president trump showing off a confidential map that contains sensitive intelligence information after he left office for months we have known that president trump took hundreds of classified documents with him when he left the white house, and we've known among those documents were top secret papers that could contain things like sensitive information, but this reporting in "the new york times" tonight is potentially the first instance we know of trump not just having that sensitive info in a broom closet somewhere but of him actually showing it off, potentially damaging national security, potentially violating laws like the espionage act. so that information is new and it is huge, and it is "o" one of the investigations by the special counsel into former president trump. in his other investigation, the investigation into trump's efforts to overturn the 2020 election and january 6th, we've got this today the special counsel's office has

sent subpoenas to former advisers and campaign aides related to how former president trump fund raised after the election "the washington post" reports that special counsel smith is looking to determine if trump or his advisers scammed donors by using false claims about voter fraud to raise money you might remember trump raised an absolutely eye popping $170 million in one single month after he lost the 2020 election, which is not normally how fund-raising works and now that massive haul is being investigated by special counsel jack smith all of this is coming at a time when trump is already in triage mode he's literally pulling out all the tricks he usually uses to avoid legal entanglements. now he's been backed up against the wall, literally indicted in inmanhattan d.a.'s hush money case trump is going after one of the key witnesses. today trump sued his former lawyer, michael cohen, for the

really extraordinary sum of $500 million. i'll repea million and with less than two weeks before he's set to go to trial in the civil defamation suit brought by writer e. jean carol over allegations he raped her in the '90s, trump is asking for that to be delayed so delay, delay, counter suit, counter suit we've never seen it all at once from all the angles ib3-d or 4k. but it's not just in the courts but also in the court of public opinion. >> is there anything they could throw at you legally that could convince you to drop out of the race, if you get convicted of this case in new york? >> no, i wouldn't do it. >> former president trump website on tucker carlson's fox news show last night for his first interview since his arraignment last week, and fox did what it does best.

tucker carlson listened to the former president spout nonsense about how these investigations were just the justice department being weaponized against him and how trump thinks north korean president kim jong-un is really smart because he has total dominant control of his people that's an actual quote and tucker listened intently and he didn't really push back as if these were the kind of statements that are factual, that are grounded in any kind of shared reality of course we now know for this particular fox news host that friendly attitude is all an act. tucker carlson hates donald trump. as part of the discovery prosin the more than billion dollar defamation lawsuit between the dominion voting company and fox news we got this text. we are very, very close to being able to ignore trump most nights, i truly can't wait and then later, i hate him passionately on january 6th tucker texted a

dominion defamation lawsuit. now she's expected to be a witness for dominion and she has the receipts it turns out abbey grossberg had been recording using an app on her phone discussions between bartiromo and key figures in this case, figures like giuliani and trump campaign officials themselves grossbering told fox's lawyer she had these types of recordings, pretty upfront about that, but fox never hand them over to dominion in the discovery process. after hearing them the judge designed to sanction fox news for withholding evidence if dominion wants to dominion

could conduct more depositions on fox news' dime, judge's orers. we don't know if dominion is actually going to do that, but these tapes or explosive enough the judge sanctioned fox news. off air mr. joll uniy seems pretty candid about the fact. >> whatever you can tell us in terms of evidence would be really helpful what about the dominion

terms of georgia i know during the audit they did check on those machines. they're really -- can we go off-the-record for one second here >> yeah. i don't want us to say it if it's not -- >> i would -- i think they have looked at the machines when the secretary of state did his audit there was a lot -- i think a fair bit of looking at the machines you know, the audit came in pretty darn close with the machine count loss, with the receipts so i don't know the outcome of those, but our understanding again from the secretary state's office is there weren't any physical issues with machines on those inspections. >> again, that was on december 5, 2020. trump campaign officials saying there weren't any physical issues with dominion voting machines there's a fair bit of looking at those machines, but all the

figures were pretty darn close to what they were supposed to be the whole voting machine conspiracy according to the trump officials kind of a nothingberger, or at least that's what they said in private because here was trump on the same day, december 5, 2020 >> in one michigan county using dominion voting systems nearly 6,000 votes were discovered that were wrongly switched from trump to biden they called it a glitch. you know a glitch that's like themachine broke numerous times we count glitches, and every single time the glitch went 100% to biden and no percent to trump, the same systems they used in 30 states believe me, this is something we're going to do because we can't allow it to happen, and complete overhaul of our election security systems because right now dominion is a joke okay not a very funny joke.

