the antiabortion with it's bee attacking the fda's approval o mifepristone for more than 2 years. they've been dreaming abou this mentoring for decades they got it. at least the first taste of it in part, the cause micro eas the ruling a few hours ago the judge ruled tonight that the fda of mifepristone in 200 was wrong, he's temporaril invalidated the approval fro 20 plus years ago. passive, tonight this judg says mifepristone is no longer fda approved for nationwid distribution hub the judges also decided that the order won't go into effect for another seven days fro now. given the conservative fifth circuit court of appeals and the united states supreme cour the opportunity to see kacsmaryk's order. it would probably appeal any ruling that reverses mifepristone fda approval, tonight before airtime attorne general merrick garland issued this statement, quote, the

6:05 pm
let me start with you. we had this response from th department of justice. and even before we have that we have this thing we don' normally see on the same day minutes apart from each other. competing rulings that are unplug well to the same agency >> and arguably, in conflict with perhaps not in conflict everywhere that's one of the issues how is the fda supposed to abide by both of the rulings kacsmaryk put his out first, saying that the fda, you do no have the authority to do this. i'm putting it on hold however, i'm not gonna give th plaintiff exactly -- it was a nationwide injunction immediately. instead, you say the dus department - and try to go to fifth circuit court of appeal, and try to ge my order put on hold as of right now, people should understand that the drug i still in circulation it's not being really from the market i think it's important for our audience to understand that. however, as you pointed, out i a different judge just minutes
6:06 pm
later says, no, no, no wait minute, actually the dru should stay in circulation, it should maintain the status quo so for instance, what happen in eight days from now, judg kacsmaryk, in texas, his order goes into effect so, in a place for instanc like illinois, which is a part to the washington lawsuit. what is the fda supposed to do how is it supposed to comply with both of those orders. and that's why the justice department, this case is almos immediately headed to th supreme court. it's gonna have to reconcile these things >> many, i'm gonna ask paschal friction - plea planted abortion. one campaign planned to have mifepristone, should people be getting it now should they be talking to th doctors and hanging on to. it is it a particularly safe drug i preplanned my tyleno stopping in my house >> american should be planning their reproductive health care absolutely stock up on plan b the morning after. pell but, yes on mifepristone, washington state and the participation for the stat

authority. >> it's more that they wen about it the wrong way it's not that the fda doesn' have the authority to approv drugs. it does that every day i don't think their argument i really that, their argument is more, you didn't take into account the safety concern that we have asserted, and the judge has bought into that wholesale, this opinion is chalk through of mine that makes it very clear the judg is totally on their side i that regard. on that issue, and a number of other issues, but obviously, the justice department has put forth a litany of evidence t suggest that this drug is safe and effective, and that it has said basically you don't get t second guess the fda's authority on that, i, ghan this is never been done before and it's never been the case that a federal judge has essentially told the fda, what to do about a drug that it thinks is safe, over the objections of the fda. >> interestingly enough, many, the fda doesn't take other companies research when it
