested the judge leaked and there's no evidence of that. so many of the statements and attacks being brought by donald trump are not on the actual merits of this case here but
8:08 am
more so the individuals and the mere existence of the investigation and prosecution and potential trial ahead for him. >> gabe, the judge didn't issue a gag order and said he wasn't inclined could this change in the future? >> well, the prosecution didn't ask for a gag order here but did bring up the possibility of some restrictive protective order when it comes to perhaps preventing the former president from posting discovery, evidence in this case on social media as the defense team will have to get that evidence over the next coming months. i want to point out something, jose, down there in south florida. the former president, if we thought he was going to calibrate his message at all based on the judge's comments last night, he did not he went after d.a. bragg again, went after the judge again as well as his family, and donald trump's defense team is trying to make the case he's not inciting violence, he's just defending himself from what he views as a political persecution. now, the judge said in that
8:09 am
arraignment, in that court proceeding he asked the defense team to please do not engage in words or conduct which jeopardizes the rule of law particularly as it applies to proceedings in this courtroom. so the judge walking a very fine line here, jose. he was very measured i heard him inside the courthouse i wouldn't say he admonished the former president, but he did tell him essentially to be careful. he says he would not issue a gag order at this time even if it was called for but going forward he said if something came to him, if the former president said something -- he said this for both sides, but he was actually pretty much addressing the defense counsel, he said it's something that might be considered in the future and whether former president trump in his view crosses that line and the judge does issue some sort of protective order, some ort of gag order in the future >> d.a. alvin bragg said the charges are all felonies however
8:10 am
falsifying business records can be a misdemeanor you and i have been talking about this for days and weeks. it can be raised to a felony if the act was committed to cover up another crime >> correct >> the d.a. says it has to do with the new york election law, but the crime was not mentioned anywhere in the indictment you've studied it, read through it what do you see there? >> this is where a lot of people have had criticism of alvin bragg and how he's chosen to go about this prosecution in most cases as you said when you have this sort of crime you're alleging, the falsified business documents, what you need is another crime in order to get into a felony to basically say you were falsifying business documents in order to conceal this particular crime, this second crime the bare bones of this indictment, which is not a surprise, by the way, to be issued by the manhattan d.a.'s office does not specify what that crime is. there's nothing that says it should or has to specify, but i
8:11 am
do think in a case being so closely watched it is to alvin bragg's credit he should have or would have actually talked about it he discussed it a bit and teased it during his presser. but the fact in the indictment in black and white, it concerns me, jose the thing about donald trump i find to be interesting and troubling at the same time is that the most offensive things that he does are usually not illegal. and the most illegal things he does are usually not offensive this case is not a hugely surprising and shocking case this is not the case of the century, but he did apparently break the law, and alvin bragg as the manhattan district attorney has an obligation to do his job and uphold the law here in new york city >> susan, there is no doubt that politics is either in or certainly around everything that donald trump does and that which is happening to him. how is this playing for him? >> well, think of this as a
8:12 am
dress rehearsal in that he's probably going to face other indictments. so he is attacking the judge as of course only donald trump would until maybe early may if georgia comes out with an indictment then he'll move onto that judge. politically all he's trying to do are two things -- keep his base energized i should say three things. have them give money and most of all donald trump could say something against the judge on social media and no he runs the news day and ron desantis can't do anything because he's on a book tour and he can't break through, so politically that's how donald trump works. he looks as them as pr and political problems >> charles, going forward in the
8:13 am
new york case what exactly do you think we're going to be seeing going forward >> i think we're going to see a different of maneuvers by donald trump's team up to and including a motion to dismiss at least just one and likely a motion seeking to change venue. now, i don't know either of those motions will be successful, but what they will do is elongigate that time frame we're talking about in terms of where we're going forward and when we get to see this case reach trial. i don't think there's are the only two motions we're going to see. i think we're going to see a bevy of different emotions as we go along, and i imagine they'll be strategically timed so they're not one way after another in a way going to have the effect of lengthening the duration of this prosecution that puts it square in election season which apparently is one of their goals >> i can't tell you how nice it is to be with all of you

