reid wiseman added we can see the artemis 2 mission take off late next year that does it this hour, our coverage continues with alex witt right now ♪ very good to be with all of you. i'm alex witt in for katy tur. we begin this hour in tennessee where any minute now the state's republican-led house will hold a vote to remove three democratic lawmakers from office. those lawmakers are currently making their opening statements. you see one of them right there doing so state representatives gloria johnson, justin jones, and justin pierson participated in a protest on the house floor where they held signs, led chants demanding stricter gun laws. the protest was in response to last month's shooting at a nashville school that left six dead, including three 9-year-old students those three democrats were stripped of their committee assignments, they were hit with three separate filings for their

exp expulsion. it is a step that the tennessee state house has only taken twice since the 1860s, the first being a removal for the representative for accepting a bride, the other over allegations of sexual harassment, serious crimes both of them, compared to the quote disorder and dishonor that these three democrats are being accused of we're going to talk about the precedent their removal could set, and if other republican chambers could be following suit just moments ago, democrats inside that chamber slammed a move to show unseen video from the day of the protests ahead of the vote. >> if you're showing a video where we're in the thrust and heat of what was happening that day, you're going to go right back to how you felt that day. that does not give these men and women a chance because you have those same feelings that you had then, it's a done deal it's a done deal that's not fair.

that is not fair and then they have counsel, and they didn't know anything about it that's called an ambush. sneaking behind the bushes and hitting somebody in the head with a brick that's not fair. we shouldn't do our members like that >> more than 250 legislators across the country are condemning the proposed removal in a letter first shared with nbc news, they slammed today's move as an anti-democratic attempt by republicans to quote silence elected leaders on an important issue. hundreds of protesters have gathered outside the tennessee state capitol. i'm going to be joined by one of the many organizers in just a moment, but joining me right now is nbc news digital political reporter adam edelman. adam, bring us up to speed on what is happening in the state house where the vote is expected to happen, i guess, any time now? >> thanks so much for having me. yeah, right now, one of the lawmakers who is facing

expulsion, his 20 minutes to defend himself, basically there's going to be three resolutions that will be voted on, one against mr. jones, one against representative gloria johnson, and one against representative justin pierson. they were the three democratic lawmakers that, you know, you've shown video of who protested last week, who joined protesters in their calls for stricter gun safety measures in tennessee following the terrible shooting in nashville but basically these proceedings essentially amount to a trial, and what you see here is representative jones defending himself ahead of a vote that is all but certain to expel him this afternoon. >> it's pretty extraordinary i'm curious what happens next if these three are removed, adam? is it temporary? do they lose the remainder of the terms they were elected to serve? can they run again >> so they're immediately

removed, and then the county commission in each of the counties who these three representatives, you know, represent, mr. jones represents parts of nashville ms. johnson represents parts of knoxville, and mr. pierson represents parts of memphis. county commissions in those areas will select an interim representative to fill out the term until governor bill lee who's a republican announces an special election he has 30 days to do that. once he announces it that election has to be scheduled 90 days from that announcement all three of these lawmakers can run in the seats they have been exp expelled from. >> okay. that is good to know i'm looking at the break down, 72 republicans, 23 democrats this is according to the line on the party vote it really went down as to whether or not to expel these. that vote was taken earlier this week tell me about the heavy presence of republican versus democrat in

nashville, and if there's any expectation that any sort of gun control law would be brought to that floor anytime soon. >> as you pointed out, the vote so far to sintroduce the measurs of expulsion have fallen along party lines. to expel a member, you need a super majority, the 72-23 breakdown, you explained earlier is more than enough, 7 votes more than the super majority they need to carry out these actions. as far as gun control goes, you're not going to see anything meaningful in the tennessee legislature. there have been a couple of calls for panic buttons in public school classrooms, but when it comes to anything that might make it more difficult to carry a firearm or carry a firearm closer to a school, no

