a good sunday morning to you all. i am katie phang we begin today share wit breaking news. escalating fighting in sudan's capital. u.s. forces have safel evacuated 100 -- and their dependents under u.s security from the embassy. the state department says of ration's at the embassy ar temporarily suspended. thousands of americans wer caught in the middle of tw warring factions fighting fo control of the city's capita for the past two weeks hundreds of innocent civilians have died and the stat department confirms one u.s. citizen or was killed in tha conflict nbc's courtney kube has th latest >> about 100 u.s. military special operations force undertook a daring mission saturday to rescue u.s government personnel who hav been caught in the middle of

intense fighting in sudan' capital khartoum the mets - mission began at 9 am saturday in djibouti, u.s. troops flyin 800 miles to sudan what the airport still close in the city -- too dangerous to drive, th u.s. military had two and thre helicopters at the u.s. embass and khartoum they were on the ground fo about an hour. managing to load about 8 people including several unite nations diplomats, one child and a number of pets befor flying them to ethiopia to board planes and fly on to djibouti he was somebody in khartoum is now shuttered. u.s. officials say they hope that's only temporary. officials also said that there were no injuries among those who were evacuated and that many of them have already less djibouti. today is the third and one supposed to be the final day o a cease-fire that was supposed to mark th muslim holiday eid al-fitr it's been marked by violence and even - widespread reports of gunfire,

he's been one throughout his political career we expect him to speak to trade union conference in d.c. on tuesday i really can't think of a more welcoming and supportive o people to be around the da that the president is set to announce this. as far as what happens after tuesday, if this does happen o tuesday, we really don't expec much to change significantly a far as what we see publicl from the president as an incumbent, we know he has that advantage. sort of playing two role simultaneously being president and also candidate at the same time we expect him to continue usin the power of his platform. continuing to do these ros garden speeches that he's been doing. two of them just in the last week it's stead of going out on the campaign trail, we'll see hi continue to do a stops and swing states on this invest in america tour touting what this white hous sees as their legislativ accomplishments. things like the chips and sign bill the bipartisan infrastructur law.

their handling of the covid-19 pandemic all things are there going t be saying that will continue into 2024. al east for the time being for the next few months, we don' expect much to change at least publicly by the presidents team, katie. >> we'll be looking to tuesday and our thanks to you, allie raffa, for joining us this morning. the u.s. debt ceiling deadline inches closer wallet and tense battle for a bipartisa agreement is spiraling a republicans try to gai control. earlier this week, house speaker kevin mccarthy propose a plan to increase the deb ceiling to 1.5 trillion dollar over the next year his bill also aims to cut item on president biden's agenda. like rescinding unspent covi relief funds canceling biden's student debt forgiveness plan canceling enhance irs fundin for medicaid and other federal aid programs although mccarthy's legislatio has been praised by right-wing members of the caucus, it' also getting skepticism from centrist republicans

i will say, katie, mccarthy' plan doesn't specify spendin cuts where he would cut becaus republicans haven't been abl to really coalesce around that taking us back to 2022 levels. which you heard schumer sa there would cause a lot of the presidents priorities. including things they were abl to pass an inflation rate -- that has a lot to do with gree energy, of course, als workplace credits. and all of these initiatives o the president is frankly running on this is no chance of making it onto the floor we are still not any closer to a solution for the debt ceilin increase which by the way, w will default on sometime ove the summer the treasury secretary has bee in emergency measures sinc sometime in january. this is really an openin market hopefully, mccarthy hopes of this will get the president to the negotiating table again. the white house said they're not willing to negotiate ove this they want a clean debt ceiling increase and then potentiall talk about spending cuts in th future >> julie, what are the chances mccarthy actually manages to get enough gop votes to ge

