trump ally jim jordan leading a rare field hearing, as they're calling it, of the house judiciary committee trying to put a spotlight on violent crime while taking on manhattan d.a. alvin bragg, the same alvin bragg leading the criminal indictment against donald trump. >> jim jordan engages in a lot of political theater in washington but he should no better than to take his tired act to broadway. right now. snowballing fallout from the leak of classified documents as we learn new details about what were in those pages. i'll talk with congressman jim himes, the ranking democratic on the intelligence committee about how this impacts u.s. national security and sources a delay in delaware. we should have been an hour into the hotly watched fox defamation

trial. why the holdup we begin in delaware where we just heard from the judge. i want to get right to nbc's emilie ikeda and legal analyst danny sef cevallos >> reporter: we first got word that the start of the trial will be pushed to tomorrow last night. the judge just made this formal announcement within the last hour or so it was short and sweet, lasted a matter of a few minutes. we didn't get any insight into why potentially we could see this delay he did say, quote, this is not unusual and noted he hasn't gone through a trial that has lasted more than two weeks without a delay. he said they did build in space for delays the "wall street journal" and

"washington post" sources saying there have been last-minute pushes for settlement talks. keep in mind there could be a settlement reached until the verdict is rendered. the jury needs to be set, needs to be finalized. lawyers from fox and dominion will have the chance to strike six jurors, really narrowing the pool as what started from 12 jurors yors and 12 alternates. there is concern of potential jury tampering because of the high profile case like this. the potential jurors had to answer questions like do you regular watch fox news programming and things along those lines. the lawyers playing close decision while they make the decisions to strike the jurors tomorrow after that opening arguments will begin, ana. >> danny, there was no reason by

the judge given for this delay there's been speculation about potential settlement talks happening. would it be unusual for both sides to agree on a settlement this close to the trial? >> no. it would be very usual we cover a lot of criminal cases. once the decision is made to go to trial, you're going to trial and there's not wiggle room. in civil cases there's a lot of wiggle room. here is how almost every civil case works, including my own you prepare on each side as if you're absolutely going the trial. then, like a couple of gunslingers staring each other down, you get to the eve of trial and the reality is defendants can't handle the risk of the verdict and plaintiffs would rather see money today than money tomorrow maybe if it's on appeal and a lot of other x factors. when it comes to civil cases, there's a lot of risk. neither side wants risk. they want certainty. the reality is in most civil cases even if both sides are absolutely preparing for trial,

they get to the courthouse steps and it's not uncommon for them to settle. i'd say the majority of civil cases settle civil litigators go to trial way less awful than criminal. >> not every trial is $1.6 billion, with a b, civil case. a lot of money at stake. a lot in terms of the bigger picture with media rights also at stake here danny cevallos, emmy eye kaieda, thank you very much let's turn to the house republican split screen moment in new york. we're about an hour into the highly unusual field hearing led by republicans on the house judiciary committee. house speaker kevin mccarthy is set to speak any minute at the new york stock exchange about the economy. joining us now from new york city is nbc's capitol hill correspondent ryan nobles. ryan, crime and the economy

dominated the conversation during the midterms. will probably be big issues in 204. what are we seeing from republican leaders this morning? >> ana, what we see is house republicans attempting to create the native that new york city has a crime problem and the district attorney in charge of prosecuting these crimes and putting the bad guys away is not focusing on the right things this is an attempt by house republicans to a certain extent to offer a level of cover for former president donald trump who is, of course, facing 34 different criminal counts from that manhattan prosecutor's office so far this morning, we've heard from victims of violent crime, their family we've also heard from people that own businesses here in new york city who believe it is a real problem there was also a bit of a skirmish outside the hearing room before the hearing began with protesters complaining that jim jordan brought this hearing here saying he's also focusing on the wrong things. democrats are not taking this sitting down by any stretch of the imagination.