such proposals are going to see the light of day in nashville. >> okay. thank you so much for that as we look at one of those defendants literally now making a case for himself to not be removed. joining me now msnbc anchor, lindsey reiser who was in nashville last week covering the covenant school shooting i know you spoke yesterday with one of the three targeted lawmakers, that being representative justin jones. all three of them are calling this a republican distraction from the actual issue which is guns >> reporter: yeah, in fact, alex, good to be with you, justin jones, who is making the case for why he shouldn't be expelled from the body said a lunc lynch mob assembled to lynch our democratic process we have a lot of loud voices, unbecoming of the house, deserving of expulsion this has happened three times in both chambers since the civil

war. it's an extraordinary step we have people on the other side one lawmaker said, look, i don't condone what they did, i don't think that it was appropriate. at the same time, he didn't think it was deserving of an expulsion. he thought, as you said, basically the example of silencing the opposition we did see the house vote on measures to address safety, things like school resource officer inpublic and private schools. to address the fact that a new build of a school needs to have a vestibule, two points of entry at each school that would be locked so somebody couldn't walk right in we have, for example, the rally organizer last week, when this all went down with the bull horns, what we're exactly talking about today, she told me this is a band-aid on an issue she said we shouldn't be talking about things like more guns in classes, we should be talking about the root cause here in gun control. we know the democratic caucus yesterday unveiled a series of proposals, including red flag

laws they want to ban assault weapons. that doesn't jive with what we're seeing in the super majority here in tennessee we're seeing the governor want to add more funding to, for example, behavioral specialists in schools, and again, those school krresource officers, but nothing to talk and address about gun access in the state right now. what we're going to see is this lawmaker talk about why he shouldn't be expelled, and then they're going to vote on the resolution, and then we're going to hear from each of the other lawmakers here we should note, alex, they can run again, and so after this happens, we expect these members to be expelled just simply based on the math, it just requires a 2/3 majority which republicans have and then some, the governor has 30 days to set a special election, but they can go back to their home districts and run again. . >> it's extraordinary. we're going to take a listen quickly. we see the state lawmaker, that being justin jones, and he's just grabbing a sip of water as he's trying to make a case to

not be expelled. the math is certainly against him. we want to listen to the statements that he makes, and see how he proposes to stay there in that legal body there let's take a listen. >> this is unprecedented not just for our state, but it's the reason why states across this nation are sending letters condemning this body the white house is talking about what's happening in this body because what tennessee is doing is a power grab of ousting three lawmakers, your colleagues, simply because you have the numbers to do it if i didn't know this was happening to us -- >> really interesting that we dipped in right there where he talks about it being a power grab to expel colleagues that they don't want to have among them that is extraordinary, lindsey it is a precedent-setting move potentially. how concerned are folks about that i mean, could there be a domino

effect with other republican-led chambers that are literally silencing and removing lawmakers in this case, those that are just demanding legislative gun reform. >> reporter: i talked to a state senator just across the hall here in the house chambers, about the precedent this could set, regardless of who has the power at the time, democrats or republicans. of course republicans have had the super majority let's listen to what senator yarborough told me earlier this morning. >> what's going on today is a disproportionate and dangerous precedent. typically expulsion from the tennessee legislature has been reserved for the most egregious offenses, not even when people are indicted by convicted of felonies that is when there has been traditionally expulsions in tennessee. because three members in the midst of a gun violence epidemic and national tragedy joined with

protests to demand change, that is a abhorrent reason to consider removing them from office >> reporter: the house leadership saying that what they did amounted to an insurrection. clearly the two sides here not seeing eye to eye on this issue. >> not at all. we're keeping a close eye on what does happen here. we'll bring the latest when a vote is taken. micah brooks helped organize the protest in nashville mi karks welcome let me talk to you about how the protesters on the ground feel today. what have you been hearing in response to this vote? how much anger is there, and a sense of injustice because of it >> right young people are upset as we are demanding that our legislators wail listen to us and pass gun violence prevention legislation. instead they're ignoring us completely and moving to do these silly things like

expelling lawmakers instead of caring about what's actually killing children day in and day out. >> you talk about listening to you, in fact, representative justin jones said this isn't about losing his job it's about being silenced, thus no one can listen to him how dangerous is this when elected officials stand ing with their constituents who are protesting get punished like this >> it's completely dangerous, and it's horrifying because it's anti-democratic. our leaders are listening to us, trying to listen to us and amplify our voices they are then being silenced and going so far to potentially expelling them in a few moments. this is a completely horrifying, and it's not acceptable. >> i know that nashville is within the state of tennessee, 12th in the nation when it comes to gun deaths. do you see that changing at all given what's happening right now? i mean, what would it take to have some sort of meaningful gun