this even moving forward >> he hopes to have a vote o this sometime next week. the house is out for a reces for a week following that. it's not really clear how he's going to get there he needs 218 he has a very slim majority. i talk to members moderate members of the hard righ freedom caucus they're all a little squishy o this plan for differen reasons. for example, congresswoman nancy mace, she's a moderate she told me just on thursday she's leaning know on this pla for reasons she outlined tha have to do with green energy she thinks this plan could potentially take us in the wrong direction there. on the flip side, you have fiscal conservatives who say this doesn't balance the budge enough in this plan, mccarthy plans t cut about four point trillio dollars in spending over the next decade. to have a new spending at 1% each year. they say they're not sure this takes that far enough. remember, he can only lose a couple of votes. it's not clear if this eve

forums will make the decisio on whether to attend, get this while the trial is in progress joining me now is barbar mcquade msnbc legal analys former attorney in - also the co-host of the hashta sisters -- also are the smartest people i know so i wanted you to be her as we look ahead to tuesday' trial. let's quickly, barr, but let's walk through jury selection. i think you and i both know as former trial lawyer, as you ca when it was a trial based on who you pick to sit in tha jury box do you think it's gonna be har to get a jury in e. jean carroll's trial. >> i agree with you that thi is a critical point of a trial like this. where the stakes are so high there's a lot of publicity around both of these individuals and the case itself i'm sure you've had this experience you can always find enough people to sit on a jury in a city of 10 million people, the will find them

it may take some effort. that may put some people in th box and ask them questions people will have stron opinions about the case for th parties. the question of course does no have you ever heard of eithe these people or of this case but can you set aside anything you heard outside of the courtroom and decide the cas solely based on what you hea in side at the court room. i'm confident they wil ultimately find 12 people wh can do that. >> barb, as i mentioned, trump's lawyers trying it in order from the court excusin trump from appearing even trum saying i'm gonna save manhatta nights from bad traffic. but the judge saying not happening on my watch. what are some pros and cons in your opinion about trump not appearing for this civil trial >> if i were a lawyer fo donald trump, god forbid, would advise him to be there i think it's a bad look for jury who is wondering what - where is he? is there something mor important than being here? it is certainly at his peril t not show up.

i suppose politically, he ca say this isn't worth my time this is frivolous, this is a insignificant matter and i'm focused on more importan things as a campaign for the presidency i suppose that's part of it. he asked for this instructio that the jury be told that h is doing the set of th goodness of it's hard for th good people of new york at the courthouse personnel i don't know what the last tim donald trump did a paper for somebody else but it's laughable that he would be doing that now and the judge wisely said i' not giving that instruction. it's your choice be there are not i'm a target jury that you'v done some favor by not being here >> another potential pitfall for trump showing up for thi trial is the fact that judge kaplan has ruled that th testimony of two other women who have alleged that trum sexually assaulted them mayb entered into evidence at thi upcoming trial the judges also allowing aging carroll to use that infamous october 2016 access hollywoo tape as evidence how much do you think this i factoring into a decision by trump to actually show up an

do you think this actually affects the outcome ultimately of this case >> it may be that it's ver awkward for trump to have to sit there and listen to that for his accusers to look him i the eye and say these things t his face i'm sure it's humiliating to sit there and hear people sa those things it's always awkward if h doesn't want to testify, which i would highly recommend he no do i think sometimes the jury looks to the person and wonder how are you reacting to this are you squirming? are you demonstrating physical reactions from which we should infer guilt? i think this testimony i important. ordinarily, as you know, under rule of evidence 404(b), ordinarily prior acts of the same crime are not admissibl just to show a person' propensity to engage in this bad conduct. we look at this conduct alone. it can be admissible if it shows other things like person's mo. if the way the person discusse

this kind of issue in the past is similar to this one if they engage in behavior wit the same way in the past it lends credibility to th claim of the person who is bringing the lawsuit under that analysis, judge caplan has ruled that this additional testimony and evidence may come into play. i think it will be persuasiv to a jury. >> one last question quickly, let's talk about on other trump's cases. he's got a lot but just on other. this week, trump advisor boris if he met with the special counsel's office for the secon time explain to the viewers wha doesn't mean for boris to meet with the special counsel investigators versus actuall testifying before a grand jury >> ordinarily, before you pu someone in a grand jury, you want to explore what it is the know and they may be thinking about giving him some sort o immunity but oftentimes it's useful t explore that they are probably assessin what he knows. he may have said i want to com in and share with you what i