they're participating and pushing back on jordan's claims that new york city has a crime problem and even argued if you compare new york city's crime statistics to other major cities that new york city is a pretty safe city. this is the backdrop of a hotly contested presidential election, in statehouses and in congress as well where crime is going to be a big issue and republicans believe they have an opportunity here to make that a big issue as we get closer and closer to election day ana. >> ryan nobles reporting for us. for more on this, we're joined by former democratic congressman max rose, former new york city mayor bill deblasio and former congressman david jolly who served as a republican from florida. congressman rose, let me start with you leading this hearing is republican jim jordan of ohio. according to "the columbus dispatch," columbus, ohio, which

jordan represents has a higher homicide rate than new york city is this all just political theater, or is there a real conversation about crime to be had here >> it's great to see you yes, this is 100% political theory it's a conspiracy ladened smoke screen designed to distract the american people from the fact that donald trump broke the law in new york n washington, d.c. and in georgia and there will be several more cases to come most likely the problem with the democratic party often is we stick to facts and just a policy ladened discussion when the truth of the matter is whatever jim jordan says will be taken by fox news and the rest of the far right echo chamber and spread as gospel what needs to happen along this fact-driven and policy-driven line of argument is another

sincere focus on the fact that jim jordan, the lead messenger for this effort, has had multiple sexual assault allegations driven against him that are absolutely credible we need to focus on the fact that the majority of the weapons moving into new york city are coming from red-led states these are the types of arguments that also need to be put forth by the democratic party because this is absolutely political theater as you said. >> it makes it sound like you don't think democrats are fighting back effectively. >> i think it needs to be more effective because the democratic party needs to understand that this is politics coming from the far right. this is not about policy for them they will do everything to distract the american people or attempt to distract the american people from the actual facts of the case against donald trump because those facts are not on their side >> so they're talking about

crime. at least that's how they have -- that is the focus of this hearing is what they're saying so you look at the facts here in new york city, and i'll come to you,mayor deblasio since you were the top dog, so to speak, in new york city for quite some time we note in the last year or so, in 2022 shootings and murders went down in new york city overall major crime went up largely driven by robberies and burglaries republicans say the manhattan district attorney's office should be cracking down on violent criminals instead of going after donald trump for hush money payments. >> i think it's clear crime is going down rapidly in new york city we were the epicenter. alvin bragg with mayor adams, with all of law enforcement in new york city is working to drive down crime, and the numbers say that it is working

let's face it, this hearing really isn't about crime that's not what's motivating them what's motivating them is an attempt to intimidate alvin bragg, one of self things you're seeing jim jordan doing, including the subpoena it's also an attempt to distract -- the whole problem is they don't have an answer for all the things donald trump has done that has led to more than one criminal accusations you'll see a whole host of accusations play out in the next few weeks. i think it's back firing, ana. i think jim jordan's attempt looks pretty desperate, just reminding people that the actual criminal, the actual person going to trial is donald trump. >> what do you say to those who think donald trump has been unfairly singled out, targeted because of political motivations? >> you can't have this many different cases in multiple

jurisdictions, federal and state and say, oh, this is all political, i don't buy that one bit. this is all based on evidence. the sad truth is for many years donald trump got away with a lot and the law enforcement system wasn't as strong as it could have been. he was very connected. he used his money very wisely. we know of many situations where there were questionable business practices and other activities that didn't lead to prosecution. the fact that there's finally prosecution in multiple jurisdictions says he went too far, thought he could get away with it. the game is up now. >> let's remind everybody that he is only facing criminal charges in one jurisdiction, civil case in new york, but the other on going investigations are just that. they're ongoing. there haven't been additional charges brought at this time congressman jolly, i want to

point out these are members of congress takingon a local prosecutor, coming to new york to hold the hearing instead of holding the hearing in washington how unusual is this? >> highly. it needs to be condemned republicans have subpoenaed members of alvin bragg's office, a former prosecutor. they're asking for documents from bragg unprecedented. what you're seeing today is the effort to remove this from the court of law into the court of public opinion the mayor and congressman rose are exactly right. this is jim jordan's effort to delegitimize alvin bragg and undermine his credibility. if they can project on the conservative voters, the fox news viewers, that alvin bragg doesn't have legitimacy, then the charges don't. if there were to be a conviction, that comes into question as well listen, many of the witnesses today are election deniers,

