intercepts, basicall electronic intercepts. if they is the specific piec of information in thes documents, then whoever is, if they were listening to gathe that information, is able to get that information and the were listening to that phone call or something, then they'r going to cut that off. the u.s. could lose a key piec of, a key area that they'r able to gather information from that is a big concern righ now. the second one is more in th diplomatic world that's that some of thes documents appear to show tha the u.s. was even listening in on some allies this creates tension, it creates a difficul relationship and conversatio between the u.s. and som allies depending on exactly what ma be disclosed and some of these documents. i think it's important to poin out, as valid in her piece that they appear to be real, but they also appear to be doctored, many of them we have to keep in mind that i this is some sort of a disinformation campaign by russia, what would be th

prettyhe looks sour, and glam. clearly, he was concerned. about the fact that he was forced to be in that courtroom that said, it's pretty clear that the trump lawyers do have a lot of legal challenges that they can bring here. the case that allen bragg ha brought is plausible, bu doesn't seem particularl strong it rests on a novel lega theory that the stat prosecutor can use a federal offense, a federal campaig finance violation, as an underlying crime to bump u what would otherwise be misdemeanor. we will see whether that survives motions to dismiss, o move this to federal court this is going to drag on for quite some time. >> so, apart from challengin

the venue, here are some mor areas where the defense team sees the vulnerabilities let's watch. >> you don't typically run as defense attorney by filing a pretrial motion that says, hey judge, they've got the worst witness imaginable, they'r going to convicted perjure with an ax to grind. that's the kind of stuff wit the judge, the soviet, that wa their choice legal motions that pick apar the statute of limitations problem, the specific intent problem, the boot strapping of perhaps federal election law into a new york case, there is a lot to play with their i think there will be some robust motions i hope, and think, probably, much earlier than december which is the next court date >> lisa, first i should mentio that this is the lawyer fo trump's mar-a-lago classifie documents case let me ask you about some of the things he brought out. the statute of limitations intense. do you see those as weak areas for prosecutors? >> i don't necessarily see the most weak areas, but they're predictable areas for pretrial motions. statute of limitations as really interesting one, lindsey, it's something i've liked a fe

months ago in new york state, where jim trusty is not a practitioner there is case law that says yo can extend statute o limitations for a nonresiden defendants for every perio over 24 hours, if that perso is outside the state let's take it on faith tha donald trump was still a resident of the state of new york while he was presidents and living in washington until the fall of 2019 where h declared himself a resident of florida for, tax purposes. that's still wins th prosecution here, a real meaningful extension of what ordinarily would be a statut of limitations to bring felony charges against him. i'm not so concerned about that the specific intent issue is another potential problem, but i think one where the new york da's office has that amply covered. here's why all they have to show is tha trump falsified business records with an intent t conceal, or commit, anothe crime. he doesn't have to hav completed that crime and, the crime doesn't have to

be his own it could be that he falsifie business records, for example, to cover up the fact tha michael cohen, and allen weisselberg, or conspiring t commit tax fraud, for example, with respect to cohen' personal income taxes. as you think the da has a righ answer i agree with michael, some o these things are untested. i also trust that the manhatta da's office has been studyin this for a significant perio of time, and they have confidence that their case i going to hold up on this motio process, lindsey >> what if one of these cases, as in this indictment, that is in charge, is a federa campaign violation allegation. not a state one. >> you know, one of the things that's really interesting in a statement of facts, is tha allen -- lays out three possibilities for the ways in which this false records charge could b bumped up to a felony. one of them is, as michael mentions of campaign violation that michael cohen was charged with implied guilty to there were two more. one is an intense, by cohe weisselberg, again, to defraud state and federal ta

authorities by disguising as come the reimbursements fo michael cohen have paid stormy daniels. what they did was double the amount of money that cohen would have been owed, that $180,000 that he was out for having paid stormy daniels, an then an unrelated payment to a pollster they doubled that. when he paid income tax, h would essentially be - he would receive that hundre 80,000 back. the other possibility is a state election law violation that deals with conspiring t promote the election of particular person to publi office through unlawful means. those unlawful means don't hav to be something that trump himself died it could be a conspiracy, fo example, among trump, cohen, and the folks at the nationa enquirer, to have paid karen mcdougal through the acquirer' own funds in this fals business records on their end. i do think they have a numbe of possibilities, in the stage in the litigation, they're not legally required to specif which of those theories they'r

relying on they may not ever be require to specify which those theories they may be able to go to th jury and say, we think trump was trying to commit one o these three things or conceal one of these thre things, by falsifying business records. that might legally be enough t get them over the line,. lindsey >> let's take a step back your mind of when the players here stormy daniels, michael cohen, karen mcdougal, david pecker the door man who can you see testifying i this does go to trial. >> well certainly michae cohen. just speaking up on what - the potential tax violations here you know, that has been thrown out there. bragg baited very brie reference to it. if the tax violation is that there was a conspiracy to le cohen defraud taxpayers by not being income on us, and i thin michael cohen would have t plead guilty to that, if that' the crime that alvin bragg's

withheld from the voters about this long ago sexual encounter he had with stormy daniels nin years before the 2016 election it's a long time ago, about, you know, frankly, what is nott. there are a lot bigger one coming down the pike matt georgia investigation i in its final stages. we are likely to see crimina charges coming out of that i the next couple of months. i think that donald trump ha much bigger legal problems ahead then this particular case >> lisa, that said, when you look at the timeline for thi case, next week the defens should get grand jury minute and exhibits, then there's largely a -- till june. finally deadlines, we got on in august, one is of timber. trump is then due back in cour in december. why might prosecutors favor january trial? given the sense the defens wanted more time, how do you feel the judge is going to roll? >> i think it depends, lindsay

on what they bring some of those pre trial motions. you, know they don't have to bring any of their pre trial motions until august, as you just noted but jim trust seems to be -- and suggested that they ar going to bring a ray o emotions before august if i am the da's office, i'm going to push for the earliest trial date i can so that donal trump can't say to judge one or anyone else presiding ove this case, this is interviewin with my right to be candidate. i'm supposed to be here, o there, campaigning for the presidency of the united states however, i do think that it' likely that this trial wil slip beyond january. what i think the da's office i hopeful, is they can pin dow trump's lawyers to that spring of 2024 date that they propose last week at the arraignment beyond that, if it slips beyond, that i think we're really in danger of a collision betwee the campaign calendar, and donald trump's legal troubles. another thing is that the firs to charge does it mean first t trial. charlie savage at the new york