it's a disgrace that in 2020 no state in america even makes any real attempt to verify those who cast ballots by mail are eligible and lawfully registered voters the evidence of fraud is overwhelming >> one thing in public, another thing entirely in private. and this is no minor detail. this is the core of the big lie. here is a taste of how fox news continued to cover dominion voting systems after that december 5th phone call. >> we're looking into the dominion voting machines with this new forensic examination, so this is an investigation that has taken a few weeks. it'll take time, but what we have now is such significant and overwhelming evidence that there is voter fraud, there is a lot of irregularities and just complete disregard for the laws in these states. >> now, we get to -- we get to detroit and we have a truck that pulled in at 4:30 in the morning

with 100,000 votes and the dominion machine as filled with holes as swiss cheese and was developed to steal elections and being used in the states that are involve. so there's a lot going to come out here over the next month or so >> tens of thousands of ballots were being illegally dropped dominion, no one even knows who ownatize these machines are controlling our country. it was a rigged election it was really a sham and a shame. >> one thing in public, another thing in private again, i do not know if dominion will choose to do another round of depositions because of this the trial is slated to start monday, so more depositions could mean delaying that trial but even if dominion chooses not to, these recordings sound fairly damning in turps of what they do to undercut the big lie. rudy giuliani, trump's own campaign officials, the core of that whole conspiracy sis just

nothing. joining us now is the attorney for former fox producer abbey grossberg who's suing the network. we really appreciate it. i know we have a slight delay so i'm going to get right to the questions, and i think a lot of people would like to a know a bit more about how and why ms. grossberg made these recordings. >> good evening, alex. thanks for having me on. let me just step back one second and say in answering your question we didn't actually play the tapes in court today dominion's attorneys did we turned over the recordings to fox's attorneys thinking at some point they'd get there and it turned out months and months later we noticed the

recordings weren't anywhere in the record as it became unsealed, as the papers were filed for the summary judgment motion, so ultimately we felt we had to come forward and provide that evidence, or at least let the court know we have that evidence as we did our filing in delaware abbey has two lawsuits, one is in the southern district of new york that is really the heart of the dispute which alleges a very toxic and horrific work environment that she was subjected to not so much at maria bartiromo's show, but when she left ms. bartiromo's show and left. it's also significant that the coercion that we allege that occurred during her deposition preparation occurred as she was transitioning from ms. bartiromo's show to mr. carson's show, and we see the two issues and the two lawsuits linked.

the lawsuit in delaware alleges the vast conspiracy to essentially cause abbey to -- to defame herself by -- by -- with the transcript that was coerced out of her and when she was afforded the opportunity to correct until we file the lawsuit, and the lack of full disclosure in the transcript became apparent to the world, and then there's lawsuit in the southern district, and the two are related because really we allege that fox news scapegoated abbey and to a degree ms. bartiromo when they finally found out that there was going to be liability. it's very telling that the order from on high came down not to have mr. giuliani and ms. powell

on any longer on any show including ms. bartiromo's the day the smart tech lawsuit, which is another defamation lawsuit which is percolating along in new york i think for 2.7 billion dropped and fox became aware of it >> so let's talk a little bit about the recordings and how she came to make them and why you think given the current suits here, the current complaints, why you think fox news did not make these available to dominion during the discovery process >> well, i really -- i can only speculate as to what is in fox news' mind and the minds of their attorneys, but i'll tell you, you know, they have a lot of lawyers litigating the case, in delaware the defamation case that dominion has brought. and you know i think among them the practitioners there have

over 150 years of experience, and it's -- it's really unlikely that they really drop the ball and just forgot to turn this obviously relevant evidence over it's more likely they've been hiding the ball as we've alleged all along. and the reason is obvious because i don't mean to make dominion's arguments for them. they're doing pretty well, but seems to me that these tapes go to the heart of the issue that's been left for the court -- for the jury rather in the dominion case, which is whether there's actual malice. one could even argue if dominion had these tapes, and by the way there seems to be other evidence also withheld from what i've been reading just in the dominion case, it would seem to me if they had this evidence and had been able to use it in their

summary judgment motion, maybe they would have gotten a complete victory >> you make the case and the point it would be hard for fox news executives, ms. grossbering was forthcoming about recording a certain app on her phone and attach transcripts to her e-mails to higher ups at fox and you would make the point that people in the control room make these conversations would you on behalf of our client be able to elaborate more around the culture in and around fox news as it pertains to sensitive information like this? >> sure. i mean i would go one further and say that it's -- it's virtually impossible if not actually impossible that fox news wasn't aware of it and wasn't aware that there was -- there was, you know, evidence being presented to fox news