instigators, antifa was behind j 6. this is a bit of a republican road show. it does say there's a permanency to their support of donald trump where many have thought that maybe prosecutors could get donald trump out of the picture for other republicans to come forward, jordan, gaetz and others are saying, no, donald trump is our man and we're going to back him through '24 even if it means interviewing in a local prosecution. >> but i don't understand that, congressman jolly. why wouldn't republicans use the trump indictment as their chance to break with him? >> this is a view into internal republican politics in a real way. the party elders, if you will, the mitch mcconnells and even the kevin mccarthys, though he has it both ways, all of them do want to be past donald trump, but that is not the winning hand in republican politics the winning hand remains the stefanik, jim jordan, matt gaetz, marjorie taylor greene

"washington post" reports that some of those classified documents showed the u.s. knew of four additional chinese spy balloons over the u.s. nbc has not verified those documents and the pentagon isn't commenting joining us, nbc news justice and intelligence correspondent ken dilanian what new details are we learning about the leak itself? >> good morning. members of congress vowed a thorough investigation of this

matter over the weekend as a number of new revelations were published by "the washington post" which appears to have access to a new tranche of leaked documents that nbc news has not seen one of these documents talked about chinese spy balloons another one said china could quickly establish air superiority if it invaded taiwan a third said that russia believes its disinformation on social media are hugely successful and only 1% of their bots are detected. it could mean that americans may be unknowingly exposed to a lot of russian propaganda. the alleged leaker, jack texeira faces a one. i emailed his lawyer this morning but have not heard back. lawmakers are focusing on the obviously security failures including how the leaker was able to smuggle printed documents out of a secure facility, but also looking at systemic issues including why

are there 1.3 million americans with top secret clearances and why a national guard intelligence wing on cape cod needed access to some of the nation's most sensitive intelligence reporting. >> ken dilanian, thank you let's bring in democratic congressman from connecticut jim himes. thanks for being with us now that there's been an arrest, what's your biggest question about this leak? what's your biggest concern? >> two big questions one is, of course, how could this happen. i think we have a little bit of a good sense for how this happened obviously this individual, he's innocent until proven guilty, but he was able to print off top secret documents from a military network. obviously, that's going to need to be rethought. there's a challenge there, ana intelligence is valuable when it's shared. one of the lessons from 9/11 is

there wasn't enough sharing going on the more you share, the more opportunity there is for people to do what this individual did the other question is how is it that this stuff was apparently in the wild for a couple months, maybe as much as two months before the federal government even knew about it a lot of congressional oversight to be done on precisely the question you asked. >> house speaker kevin mccarthy said the biden administration was asleep at the switch is that how you see it >> i'm not surprised that kevin mccarthy is going to seize on every moment possible to try to take a strike at the president of the united states that is sadly one of the definitions of the congress these days even though we used to live in a world where partisanship stopped at the water's edge the frightening thing is these things happened under president trump biden, president trump, president obama. >> we're told the u.s. intel

agencies may now change how they monitor social media sites and chat rooms following all of this difficult to do because of privacy and other concerns there. is it enough, though, to up the monitoring >> well, you ask a delicate question there i will tell you it will not be the intelligence agencies, the cia, to monitor the networks that's a job for the fbi if they fear a crime is being committed, it would be the fbi that does this a lot of this stuff, whether talking about twitter or public facebook page, a lot of this stuff is out in the open because it's out in the open, the people shouting on twitter or putting stuff up on facebook pages, they don't have a reasonable expectation of privacy. so, yeah, there is theoretically nothing stopping the fbi from -- i don't want them to spend a lot of time and manpower on this, but for having procedures to look for classified information that is on public platforms.