reform passed in the state of tennessee? >> yeah, i mean, it's desperately needed, and as we have so many youth standing up, that's what it's going to take it's going to take continued action from young people and people listening to them, leaders like justin jones listening to young people and people who are on the front lines of this gun violence epidemic so on monday, 7,000 people walked out of their classroom into the tstate capitol to deman action so we need lawmakers to continue listening to us so that they actually see change and hear what young people and people bearing the brunt of the gun violence epidemic actually want. it's not arming teachers, it's an assault weapons ban, and extreme risk protection orders. >> micah brooks with march for or lives, thank you for your time, and for organizing this

government fell. at the time, president joe biden ordered the reviews to determine exactly what went wrong. and just minutes ago at the white house press briefing, national security council spokesperson john kirby laid out the circumstances surrounding the withdrawal for president biden. >> that decisions made and the lack of planning done by the previous administration significantly limited options available to him the president's transition team asked to see plans for that removal. they asked to see plans for a security transition to the afghan government. and they asked to see plans to increase the processing of special immigrant visas. none were forthright transitions matter that's the first lesson learned here >> joining me now, nbc news reporter dan de luce, and nbc white house correspondent mike memoli dan, you first here, tell us what's in this report? >> you know, there are not really new facts as far as we

can see in this report it's very much an argument, similar to the argument they made right after that chaotic withdrawal that really they inherited this terrible situation from the trump administration, that the intelligence committee wasn't predicting the afghan army would collapse so quickly, and they did the best they could in those circumstances. it's very defensive in tone, and it doesn't mention that as early as april of that year, there were lawmakers and refugee advocates and veterans groups that were all pleading with the white house privately and publicly to start evacuating all of the afghans that had worked as interpreters and other jobs for u.s. forces. i think this is not going to resolve the criticism and debate about how the withdrawal was managed, setting aside whether the decision to withdraw was the right one. >> so mike, it seems like the biden administration is laying the blame at the feet of the trump administration you heard the word transgression

three different times in the sound byte we heard from john kirby. >> that's certainly the take away from the public summary that the white house issued to what is otherwise a classified document that is being sent to capitol hill it's an important distinction between the two. let me read from the sum of those 12 pages from the white house summary, one, president biden's choices for how to execute from afghanistan were severely constrained by conditions created by his predecessor. page two, during the transition, outgoing administration provided no plans for how to conduct the final withdrawal page 3, the departing trump administration left the biden administration with a date for withdrawal but no plan for executing it so that is the unmistakable take away from, again, the white house's summary of this document but lawmakers on the key committees, foreign affairs, armed services, the intelligence committees will be seeing what is the classified assessment from the pentagon itself, which may come with some more harsh

realities to this white house. it is worth noting that as john kirby stood at the white house podium for more than an hour he was asked several times if the president ultimately takes responsibility for the decisions he set into motion once he did take over in the white house yes, he is the commander in chief. what the white house is essentially saying is given the difficult circumstances he inherited, he stands by the decisions he made, which followed interestingly, one of their take aways, one of the lessons learned, they applied to the invasion of ukraine, despite the fact that the ukrainian government didn't like how the planning that the white house was undertaking in the event of a potential collapse of the government in kyiv, it was some of those warnings, some of the intelligence sharing that they did which helped create the conditions in which ukraine's capitol still stands, and the public pressure on russia was as robust as it was >> very interesting, and the fact is the biden administration had seven months after taking over from the trump administration before that

house republicans have ramped up their probe into manhattan d.a. alvin bragg and his decision to prosecute donald trump. judiciary chair jim jordan has just subpoenaed former new york prosecutor mark pomeranz pomeranz had been investigating trump's business practices but stepped down last year after bragg initially declined to pursue charges against the former president congressman jordan previously sent a letter asking pomeranz to speak with the committee about his resignation, but pomeranz