through it's show host and ms. grossbering that was contrary to what was going on. first of all, abbey made it a regular practice to use this particular transcription software anytime she dealt with preinterviews with ms. bartiromo and made a regular practice of sending those transcriptions via e-mail to ms. bartiromo. and i believe from what i've heard i haven't had the benefit of bet getting the transcript today, but our local counsel reported fox news stood up and said they weren't aware of these until march 20th when they saw and corrected even the delaware case, can that's when they turn them over. that really is almost impossible to believe because if they'd just done a regular search of

the relevant e-mails, they would have come up with -- with this evidence i think they went so far as to try to excuse themselves by saying, well, first of all, it was on abbey's personal phone as opposed to her company phone ms. grossberg gave her phone over to fox news twice to attorneys who drilled her for four days to coerce to basically incomplete and self-serving testimony and also put her in a position where she actually came across in the transcript as someone either ignorant or not doing her job. neither one of those things are true, but that's the false lens she was participated in. >> is ms. grossberg going to testify in the fox news dominion trial? >> ms. grossberg is ready to tell the truth in any appropriate form she has already, you know, taken on the, you know, the david

vers versus goliath battle of fox news to treat her as something less than a human being and not afford her work opportunity and the promotion she deserved to executive producer, and then to actually try to scapegoat her and try to hide information that exculpated her from having anything to do with this big lie perpetrated. and in fact one of the tapes you played the question -- the voice on that tape is ms. grossberg's. she's the one who asks the questions about the voting machines because she organized that interview in order to get to the bought of what the truth was, because she was worried ms.

bartiromo was not going too far in what she was producing. so that story never came out what the fox news attorneys tried to get ms. grossberg to say during her deposition is that nothing ever fell between the cracks at fox news in fact, ms. bartiromo we argue because they were both women and they were subjected to a chauvinistic attitude, they were characterized as being in a bubble and able to go wild and ms. bartiromo was called all sorts of unflattering names by a number of the male executives at fox news but that show which was at the time the number one rated show on weekends, ms. bartiromo's weekend show not only fox news but all of fox had exactly one staff member, ms. grossberg. and although ms. grossberg repeatedly asked for additional support so she could fully vet

all of the counter allegations and the warnings that were coming in from dominion. she never received that, and in fact was encouraged to just continue to let ms. bartiromo say what she wants because at the beginning before they really got worried once legal liability was at their doorstep, it was a ratings answer they were concerned about losing -- losing audience from the fact they called arizona early i guess first in the 2020 presidential election, and they needed ways to actually come back and try to bump the ratings, and this was a way to do it, so we allege. >> abbey grossberg is now a central voice in all of this thank you so much for your time and thoughts this evening. >> thank you, alex thanks for having me on.

>> now, there is another piece of tape rorred by abbey grossberg that doesn't have to do with the fox dominion lawsuit but has every effort to overturn the 2020 election. those officials raise the date of skbrn 6th now, this was two weeks before former president trump issued his infamous tweet imploring his supporters to come to a big protest in d.c. on january 6th saying it will be wild and the trump team wanted to make very sure that fox news had that date marked on their calenders. they wanted fox news and the fox news audience to be very clear the real back stop for the election would be january 6th. mark it on your calenders. here's a portion of that tape. >> i've seen so much reporting and realizing that a lot of

recordings we just played you before the break along with the newly amended complaint in a separate civil case file, things got a whole lot more complicated for fox news ahead of its big defamation trial lawyers for the plaintiff in that case, dominion voting systems, just played grossberg's recordings and others for the judge overseeing the case today. because those tapes were revealed only today and fox did not include them during the earlier discovery process, the judge has now sanctioned fox news and its parent company, and that judge is now considering further investigation of fox's discovery process. all of that scolding may result in another round of discovery for fox, and that is how the dominion case is going just days before the trial is scheduled to start. also separately a fox shareholder just sued yesterday for failing to stop fox news from reporting false information about the 2020 election. joining us now our katie fang

and jim routenberg i'd love to ask your immediate reaction to the tapes and how damaging this is for fox days before this trial is set to begin. >> first of all, there are two audiences that matter the most one is the judge very unhappy, not where you want to be days before a trial starts. the second will be the 12 jurors, so we'll see how this plays out. a lot of this right now we're talking about this on television, very bad for fox in a reputational way they say there are explanations for these things and we'll see what happens but this is a horrendous way to come into a trial. >> katie, in terms of the judge sanctioning fox, first of all what does that mean and do you think it's plausible there'll be another round of discovery which has already been so painful for