>> what else needs to happen to prevent this type of thing from happening again? do you think fewer people should have access to classified materials? >> yes, i do i think there should be less classified material. i think fewer people should have access to it in this particular case, this is in some ways reminiscent of the snowden case in as much as edward snowden was a very young, idea logically screwed-up individual who had access to the crowned jewels i would like to think in this day and age of chat gpt and advanced computing, we ought to make it possible for administrators to maintain the health of the networks even if they're not reviewing every element on that network and certainly not printing it out. i think there are basic things that can be done to make our information a lot more secure. >> we still don't know the depth of the leak at this point, the revelations from this intel leak are still coming to light, according to "the washington post" that there were additional

chinese spy balloons that intel agencies were aware of the post also says documents have revealed some of what the u.s. knew and still didn't know about the balloon that had been shot down. i wonder how much a leak like this helps china. >> well, you know, on the issue of balloons, i'm not sure it's that helpful to them they obviously know better than we do -- >> now they know what we know. >> balloons are visible by people hiking in montana you don't need a lot of advanced technology this is what you always worry about, and i'll stress this intelligence -- first of all, we don't know how much of it is authentic. some appears to be also, people need to understand that just because the cia says there might be an issue around here, they might believe that are great conviction or very weak conviction. i wouldn't take at face value

all that you hear about this what we really worry about, the russians in particular looking at this intelligence and figuring out how we got it that's why we work so hard to protect our sources of the intelligence and the methods we use to collect them. if you're smart, you can usually get at how we might have learned something. that means that could get shut off. >> congress woman marjorie taylor greene has defended the alleged leaker on twitter. what's your reaction to that, defending the person who is allegedly at fault here? >> it's really sad for me to see somebody like marjorie taylor greene go that crazy, but also to see a prominent member of the republican party, the party of teddy roosevelt and dwight eisenhower, go to a place where she's so consumed in her hatred for the president of the united states and the democratic party that she would side with enemies of the united states

we're back right now, another american community is mourning after a mass shooting, this time it happened at a sweet 16 birthday party in alabama officials in dadeville say at least four people are dead and 28 injured after a shooting broke out at a dance studio saturday night authorities have not released any information about the suspect. nbc's priscilla thompson is joining us in dadeville, about 85 miles from birmingham what do we know about the victims of the shooting? >> reporter: police have not

arrested a suspect and have not released any details about possible leads into what may have happened here as this community is continuing to grieve and waiting for answers about how all of this unfolded and who is responsible this morning, a community is reeling after unthinkable tragedy at a sweet 16. >> oh, my god. >> oh, my god. >> reporter: officials say four people were killed and at least 28 injured at the birthday celebration late saturday. the party's deejay describing a chaotic scene saying the room was dark and packed before shots rang out he tried to protect as many teenagers as he could, sheeding them as others fled for the exit. >> after everybody ran out, i made sure they were okay >> reporter: according to family members, philstavious dowdell was among the victims, a star on the football team, planning to play at alabama jacksonville

state next year. >> a huge smile, he got a heart, he's humble. he's a grandmother's boy. >> reporter: the tight-knit town of dadeville, alabama, is in shock. >> did you ever think anything like that would happen here? >> no, ma'am not in a million years that's why it's so shocking. everybody knows each other everybody loves each other. >> reporter: officials not giving any word on motivation. asking the community for leads the tiny alabama community not the only one to be rocked by gun violence this weekend. two were killed and four more injured in a park shooting in louisville on saturday, less than a week after another mass shooting at a bank there killed five president biden calling the seemingly endless wave of shootings outrageous and unacceptable and asking congress to pass gun safety reforms in dadeville an emotional vigil late sunday included many students jordan rambo says he lost a best friend that night.