no employment income meanwhile, chief justice roberts has been absolutel silent who is watching the watchers joining me now is someone wh is watching the washers, walte shaub -- and former director of the u.s office of government ethics. walt, you had a busy tim during the trump administratio when it came to ethics still going, it looks like what do you think about chie justice roberts do you think he should testif before the senate judiciar committee about judicial ethics? what would you like to see don if he absolutely refuses to do so >> i think it would be positively disgraceful if he refuses to speak - testify in front of congress it would be a real statement that the supreme court justice feel themselves as ruler instead of a public servants they owe us a response they owe us transparency

roberts himself has been disdainful of government ethics, writing in a 2011 year and a report basically hands-off the court should be able t regulate its own affairs obviously, they cannot regulat their affairs. i don't know that there is muc congress if he refuses to show up because of course, to enforce subpoena you, had to go to court, that would end up in th supreme court. unfortunately, that's a no win situation. i think justice -- chief justice roberts owes us response a shame on him if he doesn't it'll only further - trust in the court >> retired justice stephen breyer in response t questioning to share his views on clarence thomas said that h thinks clarence is a quote man of integrity he then went further to sa that the problem with the code of ethics for scotus is that justices cannot be replaced if they disqualify themselves lik a lower court judge might do walt, is that really the

biggest impediment to ethica oversight on a scotus? >> shame on him. of course, that's a word i jus use but it's worth using ove and over again with thes justices there is this culture of exceptionalism on the cour that we are somehow above th law. the reality is that he may hav some concerns about recusal an that may owe to our curren structure of the supreme court whether he is -- no one who could fill in first of all, we lived wit only eight justices for a long time now after mitch mcconnel refused to confirm merrick garland or even hold a hearing on him the court didn't issue any traumatic or radical decisions compared to what they're doing with a supermajority i think more importantly, code of ethics would include things like gift rules. so that there would be a question about whether these kind of lavish gifts could b accepted if you believe republic -- that a rental of the plane would've been $500,000 for one

trip or rental of the plane an the yacht on one trip. we're talking gifts that hav actually potentially amounte to millions of dollars worth o gifts. all at the department of justice routinely prosecutes federal employees. 26,000 federal employees who file public financia disclosures. and almost a half million more who filed confidential disclosures. so the idea that all of thes lower level employees should b subject to either criminal penalties or civil monetar penalties. but the justices shouldn't be. that goes back to that culture of exceptionalism. they think there are above the law. two democratic congressman for now only two but i think numbers growing. they're requesting - justice thomas like you ar talking about right now to the u.s. attorney general fo potential violations of th ethics and government act. what would that entail you talked about potential criminal exposure but. i think more realistically would be looking at civi

monetary penalties >> yes, in fact, the judicia conference should do that. the supreme court claims the judicial conference has no authority over it. chief justice roberts made tha point quite vigorously in th 2011 year and a report -- with this judicial conference, the attorney general can act o his own. there are mechanisms for criminal prosecutions, civil monetary penalties colleague of mine at the project of government oversigh -- filed a complaint last wee with the civil division asking them to pursue civil monetar penalties against him. we're talking $71,000 potentia fine per omission. if they can prove ten omissions, yves got a $700,000 in fines that's nothing to sneeze at. the burden of proof is muc lower in civil cases they'll have to prove it's mor likely than not that he di this willingly and knowingly

the judiciary committee manage to advance a handful of biden' nominees with bipartisan support. this is a real problem republicans have blocked attempts to temporarily replac senator feinstein on the committee. the margin for democrats in th senate as we know is already really slim. how harmful could find signs prolonged absence end up being for democrats? >> it'll stop the judicial nomination process eventuall they won't have the votes to get these judges in. i think it's also a larger issue. reporting there was -- talked about how people and he staff don't really think she's gonna be able to come back this is there's really no plan to bring her back. fundamentally, this is a job you are a public servant you are there to serve the public this idea that somehow because she is a woman or because she' older that she should be immun from that is really ridiculous