fox in terms of revealing these communications between fox staffers >> when you're an attorney or party in litigation, you never want to be sanctioned by the court especially on the eve of trial. to jim's point there's a potential jury pool out there that does not only listen to fox news, that does not only watch a certain news channel and because of that there's the potential for a future juror going to sit in this jury trial hearing that fox has now been sanctioned because it's been hiding evidence, evidence of consciousness of guilt when you do something like that the problem is going to be the following. dominion is literally on the courthouse steps about to start the biggest jury trial of its career i guess or its longevity as a company, excuse me. and so because of that do you take advantage of any, quote, additional discovery the judge has allowed you to do? discovery is literally construed, there's a reason why some of the discovery requests

in this case were any and all documents, correspondents, e-mails, et cetera that dealt or related to actual malice or related to rudy giuliani or sydney powell. all these things should have been produced. so the fact it took abbey grossberg as a former employee of fox to come forward and bring it to the court's attention further underscores the court's anger, it's ire. it's so offended by this act committed by fox, fox was already starting behind the eight ball on the summary judgment motions, and even now in a worse position because the credibility of its own lawyers are suspect as well. >> it's in the pocket. if it's past the eight ball, i've got to ask the judges also mad at fox because it says fox -- i'm paraphrasing here, but not been truthful about the role murdoch plays they've not been fulsome, if you

will, about the fact he is both a chair and officer -- officer of the fox news corporation and chair of the fox corp. the fact he's involved directly with the news corp going on perhaps would have changed the judge's ruling about what is in the discovery process. not to get too technical but seems like a fair lebig deal >> it is because dominion has sued fox corporation as the parent company and fox news as the subsidiary of the parent company fox corp and what dominion has tried to do is make sure it has evidence going into the trial that shows not only was it fox news involved but fox corp. the reason rupert murdoch is critical to this entire presentation of dominion is because if fox was trying to insulate rupert murdoch and its lawyers were making it seem like they did not have control in the day to day operations of what was being put forth in front of

the viewers there could be an argument made it doesn't make a difference you need to have less rupert and less sydney, and less lindel it will make a difference now. the fact rupert murdoch is going to be called by dominion as its own case and chief by this monday considering the following, alex. you're going to have jury selection happen and then opening statements on monday and then you're going to have dominion call rupert murdoch, and he's going to be confronted with all those e-mails and communications where he said the host was endorsing the lies and criminally trump is responsible for january 6th. and that is so powerful to hear that come out of the mouth of the guy who's the head of fox. >> you've reported the culture and the involvement of rupert murdoch. first of all, speak if you could to the watershed moment this

represents in terms of murdoch being implicated, having to take the trial, all the rest and is there any chance the culture inside fox changes nothing happened it seems after the sexual harassment lawsuits grossberg came forward with her own claims about sex discrimination what do you think this represents in terms of fox and its time line? >> well, interesting rupert murdoch's entire empire was built on one concept, give the audience what it wants and he's become -- had incredible success in this way but fox's audience started wanting something that the news part of fox could not give it. and here you see fox go down as we described it in our story last weekend, down the rabbit hole thequestion is do they pull back there's some key testimony in rupert murdoch's own deposition why they did not want to alienate trump they didn't want to alienate trump in their coverage of

election lies is their audience, they are fans of trump so toillionate trump will affect ratings. even if they win a trial they certainly don't want to go through anything like this again. >> do you get the sense there's fear inside fox what this represents, the fact the king is being -- his time on the throne as someone who's leading the organization could be in jeopardy >> i think that they are so busy preparing for trial it's a little bit hard to read. what we see in these e-mails is fear over audience, over ratings. rupert murdoch controls this from the top i think he'll be there, his son is there, and we'll see what happens after this trial, but they're certainly in control >> it's a family affair. >> thank you for your time tonight and great reporting. we have more to come this evening including senator rafael warnock on the democrats call

the integrity of our democracy nothing could be more important than that. i am heartened that representative pearson and representative jones have been rightfully returned to their seat the city counsels in nashville and memphis did the right thing. but this unabashed assault on the very foundations of democracy continues unabated i think this is a very dangerous precedent, and returning them as their local leadership did this week doesn't solve the problem we -- i reached out to the justice department because i think that it is its duty to investigate weather the constitutional rights first of all of the citizens that they represent are violated citizens have a right to decide who's going to represent them. and, unfortunately, members of the state legislature i think