the driven snow, and all we're just trying to get to the bottom of what's wrong. i've never known a house committee to attack a district attorney for doing his job and in this instance this has been going on as you know a citizens grand jury found that donald trump had committed a fault, an error, so they recommended an indictment. but i'm more concerned about the fact that as a member of congress we've now gone into uncharted territory. we're now moving toward telling an elected official how they should do their job. i don't think, jose, anybody in their right mind -- we know
8:20 am
donald trump paid the money. we know there were circumstances around the payment of the money, so it's no -- it's not a question of did he or didn't he. but my republican colleagues are somehow saying because the district attorney is doing his job, that's not right. so i think starting in december when they have to come back to court, a lot of things will become clearer by then >> yeah, you know, it is -- it's interesting because it's been, you know, mostly focused on mccarthy and what he's been saying and a group of chairs of the house. but, for example, trump critic republican senator mitt romney had this to say. he said, quote, the new york prosecutor has stretched to reach felony criminal charges in order to fit a political agenda, the prosecutors overreached, that's a dangerous precedent for criminalizing political opponents and damages the public's faith in our justice
8:21 am
system i think, congressman, it's the necessary faith in justice system that are one of the pillars of a democracy >> absolutely. and as you know guilt or innocence will be determined by citizens in this democracy and so the prosecutor can present his case donald trump will have his day in court and he'll present his defense, but i think for my colleagues to get out in front of this like they are, is they're disingenuous to our system of jurisprudence in this country. so what we have to do is let the evidence defend itself i'm convinced that donald trump will get a fair trial. i'm convinced that the evidence
8:22 am
will determine guilt or innocence and that he'll be judged by his peers. it's not an intimidation process. i'll tell you i am concerned about the language he continues to use with respect to the prosecutor, with respect to the judge, with respect to the judge's daughter that's not the kind of language that you would expect a former president of the united states to be doing. he's been admonished by the court to tone it down. i suggest that he does but more importantly some of his same rhetoric i saw develop during january 6th, so the potential for somebody to take donald trump at his word and some of the other members of congress at their word harbors potential danger for the rest of us in this country >> and congressman, i want to turn to your district, mississippi is still picking up the pieces after that violent

8:31 am
abortion law that is on the books and in effect since the overturning of roe that's why you have so much attention on this race and record amount of spending on this race and that's why it's so contentions to this very end i want you to listen to what we heard from both candidates during the speeches last night >> my opponent is a serial liar. she's disregarded judicial ethics she's demeaned the judiciary with her behavior, and this is the future that we have to look forward to in wisconsin. >> today i am proud that we are going to be able to live up to our motto. our state is taking a step forward to a better and brighter future where our rights and freedoms will be protected
8:32 am
>> going back to that abortion issue, i'll tell you that is something that voters at polling locations yesterday if you watched any of the campaign ads, that was an issue that was central to this campaign, protasiewicz saying she saw that as a key value but she said that was one of her core values, a woman's right to choose and you see how voters reacted with a pretty sizable win in this battleground state. >> so, steve, what did you see in these two races >> it's interesting, picking up on those themes. we talked last november when democrats had that better than expected mid-term election, about two factors potentially driving that, donald trump his claims about the 20 election being center stage and a voters reacting to that in a lot of states and obviously the abortion following the supreme court's decision last summer overturning roe v. wade. and you heard in the reports there the democratically aligned candidate and technically this was not a democrat, republican
8:33 am
election the democratic candidate said she was going to rule in favor of abortion rights if elected to the court here, and republican aligned dan kelly you heard him saying he says he was smeared, but what democrats were saying about kelly they were playing up abortion and playing up what they said were his ties to trump aligned efforts to overturn results of the 2020 election in wisconsin, one of those states the trump folks targeted with their lawsuits and i think what's striking some of the patterns that we saw nationally last november that gave democrats that better than expected night, they were very much in evidence, this 10-point victory. for instance take a look at deign county, this is where madison is this is most liberal county in the state of wisconsin here. no surprise protasiewicz wins it, but two things one, her margin here she actually outperformed joe
8:34 am
biden. she did better in the state supreme court last night than biden did against trump in probably the most liberal county in the state the other thing is the turnout coming out of deign county, the interest among college educated liberal voters massive she's gotten 197,000 votes, protasiewicz did out of deign count a. the formula for democrats out of wisconsin historically is they get the most from milwaukee and then from deign, but 179,000 in deign from protasiewicz and take a look at milwaukee county, 170,000. she's going to get more votes, and that's a big shift in the state. then there's the traditionally republican suburbs right outside of milwaukee, one of them i'll show you right here. this has the highest concentration of adults with college degrees of any county in wisconsin, and it exemplifies what we've been talking about nationally with suburban
8:35 am
counties with high degrees of college education, college degree attainment moving away from the republican party, so kelly, the republican aligned candidate wins it last night but that margin is only 4.5 points take a look at the journey ozaki county has been on trump won it by 12 in 2020, trump won it by 19 in 2016 back a decade ago mitt romney was winning this county by 30 points it's come all the way down last night to not even 5 points by the republican aligned candidate. you're seeing incredible enthusiasm from liberal voters, and you're seeing a continued shift, a continued erosion from republicans in those suburban areas. we talked last november nationally seeing this in a number of places and the question was, was it abortion, was it trump, was it a combination of those things? you can decide for yourself there, but i think those two factors were very much in evidence in this result last night in wisconsin and were very much in evidence last november when democrats had a better

8:42 am