declined meanwhile, donald trump's latest calls for congress to defund the fbi and doj, they are splitting republicans, some of his most loyal allies are distancing themselves and down playing that idea joining me from west palm beach in florida is nbc news correspondent dasha burns and from capitol hill, we have nbc news correspondent sahil kapur welcome to you both. dasha, i'm going to start with calls from donald trump to defund the fbi and doj what has sparked that and how are republicans responding it seems a bit splintered in their response >> yeah, that's absolutely right. you have folks like lindsey graham saying this is a bad idea when you zoom out big picture, this is going against the republican brand in every possible way i mean, defund the police is what they criticized democrats for, so this is not a direction that a lot of folks want to go at the same time, you have others like congressman jim

jordan saying, yeah, we should consider using the power of the purse in congress to potentially pull federal funding from the fbi, from the doj saying he's going to be talking to kevin mccarthy, talking to james comer potentially about this and so that also goes to show the power that trump's posts on truth social can have when it comes to some of the top leadership in the republican party. so you have this splintering, but overall this still continues to tell the story of the power and of the support and the real momentum that the former president has within the gop right now, alex. >> so extraordinary, though, to your point, dasha, that it really goes against the republican brand entirely. it's a trumpian brand, perhaps, but not republican brand so sahill, t to you, there's a

government funding plan, is there any chance at all that they defund the flederal police? >> if jim jordan had his way, they would, they would have to convince kevin mccarthy to get something like that through the house of representatives, which is far from certain given the slim majority, and it's dead on arrival in the democratic senate, and president biden is not going to sign a bill that defunds federal law enforcement, he's a proponent of increasing funding for the fbi, doj and local police this is a question of if donald trump comes back to power as president, this is the kind of thing they would pursue down the road. >> the new subpoena to mark pomeranz, so jim jordan first requested him to cooperate it was voluntarily, he did that on march 22nd. pomeranz politely declined, but this subpoena has he responded to that, and could he fight it, and if so, under what circumstances? >> he has not responded to the subpoena yet, alex, at least that we're aware of. it's a new subpoena in which the

chairman of the judiciary committee, jim jordan said pomeranz is uniquely situated to provide information on the investigation into the prosecutors. a former prosecutor in the manhattan d.a.'s office, he helped lead the investigation into trump early in 2022 when it looked like alvin bragg was not going to prosecute trump pomeranz resigned and was public about his criticism, said that was wrong, trump was guilt of felonies jordan is shining a light on pomeranz's public statements, both in his resignation letter and his book whichhe took on the road, being heavily critical of trump saying he was guilty of numerous felony violations, also called him a malignant narcissist and a megalomaniac this boils down to jim jordan trying to build a narrative that the public pressure that pomeranz put on alvin bragg led to the indictment. bragg's office denies there is any public pressure. just that he's following the

law. i have a statement, he says, quote, the house gop continues to attempt to undermine an active investigation with an unprecedented campaign of harassment and intimidation. he goes on to call this an abuse of power and will not deter us from our duty to uphold the law. alex. >> all right you beat me to it, my friend i was going to read that newly released statement as well by d.a. bragg thank you both for that. joining me now political white house editor and msnbc contributor, sam stein good to see you. we have pomeranz, this guy has been critical of alvin bragg i mean, we know this he is not on house republicans' side, though, by any means why would they ask him to testify? if they're trying to discredit this case against donald trump >> you know, that's an interesting question that i was asking to fellow editors here in our slack channels trying to figure out what the long-term strategy is here because you can see a future in

which pomeranz does agree to testify, comes to the hill, and lists the ways, the copious ways in which he believes trump should have been prosecuted. that the prosecution is, in fact, legitimate or going through what he believes are act that is maybe we don't know about that donald trump and/or the trump organization have taken. it's a high-risk strategy. my suspicion is that jim jordan and house republicans have done this for one or two reasons, one, they feel like he'll never agree to testify in an ongoing investigation. the standard is you do not discuss ongoing investigations and what led to those investigations, so he might as well call his bluff and say hey, look, we're not going to talk about it the other one is they want to expose what they believe is a political motivation to target donald trump, and if you can get this guy on the stand to say, you know, read him back some statements that he made that were critical of trump, perhaps you can frame him as being motivated by pure politics and not the law. >> to your point, the fact is that getting him on the stand,