>> it's hard me and him were very, very close. it doesn't seem real >> reporter: investigators are working to confirm and speak to everyone who was at that party on saturday. they are urging the public that there is no tip too small as they continue to investigate this today students are back at school the superintendent said there are counselors on hand to help them as so many of them are still processing this and grieving ana. >> priscilla thompson, such a sad story. joining us is rob demeco former fbi investigator and senior risk adviser for global guardian. police still haven't given a whole lot of information, but they do say they're still searching for a suspect, so the suspect is still out there what's happening right now with the investigation do you think >> right now they're going through witness statements it's going to be chaotic

everyone has a different perspective. the deejay said someone was denied to get in about an hour before the shooting because he or she had a weapon and also said at one point where the chaperone mothers said everyone with guns get out, and five minutes after that the shooting started. so they're having to go through all of these statements. the people that were injured, one of the victims said she saw multiple shooters. no one else has said that from what i saw so sorting all that out is the biggest thing. it is a little bit -- the difference you see in large cities when this happens and the police department who have media training coming out and getting the facts out, you're not seeing it here probably because it's a small pd they're overwhelmed with resources even though the state is now coming in i'm sure the fbi will come in and start providing assistance

to what the locals could do. >> i wonder how this big crowd impacts this, you have more witnesses and maybe more chaos could it make it more difficult to figure out who was actually do the shooting? >> absolutely. it was dark. it was a dance party and there could have been multi-al things going on one of the things that came out, it actually came out ten years ago on the boston bombing. all the camera footage is now out here the fbi was overwhelmed with camera photography from phones and all the other things that they actually had to redo how they took all that information in because the files were large. now you're dealing with the same thing. probably have phones going, filming things now this police department and the state have to go through all that video again to filter out what was going on at the time. it may be a small shot it may be something like blair witch where it's really hard to watch and you have to slow it down

welcome back the mexican navy and u.s. coast guard are working together to searchfor three americans apparently lost at sea all three were experienced sailors. they were set to sail from the mexico to san diego. no one has heard from them in nearly two weeks now nbc news national correspondent miguel almaguer is following this in los angeles. >> between the three of them, the missing sailors have about 100 years of experience out at sea, but now missing 13 days authorities and search crews are growing more desperate every day. every day >> reporter: this morning a desperate search for three american sailors lost off the coast of mexico is underway. the mexican navy and u.s. coast guard scouring a 2,500 square mile search area at sea for husband and wife frank and kari

o'brien and their friend william gross. all are said to be experienced sailors. the o'briens are even licensed coast guard captains, but none has been seen in nearly two weeks. >> we're pleading for anyone out there to be on the lookout we miss you so much and love you so much. we just want you to come home. >> reporter: the trio was on their way to san diego and was last heard from on tuesday, april 4th, when they set sail from the mexican port city of maz mazatlan they planned to stop for supplies in cabo san lucas two days later, but the coast guard says there is no record of them arriving, and their location is unknown. >> there's no confirmation they had filled the vessel's fuel tanks, nor confirmation that they took on food and supplies. >> reporter: the group was traveling on the o'brien's 44 foot sailing vessel, ocean bound with minimal technology on board, and they may have encountered winds over 30 knots

it is race day in boston runners are on the streets right now for the city's 127th marathon, and this year's race marks a decade since the tragic bombing that terrorized that city killing three and injuring more than 260 others some of the 30,000 runners participating today will be honoring those lost and injured ten years ago. nbc's kathy park joins us live

from boston near the finish line it is an exhilarating time there in boston, so much to celebrate, so much tragically to remember as well. i know it's always emotional but especially this year, what are you hearing? >> hey, ana, good morning to you. yeah, there is still so much excitement for marathon monday you probably hear the applause behind me. the wheelchair racers are actually wrapping up right now.n for this marathon. a lot of people are running this race, if they're not running, they're cheering on the runners. this year strikes a little bit differently. we are commemorating the ten-year anniversary of the marathon bombings. this weekend there were several programs and events honoring the victims and survivors, as well as the first responders who rushed in to help save lives we had a chance to speak with someone who was actually at the event ten years ago running the race she wasn't injured, but she says crossing that finish line still stir stirs up so many memories. take a listen.
