republican caucus, the likes o marjorie taylor greene, lauren boebert, matt gates, and others, they leverage the situation to secure mark committe assignments and increase their influence in the caucus. and that is where the real chaos began. it's one of mccarthy's first actions as speaker was to stri representatives eric swalwell, adam schiff, ilhan omar of certain community assignments. and that has been the 12 punch of kevin mccarthy's tenure empowering the far-right allies, subverting the democrati process. consider jim jordan' weaponization subcommittee which was allegedly supposed t produce evidence that american conservatives are victims of a vast federal plot to suppres their freedoms instead, the panels hearings have devolved into conspirac elated therapy sessions for grieved right wingers. and then, there is the highest oversight committee chaired by a friend of this show, at leas one of our favorites, jame comer, a republican who ha been quite vocal about his desire to investigate and take down the bidens, while als

shutting down vali investigations into trump an his family now, let's be fair here for moment, before going t properly grade the maga-controlled house, we ca just focus on how badly th committees have devolved, we should look at the work they are doing for the people you know, the actual legislation there crafting, th real work. and lo and behold, there i been almost no substantive legislation passed by the gop. instead, mccarthy holds vote on absurd things, messagin bills, denouncing socialism, and condemning critical race theory that really have no chance of becoming law, and do nothing to solve the actua problems the american people are facing and guess what the next 100 days, well, thing are not looking great 14 mag either we have just seven weeks t raise the debt limit or risk cataclysmic economic consequences and house republicans appear n closer to a possible deal an then back in january

so, if we're going to grade th first 100 days of the maga -controlled house, well, tha rate is pretty low and this professor has littl faith that is going to improve as time goes on. joining me now is democratic congressman greg casar o texas. congressman, it's great to hav you back on the show thank you so much for making time for us. i wanted, and i imagine your expectations probably were not very high like mine were, bu has anything particularl disappointed you in the past 100 days what grade would you give hous republicans? >> well, the house republicans certainly get a death, doubl minus, on delivering for a minute american people but as you point out, they ver clearly haven't said that as their goal and, so even though it's not going well for them, we have t work doubly hard to make sur they don't achieve their goals one of which is to try t instill despair an hopelessness and the community and we know hopelessness is th greatest enemy of justice. they want to keep making folks

despair with these messaging make us feel like we can't mak any change, make folks fee like government is so broken why even participate we can't let them do that. and then, second, as you noted speaker mccarthy is giving the keys to the car to the marjori taylor greene faction of tha republican party, an threatening to drive the car straight to the global economy costing people millions of job and untold economic sufferin if we don't do what they want, which is cut critical programs like social security, medicaid medicare, head start, and snap these are incredible program that we want and built as democracy. we want to grow them, and we can't get into negotiating and compromising with folks that are holding the entire economy for ransom >> let me ask you on how i looks like from the inside i mean, you're on the hous oversight committee. you've witnessed just how much of a circus chairman james comer's hearings have become what can you tell us i mean, you know, outsiders, are we getting it wrong? is there any misconception is there any important wor that's actually being done

>> this is a critica committee. it used to be chaired by legendary texas congressma jack brooks, who wrote the impeachment proceedings fo nixon, investigating watergate made sure government trying to effectively and efficiently. he was called the meanest me and congress, even though he was a nice guy, but it was because he had no patience for grifters and people that i used government power an dollars. it's an incredible power but when the horrible trai crash happened in east palestine, james comer wante to investigate the biden administration, but didn't wan to call in the ceo of norfol southern when we had a hearing abou fentanyl, he didn't want t talk about addiction counselin or treatment for folks, or addressing the public health crisis of fentanyl they wanted to blame this on immigrants, which even the mos conservative border patrol chief said, it's not immigrant that are trafficking fentany into the country they just don't take i seriously because they are

before a grand jury in one o the federal probes is facing trump filed an appeal earlie this week and asked a cour yesterday to take immediat action and blocking pence' testimony in the special counsel's investigation into trump's efforts to overturn th 2020 election. of course, this is on brand fo the ex president trump has already tried to block other former aides fro testifying before the same grand jury, citing executive privilege. a federal appeals court ha since denied that emotion an some of those aides have begun testifying, including the like of stephen miller and trump' one-time director of nationa intelligence, john ratcliffe joining me now is my saturda night panel, hayes brown writer and editor at msnbc daily. we cynthia alksne, msnbc legal analyst. she is also former federal prosecutor and mike lyon, host of can w please talk broadcast.