he may not comply. that's an expectation that you believe jim jordan and republicans expect could he use the cloak as d.a. bragg just put out in his statement, the gop is attempting to undermine an active investigation in an ongoing new york criminal case is that all that he might need to say i can't come and talk to you, so stop asking? >> yeah, and i fully suspect that that's what they're considering. now, there may be some wiggle room here. he's not on the case he may or his representatives may say, we'll show up but we can't talk about x, y and z. we'll keep it to a, b and c. the much more likely scenario, at least my first reading of this, this is an ongoing case, and it would be highly inappropriate or prejudice the case if i were to talk about it and inadvertently reveal elements of what went into the investigation. so, no, i cannot talk about this. let's touch right now on donald trump's calls to defund

the fbi and doj. one of his most vocal allies in congress, lindsey graham, certainly not with him on this let's play his response. >> i'm not for defunding the police i think it's a bad idea. as frustrated as he has a right to be about some things the fbi has done, terrorism alerts out there and, you know, talking your guard down from one moment could be very dangerous for the public >> you know, sam, donald trump seems to already being creating headaches for republicans everywhere how careful do they have to be in siding with him on this issue especially because as i was talking with our two correspondents, it could really undercut their tough-on-crime messaging? >> yeah, i mean, this is sort of quintessential trump, right? everything is through the prism of how it impacts him specifically and personally. policies are not actually well

thought out. white papers or memos, they're just sort of, you know, your guttural reaction to the news cycle in which you find yourself i'm not surprised that he's out there calling for the defunding of the fbi he has held a grudge against the fbi since he entered office, even beforehand, and i'm not surprised for that matter that lindsey graham is not with him this is part of doing business with trump when you're a republican you can excite the base, you can ride that excitement sometimes to electoral success but you have to deal with these sort of bizarre peaked policy demands, that don't really make sense, and have to try to create strategic distance. >> it's kind of like a high wire act, don't you agree, sam stein. >> constant high wire. >> good to see you thank you much. coming up, why paris protesters stormed the officers of u.s. based investment firm blackrock, and china is fuming over the state side meeting with

vitali welcome, so first of all, explain what abortion trafficking is, how it's defined under this idaho law, how it would work, and will it be challenged >> reporter: yeah, alex, it's definitely going to be challenged, and those challenges are already happening right now because this is one of the most restrictive laws we have seen in the post-roe era, and it's a place where it's a new front line that reproductive rights advocates are planning to fight on you're right, it's one of the first states that criminalizes the idea of helping someone else get abortion care if they were to do it outside of the state of idaho. what we're talking about here when they say abortion trafficking is anyone who helps pregnant minors that do not have the consent of their parents, helping them get abortion care, their parents helping them get abortion care. whether that is abortion medically or abortion by way of the abortion pill. and so it includes traveling over state lines or of course

going somewhere outside of the state to pick up the abortion pill. and i think what is important here, too, is this is not just talking about whether it is a family friend or someone else who might help these children, minors who are getting this care. but it is also any potential provider who refers them outside of the state. whether it is to refer them to a place where they can pick up the abortion pill or whether it is to a clinic where they can actually have a medical abortion. the other piece of it, too, is that if local prosecutors don't push forward on these cases whether they don't feel they have the evidence or don't want to prosecute the cases, the bill says the state attorney general can move in and prosecute those cases himself so yet another front line here as we are watching the post roe era be legislated in conservative states across the country. >> wait a minute, you just said the state attorneycal prosecuto don't feel they have the evidence. >> yeah. that's one of the things that

is stipulated in this bill. and you're right to kind of have a little bit of surprise, because typically, you leave it to local prosecutor to have their own decision making process about what they will and will not prosecute. something we have been talking about a lot lately actually, so the fact they can have the state attorney general then move in on these cases, it's another layer where it is clear there is a real intent to start prosecuting some of these cases, and why you are seeing an intervention from reproductive rights advocates and others who are trying to fight on all of these fronts. while it is criminalizing the action of trying to go over state lines, they can't actually criminalize that. trying to prove intent of moving around just in the state of idaho. >> the intimidation by the state attorney general going after local jurists an lawmakers. that's pretty extraordinary. thank you very much for all of that. appreciate that ali.
