politicsnation tonight's lead, one step at time he right now, abortion right activists are breathing a sigh of relief. as a key abortion pill wil stay on the market for now but, the fight over access t the bill now heads back to a appeals court. where the legal battle wil resume next month. meanwhile, on this earth day weekend, president biden i shoring up his green credential's with the bi announcement on environmenta justice. ahead of an even bigge announcement that he will ru for reelection that news is expected as early as tuesday as the 2024 presidential fields take shape on both sides.

after in him urgency request b the justice department to bloc lower court rulings that would severely restrict access to th drug, even in states lik vermont where abortion i legal. it is there a federa legislative avenue here that can more formally protec access, or is it a state b state solution in your view? >> well, the reality is that with the supreme court decisio in dobbs, they have just unleash all of the antiabortio activists around the country including some judges like the one in that texas. there is a theoretical legislative fix and that of th wellness health protection act which i voted for when i was a member of the house. but, in candor, we don't hav the votes to get it through th senate and they aren't eve going to bring it up in th house. so, the courts are really th center of action right now and there are a couple o things about this decision i texas that are jus

astonishing. number one, you have a singl judge that is asserting himsel to make a new rule for the entire nation, even assure diction is silly with in tha one single district. now, thank goodness we got a reprieve but, the second thing is tha is truly ominous and shows how extreme this judge was the reaction, the antiabortion fourth of. he is making a decision that a fda federal drug administratio approved drug that was don after scientific trials, has been in the u.s. based o science, he is saying that i is not a valid drug. now, it that kind of reasoning and power grab could be applie to cancer treatment drugs. so, accountable differen levels this is a shockin decision and we have temporary relief with the supreme court holding it but, keep in mind alito, the author of jobs and thomas, a big proponent of, jobs bot dissented. >> now, let's go to this

senator. nbc news is reporting that president biden is expected to formally announce his 2024 reelection bid next week that could come as soon as tuesday. the four year anniversary of his 2020 announcement to the date according to three sources familiar with the plans, the expect he may do so on tha day. now, we are about a year and a half from election day what message would you like to hear from the president, if he decides to run again >> well, you know what has worked for him is the bottom o middle out focus on the econom where everyone is included and it is not a top down deal. i think you saw that in hi inflation reduction act, including this recen announcement that we are going to make certain that the benefits of our attack o climate change or helpful to all communities, who particularly have been pushe to the side and actually suffered you see it with his approach o

is gushing about whether climate change exists. we are having a discussion in competition about whether yo can get that battery factory i your district. in fact, a big battery factory two billion dollar investment, isn't marjorie taylor greene's district in georgia. >> one last question senate minority leader mitch mcconnell said that democrat cannot expect this caucus to allow temporary replacement fo senator diane feinstein on the senate judiciary committee that request coming from majority leader chuck schumer. as feinstein recovers from health issues that have kept her absent from the senate for the last two months, the senator insisting that she wil serve the rest of the last ter rather than resigning as som democrats have called for. hanging in the balance, ou biden judicial picks who canno get confirmed because democrat only have a one seat majorit on senate judiciary.
2:09 pm
feinstein seat if mcconnell has already shu down the request, how do senat democrats proceed in this case >> we can't. this is going to be a decision that senator feinstein has t make without her presence, it is 10 to 10. and you know, i am disappointe that there wasn't and reasonable workplace accommodation for a person who has been, by all accounts, and extraordinary leader the mayor of san francisco the senator from california fo so many years. and widely respected for everything she has done. she has got a health issue, an i'd prefer that senato mcconnell make an accommodatio to help her get through this but, i think at the end of the day senator feinstein and thos folks around here are going to be able to assess when and how she can come back. and if she can't, what is th right decision for her to make but that will be known in time she's done a tremendous job.
2:10 pm
she has made adjustments in he situation. she could've been president or third in line to the presidency she relinquish that. she could've been chair of the judiciary committee, she's relinquish that. she made this request for an accommodation. so, i think this will work out but it is not sustainable. the fact, is the only person who can make this decision i senator feinstein. >> all right, thank you fo being with us tonight, senator peter wells. now, to kansas city where a 16 year ralph y'all is recovering at home after being shot twice including once in the head b 84-year-old homeowner andrew lester as y'all's searched for hi younger brothers and rang th wrong doorbell last week this week, last year pled no guilty to two felonies charges over the shooting, maintaining he acted purely out of fear. even as the county prosecuto and leicester's family suggest there was likely a racia