have been playing games for so long, engaged in partisan and racial gerrymandering so right now the tennessee legislature doesn't actually look the way the people of tennessee voted. so they've been getting away with this, playing these games so long they have convinced themselves the peoples house doesn't belong to them, doesn't belong to the people, it belongs to them. and so i think there's a role for the federal government to play here which is why we cept the letter and continues to make the case >> the idea the peoples house doesn't belong to them, people of color versus the white patriarchy in many ways. i've got to ask you invoke the legacy of civil rights icon julia bond in your letter. do you see this moment as a signal moment in civil rights as that moment was with julian bond >> i do, and i think this a defining moment for our

democracy writ large we are seeing a kind of assault on our democratic values by people who are behaving in desperate ways because they know they're losing the argument. they're on the wrong side of the gun safety issue let us not forget the context in which all of this happened because i'm afraid too often we get sort of caught up in the political conversation, the back and forth in america sometimes, and we forget about what's really at stake. and we fail to center the people's concerns. six people were killed in a school, three of them precious little children, and then three others who were trusted with the care of our children and out of that tragedy you saw citizens stand up in the best of the american tradition trying to assemble peacefully, nonviolently

and rather to respond with common sense gun safety laws, we saw these legislators respond in the most draconian ways against those nonviolently protesting. i do think there's precedent here to answer your question julian bond was a young legislator elected to the legislature at a different time, and there were those that didn't like what he was saying at the time so they decided they were going to usurp the peoples will. the supreme court found them to be in the wrong position and so he was seated. whether it means standing up against partisan or racial gerrymandering or the inordinate impact of dark money in our politics or voter suppression or the games partisan actors play, in my own runoff election this past season i had to sue the secretary of state i had to sue state officials so

that georgia voters could vote on the weekend, the first weekend of the runoff. and thankfully i won but we've got to stand up -- and i'm so proud of these young legislators are standing up in this defining moment in america. >> can we talk about those yuj legislators? because i think a lot of people had no idea, for example, who justin pearson was until all this unfolded. and what the country has witnessed what feel like the next generation of leaders in this country and someone widely recognized as one of the great orders of american and public life and certainly in the u.s. senate i wonder what you have made from some of these impromptu speeches you're hearing from some of these ousted lawmakers >> i'm so very proud of all these legislators, representative jones, representative pearson, representativejohnson who had the courage to say she felt her skin color had something to do with the fact she was not unseated they are standing up in a

defining moment. and when you look at the history of activism in our country there's never been change really with young people at the center. i spoke with representative jones earlier tonight, prayed with him and talked with him about this moment in his life and the moment in our country. and i'm inspired both by their oratory but more importantly the eloquence of their witness it's no small thing to say i'm going to stand up and i'm not going to be silenced by those who would try to exercise their power in ways that are wholly inappropriate. these are young people still in their 20s. i remember there was another young preacher named martin luther king jr. who stood up in montgomery, he was 27 years old, the age of these young legislators and the rest is history. you never know the difference your voice will make, but i'm

glad they decided to stand up and by some stroke of grace and human resilience they've captured the imagination of the whole country and i hope pushed us closer to finally getting some common sense gun safety laws passed in the congress in the kind of movement we need in order to safeguard or democracy. >> i do want to ask you one question on that because it is the sort of central issue here, which is what is the movement, will it happen, can we change our general posture towards weaponry and a weaponized america? in tennesseethe republican governor is supporting a red flag law that seems like progress around the corner in florida governor desantis is now succeeded in making concealed carry weapons for those without permits. how do you see the landscape as it concerns gun safety in this country? are you pessimistic? are you optimistic from someone on the front lines how do you understand our position right now and where the energy is headed >> well, we can't let up

i'm proud of the fact that last congress we passed the first bipartisan gun safety law in 30 years. it was modest but significant. clearly it's not enough because we're still seeing children and other people being slaughtered in classrooms and grocery stores, in-houses of worship, so we have to do more and here's why it's a democracy issue. because the people in america, ordinary citizens on the left and the right, are closer in their views -- their differences notwithstanding, are closer in their views on this issue than what is reflected in this legislation we've gotten passed so far most americans believe we ought to have universal background checks most americans believe as i do that we ought to have a ban on assault weapons, but we haven't been able to get movement on this but i'm not about to give up, and i'm going to keep talking to all of my callees until we get