great to have all of you wit us cynthia, i'll start with you given the appeals court speier dismissal of trump's motion, trying to block his former aides from testifying, wha chances does he have to no block pence's testimony, and what with this look like i this appeal work to go to th supreme court? >> he has zero chance. he will lose in a district court. and he lost in the distric court already. he will lose on appeal, and my conscience, the supreme cour will take it i would say slim to none, an slim has walked out the door >> all right, hayes, you thoughts on this i mean, we don't know th specifics of what trump' former aides are being asked but there are reports that federal prosecutors are lookin into whether, you know, th former president and his advisers scammed donors by using false claims of vote fraud to raise money, an specifically, they're lookin into the time period between november 2020 and of course th insurrection, and later in january 2021 >> yes, i think that there i

no chance that this appeal fro trump is going to have muc effect and i think that the special counsel's right to look in thi area because they were raising so much money during thi period and what jackson, the specia counsel will be looking at, is what where these aides sayin in private versus what the were telling people when the were making the fundraisin appeals. now, one of the most damning pieces of evidence that we'v had so far to the fact tha they were trying to commit fraud by trying to raise all thismoney was that trump had outside investigators look int the claim of fraud befor january, and was told directly by these investigators from th berkeley research center, if i believe, that there was no truth to these claims. and yet, they were still sending these fundraisin emails given what steve bannon ha been charged for in manhattan, and the manhattan court fo raising money to supposedl build, that was never going to

happen i do think that that is a very strong case for jack smith t make, eventually >> let's switch gears for moment to a different specia counsel probe, mike, the one folks are handling o classified documents investigators are also askin about whether the former president showed off a map t his aides and visitors wit sensitive intelligence information that he took whe he left office and as more information abou these investigations come out, we see the links that trum tried to maintain hi connection to the white house. what do you make of this, mike >> you know, ayman, first off, a great question and thank you for having m back on the program. you know, i've had a bunch o former federal prosecutors criminal defense attorneys, an even a former fbi special agen in charge of espionage on th program to talk about this and the common line through al of them was this special documents case, right? with respect to not only the amount of documents that the former president had in hi possession, but the fact tha

he's publicly gone o television, on sean hannity' program, saying he's declassified them in his mind, so he's entitled to then recently on a program on msnbc on meet the press, with todd one of trump's attorneys was talking about playing th whataboutism game as we always like to talk about here on thi show, saying that the former vice president and pence and biden when he was a vice president, both misclassifie documents. and at the time, i tweeted, if you are president trump righ now, your attorney is playin the whataboutism game in the court of public opinion, the you probably need new lega counsel. so, i think the big thing fo me with this, with respect t former president trump's case, and like i said, of all th people that i've talked to i the legal field about this this is the one with the mos teeth, right because i would refer to cynthia on all of this as well obviously. but i think this is the one of the most teeth because it has paper trail, and it ha contradictory statements fro the former president o television, on his truth socia platform and we know that there is, lik i said, a paper trail leadin

you lied again, and then w found them so, that part of the case is actually pretty easy, and read to go. and the obstruction case looks like it's also getting easie and ready to go, because the one thing we know is a federal judge has pierced the attorney client privilege on th obstruction issue with one o his lawyers. and now, we find out tonight and that the lawyer has recuse himself, evan corcoran, and yo don't recuse yourself unless you think there's an indictmen coming down the pipe and his testimony relates to the obstruction. so, not only do we have th documents part done, the obstruction has to do with corcoran, it has to do wit walt not, i don't know how t pronounce his last name, movin the documents, and the testimony that they have gathered that the presiden went to the documents and south, so he has the statements t sean hannity and his ranting o truth social could come in, too, but the heart of the soul of the case will be people at

over the last week is that w expect the supreme court justice to be able to interpre really obscure, difficult, thorny laws, but his apparen excuses that he couldn't understand the ethical guidelines that were require of him that makes no sense. he has to have known that this is a transaction that should have been reported, and if thi is his argument, maybe h should be on the bench to this point. maybe he should consider retiring if he can't keep trac of those sorts of things in hi head i am just saying, there is n way that anyone who is in that position would not know that you have to disclose this sort of deal period >> the troubling thing for m is that propublica reports - after its report, slee confirmed that thomas's mother actually still lives at th house that is now owned an completely remodelled by crow.

really, because that sort of thing that makes the constitution deal with the supreme court. that was the idea of the founders to say well, we'r gonna put these people on th bench for life but for good behavior. and, without good behavior impeachment was supposed to be the tool, the very political tool, that was used during the man. if that's not an option, the they're at least needs to be some sort of investigation within the senate judiciar committee if the house isn't going to do it, to look an compare the difference between what the son judiciary committee is gonna be focuse on, versus what the hous judiciary committee is gonna b focused on if the house republicans had any serve integrity, they woul be jumping up and down tryin to investigate this, trying to see is this person who will be have trusted to ensure the constitution acting in a corrupt manner if they want to talk about corruption and government, which they clearly do, the nee to be looking into this. >> yeah, instead republicans are too busy -
