senator catherine cortez masto described that texas rulin with a word i cannot say o television and that exclusive interview i coming up first. plus, what is next for justi j. pearson one of the tennessee three who captivity the country this week i will ask him when he joins m in just a few minutes. meanwhile, after donald trump' arraignment in new york, republican stepped up thei calls to defund the fbi into the doj. i will explain all the reasons why the gop is anything but th party of law and order and later, what was th governor of california doing i alabama? i traveled to montgomery for a wide-ranging conversation with governor gavin newsom. i asked him about gun reform abortion rights, the trump indictment and of course his favorite foil, ron desantis. i try not to be alarmists on this show, but every now and
9:02 am
then there is good reason to b alarmed. on friday night there was a ne assault on women's rights in this country because a federal judge in amarillo, texas, issued ruling that may undo the fda's 23 year approval of the drug myth oprah stone mifepristone is one of the two drugs commonly used in medical abortions. and the man responsible fo that ruling was matthew -- who has made no secret of hi strong opposition to a woman's right to choose. in fact, back in college h wrote this in a school newspaper. the democratic party's ability to condone the federally sanctioned eradication o innocent human life is indicative of the mora ambivalence under guarding thi party. he was talking about moral ambivalence back in college. after working for a number o conservative causes, he even served as a trustee on the board of an antiabortion organization so it is pretty safe to sa that restricting reproductiv freedom, limiting abortion rights has all been the focu of his career today. the thing is that if his lates
9:03 am
ruling stands, millions of women across the country wil be impacted aids, because more than half of all abortions are medical abortions. using this to pale met regimen that includes mid upper stone. even in some states wher abortion is legal this rulin may mean that women can no longer go to the pharmacy to get the pill they might need to go for it directly to a provider the problem with that is tha as of now only 36 states eve have legal abortion providers. and many of those are alread overwhelmed by the influx of patients coming from other states where abortion is now illegal. that all means that patients may have to wait weeks o months for an appointment an that patients seeking an abortion, patient seekin consultation with a doctor in short, this is all going to dramatically cut access fo women. but the impact is also far mor reaching for the medical community. this judge has no medica background none whatsoever.
9:04 am
but his ruling could describ what scientists at the fda hav deemed safe for decades. this has never happened before a court has never revoked fd approval of a drug on ground like this. what if the judge has personal issue with the use of stem cells or the components o a cancer drug? can they also overruled th medical community in those cases to and if they do, what do people who need those drugs do? right now across the country pro-choice governors are tryin to figure out what exactly the have the power to do it is not that the ruling was huge shock but their options are limited. some states may take steps t expand access to mid oppressed stall, which is the other drug in the abortion pearl regiment that drug can be taken t safely and a pregnancy it's gone that way in europe and other parts of the world but it also has long bee considered both less effective and more painful again, putting all of this burden on women. meanwhile, the legal pat forward may also sound a littl bit complicated.
9:05 am
that's because another judge i washington state also on frida night issued a competing rulin that effectively protect access to mifepristone but only in 17 states as wel as d.c.. the justice truman's already also filed an appeal of th texas decision that will ask the supreme court for emergenc relief but if no higher court acts by friday then matthews order could take effect and all of this will likely end up before the supreme court. so if you thought the dobb decision was the last word o the rollback of women's rights in this country, by our cour system, judge has america th other plans. joining me now is democratic senator catherine cortez masto of nevada. thank you so much for joinin me here this morning the dobbs decision was i think unquestionably a fire alarm fo abortion access for millions o women across the country you senator have been sounding the alarm over access to mifepristone for months.
9:06 am
how does the impact of thi ruling compared to jobs, i your view, in terms of the impact on women? >> it is a continuation, jen it's just like you said. we are alarmist, and we should be it started way back when, when they started putting these far-right federalists are just on the bench for this very reason and this is what - i come from nevada in a stat it is a proud pro-choice state two thirds of the voters her voted to allow and codify ro versus wade and you can really respect women's right to choos which is democrats and republicans and non-partisan and men and women. i can tell you just in the las two years as i was going aroun the state talking about my reelection, this was an issu for so many people, becaus they saw what was happening, this erosion of women's rights in this country when it come to the right to choose

and reproductive freedom rights. that's to me is the path tha far right extremist republican started when they starte stacking the supreme court when they started stacking these benches with these federalist judges. and now we are seeing th repercussions. what is so crazy about all o this, john, and we know this is that the repeal of roe v. wade, which was their ultimate goal, the ruling in there said we need to leave it to the states let's give this back to th states and the elected officials. it is a states rights issue. well, my state is a proud pr choice state but this decision by thi right-wing judges going to hav an impact on whether we ca provide the essential care tha is safe and effective that women need when it comes t medicated abortion it is unprecedented. >> it is unprecedented and you get it is wort repeating, a judge has never overrule the fda on thes grounds before there are some members o congress who have suggeste that president biden and other
9:08 am
leaders should ignore th ruling i certainly understand the sentiment. but do you think that is a viable path forward? >> no, we can't ignore the rule i believe in the rule of law and listen, i'm in the, vada i'm one of the 17 states you just talked about that as part of that ruling in washington that is protecting the right t have access to this medicate abortion, mifepristone and it is important that we le it play out and continue t fight in the courts. this is not a call to action for everyone, whether it is in the court system or when you g to vote, are making sure tha there are electe representatives, particularl those far-right electe republicans, who are makin these decisions on our behalf. they are listening to th american public. because in the vetted tw thirds of the voters support a woman's right to choose. but across the country the majority of american support a woman's right to choose. here is what i, now and this i a concern i think for all of u to pay attention to and why it
9:09 am
is important to see the next step this is a concerted effort the have had to really erode and take aback women's rights in this country and this is about our freedom. i talk to people in nevada this is about it once right to choose and the freedom t access the science and the medication they need when they need it. i would never impose my rights in my beliefs on a woman i don't know what it is like t walk in her shoes. for a woman to make thes decisions, she should have all of the available information and medication and access an science and doctors and make those decisions that are important for her. but what these right-win judges and others who ar making these decisions for u to think is that the representatives should be th ones making these decisions, and taking away these rights for women. it is starting with the repeal of roe v. wade and now they ar taking away the key drug tha women need with their doctor to make these decisions. and it is not just about
9:10 am
abortion it is about when there is miscarriage. the next step is contraception going after women's rights whe it comes to our reproductive freedom in the need fo contraception. so this is a concerted effor that we have seen playing ou across the country, and we hav to be vigilant i will say this, jen the good news is what we saw i wisconsin, the voters in wisconsin and kansas and michigan, i don't understand why these elected republican do not get that this is such a emotional, personal issue fo individuals. and that's why you see voter coming out and saying no, yo can't take this away from us >> it does seem, as you said such a majority of people in a nevada, democrats an republicans independents supported women's right to choose republicans have been pretty silent here. do you think this ruling could be a political problem for them? >> i will tell you what, the
9:11 am
republicans in my state are no silent when i was running for reelection they came out and they supported me, and we di press conferences together and that is one of the reasons why i am back in the senate. i am back and elected to address this issue, to protect women's rights in the state of nevada so again, it comes down to listening to the america public, listening to voter about what voters want and it's not ignoring what t the voters really want for their own freedoms for some sort of personal gain and that's what we see happening across the country with some of these far-right extremists who are only in their for their personal gain, and are taking away and erodin the rights of women across thi country. >> senator catherine corte masto, thank you for being s it's poking on this issue fo so long. hopefully we will talk to yo again about it soon. up next, why am actually hopeful about what we saw this week one of the expelled lawmaker just in jay pierson joins me i just a few minutes
